CXCVII.

10 929 An.C. 1571 § 7.

CXCVII.
The town of Ripae Transonae in the province of Picenum elevated to the dignity of a city, and its parochial church of St. Benignus erected into a cathedral and episcopal church.
Pius, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 Supported by the protection of Him whose are the ends of the earth, the hinges, and to whom the thoughts of men are prepared, and whose providence receives the ordering of all things, so that the Christian faithful subject to us and to the Apostolic See also in temporal dominion, on account of their special faith and devotion toward us and that same See, may receive consolation and, with the increase of divine worship, we willingly, when it is requested of us, expend our effective labor and efforts that new episcopal sees may be planted in notable and populous towns.
2 § 1. Indeed, since the town of Ripae Transonae of the diocese of Firmum, situated in the Picene territory, between Asculum and Firmum, in the sight of the Adriatic gulf, fortified with a wall and ditch, consisting of more than a thousand families, and governed by four men called anthiani residing in the palace of the commune with an honest household, and filled with many and various shops and workshops of merchandise, and with monasteries, convents or houses of men and women of different Orders, in which many pious and charitable works are exercised, four confraternities and one hospital, as well as fourteen parochial churches and honorable inhabitants, having ample territory where about three hundred families dwell, and eighteen churches with cure of souls, each of which has its own rector, exists among the other towns of our province of the March of Ancona as notably distinguished, and we have learned that its inhabitants have always been most faithful and devoted to that See, we deem it worthy, indeed rather obligatory, that an episcopal see be placed therein.
3 § 2. And whereas the present universitas of that town, which has supplicated us repeatedly on this matter, has promised at its own expense to enlarge and adorn the church of St. Benignus of that town, which is parochial, if it be erected into a cathedral, together with its house for the bishop's residence, and has bound itself with valid obligations; and moreover has assigned to the episcopal table of the cathedral church to be erected six hundred scudi annually, and fruits and revenues, or of lands and tenements solemnly consigned to the church to be erected, namely one of seventy-six in the district called di Coco, and another of capacity of one hundred and thirty salmas, the measure of those parts, in the district of Guardianae and the territory of that town, belonging and pertaining to that universitas, in perpetuity and in ownership.
4 § 3. We, who formerly among other things willed that those seeking ecclesiastical benefices to be united to others should be bound to express the annual value also of the benefice to which another was sought to be united, and always in unions com- And its universitas supplicates for obtaining the erection into an episcopal See, to which a dowry was assigned.
5 Heraclius of the town in Ernia, and the church of St. Benignus into an episcopal see for a bishop, to be called the Bishop of Ripae Transonae, a mission should be made to those parts, with the archdeaconry being called together with venerable fathers of ours of the Holy Roman Church, cardinals. After mature deliberation with their counsel and assent, and from the fullness of apostolic power, we perpetually segregate, dismember, separate and exempt the aforesaid town with all its territory, churches and persons, both secular and ecclesiastical, from the diocese of Firmum, and also from the jurisdiction and superiority of the bishops of Firmum, Aprutium and Asculum, as well as of the abbot or commendatory of the monastery of Campifellonis, of the Order of St. Benedict, of no diocese, for the time being existing, or of any other bishop, chapter, abbot and monastery, to which it is known to be subject in whole or in part; and we erect the same town into a city, to be called Ripae Transonae, with the rights, honors and preeminences which other cities and their citizens use, enjoy and possess, and shall be able to use, enjoy and possess in any way in the future; and the church of St. Benignus of this kind into a cathedral see immediately subject to the aforesaid see, under the same invocation of St. Benignus, and in it an episcopal seat for one bishop, to be called the Bishop of Ripae Transonae, who shall preside over the same church and its city and diocese, and shall order and reduce it into the perfect form of a cathedral church, shall convoke abbots, prelates and others to synod, shall uproot, destroy, build, plant, and shall have and exercise all and singular episcopal offices and rights, with its chapter episcopal and capitular table and all other cathedral and pontifical insignia, as well as rights, jurisdictions, faculties, prerogatives, privileges, honors, graces, favors and indults, real, personal and mixed, which other cathedral churches, and their prelates, chapters and persons use, enjoy and possess in any way, and shall be able to use, enjoy and possess in the future; and moreover, that the same cathedral church of Ripae Transonae may be rendered perfect in every respect, in it we perpetually erect and institute two dignities, namely one archpresbyterate, a dignity there greater than the pontifical, for one archpriest, who shall exercise the care of souls of the parishioners of the church of St. Benignus erected into a cathedral in this manner, and one archdeaconate, for one archdeacon, as well as twelve canonicates, with as many prebends for twelve canons, who shall serve the same church in divine offices, and together shall constitute one chapter, with the consent of the modern rector of the aforesaid church of St. Benignus acceding to this, to the praise and glory of almighty God and honor of His most glorious Mother the Virgin Mary and the whole heavenly court and the exaltation of the Catholic faith. § 4. And we adorn the aforesaid town as a city, and its inhabitants as citizens, as well as the aforesaid church of St. Benignus with the honor, name, title and insignia of a cathedral church; and to the said church of Ripae Transonae and its episcopal table, for a dowry, the said two pieces of land, as aforesaid assigned, as well as to the archpresbyterate of the church of Ripae Transonae of this kind all things, goods, fruits, revenues, proceeds, rights, emoluments and revenues whatsoever of the aforesaid church of St. Benignus we perpetually apply and appropriate; but to the Archdeaconate of the Blessed Mary of the Annunciation of Agello, with its rural areas, and to one and the same of Ss. Nicholas, Rusticus and Eleutherius parish, and another and the same of St. Michael of the Hill, and another and the same of St. Mary of the Valley, and another and the same of Ss. Savior and Antoninus, and another and the same of St. Thomas in Cletis, and another and the same of St. Blaise of the Square, and another and the same of St. Hippolytus and Cassianus, and another and the same of Ss. Gregory and Margaret priory, and another and the same of St. Michael of Rofflano, and another and the same of St. Roch and Pastor, and another and the same of St. Eumenius called a prepositure, as well as to the remaining and the same canonicates and prebends aforesaid, the remaining church of St. Savior of Agello, a parish church situated and founded in the said city of Ripae Transonae, vacant from now, the remaining ones moreover from now as from then, whenever it shall happen that those or any of them, through cession or death or privation of those now holding them or otherwise in any way, become vacant, even if now vacant, through free resignations of any of them made in the Roman Curia or outside it, even before a public notary and witnesses, willingly made, or through the constitutions of John, Pope of happy memory, XXII, our predecessor, which begins Execrabilis, or through the acquisition of another ecclesiastical benefice, granted by any authority, become vacant, even if they shall have been vacant for so long a time that their collation, according to the statute of the Lateran council, has legitimately devolved to the same see, and the churches themselves exist as subject to apostolic disposition specially or generally, and suits concerning them, the status of which we wish to be held as expressed in these presents, are pending undecided, provided that their disposition pertains to us in this instance, with all and singular their and each of their annexes, so that it shall be lawful for the same archpriest, archdeacon and canons for the time being existing to freely apprehend corporeal possession of them by their own authority and perpetually retain them, and by their own authority to receive, exact and collect their fruits, revenues and proceeds, and convert them to their own and each of their uses and utility, we perpetually unite, annex and incorporate.
6 § 5. And to the aforesaid bishop and canons, so that for the wholesome direction and prosperous state and happy success of the cathedral church erected in this manner and of the persons aforesaid therein, and of the divine offices celebrated in it, and for the perception of fruits, revenues, proceeds, rights, emoluments and daily distributions and their division and apportionment among them, and in all matters and their circumstances whatsoever, they may make, and having made, whenever it shall seem opportune, change, limit, correct and interpret according to the quality of things and times, and in place thereof make and issue other ordinances, chapters and statutes, whenever it shall seem expedient to them, which all things, after they shall have been issued and made, from now as from then and conversely (if they shall be lawful and honest and not contrary to the sacred canons) by the same authority, even with the supply of defects, are confirmed and are to be considered as confirmed by that very fact, we grant and indulge.
7 § 6. And whereas the city of Ripatransone is divided into four regions, so that in each region one parochial church alone for one parish, which can exercise the care of the parishioners dwelling therein, namely in the region of St. Benignus of Agello erected into a cathedral, in that of St. Dominic, St. Angel of Rofflano, in that of Mount Antique of Sts. Nicholas, Rusticus and Eleutherius, and in that called the Head of Mount, the churches of Sts. Gregory and Margaret appear to suffice, we separate and dismember all and singular parishioners and neighbors of both sexes from the other parochial churches of the city of Ripatransone and the rights of these parochial churches, and we perpetually suppress the care of souls in them; and those and that and the aforesaid rights, as to Agello, to St. Benignus erected into a cathedral; as to the Faculty of the bishop and canons to make statutes for the happy success of the cathedral church.
8 Constitution of four parochial churches in four regions of the said city.
9 PIUS V PP.
10 929 An.C. 1571 St. Dominic, to St. Angel of Rofflano; as to Mount Antique to Sts. Nicholas, Rusticus and Eleutherius; but as to the parishioners and neighbors of the Head of Mount regions of this kind, to the aforesaid parochial churches of Sts. Gregory and Margaret, so that each region may have its own priest and pastor, we perpetually transfer. § 7. Likewise of the same St. Angel and Sts. Nicholas, Rusticus and Eleutherius, and the rights of having parishes in the rectors of the parochial churches of Sts. Gregory and Margaret, we indulge to the rectors of the said cathedral church as canons, so that they may cause them to serve in divine matters through perpetual vicars to be approved by the ordinary of the place, and may exercise the care of the souls of their parishioners.
11 § 8. Likewise an archpresbyterate, an archdeaconate and twelve canonicates with their prebends vacant from the original erection of this church and chapter, namely of the church of St. Benignus aforesaid erected into a cathedral, who shall be archpriest of the said church of Ripatransone, and in it shall hold the dignity next after the pontifical; and of the church of St. Mary of the Annunciation of Agello, who shall be archdeacon of the same church of Ripatransone, and shall hold a dignity, yet not next after the pontifical; but the other parochial churches, as aforesaid, united, each of which fruits, revenues and proceeds do not exceed the annual value of twenty-four ducats of gold of the Camera, according to common estimation, we confer on the rectors of the same, who are canons of the same church of Ripatransone, and we provide for them also with the fullness of canonical right.
12 § 9. And we will that henceforth, in perpetuity in future times, in the choir, chapter, processions and other public or private acts, the archpriest shall have the first place, the archdeacon the second place, but the newly created canons after the aforesaid archpriest and archdeacon, according to their reception and admission, if they shall have consented to it, each one of them shall have their places.
13 § 10. And whereas the fruits, revenues and proceeds of the canonicates and prebends of the said church of Ripatransone appear sufficiently meager, we perpetually suppress and extinguish a simple ecclesiastical benefice under the invocation of St. Angel of Villesmagn, within the said city of Ripatransone, by the consent of its rector, and its and its annexed fruits, rights and emoluments whatsoever, as well as the tithe of fruits, revenues and proceeds of whatsoever kind from the novalia of the said university called Fulgaia, by the consent of the same university, we perpetually apply and appropriate to the same chapter and its capitular table for daily distributions, according to the prudent ordinance of the bishop of Ripatransone, to be distributed among those holding dignities and the aforesaid canons.
14 § 11. Moreover, for the greater convenience and spiritual consolation of the Christian faithful and the inhabitants of those places and regions, We do also perpetually dismember, separate and exempt from the jurisdiction, power, dominion and any other superiority of the churches of Firmum and Asculum, and of the monastery of Farfa, and of their bishops, abbots or commendataries now and for the time being, to whom these places, fortresses and towns and their churches and aforesaid persons are now known to be subject, the places, fortresses and towns of Columnella, Aquae Vivae, St. Benedict, Marani, St. Andrew, the Grottae ad Mare, Gissi, Quinzani, Moneta in the diocese of Prandone, Furcae, Mons Altus, Mons de Novem, Rotella, Porculae, Cossignani and Passignani, situated in the aforesaid province of the Marches and existing anywhere, and which are now and for the time being subject, mediately or immediately respectively, to the abbots or commendataries of the monastery of Farfa and to the bishops of Firmum and Asculum, by reason of the monastery and the churches of Firmum and Asculum; as well as the collegiate, parochial and other churches, monasteries, prepositorates, priorates and all other whatsoever, howsoever many and of whatsoever kind, with cure or without cure, secular and of whatsoever Orders regular, ecclesiastical benefices, even if secular canonicates and prebends, personates, administrations, offices, even with cure and elective, even in collegiate churches; and regular benefices of this kind, prepositorates, prepositorships, dignities, even conventual, personates, administrations and offices, even claustral, chaplaincies, chapels, hospitals and other pious places situated in them, and to which dignities, priorates, prepositorates and prepositorships of this kind it has been customary to be assumed by election, and the persons of both sexes, inhabitants and residents of those same places, fortresses and towns, both lay and clerical, priests, beneficiaries and religious of whatsoever kind, of whatsoever status, order and condition they may be, We do perpetually dismember, separate and exempt from the jurisdiction, power, dominion and any other superiority of the churches of Firmum and Asculum, and of the monastery of Farfa, and of their bishops, abbots or commendataries now and for the time being existing, to whom these places, fortresses and towns and their aforesaid churches and persons are now known to be subject; and these places, fortresses and towns and their persons, both secular and ecclesiastical, and religious of whatsoever Orders, churches, monasteries, priorates, prepositorates, prepositorships and other ecclesiastical benefices, hospitals and pious places of this kind, with all their rights and appurtenances, We do freely grant and assign to the church of Ripano aforesaid, for the diocese, clergy and people, in such manner that it shall be lawful for the bishop of the same church of Ripano, being placed over the same church of Ripano both at this first time and hereafter, through himself or through another or others in his name, to freely apprehend corporeal possession or quasi-possession of the administration, spirituality and all manner of diocesan right, by his own authority, without the license of the bishops of Firmum and Asculum and of the abbot or commendatary of the same monastery of Farfa now and for the time being existing being required in this matter, and having apprehended it to retain it perpetually; and We do likewise grant and assign it perpetually from the fullness of the same power; and We do subject and subordinate it to the jurisdiction, dominion, power and superiority of the same church of Ripano and of its bishop for the time being existing, in the same manner and form in which they were subject to the churches of Firmum and Asculum and to the monastery of Farfa, and to their bishops, abbot or commendatary respectively. § 12. Notwithstanding our prior will, the derogation of acquired right, the most recently celebrated Council of the Lateran prohibiting perpetual unions except in cases permitted by law, as well as the constitutions and ordinances of blessed memory Pope Boniface VIII, also our predecessor, and other apostolic ones, and those issued in provincial and synodal councils, special or general; and the statutes and customs of the churches of Firmum and Asculum and the monastery of Farfa and of the Order of this kind, strengthened by oath, apostolic confirmation or any other firmness; and also privileges, indults and apostolic letters granted to the churches of Firmum and Asculum and the monastery of Farfa and to their chapters, convents, superiors and persons, under whatsoever tenors, and with whatsoever, even derogatory clauses of derogations and other more efficacious and unusual clauses, and other decrees, even consistorially, in general or in particular, all and singular of which, holding their causes and effects as expressed in the present, which would otherwise remain in their force, We do on this occasion only, specially and expressly derogate from, and from all other things contrary whatsoever.
15 § 13. We will, however, that to the churches of Firmum, Aprutium and Asculum, and to the monasteries of Farfa and Campus Felonis, and to the other churches and their prelates, abbots or commendataries, now and for the time being present and future aforesaid, by means of this separation, dismemberment and exemption as regards temporal goods, if any which in the said places separated, dismembered and exempted in this manner they have; and as regards the superiority which the monasteries of Farfa and Campus Felonis and their abbots or commendataries in this manner have in the monasteries or regular priories of the said Order existing in the aforesaid separated places, no prejudice shall be inflicted, but the bishop of Ripa Transonis in the aforesaid monasteries shall have and exercise only that jurisdiction which other bishops in similar cases are accustomed to have and exercise.
