PIO
salute e benedizione apostolica.

5 CARD. RICHARD,

6 Arcivescovo di Parigi.

7 L'Enciclica e la gravità di questa causa lo hanno fatto, ma anche quella singolare carità con la quale voi e tutte le vostre cose, per i meriti immortali della nazione verso la Chiesa, perseguiamo. — Condannata dunque, come dovevamo, la legge iniqua, abbiamo cominciato a considerare diligentissimamente se mai i precetti della medesima legge ci lasciassero qualche facoltà di ordinare così in Gallia le cose religiose, che i sacrosanti principi su cui la Chiesa si fonda non subissero alcun danno. In ciò ci è parso bene di consultare anche voi tutti Vescovi della Gallia;

13 Lettera che nella propria bona arbitrium Enciclica avesse lasciato, non certo con un solo titolo si comportò ingiustamente, tuttavia nella condizione la Chiesa collocata si deve dire non del tutto intollerabile. Ma assai diversamente si tratta oggi la cosa in Francia: dove gli ingiusti conditori di questa legge uno strumento a sé prepararono non tanto per separare dalla Repubblica la Chiesa, quanto per opprimerla si vede. — Così, gli studi di pace professati, e la concordia promessa, portano alla religione della patria una guerra atroce, e gettate le fiaccole delle acerrime contese, cittadini con cittadini si scontrano, con quanto danno della stessa repubblica, nessuno non vede. Cercheranno certamente di questo conflitto e di ciò che seguirà, dei maggiori in Noi trasferire la colpa. Ma chiunque i fatti con sincero giudizio avrà valutato, che Noi stessi nelle Lettere Encicliche Vehementer Nos toccammo, giudicherà, se Noi siamo da biasimare che, altre volte da altri sofferti ingiurie tollerando, per causa della diletta nazione, all'ultimo costretti i santissimi limiti dell'Apostolico ufficio oltrepassare, negammo potere;

5 CARD. RICHARD,

6 Archevêque de Paris.

7 Epistola Encyclica et gravitas huius causae fecit, sed illa etiam singularis caritas, qua vos vestraque omnia, pro immortalibus nationis in Ecclesiam meritis, prosequimur. — Damnata igitur, ut debuimus, improba lege, id considerare diligentissime coepimus, ullamne demum eiusdem praescripta legis relinquerent Nobis facultatem ita ordinandae in Gallia religiosae rei, ut sacrosancta principia quibus Ecclesia nititur, nihil detrimenti caperent. In quo visum Nobis est, vos etiam Galliae Episcopos adhibere in consilium universos;

13 Epistola que in propria bona arbitrium Encyclica reliquerit, non uno quidem nomine iniuste se gessit, sed tamen in conditione Ecclesiam collocasse dicenda est non omnino intolerabili. Verum multo secus agitur hodie res in Gallia: ubi iniustae huius legis conditores instrumentum sibi comparasse non tam ad separandam a Republica Ecclesiam, quam ad opprimendam videntur. — Ita, studia pacis professi, concordiamque polliciti, inferunt religioni patriae bellum atrox, iniectisque acerrimarum contentionum facibus, cives cum civibus committunt, quanta cum pernicie ipsius reipublicae, nemo non videt. Studebunt profecto certaminis huius et eorum quae secutura sunt, maiorum in Nos transferre culpam. Sed quisquis facta sincero iudicio aestimaverit, quae Ipsi etiam in Litteris Encyclicis Vehementer Nos attigimus, diiudicabit, utrum Nos reprehendendi simus qui, alias ex aliis perpessi iniurias toleranter, dilectae nationis causa, ad ultimum coacti sanctissimos Apostolici officii transire terminos, negavimus posse ;

Nos, quin Nostris satisfacturi sint praescriptionibus et votis, minime dubitamus : interea divinam benignitatem conciliare vobis omnibus, patrocinio confisi Mariae Immaculatae, impense studebimus. Auspicem caelestium munerum ac testem paternae benevolentiae Nostrae, Vobis, Venerabiles Fratres, universaeque Gallorum genti Apostolicam benedictionem amantissime impertimus.

PIUS
greetings and Apostolic blessing.

1 We discharge a most grave duty of office, and one long owed to you, to whom after the enactment of the law concerning the separation of the Gallican Republic and Church we signified in due time what we judged ought to be done to protect and preserve religion there.

2 Indeed, the expectation of your desire that we should produce this, not only the magnitude (i) of the Bishops of Gaul, responding in the Encyclical letters set forth below, sent this telegram to Rome, by which the sense of filial obedience and grateful affection toward A Notre Très Saint Père le Pape Pie X Vatican — Rome.

3 Paris, 4 September 1906.

4 Most Holy Father, The Cardinals Archbishops and Bishops assembled with the approval of Your Holiness in plenary assembly to take all the means which law recognizes to all citizens in order to dispose and organize worship in their Country, hasten to express to Him their profound gratitude for the directions so luminous which He has deigned to communicate to them in the Encyclical Gravissimo, they lay at His feet the homage of their filial obedience in which they wish with their priests and their faithful courageously to persevere despite all trials and all perils. They hope that their assembly and that their union and their efforts aided by Your paternal Blessing will merit for them the grace of finding opportune solutions for public peace and the salvation of the Church of France.

5 CARD. RICHARD,

6 Archbishop of Paris.

7 The Encyclical Letter and the gravity of this cause brought this about, but also that singular charity with which we regard you and all your affairs, for the immortal merits of the nation toward the Church. — Having therefore condemned, as we ought, the wicked law, we began to consider most carefully whether any provisions of that same law might leave us the faculty of so ordering religious matters in Gaul that the most sacred principles on which the Church rests should suffer no detriment. In this matter it seemed good to us to take counsel also with you, all the Bishops of Gaul;

8 and having called together this very assembly and summoned you all especially for this purpose, that you might deliberate, we commanded. Now, however, having learned your consultations, having sought the opinions of several Cardinals, having long and much meditated on the matter with us, and having implored with great prayers the Father of lights, we see altogether that what you almost all to a man judged, the same we must confirm by Apostolic authority. Accordingly, concerning associations of citizens, such as the law orders to be constituted for the purpose of conducting divine worship, we decree that they can be formed by agreement without the most sacred rights, which pertain to the very life of the Church itself, being violated (i). — Having set aside, however, con- (i) For the associations for worship, which the Gallican law of 9 December 1905 alone recognizes, ought in no way to depend on ecclesiastical authority, but entirely on civil authority. Thus article 4 of this law provides: « Within the period of one year from the promulgation of the present law, the movable and immovable property of the Menses, Fabrics, Presbyteral Councils, Consistories and other public establishments of worship shall be, with all the charges and obligations which burden them and with their special assignment, transferred by the legal representatives of these establishments to the Associations which, in conforming to the rules of general organization of worship which they propose to ensure the exercise, shall have been legally formed, according to the prescriptions of article 19, for the exercise of this worship in the former districts of said establishments ». Article 8 moreover adds: « Failing an ecclesiastical establishment to have, within the period fixed by article 4, proceeded to the attributions above prescribed, provision shall be made for it by decree.

9 « At the expiration of said period, the property to be attributed shall, until their attribution, be placed under sequestration.

10 In the case where the goods assigned by virtue of article 4 and paragraph 1 of the present article shall be, either from the beginning or subsequently, claimed by several Associations formed for the exercise of the same worship, the assignment which shall have been made by the representatives of the establishment or by decree may be contested before the Council of State acting in contentious matters, which shall pronounce judgment taking into account all the circumstances of fact. The petition shall be introduced before the Council of State within the period of one year from the date of the decree or from the notification to the prefectoral authority by the legal representatives of the public establishments of worship of the assignment effected by them. This notification must be made within the period of one month. An Encyclical Letter to these associations, which We are indeed prohibited by conscience of duty from approving, it may seem opportune to attempt whether it be permitted, in their place, to establish some other kind of association of societies, which may be at once legitimate and canonical, and thus to defend these most laborious times which impend for French Catholics. Truly these matters hold Us with such solicitude and anxiety that nothing affects Us more; and would that hope might shine forth, if not good, yet at least some, that We might, with divine law preserved, enter upon this experiment, so that We might free Our beloved sons from fear of such great ancestors. But since, with this law remaining in force, no such hope is shown, We deny that it is permitted to attempt this other kind of association until it shall have been legitimately and certainly established that the divine constitution of the Church, and the immutable rights of the Roman Pontiff and Bishops, and their power over goods necessary to the Church, especially temples, shall always remain safe and secure through these same associations and protected: to wish otherwise than this, unless We were abandoning religion and bringing about the destruction of the Gallican Church, We cannot.

11 The assignment may subsequently be contested in case of schism in the Association endowed, of creation of a new Association as a result of a modification in the territory of the ecclesiastical circumscription, and in the case where the Association to which assignment was made is no longer in a position to fulfill its object. Finally article 9 decrees: In default of any Association to receive the goods of a public establishment of worship, these goods shall be assigned by decree to communal establishments of assistance or beneficence situated within the territorial limits of the ecclesiastical circumscription concerned. In case of dissolution of an Association, the goods which shall have been devolved to it in execution of articles 4 and 8 shall be assigned by decree rendered in Council of State, either to analogous Associations in the same circumscription or, failing these, in the nearest circumscriptions, or to the establishments referred to in paragraph 1 of the present article (N.R.). An Encyclical Letter and abandoning the duty of office, We cannot.

12 It remains, Venerable Brethren, that you, employing every means which the rights of citizenship shall permit you to use, apply yourselves to arranging and instructing the religious worship. Nor indeed in so great and arduous a matter shall We suffer Our part to be desired. Surely, though absent in body, yet in thought and spirit We shall be with you, and shall opportunely assist you with counsel and authority. Wherefore undertake courageously the burden which, prompted by love of the Church and of your fatherland, We impose upon you: for the rest, rest assured in the goodness of divine providence, whose timely aid shall not fail to Gaul, We are altogether confident. Now it is not difficult to foresee with what accusations the enemies of religion will receive these decrees and mandates of Ours. They will strive to persuade the people that We have not looked solely to the salvation of the Gallican Church; that We have had also another purpose, alien to religion: that the form of the Republic in Gaul is hateful to Us, and that for the sake of overthrowing it We are sailing with the efforts of factions: that We have refused to Gaul what the Apostolic See has not unwillingly granted to others. These things and similar ones, which, as it is possible to discern from certain indications, are being widely scattered among the common people to stir up minds, We now indignantly denounce to be most false, and it shall be your part, Venerable Brethren, and that of all good men to refute them, lest namely they deceive the ignorant and unlearned. Specifically indeed as to that matter, that the Church has shown herself more accommodating elsewhere in a similar cause, you ought to demonstrate that she did this when circumstances were altogether different, and especially when the divine Hierarchical order had been consulted in some way at least (i). If any state has so separated the Church from itself as to have granted her full freedom of common liberty, free (i) These are referred to the associations of worship which the Church tolerated in Germany (N.R.).

13 A Letter which in its own provisions left discretion to the Encyclical did not indeed act unjustly in one respect alone, but nevertheless must be said to have placed the Church in a condition not altogether intolerable. But matters proceed far otherwise in Gaul today: where the framers of this unjust law appear to have prepared for themselves an instrument not so much to separate the Church from the Republic, as to oppress it. — Thus, professing zeal for peace and promising concord, they wage a fierce war against the religion of the fatherland, and by hurling the torches of the bitterest contentions, they set citizen against citizen, with how great a calamity to the Republic itself, no one fails to see. They will certainly strive to transfer the blame for this conflict and what shall follow upon Us and our predecessors. But whoever shall weigh the facts with sincere judgment, which We ourselves touched upon also in Our Encyclical Letter Vehementer Nos, shall determine whether We are to be blamed, who, having otherwise endured injuries from various quarters with patience, compelled by the cause of the beloved nation, driven at last to transgress the most sacred bounds of Apostolic office, denied that We could;

14 or rather whether the entire blame rests with those who, driven by envy of the Catholic name to these very extremes, have brought it about.

15 But indeed, if Catholic men from Gaul truly wish to show their obedience and zeal to Us, let them contend for the Church in the manner in which We have admonished them, namely with constancy and fortitude, yet doing nothing seditious or violent. Not by force, but by constancy, as if stationed in the citadel of justice, shall they break at length the stubbornness of their enemies:

16 let them understand, however, what We have already said and must be said again, that they shall strive toward this victory in vain unless they have conspired together with the utmost unity in the protection of religion. They have Our judgment concerning the use of the law:

17 let them follow the nefarious decrees, as is fitting, with willing hearts; and whatever anyone has hitherto held by disputing concerning this very matter, let them beware, We beseech, lest anyone offend another on account of seeing better. What the contention of consenting wills and joined forces can accomplish, let them learn in good time from their adversaries; and in the same way that it was permitted to these to impose and brand upon it a most wicked law, in the same way it shall be permitted to ours to remove and extinguish it. — In such peril to Gaul, if indeed all and sundry, as many as think the greatest good of the fatherland must be protected with the utmost effort, shall labor together with Us and with their Bishops and among themselves for religion in the manner that is necessary, not only is the salvation of the Gallic Church not to be despaired of, but it is to be hoped that soon it shall rise again to its former dignity and prosperity. We do not doubt in the least that Our prescriptions and wishes shall be satisfied by Ours: meanwhile, trusting in the patronage of Mary Immaculate, We shall earnestly strive to conciliate divine benevolence for you all. As a pledge of heavenly gifts and a token of Our paternal benevolence, We most lovingly impart to you, Venerable Brethren, and to the entire nation of the Gauls the Apostolic Blessing.

18 Given at Rome at St. Peter's, on 10 August, on the feast of St. Lawrence the Martyr, in the year 1906, the fourth year of Our Pontificate.
