Inter varias sollicitudines

Bull erecting the Catholic University of Laval in Quebec

Bull of Pope Pius IX ·

TO OUR VENERABLE BROTHERS ELEAZAR ALEXANDER TASCHEREAU, ARCHBISHOP OF QUEBEC, AND THE OTHER BISHOPS OF THE CANADIAN REGION, AND TO OUR BELOVED SONS THOMAS STEPHEN HAMEL, RECTOR, AND THE OTHER PROFESSORS OF THE CATHOLIC UNIVERSITY OF LAVAL IN THE CITY OF QUEBEC. GREETINGS AND APOSTOLIC BLESSING.

1 Among the various cares by which We are pressed on all sides in the proper discharge of the Apostolic office committed to Us, We willingly embrace that care by which opportunity and suitable convenience for the pursuit of letters may be afforded to those everywhere who desire to devote themselves to literary studies, so that errors, which are for the most part born from ignorance of letters and which disfigure the sacred doctrine of Christian society, may be destroyed as completely as possible; for in every age experience teaches that public Universities of studies have contributed greatly to the attainment of this end.

2 Long ago, venerable brothers, Peter Flavian Turgeon, Archbishop of Quebec, and the other Bishops of the Canadian Region made known to Us through the Sacred Congregation for the Propagation of the Christian Faith that it was their desire that a Catholic University be canonically erected in the City of Quebec.

3 Since, however, that University, under the patronage of the Blessed Virgin Mary conceived without stain, was founded twenty-four years ago by the Seminary of Quebec with the prior approval of the Holy See and the full consent of the civil authority, and recently our venerable brother Eleazar Alexander Taschereau, Archbishop of Quebec, and our beloved son Thomas Stephen Hamel, Rector of the same University, have presented to Us a humble petition for obtaining canonical institution, We, through the same venerable brothers, the Cardinals of the Holy Roman Church of the Sacred Council for the Propagation of the Christian Faith assembled in general convocation on the eighth day of May in the year of Our Lord eighteen hundred and seventy-six, having ascertained that the City of Quebec is to be held as the Metropolis of the Catholic Religion in North America, from the fact that it is the mother of sixty dioceses, and moreover that access to it lies open easily from all parts of the Canadian region, having further ascertained that the University, whose canonical institution is sought, is adorned with vast buildings worthy of admiration both in artistic workmanship and in magnificent expenditure, with a copious library and various select museums for the aid of all kinds of science, and is governed by the teaching and direction of wise men, many of whom have drawn their learning in this very City of Rome at the Gregorian University of the Society of Jesus and at the school of St. Apollinaris, and have brought forth the most abundant fruits both for Christian and civil society, having provided by the erection of great buildings for their instruction under the discipline of zealous priests, restraining them from the corruption of morals, and being able to expect greater benefits therefrom for Religion and good morals, We have deemed it fitting to canonically erect, establish, and confirm the aforesaid University equally and in the same principal manner as the more celebrated Universities.

4 According to the mind, however, of the same venerable brothers, We will and decree that this institution be made under the law that the Protector of the same University shall be the Prefect for the time being of the aforesaid Sacred Congregation of the Propagation of the Faith, with which office our beloved son Alexander, of the Title of St. Mary Across the Tiber, Presbyter Cardinal of the Holy Roman Church, called Franchi, is today invested, and that the Archbishop of Quebec shall perform the office of Apostolic Chancellor, and that the same University shall have the right to confer the degree of Doctor and other inferior academic degrees in individual faculties according to the customary Statutes of Universities, and that the supreme vigilance of doctrine and discipline, that is, of faith and morals, shall rest with the Archbishop and all the Bishops of the Province of Quebec or Lower Canada, but in all other matters everything shall be regulated according to the judgment of the Sacred Congregation of the Propagation of the Faith issued on the first day of February in the year of Our Lord eighteen hundred and seventy-six and according to the laws of the University itself, whose congruity and utility long experience has proved.

5 Since, however, the Queen of Great Britain, Victoria, has long since fortified and honored the University with an ample diploma of approval, in no respect of which do We wish anything to be derogated, and has granted full freedom of teaching on that account; hence We have deemed it fitting, by the counsel of the same venerable brothers, that the same Queen and both the Federal and Provincial governments of Quebec be honored with due praise for the reasons adduced.

6 Finally, we earnestly exhort the Bishops of the Province of Quebec to take care to aggregate their Seminaries and Colleges to that same Laval University, which has exhibited and exhibits such clear testimonies of sound doctrine and integrity of faith; so that in this way students may become increasingly more suitable to attend it. Moreover, we commend to all the Archbishops and Bishops of the Dominion of Canada that they strive to send youths of good promise to the same University for the sake of studies, and persuade parents not to allow their sons, left to their own liberty, to wander about in the city of Quebec, but rather to be received in those hospitable dwellings devoted solely to their moral instruction and easier progress in learning, built from the ground up through so many and such great sacrifices by the Quebec Seminary, and for the maintenance of which in the advantage of studious youth, the Professors and Moderators themselves, following the examples of their predecessors, have not ceased to contribute with the greatest liberality.

7 Moreover, these present Letters and the matters contained in them can in no way be noted, impugned, or otherwise broken, retracted, suspended, restricted, limited, or have anything derogated from them on account of the defect of subreption or obreption or nullity, or on account of Our intention, or any other defect, whether from the fact that those having or pretending to have an interest in the foregoing were not called, cited, and heard, or from any other causes, occasions, or pretexts whatsoever; nor can they be comprehended under any constitutions, revocations, limitations, derogations, modifications, decrees, or declarations, whether general or special, even those issued by Our own motion, knowledge, and fullness of power in like manner; but they shall always be excepted from those and perpetually valid, firm, and efficacious, and shall produce and obtain their full and complete effects; and shall be perpetually and inviolably observed by all to whom it pertains and shall pertain in any way in the future, and ought to afford the fullest support to the said University, as aforesaid erected, and to its persons in perpetuity for future times: and thus in the foregoing matters by whatever ordinary or delegated Judges, even the Auditors of the Causes of the Apostolic Palace, and also the Cardinals of the Holy Roman Church, it ought to be judged and defined, with the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, and if anything contrary to this should happen to be attempted by anyone whatsoever with any authority, knowingly or unknowingly, We decree it to be null and void.

8 Wherefore to Our beloved son Alexander, Presbyter Cardinal of the Holy Roman Church, called Franchi, Prefect of Our Sacred Congregation of Propaganda Fide, and to his successors existing for the time being, by Apostolic writings We command, and to him We grant and bestow full faculty, authority, and jurisdiction of every kind; that he himself take care to execute these Our Letters and the matters contained in them, and assisting the same University and its persons with the protection of effective defense, cause these present Letters of Ours and the matters contained in them to be inviolably observed by all to whom it pertains and shall pertain for the time being by the authority of Ourselves and the Apostolic See, and let the same University and its persons, whom these present Letters concern, peacefully enjoy and rejoice in all and singular things granted by the tenor of these Letters, restraining contradictors, with the proper observances being maintained. Notwithstanding, insofar as it may be necessary, Our and Our Chancery's Rule of not taking away acquired right, and other constitutions and ordinances issued by Our Predecessors the Pontiffs, whether general or special, and also the Statutes of the said University, and also any Indults and Apostolic Letters whatsoever in whatever tenors and forms; all and singular of which, even if special, specific, express, and individual mention ought to be made of them and their entire tenors, and not by general clauses importing the same, or any other expression, or any other exquisite form ought to be observed for this purpose, the Letters of all and singular of which We hold to be fully and sufficiently expressed and inserted in these present Letters, which would otherwise remain in their force, for the purpose of the foregoing, on this occasion only, We derogate most broadly and fully, and to all other things contrary whatsoever.

9 We will, however, that to copies of these same present Letters, even at the expense of those seeking them, subscribed by the hand of some public notary and furnished with the Seal of a person constituted in ecclesiastical Dignity, the same faith be given as would be given to these present Letters themselves if they were exhibited or shown.

10 Let no one whatsoever be permitted to infringe this page of Our erection, institution, confirmation, subjection, Indult, exhortation, mandate, derogation, and will, or to act against it with rash presumption. If anyone, however, should presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul.

11 Given at Rome at St. Peter's in the year of the Incarnation of the Lord one thousand eight hundred and seventy-six on the Ides of May, in the thirtieth year of Our Pontificate.

AI VENERABILI FRATELLI ELEAZRO ALESSANDRO TASCHEREAU ARCIVESCOVO DI QUEBEC E AGLI ALTRI VESCOVI DELLA REGIONE CANADESE, NONCHÉ AI DILETTI FIGLI TOMMASO STEFANO HAMEL RETTORE E AGLI ALTRI PROFESSORI DELL'UNIVERSITÀ CATTOLICA LAVALENSE NELLA CITTÀ DI QUEBEC. SALUTE E BENEDIZIONE APOSTOLICA.
