A PART OF THE TERRITORY OF THE ARCHDIOCESE OF BALTIMORE IS SEPARATED AND A NEW ARCHDIOCESE OF WASHINGTON IS ERECTED THEREFROM, EQUALLY UNITED PRINCIPALLY TO THE SAME CHURCH OF BALTIMORE. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER
1 It is the prerogative of the Supreme ecclesiastical authority both to erect new dioceses, if the circumstances of things and places demand it, and to confer hierarchical rank upon those cities which excel in the increase of religion and in the dignity which they possess. Now within the limits of the Archdiocese of Baltimore there exists the city of Washington, the seat of the Government of the United States of America, which flourishes greatly with many Catholic institutions (among which are numbered distinguished Universities for studies and colleges for the instruction of youth), and at the same time has become so frequent in inhabitants in these recent years and grows daily with such strength and resources that the Apostolic See has rightly and deservedly deemed it worthy to be adorned with the splendor of an archiepiscopal see; and the more willingly because it is reported to be a welcome occasion of the one hundred and fiftieth year recurring, from which both the city of Washington itself was constituted the capital of the Federal States and the episcopal see of Baltimore was first established. Wherefore We, having heard the venerable Brethren Hamlet John Cicognani, Archbishop with the title of Laodicea in Phrygia, Apostolic Delegate in the United States of America, and Michael Joseph Curley, Archbishop of Baltimore, and having supplied, insofar as it is necessary, the consent of those to whom it pertains, or of those who presume it to pertain to them, by the fullness of apostolic power we separate the city of Washington and the entire territory contained within the limits of the District of Columbia from the Archdiocese of Baltimore and erect from it a new archdiocese, to be named Washingtonian from the city of Washington itself. To this new see we grant all the rights, privileges and prerogatives which the other archiepiscopal sees enjoy and possess according to the norm of common law, and we bind it by the same obligations and burdens by which the others are bound. We establish the archiepiscopal cathedral of this archdiocese in the church existing in the same city of Washington, dedicated to God in honor of St. Matthew the Apostle, and we therefore raise it to the rank and dignity of an archiepiscopal church and grant to it the rights, honors and privileges pertaining to the other archiepiscopal churches according to the norm of the sacred canons. We will, however, that this new Archdiocese of Washington be equally and principally united to the metropolitan Church of Baltimore, under the common designation of Baltimore-Washington. Both Churches therefore shall be under the jurisdiction, governance and administration of one Archbishop for the time being of Baltimore-Washington. He himself shall receive canonical possession of the two Archdioceses separately, with the honor of precedence preserved to the see of Baltimore, and likewise shall have his habitual residence in the city of Baltimore, yet in such a way that for some time during the year, whether continuous or intermittent, he may also dwell in the Archdiocese of Washington. Moreover, to render the governance of these Churches more strictly united, we decree that there shall be one archiepiscopal Curia, indeed in the city of Baltimore, for the two Archdioceses, one College of Diocesan Consultors, and likewise one Vicar Capitular, to be elected when the see is vacant. As regards the clergy in particular, we decree that, as soon as these Letters of Ours concerning the erection of the new Archdiocese shall be carried into effect, the clergy legitimately existing within its limits shall by that very fact be incardinated in this Church, saving however to the Archbishop the faculty of employing clergy for the benefit of either archdiocese and of conferring ecclesiastical benefices upon them indiscriminately. For the execution of all these things, as disposed and constituted above, we select the venerable Brother Hamlet John Cicognani, whom we mentioned above, Apostolic Delegate in the United States of America, and we therefore grant to him the faculties necessary and opportune for this purpose, even to subdelegate for the matter in question any man constituted in ecclesiastical dignity, with the charge to him to transmit to the Sacred Consistorial Congregation as soon as possible an authentic copy of the acts of the execution performed. These Letters of Ours and all things contained in them, even from the fact that anyone to whom it pertains, or who presumes it to pertain to him, has not been heard, or has not consented to the foregoing, even if they should be worthy of express, specific and individual mention, can at no time ever be noted, impugned or called into question on account of the vice of subreptitiousness or obreption or nullity, or of Our intention, or any other defect, however substantial and unforeseen; but these Letters, as made and emanated from certain knowledge and the fullness of power, shall exist perpetually valid and shall be, shall obtain and secure their full and complete effects, and ought to be inviolably observed by all to whom it pertains; and if it should happen at any time that anyone, by whatever authority, knowingly or unknowingly attempts anything contrary to these things, we will and decree that it be entirely null and void; notwithstanding, insofar as it is necessary, the rules established in synodal, provincial, general and universal Councils, general or special Apostolic Constitutions and Ordinances, and any other dispositions of the Roman Pontiffs, Our Predecessors, and all other things to the contrary whatsoever, even those worthy of special mention, all of which we derogate by these presents. We will finally that to copies of these Letters, even printed ones, subscribed however by the hand of some public notary and furnished with the seal of a man constituted in ecclesiastical dignity or office, the same faith be given as would be given to these Letters themselves, if they themselves were exhibited or shown. Let no one be permitted to infringe this page of our dismemberment, erection, concession, statute, mandate, derogation and will, or to act contrary to it. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul. Given at Rome at St. Peter's, in the year of Our Lord one thousand nine hundred thirty-nine, on the twenty-second day of the month of July, in the first year of Our Pontificate.
