Brief on the election of the Roman Pontiff
PIUS, BISHOP
Servant of the Servants of God, for perpetual remembrance of the matter.
1 Although by Apostolic letters given on the twenty-fourth day before the Kalends of September in the year one thousand eight hundred and seventy-one, whose beginning is « In hac sublimi », we endeavored to remove canonical obstacles which might have made the new election of the Roman Pontiff less safe and expeditious during these troubled times, yet since the circumstances of disturbed affairs appear to create greater difficulties daily, we have determined to meet them more carefully, having also sought the counsel of certain of the Cardinals of the Holy Roman Church. First therefore we confirm those same letters and all faculties granted therein from the fullness of our power, as well as all derogations from Apostolic constitutions in the manner and form there expressed; and at the same time we forbid that doubts be raised concerning their force and efficacy, whether because the public order does not appear to be disturbed during the time of vacancy of the Apostolic See, or because dangers are thought to be absent, or on any other pretext whatsoever: for we will that they remain in their full strength and obtain their complete effect until they shall have been revoked by us.
2 We decree that it belongs to the College of Cardinals alone, or to the greater part thereof, and to no others, to judge concerning the necessity or expediency of the use of all or some only of the faculties granted by us. Although we have granted that broad faculty to the College of Cardinals, especially regarding the time and place of the election of the future Roman Pontiff, we nevertheless declare that nothing has been changed either with respect to the general sanction of sacred canons that nothing be changed when the See is vacant, or with respect to the special constitutions by which it has been provided that such power and jurisdiction as belonged to the Pontiff while living shall not pass to the College of Cardinals, so that the College may not be able to dispose in any way of the rights of the Apostolic See and the Roman Church; and at the same time it is declared that the aforesaid College ought to guard and defend those rights, but in no way be able to diminish them.
3 Although we trust in the Lord, having perceived the religion and faith of those same Cardinals, that neither the College nor anyone from it will fail in this office, to which they are bound also by solemn oath, yet according to the nature of our duty we admonish all and each of the Cardinals and by admonishing command them that they adhere to canonical rules and neither directly attempt anything detracting from the rights of the Apostolic See and the Roman Church, nor indirectly appear to attempt to detract through the appearance of connivance, namely through dissimulation of crimes perpetrated against those rights.
4 Regarding Pontifical obsequies we command that the customary display introduced by constitutions, ordinances, and custom be omitted, and that they be performed by the College of Cardinals in modest rite and form in the Chapel of the Vatican Palace, if the Pontiff shall have been able to close his final day there.
5 But if the Cardinals should judge that the use of our concessions ought to be restrained by reason of circumstances, or should think it expedient to defer the election even after the ninth day, in this case also they have been given the faculty to relax or moderate the laws which pertain to the closure of the Conclave. And for this reason all the more do we grant to those same Cardinals the faculty of not observing the customary ceremonies and prescriptions and of making new dispositions concerning them, especially indeed regarding the custody of the Conclave, or of the place appointed for the election, regarding the supply of things pertaining to sustenance, the quality, endowments, and number of persons to be admitted in the aforesaid place, not however exceeding the customary number, and regarding emoluments either to be abolished or to be moderated, and other matters of this kind.
6 While, however, in order to attain the proposed end more expeditiously, we permit the material closure of the Conclave or of the place of election to be relaxed, we in no way relax the obligation of observing secrecy in all matters which pertain to the election of the Roman Pontiff, and in those things which are done in the Conclave or place of election. Therefore in the manner and form and under the penalties imposed by the constitutions of our Predecessors, we command again and enjoin that this secrecy be most carefully observed and be caused to be observed by others, and indeed all the more carefully and strictly the more grave the difficulty of the times proves itself to be. But first of all we admonish, and earnestly beseech in the Lord the Cardinals, that they proceed to the election moved by no inclination or aversion of mind, inclined by the favor or obsequiousness of no one, not moved by the intercession of the powerful in the world, but with eyes fixed solely on the glory of God and the utility of the Church, that they strive to elect more quickly him whom they shall have judged to be worthy above all others and to be a diligent Pastor of the whole flock of Christ.
7 Although We have established various provisions regarding the time, place, and enclosure of the Conclave for confirming what We have derogated and granted in the constitution of the year 1871, nevertheless, lest any opening for doubt creep in, We specifically derogate also from the Constitution of Gregory X in the First Council of Lyons, which begins Ubi periculum, in that part which grants to the Lords and other Rectors and officials of the city in which the election of the Roman Pontiff is to be celebrated, authority and power to cause the prescriptions given for the aforesaid election to be observed. In like manner, We have derogated from the Constitution of Clement V in the Council of Vienne, which begins Ne Romani, in that part which grants some power to the executors appointed in the aforesaid Constitution of Gregory X. We have finally derogated from the Constitution In Eligendis of Pius IV, in that it designates as executors the Prelates, Rectors, Officials of the City and others chosen for the custody of the Conclave; and for the effect of all these things We absolve the individual Cardinals from the bond of the oath taken to observe the Constitutions of the Roman Pontiff concerning the election. 1 What We commanded to be done concerning Our preceding Constitution of the year 1871, the same We also prescribe concerning this one, that it be recited first with that one in particular, then in the general Congregation of Cardinals, to whom it shall be the right to interpret and explain whatever doubt may arise in the execution of either constitution.
8 The faculties, however, which We have granted to the College of Cardinals through this and Our preceding Letters, We will that they exercise their force in the manner and form as stated therein, not only for the immediately future election of the Pontiff, but also for the next following one, unless they shall have been revoked by Us Ourselves or by Our Successor.
9 These things therefore We establish, prescribe, and grant, decreeing that these present Letters and whatever is contained in them can in no way be impugned even on the ground that anyone having or pretending to have any right or interest in the aforesaid matters has in no way consented to them, nor has been called or heard regarding them, or from any other causes whatsoever, but that the same shall always remain firm, valid, and effective in perpetuity, and shall obtain and secure their full and complete effects, and shall most fully avail those to whom it pertains and shall pertain for the time being, and ought to be respectively and inviolably observed by them, and that it shall be null and void if anything contrary to these things shall happen to be attempted by anyone whatsoever with any authority, knowingly or unknowingly.
10 Notwithstanding, insofar as it may be necessary, the law acquired not being taken away and Our other rules and those of the Apostolic Chancery, and likewise the Constitutions and Apostolic Ordinances issued concerning the election of the Roman Pontiff as much by Alexander III, Gregory X, Clement V, Pius IV, Gregory XV, Clement XII, and other Roman Pontiffs Our Predecessors, as also by Us, whose tenors We hold as fully and sufficiently expressed in these presents, and as inserted word for word in the same, all and singular of them for the effect of the aforesaid matters only, those remaining in their value as to the rest and in what they contain, with the broadest and most complete derogation worthy of contrary matters whatsoever.
11 We will moreover that copies or exemplars of these present Letters, even if printed, subscribed by the hand of some public Notary and furnished with the seal of a person constituted in ecclesiastical dignity, shall have the same force as these presents themselves would have if they were exhibited or shown. Let no man therefore be permitted to infringe this page of Our permission, dispensation, ordinance, decree, mandate, will, and derogation, or to dare to act contrary to it. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul.
12 Given at Rome at St. Peter's, in the year of the Incarnation of the Lord 1874, on the sixth day before the Ides of September, in the twenty-ninth year of Our Pontificate.

PIUS EPISCOPUS
Servus Servorum Dei, ad perpetuam rei memoriam.
1 Licet per Apostolicas litteras datas decimo Kalendas Septembris anni millesimi octingentesimi septuagesimi primi, quarum initium « In hac sublimi , ea submovere studuerimus canonica obstacula, quae minus tutam et expeditam per trepida haec tempora facere potuissent novam Romani Pontificis electionem, cum tamen perturbatarum rerum adiuncta crebriores quotidie creare videantur difficultates, diligentius etiam iis, iterum nonnullorum $. R. E. Cardinalium consilio exquisito, occurrere decrevimus.
Pari modo, derogavimus Constitutioni Clementis V in Concilio Viennensi, cui initium Ne Romani, in ea parte quae aliquam potestatem concedit executoribus in praedicta Constitutione Gregorii X deputatis.
