of the deceased. — 4. Definition concerning the condemnation of souls of the deceased dying in mortal sin. — 5. Prohibition of holding otherwise. — Penal sanction.
1 Benedict, bishop, servant of the servants of God, for perpetual remembrance of the matter.
2 Blessed be God in His gifts and holy in all His works, who the most holy Roman Catholic and apostolic Church, which as a vineyard His right hand hath planted, and which as the principal head of all Churches He hath set up as victorious 1, the Lord saying to Peter: Thou art Peter, and upon this rock I will build My Church, doth not abandon through His mercy, but through His blessed Apostles, especially Peter and Paul, singular defenders of that same Church, doth guard with pious kindness and continual devotion: so that, governed by the same rectors, it remaineth stable in itself, founded upon a firm rock; and all cultivators of Christian faith obey it, are subject to it, attend to it, live under its teaching, stand under its discipline and correction. Let not the rash be dogmatized in it, let not the incautious be inserted, let not the reckless in faith be brought in; and thus let men decline from evil and do good, walk in straight paths and advance to better things through holy desires, nor let them hope for the near eternal life rewards of the just, let them fear the not remote calamities of hell for the wicked.
3 It is the office of the Roman Church to define and correct all things.
4 John therefore, Pontiff XXII, wished to define the dissensions of certain articles concerning which he, but prevented by death, was not able to accomplish it.
5 For it is written: Behold, I come quickly, and my reward is with me, to render to every man according to his works. But if anyone shall attempt otherwise, let him forthwith by his own authority, and even by penalties imposed as he shall see fit, utterly root it out. For which reason, that subsisting in itself it might inform others, our Saviour Jesus Christ is reported to have besought the Father at the time of His Passion, saying: Simon, behold Satan hath desired to have you, that he may sift you as wheat: but I have prayed for thee, that thy faith fail not: and thou, being once converted, confirm thy brethren. § 1. Indeed, long ago in the time of our predecessor of happy memory, John XXII, a matter of question arose among certain masters even of the theological faculty concerning the vision of the souls of just men after their death, in whom there was nothing purifiable, or if there was, it would already have been purified entirely, when they departed from this world, whether they see the divine essence before the resurrection of their own bodies and the general judgment: and concerning certain other matters a question arose, some of them attempting to show the negative, some the affirmative, and others indeed according to their own imaginings, diverse and in diverse ways concerning the vision of the divine essence by souls of this kind, as it is known to appear from their sayings and writings; but upon their rejected contentions, which we here omit for the sake of brevity, because thus from our determinations they were also 2 decided among themselves. And when the same predecessor of ours, to whom the determination of the aforesaid matters pertained, prepared himself for the decision of contentions of this kind in his public consistory, both to his brethren the Cardinals of the Holy Roman Church, of whose number we were then, and to the prelates and masters in theology, of whom many were present, enjoining strictly and commanding that upon the matter of the aforesaid vision, whenever they should be required by him, each one should deliberately say what he felt. Yet, being prevented by death, as it pleased the Lord, he was not able to complete it.
6 § 2. Therefore, with our predecessor deceased in this manner, we, by divine grace assumed to the summit of the supreme apostolate, attending more diligently to the aforesaid dissensions, considering how great perils to souls impend from the aforesaid unsettled contentions of theirs, how great scandals can arise therefrom, so that their variety may perish and the solidity of truth may become known, having first had careful examination and diligent deliberation concerning the aforesaid with our brothers the aforesaid Cardinals of the Roman Church, by the counsel of those brothers, by this constitution to endure in perpetuity, by apostolic authority we define.
7 § 3. That, according to the common ordinance and definition of God concerning blessedness, the souls of all the saints, namely those who departed from this world before the Passion of our Lord Jesus Christ, as well as the souls of the holy apostles, martyrs, confessors, virgins and other faithful deceased, after they received the sacred baptism of Christ, in whom there was nothing in need of purification when they departed, nor will there be when they depart even in the future, or if there was or will be something in need of purification in them, since after their death they were purified; and that the souls of children reborn in the same baptism of Christ and to be baptized, when they shall have been baptized, departing before the use of free will, after their death and the aforesaid purification in those who had need of such purification, before the resumption of their bodies and the general judgment, after the ascension of our Saviour Lord Jesus Christ into heaven, were, are and will be in heaven, in the kingdom of the heavens and in the celestial paradise with Christ, joined to the company of the holy angels, and after the Passion and death of Lord Jesus Christ saw and see the divine essence by intuitive vision, and also by facial vision, with no creature intervening, standing in the capacity of the object seen; but the divine essence immediately shows itself to them naked, openly and plainly. And that thus seeing the same divine essence they truly enjoy it. Likewise that from such vision and enjoyment of their souls, which have already departed, they are truly blessed, and have life and eternal rest, and will have these, those who shall depart hereafter, when they shall see the same divine essence, and enjoy it before the general judgment. And that such vision of the divine essence and its enjoyment evacuate the acts of faith and hope in them, insofar as faith and hope are proper theological virtues. And that after such intuitive and facial vision and enjoyment shall have begun or will begin in them, the same vision and enjoyment without any interruption or evacuation of the aforesaid vision and enjoyment has continued and will continue until the final judgment, and from then into eternity.
8 § 4. We define moreover that according to the common ordinance of God, the souls of those departing in actual mortal sin, immediately after their death descend to hell, where they are tormented by the pains of hell, and that nevertheless on the day of judgment all men shall appear before the tribunal of Christ with their bodies, about to render an account of their deeds, so that each one may bear the things proper to the body, according as he has done, whether good or evil.
9 § 5. Decreeing that the aforesaid definitions or determinations of ours and each and every one of them are to be held by all the faithful. Whoever hereafter shall presume knowingly and obstinately to hold, assert, preach, teach or defend the contrary of the aforesaid definitions or determinations of ours and each and every one of them by word or in writing, against him as against a heretic shall proceedings be duly instituted.
10 § 6. Let no man therefore be permitted to alter this page of our constitution, etc. Given at Avignon, on the 4th day before the Kalends of February, in the 2nd year of our pontificate.
11 Given on 29 January 1336, in the 11th year of the pontificate.
