Romanum decet Pontificem

Against Nepotism

Bull of Pope Innocent XII ·

Constitution Romanum decet Pontificem, 22 June 1692.

Innocent, bishop, servant of the servants of God,

1 for perpetual remembrance of the matter.

2 It is fitting for the Roman Pontiff, as a faithful and prudent servant whom the Lord has set over his household, to order his conduct in the sight of the Catholic Church in such a manner that he himself in his days may please the Lord and be found just, and may become a model to the flock from the heart, and be a good odor of Christ in every place; and that the other bishops and prelates of the churches, called to share in the solicitude whose fullness has been committed to him, and the other faithful of Christ, whom he bears in the bowels of paternal charity as divinely entrusted to his care, may learn from his example and precepts to despise the fleeting things of this world, to escape the snares of flesh and blood, and to dispose of goods and ecclesiastical things according to the laws of equity and justice, and by the oar of spiritual things to strive toward and fly to heavenly things, with the Lord's help. Hence, turning the gaze of our consideration to those institutions of the sacred canons which forbid bishops to strive to increase their relatives with the goods and revenues of the Church, we have proposed to ourselves from the very beginning of our pontificate, as constituted in the supreme See of blessed Peter, the prince of the apostles, to whom flesh and blood have not revealed it, to observe this discipline, and hitherto, with God's help, we have striven to observe it, so that in the distribution of honors and revenues pertaining to this Holy See and our Apostolic Chamber, carefully keeping the laws and rules of justice and prudence, we have regard to the sum of merits, but no regard whatsoever to flesh and blood or any human affection. And although we hope in God's mercy that such Roman Pontiffs will succeed us as will fulfill their duty in this matter no less than in other matters, and will perfume the universal Church with the odor of spiritual aromatics; nevertheless we have decreed to indicate to others what is not permitted to us, and to constitute and establish a salutary norm and law in the S.R.E., the mother and teacher of all churches, concerning the aforesaid matters.

3 § 1. Having therefore held mature deliberation upon these matters with our venerable brothers, the cardinals of the same S.R.E., and likewise by their counsel and assent, for the glory of almighty God, the honor of the Apostolic See, and the edification and good example of bishops, prelates, and other ecclesiastics, by this our constitution, to endure perpetually, we establish and decree that this salutary discipline and practice be observed in the said S.R.E. from now on, so that neither by us nor by any of the Roman Pontiffs, our successors, in favor of our respective brothers, nephews, or any other relatives whatsoever, or affines, or those whom we may have chosen or admitted in place of nephews or other relatives through cooptation into the household or otherwise, shall there be disposed, in any manner hereafter, of goods, monies, places of mountains vacable and non-vacable, venal offices and their price, credits, revenues, things and rights whatsoever pertaining or at any time to pertain to the aforesaid See and Chamber in any way, even from the emoluments of the Dataria, the Apostolic Chancery, the Secretariat of Briefs, ecclesiastical spoils, and any portions or distributions of the apostolic palace proceeding therefrom, by the title of liberality and donation in any gratuitous or lucrative manner, directly or indirectly, even from services and merits, which however are not such as to exact recompense from the law of justice, or by any other color or pretext whatsoever, or even beyond the true measure of their services and merits, in any manner whatsoever.

4 § 2. But if the aforesaid brothers, nephews, relatives, or affines, or those placed or admitted in their stead, shall labor in poverty, the Roman Pontiff existing at the time may, for his conscientious fear, relieve their poverty in the very same manner in which it is permitted to succor the poverty of poor strangers.

5 § 3. But lest that which is directly prohibited be permitted indirectly, on account of the great number of stipends or honoraria assigned to certain offices or duties of the aforesaid See (which are accustomed to be granted most often to the aforesaid relatives by blood or marriage, or adopted or affiliated persons), we perpetually suppress and abolish all stipends, provisions, salaries and honoraria, and other emoluments of whatever kind customarily named, which heretofore have been accustomed to be paid and disbursed by the aforesaid Camera in the city of Avignon and the county of Venaissin to our vicar general in spiritual and temporal matters and to the legate de latere of the same See in those and the neighbouring five provinces, as well as to the superintendent general of the affairs of the Apostolic See, and to the governor and captain general of all the militia both cavalry and infantry of our Ecclesiastical State, and likewise to the prefect of the papal fleet and triremes, and to their and its commissioners and lieutenant general, and to the superintendent general of the fortifications and towers on the shores of both the Adriatic and Tyrrhenian seas, and to the prefect general of both the guard of the body of the Roman Pontiff and his lieutenant general, and likewise to the castellan of the Castle of St. Angelo in the City as governor, as was appointed to others, of the city of Benevento (whose government, however, shall remain in the manner of the other [cities] of our aforesaid State, as is now observed), and to the prefect of the castle of Benevento, and likewise to the governor of our town of Civitavecchia, and finally to the prefects or castellans of the castles of Perugia, Ancona and Ascoli Piceno respectively—these offices and duties themselves, with all and singular their and each of their rights, prerogatives, stipends, salaries and emoluments whatsoever, we perpetually suppress and abolish, and we prohibit them from being renewed henceforth in any manner or at any time, nor do we wish them to be assigned, paid, granted or conferred to anyone hereafter, and we decree this. But if the nature of affairs and the contingency of times should require that such military offices or duties, or some of them, be newly instituted out of manifest and pressing necessity, we will and command that vigorous and faithful men, distinguished by eminent virtue, and thoroughly skilled in military matters and exercised in long and proven practice therein, be appointed to them, to whom the Roman Pontiff existing for the time being, according to the wisdom given him by the Lord, shall assign competent and fitting stipends according to the measure of labour, diligence, and danger.

6 Moreover, if the brothers, nephews and any other relatives by blood or marriage, whether true or, as aforesaid, adopted and affiliated, of our successors and the Roman Pontiffs existing for the time being, shall choose the ecclesiastical life, and shall be capable of obtaining churches and monasteries, and other benefices and ecclesiastical offices, and annual pensions upon their fruits, we will that in the distribution of ecclesiastical revenues and income to be made to them, such moderation be observed, that only according to their merits and not beyond the fitting sustenance for the rank or dignity which they shall have obtained in the Church, with no regard whatsoever had to consanguinity, affinity, or adoption in relation to the Roman Pontiff, such ecclesiastical revenues and income shall be distributed to them, so that, the rule of ecclesiastical discipline and distributive justice being observed in all things, no one shall be left with occasion to complain or object; but ecclesiastical stipends shall be assigned with equal measure to those serving in the Church of God according to each one's merit.

7 § 4. As for those among the brothers, nephews, and other relatives by blood or marriage of the Roman Pontiffs existing for the time being aforesaid, whether true or, as aforesaid, adopted and affiliated, whom, their eminent merits so requiring, it shall happen to be raised to the sublime dignity of cardinal, we will that this moderation also be observed henceforth, namely that churches, monasteries, commendams, and benefices and ecclesiastical offices of any kind whatsoever, and annual pensions upon their fruits, to be respectively conferred, commended and granted, and reserved and assigned to each of them, shall not in total exceed the annual true value of twelve thousand scudi of Roman currency, computed together with the fruits of all benefices and offices whatsoever and the amounts of pensions: provided, however, that in this limitation there shall not be comprehended the emoluments of offices of the same Apostolic See and Roman Curia of the Holy Roman Church accustomed to be entrusted or granted to cardinals, and of other duties which have been entrusted or granted to them not for life or in perpetuity, but for a time or at the pleasure of the Roman Pontiff existing for the time being. Declaring that henceforth the aforesaid, whether they have chosen the ecclesiastical life or have been raised to the sublime dignity of cardinal, shall in no wise be able to obtain any titles burdened with reservations of fruits, whether preventive or contingent pensions, beyond the moderation respectively prescribed as above.

8 § 5. But if perchance (which God forbid) the manner concerning the aforesaid matters thus appropriately and beneficially prescribed should be exceeded in the future, it shall be the care of the Roman Pontiffs, Our successors, to rescind, revoke and reduce to nothing gratuitous donations, or lucrative dispositions, excessive subventions, grants of offices or their stipends and emoluments, and distributions of ecclesiastical revenues and income, as well as collations, commendas, grants, reservations and assignments, and other aforesaid matters made or done contrary to or beyond the manner as aforesaid prescribed, and to vindicate and take away, as aforesaid, what was given, bestowed, granted, collated, commended, reserved and assigned by the aforesaid relatives and affines, whether true or adopted and co-opted, and their heirs and successors respectively, even by royal hand and from the fullness of apostolic power, and to apply and incorporate them to the Apostolic Camera, and to confer, commend, grant and assign them respectively to others, and otherwise to provide or dispose thereupon opportunely.

9 § 6. But because it has sometimes happened that when the Roman Pontiff was ill, the signatures of graces, which are said to be made by grant, exceeded that measure which the same Roman Pontiff, when he was in good health, was accustomed to observe; We establish and decree that those to whom such signatures by grant from the Roman Pontiff when ill, even by special chirograph subscribed by the hand of the Roman Pontiff himself, or otherwise in any manner whatsoever, have been committed, of whatever status, degree, order and dignity they may be, even if they shine with the honour of the cardinalate, shall be able to sign or expedite no such graces unless two cardinals of the same Holy Roman Church have been employed thereto, who, together with the aforesaid signer before the Roman Pontiff himself granting and ordering them to be expedited, shall subscribe to the supplications or drafts or chirographs and other writings of the same graces; otherwise, whatever shall have been done or acted otherwise shall be null, void and invalid, and of no force or moment; and those who shall have contravened this most salutary sanction shall be punished with condign penalties by the Roman Pontiff when restored to health, or by his successors.

10 § 7. But in order that all and singular the aforesaid matters may be observed perpetually and inviolably, We will and by apostolic authority decree that, just as the cardinals of the same Holy Roman Church present in the Roman Curia have promised and sworn to observe this constitution as far as in them lies, and not to contravene it, nor to consent to any contravening it, even Roman Pontiffs, nor to seek absolution from the oath taken, nor to accept or receive what is offered or granted, so also by the absent cardinals of the same Holy Roman Church, whenever they shall have come to it, and by future cardinals at the assumption of the biretta, it ought to be promised and sworn, and such promise and oath shall be added and inscribed in the formula of the oath to be taken by the same cardinals. But when the vacancy of the same Apostolic See occurs at any time, the same cardinals in the conclave, when they are accustomed to take an oath concerning the observance of the constitutions of Our predecessors of happy memory, Pope Julius II, concerning the election of the Roman Pontiff, Pope Pius V, lest cities and places of the Holy Roman Church be enfeoffed, and Pope Sixtus V, concerning monies placed in the Citadel of St. Angelo not being removed thence, and certain other apostolic constitutions, shall also take an oath concerning the present constitution, to be inviolably observed by whosoever shall be elected Roman Pontiff, and afterwards he himself, having been assumed to the office of supreme apostolate, after such assumption, ought to promise and swear this same thing, observing also all and singular those things which concerning such oath are prescribed in the aforesaid constitution of Sixtus Our predecessor, issued in the year of Our Lord's Incarnation 1586, on the 11th day before the Kalends of May, in the first year of his pontificate.

11 § 8. We also will that these Our letters be reduced to a booklet, and after the aforesaid constitutions of Julius, Pius and Sixtus, which are accustomed to be read in the conclave, and of Our other predecessors, be joined together, and be inscribed in the register of Our Apostolic Chancery together with other apostolic constitutions and be published at the doors of the Lateran Church, the basilica of the Prince of the Apostles, and of the said Chancery, and in the open space of the Campus Florae of the City, and We will that the same faith be had everywhere, both in judgment and outside it, in the transcripts or copies of these present letters, even printed, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, as would be had in the same present letters if they were exhibited or shown.

12 § 9. Let no man whatsoever be permitted to infringe this page of Our constitution, suppression, abolition, taxation, statutes, decrees, will and mandate, or to dare to contravene it with rash presumption. But if anyone shall have presumed to attempt this, let him know that he shall incur the indignation of Almighty God and of the blessed Apostles Peter and Paul.

13 Given at Rome, at St. Mary Major, in the year of Our Lord's Incarnation 1692, on the 22nd day of June, in the first year of Our pontificate.

14 Given on 22 June 1692, first year of the pontificate.

Costituzione Romanum decet Pontificem, 22 giugno 1692.
