Sollicitudo omnium Ecclesiarum

Bull on the preservation of the Blessed Virgin Mary from original sin

Bull of Pope Alexander VII ·

CCCLXVI.

1 Innovation of constitutions and decrees in favor of the opinion asserting that the soul of the blessed Mary the Virgin in her creation and in the infusion into her body was preserved from original sin, published.

2 Pope Alexander VII, for perpetual remembrance of the matter.

3 The solicitude for all the churches, which, although we are far unequal in mind and strength, we bear by the will and providence of God the best and greatest, holds us anxiously intent and vigilant in this: that scandals, which on account of the corruption and frailty of human nature must necessarily arise among the faithful, arise as few as possible, and that those which do arise be removed as quickly as possible. 1 The piety of Christian faithful toward their most blessed Mother, the Virgin Mary, is ancient, those holding the opinion that her soul in the first instant of creation and of infusion into her body was by special grace and privilege of God, in view of the merits of Jesus Christ her Son, the Redeemer of the human race, preserved immune from the stain of original sin, and in this sense celebrating and solemnizing the feast of her Conception with solemn rite; and the number of these has grown and such worship toward the Mother of God has increased after the apostolic constitutions issued by our predecessor Pope Sixtus IV of blessed memory in her commendation, which the sacred Council of Trent renewed and ordered to be observed; this piety and worship toward the Mother of God was further increased and extended after monasteries of religious Orders and confraternities were erected in this name, with the approval of the Roman Pontiffs, and indulgences were granted by them, so that, with very many celebrated academies also acceding to this opinion, now almost all Catholics embrace it.

4 § 2. And because on the occasion of the contrary assertion in sermons, lectures, conclusions and public acts, namely that the same most blessed Virgin Mary was conceived with original sin, there arose in the Christian people with great offense to God scandals, quarrels and dissensions, Paul Pope V, also our predecessor of revered memory, forbade the opinion contrary to the aforesaid opinion to be taught or preached publicly. Which prohibition Pope Gregory XV, likewise our predecessor of pious memory, extended also to private conversations, moreover commanding in favor of the same opinion, that in the most holy sacrifice of the Mass and in the divine office to be celebrated, both publicly and privately, no one ought to use any name other than that of the Conception.

5 Supplication. § 3. Nevertheless, as almost all the venerable brother bishops of the Spains with the chapters of their churches have set forth to us in letters sent to us (with the addition also of an intimation from our most dear son in Christ Philip, the Catholic king of those same Spains, who sent a special envoy to us on this matter, the venerable brother Louis, bishop of Piacenza, through whom also the supplications of those kingdoms of the Spains were brought to us), some asserters of that contrary opinion continue, against the aforesaid prohibitions, both privately and publicly to impugn or to cavil at the aforesaid opinion, and so to interpret the favor shown by the Roman Pontiffs to the worship and feast according to it as to frustrate it; indeed they deny that the Roman Church favors this opinion and the worship according to it exhibited to the Blessed Virgin, attempting to disturb the pious Christian faithful from their peaceful possession as it were, whence the offenses, scandals and quarrels which our predecessors Paul V and Gregory XV wished to prevent still endure, and from the occasion of these adversaries greater inconveniences are prudently and deservedly feared for the future. Wherefore both the aforesaid bishops with the chapters of their churches and the aforementioned King Philip and his kingdoms have earnestly besought us for an appropriate remedy in these matters.

6 ordinances. § 4. We, considering that the holy Roman Church has always solemnly celebrated the feast of the Immaculate Conception of the Virgin Mary, and once ordained a special and proper office concerning this, according to the pious, devout and praiseworthy institution which was then set forth by Sixtus IV our predecessor: and wishing to favour this praiseworthy piety and devotion, and the feast and worship according to that institution exhibited in the Roman Church, never changed since the institution of that worship itself, following the example of our Roman Pontiff predecessors, and also to protect this piety and devotion of honouring and celebrating the Most Blessed Virgin, preserved by the grace of the Holy Spirit from original sin, and desiring to preserve unity of spirit in the bond of peace in the flock of Christ, with offences and quarrels settled and scandals removed, to the petition and prayers presented to us by the aforesaid bishops with the chapters of their churches, and by Philip the king and his kingdoms, we renew the constitutions and decrees issued by the Roman Pontiffs our predecessors, and especially by Sixtus IV, Paul V and Gregory XV in favour of the opinion asserting that the soul of the Blessed Virgin Mary was endowed with the grace of the Holy Spirit in its creation and in its infusion into the body, and was preserved from original sin, as well as in favour of the feast and worship of the Conception of the same Virgin Mother of God according to this pious opinion, as aforesaid, exhibited, and we command that they be observed under the censures and penalties contained in those same constitutions. § 5. And moreover all and singular who

7 shall presume to interpret the aforesaid constitutions or decrees in such a way as to frustrate the favour given by them to the said opinion and the feast or worship according to it, or who shall dare to call into question this same opinion, feast or worship, or to speak, preach, treat, dispute against them in any way whatsoever, directly or indirectly, or under any pretext, even that of examining its definability, whether by glossing or interpreting Holy Scripture, the holy Fathers or doctors, or finally under any other pretext or occasion, in writing or by word, determining or asserting anything against them, or bringing forward arguments against them and leaving them unresolved, or discoursing in any other unthinkable manner, besides the penalties and censures contained in the constitutions of Sixtus IV, to which we will that they be subject, and by these presents we subject them, we also will that they be deprived ipso facto, without any other declaration, of the faculty of preaching, publicly reading, teaching and interpreting, and of active and passive voice in any elections whatsoever; and we will that they incur ipso facto, without any other declaration, the penalty of perpetual incapacity for preaching, publicly reading, teaching and interpreting; from which penalties they can be absolved only by us ourselves or by our successors the Roman Pontiffs, or dispensation granted concerning them: and we likewise will that they be subject to other penalties to be inflicted at the discretion of us and of the same Roman Pontiffs our successors, as we subject them by these presents, renewing the constitutions or decrees of Paul V and Gregory XV mentioned above.

8 § 6. And books in which the aforesaid opinion, feast or worship according to it is called into question, or against which anything is written or read in any manner whatsoever, as above, or which contain utterances, sermons, treatises and disputations against the same, issued after the aforesaid decree of Paul V, or to be issued in any manner in the future, we prohibit under the penalties and censures contained in the Index of Prohibited Books, and we will and command that they be held ipso facto, without any other declaration, as expressly prohibited. We forbid, however, adhering to the constitutions of Sixtus IV, that anyone assert that on account of this those holding the contrary opinion, namely that the glorious Virgin Mary was conceived with original sin, incur the crime of heresy or mortal sin; since this has not yet been decided by the Roman Church and by the Apostolic See, as we now in no way will to decide or intend: but rather we subject to graver penalties, besides those to which Sixtus IV and our other Roman Pontiff predecessors subjected them, those who dare to condemn that contrary opinion as heresy or mortal sin or impiety, which penalties we inflicted above on those acting contrary to this our constitution.

9 § 7. Wishing that the transgressors of this constitution be punished, we decree that bishops and prelates, superiors and other local Ordinaries, as well as inquisitors deputed everywhere against heretical depravity, shall proceed against and inquire into the transgressors of this constitution, even if they be regulars of any Order and institute, even of the Society of Jesus, and in any manner exempt, and any other ecclesiastical and secular persons whatsoever, of any status, degree, order, or dignity, whether ecclesiastical or secular, as aforesaid, and shall strictly take action against them: for we grant to them and to each of them free faculty and authority against the same transgressors to proceed and inquire, and to coerce and punish by penalties, by the same authority and tenor, and we strictly command and enjoin them, as aforesaid, to proceed, inquire and punish.

10 § 8. Notwithstanding constitutions, ordinances, and any indults and apostolic letters whatsoever, granted in any manner to any persons, however much qualified, and constituted in any dignity and honour, even cardinal, patriarchal, archiepiscopal, episcopal, and any other, even that they cannot be proceeded against, interdicted, suspended, or excommunicated; all of which and each of which, even if for their sufficient derogation there would need to be made mention of them and their whole tenors in a special, specific and individual, express, and word for word manner, and not through general clauses, even importing the same, or other exquisite form to be observed, we having these tenors as if they were inserted word for word, by the present series specially and expressly derogate from them; and from all other things contrary whatsoever. § 9. But in order that this our constitution and all the aforesaid matters may come to the knowledge of all those to whom it concerns more suitably, in virtue of holy obedience, and under the penalty of privation from the entrance of the church to be incurred by that very fact, we command and enjoin all and singular local Ordinaries, and their vicars, suffragans and officials whatsoever, and all others to whom it in any manner pertains and belongs, that they opportunely intimate and publish this our constitution to the preachers of their diocese or district singly, and to others whom they shall judge expedient, and cause it to be intimated and published, lest anyone hereafter in any way be able to plead ignorance of the aforesaid, or excuse himself against the aforesaid.

11 § 10. We will, and likewise by the same authority decree and command, that these present letters be published and affixed by some of our couriers on the doors of the basilicas of St. John Lateran and of the Prince of the Apostles, and of the apostolic chancery, and in the square of the Campus Florae of the City in the customary manner; which affixion and publication shall so affect and bind all and singular to whom it pertains, as if it had been personally intimated to them; and that to transcripts of them, even printed ones, subscribed by the hand of some notary, and furnished with the seal of some person constituted in ecclesiastical dignity, the same faith shall be given as would be given to these present letters, if they were shown or exhibited.

12 Given at Rome, at St. Mary Major, under the Fisherman's Ring, on 8 December 1661, in the seventh year of our pontificate. Dat. 8 December 1661, pontif. year VII.

CCCLXVI.

7 praefatas constitutiones seu decreta ita pergent interpretari, ut favorem per illas diclae sententiae et feslo seu cultui secundum illam exhibito frustrentur, vel qui hanc eamdem sententiam , festum seu cultura in disputationem revocare, aut contra ea quoquo modo, directe vel indirecte, aut quovis praetextu, etiam definibilitatis eius examinandae , sive Sacranti Scripturam, sanctos Patres, sive doctores, glossandi vel interpretandi, denique alio quovis praetextu seu occasione, scripto seu voce, loqui, concionari, tractare, disputare, contra ea. quicquam determinando aut asserendo, vel argumenta contra ea afferendo, et insoluta relinquendo , aut alio quovis inexcogitabili modo disserendo, ausi fuerint, praeter poenas et censuras in constitutionibus Sixti IV contentas, quibus illos subiacere volumus, et per praesentes subiicimus, eliam concionandi, publice legendi, seu docendi et interpretandi facultate, ac voce adiva et passiva in quibuscumque electionibus eo ipso absque alia declaratione privatos esse volumus, necnon ad concionandum, publice legendum , docendum et interpretandum perpetuae inhabilitatis poenas ipso facto incurrere absque alia declaratione; a quibus poenis nonnisi a nobis ipsis vel a successoribus nostris Romanis Pontificibus absolvi, aut super iis dispensari possint: necnon eosdem aliis poenis nostro et eorumdem Romanorum Pontificum suecessorum nostrorum arbitrio infligendis pariter subiacere volumus, prout subiicimus per praesentes, innovantes Pauli V et Gregorii XV superius memoratas constitutiones sive decreta.
