Bull confirming privileges of the seven notaries of the Roman Curia
There follow privileges for the aforesaid seven older notaries.
Sixtus, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 The praiseworthy rectitude of the Apostolic See, which is directed in its acts by provident circumspection, not without reason pursues with grace and favor those whom it knows to be continually devoting to itself the study of their laborious diligence; and those things which are said to have been granted to them through the aforesaid See, so that they may persist more firmly, the Roman Pontiff constituted in the same See willingly approves and confirms, and otherwise disposes thereupon, as he perceives to be salutarily expedient in the Lord.
2 § 1. Indeed, since, as we have learned, a college of seven notaries of the number of those participating in the Apostolic See, so called, was instituted and ordained by Clement I, Peter also and Julius likewise, Roman Pontiffs our predecessors, for faithfully describing the deeds of the martyrs and whatever pertained to the Roman Church and for preserving what had been described, and they themselves, divided in seven regions of the City, by the aforesaid and other Roman Pontiffs, even our predecessors, as is believed, have been granted very many privileges, honors, graces, preeminences and prerogatives, and those notaries from that time until now have served all the aforesaid Roman Pontiffs, both in their chapel and in other public places where those Pontiffs were present, as their domestic prelates, and sent to various legations and offices, have exercised them laudably.
3 § 2. For this reason, not only do we wish to preserve the aforesaid college in its antiquity and nobility, as appears, but also to pursue it with greater favors and graces, moved by our own will, not at the instance of a petition of the aforesaid notaries or any of them or even another on their behalf offered to us concerning this, but from our mere liberality, to the college of this kind and to the same seven notaries now and for the time being existing and to each of them all and singular privileges, graces, exemptions, liberties, immunities, favors, faculties, preeminences, preferences, prerogatives, decrees, declarations and indults whatsoever granted to the college itself and its notaries by any of our Roman Pontiff predecessors, insofar as they are in use and are in no way contrary to the decrees of the Council of Trent, nor comprehended under any revocations, and also all and singular revenues, rights and emoluments whatsoever of the said college hitherto had and accustomed to be received by those same seven notaries, as they justly and peacefully possess them, by apostolic authority, by the tenor of the present, we confirm, and grant them anew to them and renew them.
4 § 3. And now and for the time being existing notaries of the said number and to each of them, we grant the faculty that whosoever, having been found fit and sufficient in knowledge and morals in canon and civil law or one of them, through diligent examination by themselves or with two doctors of that science and faculty assumed and taken with them, in both or one of these laws; whom indeed in theology, not however of any regular Order, or in arts or medicine or other lawful faculty having studied, and through similar examination of two or three doctors or masters also to be chosen by them of the faculty in which they have studied, to be held before them or any of them, for faithful attestation to be made to them by the masters or doctors themselves, having found to be skilled and sufficient in knowledge and morals aforesaid for this, with the counsel and consent of those same doctors or masters, in theology or arts or medicine or other lawful faculty of this kind, to promote to the degrees of baccalaureate, licentiate, doctorate and mastership, and to grant them authority for reading in them and for doing other acts pertaining in any way to persons constituted in degrees of this kind, and the usual insignia of those degrees to be conferred on those who, by the same authorities, faculties and privileges, as if they had received degrees of this kind in some, even famous, University, except as regards fitness for cathedral churches, may use and enjoy.
5 § 4. And notaries and public tabellio to be created, and those created to be invested in the offices of tabellio and notary of this kind by pen and inkwell, as is the custom, having first received the usual oath from them.
6 § 5. That spurious, bastard, and illegitimate children, as well as those born of incestuous and other illicit and damned intercourse, may succeed to the property of their parents, both ecclesiastical property and that of others, whether by testament or by intestate succession, without prejudice however to those succeeding by intestate succession or by fideicommissum or other valid disposition of law, and apart from emphyteutic and feudal ecclesiastical property, or property made from the fruits and other things ecclesiastical, or acquired through the Church, and without derogation of the constitution of our predecessor of happy memory, Pope Pius V, similarly our predecessor, issued concerning illegitimates, and may exercise whatever legitimate acts, and be admitted to whatever honors, dignities and offices, public or private, and may hold and exercise them in all respects and in every way, as if they had been born of legitimate matrimony, we grant dispensation to do freely and lawfully.
7 § 6. Likewise, we grant to the said college the faculty and power, by the authority and tenor aforesaid, to make statutes and ordinances for the prosperous state of the college, and to restrict, enlarge, and whenever it shall seem expedient, to delete in whole or in part those made from time to time, and to ordain others anew, and to cause them to be observed under pecuniary penalties to be applied to the same college, and under other penalties, even of suspension from the receipt of emoluments to be distributed, to be exacted at the discretion of the said college, by those appointed by the college itself.
8 § 7. And we declare the same notaries of the number of such true and undoubted familiars, continuous table companions of the Pope and his prelate, and prelates of our household and of the Roman Pontiff existing for the time being, to be able to use, enjoy and possess the same privileges and graces which true and intimate familiars use, enjoy and possess, not in their manner, but equally and in like principal fashion, without any difference.
9 § 8. And to them the bread of honor, of the same quality and goodness as is customary to be given to the same familiars and beloved sons of the Apostolic Chamber, clerics, is to be given, and to them and to each of them, at the times of the death and coronation of the Roman Pontiff, mourning vestments on account of death, and violet vestments on account of such coronation are to be assigned; and in pontifical cavalcades we decree that two of the same notaries may freely ride with mantles immediately after the assisting prelates, if they wish.
10 § 9. And to the same notaries existing for the time being, we indulge by special grace that apostolic letters for each of them, even under lead, may be expedited gratis through the Apostolic Chamber and Chancery on all and singular ecclesiastical benefices of whatsoever kind, with cure or without cure, whether of seculars or of any of the regular Orders, even if canonicates and prebends, dignities, personates, administrations or offices and dignities themselves in cathedral churches, even metropolitan, after the greater pontifical offices, or in collegiate or other principal churches, and to dignities, personates, administrations or offices of this kind which are accustomed to be assumed by election, and to which the cure of souls is attached, and also on the provisions, commends, and fruits, revenues and proceeds of ecclesiastical property, as well as annual pensions on the same fruits, revenues and proceeds, reservations and other graces, even by the Chamber or Apostolic Chancery.
11 § 10. And moreover that for each emolument assigned for expeditions of whatsoever kind to be made for cathedral churches, metropolitan and patriarchal churches, as well as monasteries and other ecclesiastical benefices for the time being, the fees of which are accustomed to be paid to the said college on account of the tax, the aforesaid rights ought always to be paid entirely to the same college; so that in whatsoever graces and mandates to be emanated by us and by the Roman Pontiff existing for the time being, even if by them expeditions of this kind, whether through the Chamber or through the Chancery or by the secret way, have been granted to be done gratis everywhere, nevertheless the right shall always be held entire and unimpaired for the aforesaid college, nor can expeditions be made unless the rights of the aforesaid college have first been paid; and that in no way and at no time the aforesaid, although by us and our aforesaid successors specially and expressly for any cause derogated to them, can be claimed to have been derogated, but rather the license of bearing arms for them and their familiars.
12 The faculty of testing also from goods acquired from ecclesiastical property for ducal rights themselves ought to be paid entirely to the said college, as is aforesaid, we establish and ordain also perpetually by the authority and tenor aforesaid.
13 § 11. Furthermore, to the same seven notaries and to each of them, to their relatives by blood, by marriage and by family connection, to their continuous table companions and to those serving them in fact, that any weapons, not however of shorter measure, otherwise prohibited, both throughout the City and the whole Ecclesiastical State of this kind, without any special license, may be carried, notwithstanding any prohibitions and banishments whatsoever, from which they shall always be exempt and excepted and shall be considered to be so; and the ministers of justice of the City and of the places of this State ought to believe and acquiesce in their lists given concerning this.
14 § 12. To the same notaries and to each of them, so that concerning any of their movable and immovable goods, both from churches or other ecclesiastical benefices, even hospitals or other pious places, of any kind, even of a privileged Order or military order, obtained and to be obtained by them and otherwise in any way, yet lawfully acquired and to be acquired, even if, according to the pious memory of Sixtus IV, Julius II, Leo X and other Roman Pontiffs, even our predecessors, letters expedited concerning this, they have not possessed immovable goods, even in the said Roman Curia and outside it, they may make a will, and concerning them among any persons of either sex, not however illegitimate or otherwise incapable, freely and without payment of any composition, dispose, make a will, make a codicil, and also distribute them among the living, grant and give them, and such wills, dispositions and grants, even after laying down the office of notary, up to the sum of two thousand gold ducats of the Camera, as regards goods acquired from churches and the other benefices aforesaid, may be made. Exemption of jurisdiction.
15 freely and lawfully, by the authority and tenor aforesaid, we grant full and free license and faculty. v pp. 627 An. C. 1585
16 § 13. And the same notaries from the jurisdiction, power, superiority and dominion of any ordinaries of places and of all other ordinaries and judges, so that the ordinaries and the others aforesaid, and their officials and vicars, and any other judges whatsoever may exercise no superiority, power, jurisdiction or dominion over them, even on account of a crime, contract or matter which it may happen to be in question, or may pronounce sentences of excommunication or otherwise, censures and penalties, unless by our mandate or that of the Roman Pontiff existing for the time being, and unless they be caught in some flagrant crime, we entirely exempt and completely free, and subject to our and the Apostolic See's jurisdiction and power alone immediately. Forbidding to the ordinaries of places and to all other judges of whatsoever quality and dignity, that they dare or presume to molest, disquiet, cause to be seized, prosecute the aforesaid notaries in any way under any color or cause, unless by our mandate and that of the Roman Pontiff existing for the time being, or caught in a flagrant crime, as is aforesaid; decreeing null and void whatever otherwise they or any one of them shall have presumed to attempt.
17 § 14. And that the said seven notaries, when assembled collegially, may create one notary in any year, without prejudice to the participation of the aforesaid notaries, and without the exemptions and privileges granted to the same seven notaries, so that he may not enjoy those.
18 § 15. Likewise, those of the said seven notaries who are doctors of both laws may be enrolled in the number of referendaries of either Signature, and one of them, the senior in the Signature of Grace, may always be present.
19 § 16. And in whatsoever acts to be made in public in the consistory for the time being, in public acts of the consistory,
20 one notary shall be summoned, who and the other notaries present there, if asked, shall draw up an instrument for perpetual memory of the matter; to which and to all other instruments and writings whatsoever signed by the hand of one of the same notaries and furnished with his seal, even without witnesses, full faith shall be given in judgment and outside everywhere in all places.
21 § 17. And since the offices of notary of this kind were instituted of old, as is aforesaid, for describing the deeds of martyrs and the years of saints, canonization of saints, that one of the same notaries in the canonization of saints and also in drawing up the process concerning this, may intervene and proceed jointly together with one of the auditors of the Apostolic Palace of causes.
22 § 18. And to all of them and to each of them public consistories and chapels of the consistory to be announced by public persons; and to them in the chapel and in all acts candles, agnus deis and palms of the same quality and quantity, as is customarily done for assisting bishops.
23 § 19. Likewise, gold and silver coins on the day of the coronation of any Roman Pontiff, which are customarily given to the clerks of the camera,
24 shall be distributed and given to the same seven notaries and to each of them as a sign of honor.
25 the many Pontifical rings customarily given to clerics, to be distributed and given to those same seven notaries and to each of them as a sign of honor.
26 § 20. And two of them, if princes and popes, their orators and patriarchs, as well as archbishops and bishops are lacking, are to be assumed by the masters of ceremonies to bear the train of Our and the Roman Pontiff existing for the time being, with other prelates in those acts in which it pertains to them, and barons being set aside.
27 § 21. And those of them who shall have been constituted in the order of priesthood may use in solemn masses and in any other pontifical insignia, even in cathedral churches, when they are used, yet of those prelates, if they are present, but if they are absent, without their consent, even without requesting it, outside the said curia.
28 § 22. Likewise to each of the same and to each of the notaries of the Roman Curia now and existing for the time being, that it may be lawful for them to have a portable altar with due reverence and honor, upon which in places suitable and fitting for this purpose, even not sacred ones, and also under ordinary or apostolic or either authority from any cause interdicted, or even in time of cessation from divine services, provided they have not given cause for such interdict, even before dawn, and also about midday, in the presence of him and his domestics and servants, mass may be celebrated by himself or by any secular or any regular priest of any Order suitable and to be approved by the ordinary, and he may attend it and hear it freely and lawfully.
29 § 23. And that the same seven notaries now and existing for the time being and each of them, who have already held the office of notary for a decade and remain, and who in the future shall hold it for at least the aforesaid time, to be computed from the day on which they were admitted into the college of the same notaries, if perchance they shall have resigned it, are nevertheless notaries and are called, and to the same honors, preeminences, precedences, privileges, immunities and exemptions and all other aforesaid matters they may use for five years only, just as if they were still in the said college; who nevertheless, except outside the City, shall not wear the rochet, nor have a place in the chapel, but shall nevertheless precede other prelates, proceeding immediately after the notaries, except the auditors of causes of the said Palace and the clerks of the Apostolic Camera, by authority and tenor of the aforesaid.
30 aforesaid we likewise grant and indulge.
31 § 24. Commanding our beloved sons the vice-chancellor, camerlengo, summoner and general auditor of the said Camera and of this bull, clerks, treasurer and of the same City governor and senator, as well as legates, vicelegates, patriarchs, archbishops, bishops, abbots, priors and governors of whatever cities, castles and places of the said Ecclesiastical State, to be chosen by the college of the said seven notaries existing for the time being and each of them, that each of them, by himself or by another or others, by our authority, to the said seven notaries now and existing for the time being, in all and singular the aforesaid matters, assist with the protection of effective defense, and cause them and each of them, as often as on their behalf they shall have been requested concerning this, to enjoy and possess all and singular the aforesaid peacefully, not permitting them and any of them to be molested, disquieted or impeded in any way whatsoever by anyone. Restraining any and all contradictors and rebels, of whatever status, degree, order, dignity or preeminence they may be, through ecclesiastical censures and pecuniary penalties and other appropriate remedies of law and fact, appeal being set aside. Decreeing all and singular the aforesaid to be perpetually valid and efficacious, and to obtain their full and complete effects; and to be observed by all, and thus and not otherwise by the same cardinals and auditors, and other judges and commissioners, with any facility and authority of judging and interpreting otherwise being removed from them and from each of them, to be judged and defined. And if anything contrary to these should be attempted by anyone, by whatever authority, knowingly or unknowingly, we declare it null and void.
32 § 25. Notwithstanding the constitutions and ordinances of St. Symmachus and Innocent IV, Paul II and other Roman Pontiffs, our predecessors, even those contrary to the examples aforesaid and to the other apostolic [documents], and those issued in general and provincial, synodal, and especially in the Tridentine councils, yet not however as regards exemption from it freely granted in general constitutions; and [notwithstanding] the laws, statutes of ourselves and of other Roman Pontiffs our predecessors, or other extravagant [documents], whatsoever general constitutions; also privileges, indults and apostolic letters, whatsoever to the colleges of officials of the Roman Curia and to their persons through whatsoever our predecessors, even by similar motu proprio and from certain knowledge and from the fullness of apostolic power, and with whatsoever, even derogatory clauses of derogations and other stronger, more efficacious and unusual clauses, irritant and other declarations and decrees, even such that by those [clauses] in no way, or unless by the express consent of those to whom it pertains, and by the counsel of our brethren, even held consistorially, and by other modes and forms preserved there throughout, it might be derogated; even if it be expressly provided among other things that if derogation of these should happen, such derogation shall not be valid unless such intention of derogating to certain persons then expressly set forth through various letters in the form of a brief with an interval of one month or other time be first presented and intimated and insinuated to them, and to others howsoever conceded and to be conceded. Which [documents], their tenors, as if they were inserted word for word in the present [document], we hold as sufficiently expressed and inserted; those [documents] otherwise remaining in their force, this time only, and for the purpose of all the aforesaid, by the series of these [letters], specially and expressly, by similar motu proprio we derogate, and [we derogate] all other things contrary whatsoever.
33 § 26. We will moreover that the present [document] in transumpts [be valid].
