A nessuno dunque ecc.

XXIX.
On the approval of a society, both of ecclesiastical and secular persons recently instituted for the erection of hospitals for the relief of poor orphans and converted women.

1 Paul, Pope III, for perpetual memory of the matter. By the office of apostolic service enjoined upon us, although unequal to it in merit, we willingly assent to those things by which the utility and wholesome direction of hospitals and other pious places are procured, and we extend the right hand of our liberality also to those whom their own merits of virtue commend manifoldly to this end.

2 § 1. Indeed, on behalf of our beloved sons, the universal poor orphans of St. Mary Magdalen in the suburb of St. Leonard of Bergamo, and of the hospitals collected in the cities and dioceses of Milan, Como, Genoa, Pavia, Brescia and Verona, both of ecclesiastical and secular persons serving in them, a petition was recently presented to us containing that, whereas formerly Jerome Miani, a citizen of Venice, seeing many poor orphans, on account of the sad events of wars pressing upon Italy and urgent famine, wandering about abandoned in various places, the same Jerome, moved by fervent devotion and piety, began the aforesaid hospital of St. Mary Magdalen; and afterwards the aforesaid hospital, both on account of the fervent charity of citizens dwelling in the city of Bergamo and the provident direction and wholesome governance of the aforesaid Jerome, grew to such an extent, by the Lord's doing, that the same Jerome applied his mind to instituting other hospitals in other parts of Italy. So that both in the Milanese and Comense and other cities and dioceses aforesaid, similar hospitals were erected, and in some of them hospitals for converted women, through the mediation of the said Jerome and certain others, whence these hospitals are led from good to better, their number increases daily and is hoped to increase; and as the same petition subjoined, if in these same hospitals, which have been accustomed to be governed by the said clerics and laymen together, there should exist one superior or head, who might there for the time being cause those serving to be gathered together, and be able to transfer them from place to place, and these hospitals should be adorned with certain prerogatives, truly the wholesome direction of the hospital itself and of those serving in it would be greatly consulted, and the poor of this kind dwelling in them would be better governed, and the said persons would be cherished in it, and would be invited to their accustomed services. Wherefore, on behalf of these poor and serving persons, we were humbly supplicated that we should deign to provide opportunely in the foregoing matters with apostolic benignity.

3 § 2. We therefore, who desire that the works of charity be exercised everywhere with sincere affections, absolving by the tenor of these presents each and every one of the poor persons aforesaid from whatever excommunication, suspension and interdict and other ecclesiastical sentences, censures and penalties, whether by law or by man, in any occasion or cause whatsoever imposed, if in any way he is bound by them, for the purpose of obtaining the effect of these presents only, and holding him absolved and to be absolved, inclined by these supplications, by apostolic authority, by the tenor of these presents, to the same hospitals, that the poor and persons dwelling and serving in them for the time being may elect one from among the persons serving in them of this kind, whether ecclesiastical or secular, as superior or head among them, who may cause them to be gathered together, and transfer them from place to place, and may frame whatever statutes and ordinances lawful and honest and not contrary to the sacred canons, and may change the same statutes, as often as it shall seem good to him, and newly establish them.

4 § 3. Likewise, priests serving the same poor for the time being may say and recite their canonical hours, both daytime and nighttime, and all divine offices according to the rite and custom and use of the Holy Roman Church, even most recently published.

5 § 4. And we perpetually grant and indulge that these same poor and all and singular serving in the said hospitals in their respective places may, their confessions having been diligently heard, freely and lawfully absolve them from all and singular their sins, cases, crimes, excesses and offences, from which the ordinaries of those places have been accustomed to absolve, and may impose salutary penance for those committed.

6 § 5. Wherefore to our venerable brothers the bishops of Caserta, Felice and Visone by apostolic letters we command that they themselves or two or one of them through another or others, by our authority, shall cause these present letters and whatever is contained in them to have full effect and to be inviolably observed, and shall permit the aforesaid poor priests and all and each of the others whom it concerns in any way to enjoy and rejoice peacefully, according to the tenor and content of these presents. Not permitting anyone to molest, impede or disturb them in any way contrary to their tenor. Restraining the gainsayers through ecclesiastical censure, appeal being set aside.

7 § 6. Notwithstanding apostolic and in the Councils provincial and synodal constitutions and ordinances and statutes and customs issued, general or special, and privileges also, indults and apostolic letters, even in the form of a brief, granted, confirmed and renewed by whatever Roman Pontiffs our predecessors and ourselves and the aforesaid See, even by way of a general law and perpetual statute and agreement and stipulated contract, and by our own motion and from certain knowledge, and from the fullness of apostolic power, even with whatsoever irritant, annulling, cassatory, revocatory, preservative, exceptive, restorative, declaratory and derogatory clauses, and other stronger, most efficacious and unusual clauses, irritant and other decrees, even to whatsoever ordinaries of places, under whatsoever forms and extensions of words, granted, confirmed and renewed, which (holding the tenor of all of them as sufficiently expressed herein), would otherwise remain in their force, we on this occasion by this series specially and expressly derogate, anything to the contrary notwithstanding. Or if to any, commonly or severally, it has been indulged by the same See that they cannot be interdicted, suspended or excommunicated by apostolic letters not making full and express mention word for word of such indult; and any other indulgence of the said See, general or special, of whatsoever tenor it may be, by which, not expressed in these presents or not wholly inserted, the effect of such grace may be hindered in any way or deferred, and of which the whole tenor must be had in our letters with special mention. For we from now decree irritate and void whatever otherwise concerning these things by anyone, by whatsoever authority, knowingly or unknowingly, may be attempted. Let no one therefore etc. Given at Rome at St. Mark, in the year of our Lord's Incarnation one thousand five hundred and forty, on the nones of June, in the sixth year of our pontificate.

8 Given on 5 June 1510, pontificate year vi.
