25 [33] Completato lo studio della lingua araba, se gli studenti, secondo il giudizio dei loro lettori e di altri deputati dalla sacra congregazione, si sarà constatato che abbiano fatto progressi, e in quel momento non si sia presentata per essi occasione di missione, o per qualche causa di momento non abbiano potuto recarsi ai Luoghi Santi, ritornino alle loro province, e ivi rimangano, finché siano adoperati al servizio della sacra congregazione, e nel frattempo il ministro provinciale li collochi nel principale convento della provincia a loro gradito, dal quale, senza consultare lo stesso generale, non possano essere rimossi;

36 [44] I. arcivescovo-Cesareo, segretario.

Petri in Monte Aureo.

12 Lector controversiarum binas singulis hebdomadibus tradat in scriptis lectiones controversiarum orientalium, et post vesperas earumdem habeat conferentias, frequentibusque exercitiis studentes instituat; singulis vero mensibus tradilae doctrinae disputationes habeanlur. Lector vero linguae arabieae ter in hebdomadà legat, et rerum, quas studentes docuerit, repetitionem ab eisdem exigat; singulis diebus, quibus legere te- 1 Vel se exercere vel exerceri legend.

17 [23] Removeatur omnino e conventu studium theologicum nuper illuc invectum, sub eiusmodi vero prohibitione minime intelligatur comprehensum artium studium, quod prò clericis inibi antea viguisse supponitur.

LXXXIX.
Confirmation of certain decrees of the Congregation for the Propagation of the Faith concerning the study of the Arabic language and controversies instituted in the convent of St. Peter on the Golden Mount in the City for the training of missionaries.
Clement Pope IX, for the perpetual memory of the matter.

1 The office of the sacred apostolate entrusted to us from heaven requires that to those things which have been wisely established by the Council for the happy propagation of the studies of the Christian religion and the protection of the Catholic faith, and which are known to subsist and be preserved in their state and progress, we add the firmness of apostolic authority, that they may stand more firmly and be observed more exactly.

2 § 1. Decrees have indeed formerly emanated from the Congregation for the Propagation of the Faith by our venerable brethren the Cardinals of the Holy Roman Church presiding over the affairs of the Propagation of the Faith for the happy and prosperous governance and direction of the study of the Arabic language and controversies in the convent of St. Peter on the Golden Mount in the City of the Order of the Friars Minor of St. Francis of the Strict Observance called Reformers, and for stirring the minds of the students, so that by applying themselves diligently to letters they may strive to become good and suitable workers for laboring in the vineyard of the Lord, with fitting rewards for their labors, certain decrees and ordinances of the tenor which follows, namely: Decrees of the sacred congregation for the Propagation of the Faith concerning the study of the Arabic language and controversies in the convent of St. Peter on the Golden Mount.

3 "After the visitation of the study of the Arabic language in the convent of St. Peter on the Golden Mount, which was carried out by the most eminent Brancaccio, specially deputed by the sacred congregation for this purpose, and having been reported by the secretary of the same sacred congregation, the most eminent Fathers, gathering from it that it had not fallen into insignificance and had declined from its original exercises, judged it fitting to provide opportunely as follows:"

4 Ten religious are required to be assigned to the study, from at least twelve, who ought to apply themselves to the aforesaid study, as was formerly the custom, but only four were found to be engaged in it at present, and some of these were somewhat unsuitable for attaining the intended end due to lack of learning; therefore it is strictly enjoined upon the Father General or the Vicar General of the Order for the time being that he place at least ten religious of the Stricter Observance devoted to the Arabic language and controversies there, and let him take care that their number of ten always remains undiminished.

5 Moreover, since the purpose of the aforesaid study is directed to this, that the sacred congregation as well as the religious order may have at hand men suitable for exercising the office of missions and skilled in those things which pertain to such a ministry, the conscience of the General is gravely burdened that he select only friars endowed with regular discipline, integrity of morals, and zeal for the glory of God, and who are readers or preachers, at least well versed in moral theology, and so that they may be able to sustain the labors of missions more vigorously, they should be not less than twenty-five years of age, nor exceed thirty-five years, and should enjoy firm bodily health. Moreover, so that the apostolic spirit of missions may be diffused throughout the whole aforesaid Order, let him summon them not from Italy alone, but from all the provinces of the reformed family.

6 Beyond the aforesaid ten, it is granted to the minister of the Roman province that he may add two others from this province, provided they are endowed with the aforesaid conditions.

7 After the lapse of eight days from their first entry into the aforesaid study, during which they are in no way permitted to leave the convent, they shall take an oath in the hands of the Father General, or, in his absence, his Vicar, or another to be deputed by him, according to the formula appended at the end of the present decrees, and they shall transmit it to the sacred congregation.

8 They shall not remain in this study beyond two years, unless perhaps the readers should judge that the stay ought to be extended to three years on account of some remarkable hope of progress, and this with a dispensation in writing from the Father General and the sacred congregation.

9 The same regard shall be had for the students while they remain in the study as if they were friars of this province, both concerning precedence according to the reception of the habit, and concerning the other things suitable to their religious needs, of which the Guardian shall be bound to provide for them no less than for the other friars of his convent under the same penalties which are decreed by the statutes of the general reform against Guardians neglecting to provide the same for their friars: let the General, however, see that their clothing is supplied to them in due time by their own Provincials.

10 Let twelve cells be restored to the students, which were formerly assigned to them, namely ten which are in the dormitory which overlooks the Aqua Paola, but in place of the first and last of the same dormitory, which on account of darkness are less suitable for study, let two other suitable ones be assigned, as near as possible to the aforesaid ones. Let the Guardian grant to the students a small garden under his care and lock, where, separated from the other friars, they may be decently refreshed, and may practice with one another in the language with the readers.

11 Two readers shall always be present in this study, one of the Arabic language, the other of controversies, elected by the general or his vicar, so that they are admitted only after previous examination and confirmation by the sacred congregation. Serious diligence and assiduity are enjoined upon them in lectures, repetitions and exercises. The readers thus elected and confirmed shall enjoy the precedence, preeminence and privileges which the actual readers of theology possess.

12 The lecturer in controversies shall deliver two lessons in writing on the controversies of the Eastern churches each week, and after Vespers of the same shall hold conferences, and shall instruct the students through frequent exercises; moreover, disputations on the doctrine taught shall be held each month. The lecturer in the Arabic language, however, shall read three times in the week, and shall require from the students a repetition of the matters which he shall have taught them; on each day on which he is bound to read, for one hour after Vespers he shall exercise his hearers.

13 [17] It is likewise forbidden to readers and students on days of lectures to leave the convent for any reason whatsoever, even under the pretext of accompanying another brother, even if he be a superior, unless the lectures and exercises for that day, which ought to be or are accustomed to be held, are completely finished. If the guardian perceives that anything is being taken away from them on this account, or that it is being done less diligently, he shall altogether prohibit their leaving the convent throughout the entire day of lectures. On feast days or days of vacation, however, it shall be permitted to the guardian to send the students outside for reasons of devotion or other honest cause, if it shall seem expedient to him, provided that theses are not held on that day, nor is permission granted to all on the same day. The guardian shall likewise be able sometimes even on days of lectures, if necessity urges, to send these same students to celebrate outside their own church, provided that not all, but only some are sent, nor is this done frequently, nor in any way during the time of lectures or exercises; in that case, however, they are bound to return immediately upon completion of the function. In order that readers, removed from distractions, may apply themselves more diligently to their study and lectures, it is forbidden to them to assume the burden of any office of visitor or any other duty, or to undertake courses of Lenten sermons either within or outside the City, which is also forbidden to students during their studies, although they are not on this account prohibited from delivering some sermon or preaching occasionally within the year on account of some occurring feast or the forty hours' devotion.

14 [18] From lectures, repetitions and exercises of either study, no one of the students shall be exempted under any title or pretext whatsoever, or ever be permitted to be absent, and if anyone shall have neglected this, he shall be corrected by the guardian; [20] and the same shall be done if he shall have failed to write down those things which are delivered by the readers; and in order that all excuse may be entirely removed, at the time when schools and exercises are in session, it shall not be permitted to anyone to call them away from them, and if anyone is called away, the reader shall not permit him to go.

15 [21] Lectures both of controversies and of the Arabic language shall be held in the morning at prime for a full hour according to the custom of the religious order.

16 [22] Every six months theses of theology shall be held in the Arabic and Latin languages, as was formerly customary, at which, as also at the theses of controversies, the guardian of the convent shall be bound to be present to encourage the spirits of the students and to discern those who are making progress, and so that he may be able to inform the general of the Order concerning those who perhaps have devoted themselves less to such study, so that, with them removed, he may be able to substitute others.

17 [23] The study of theology recently introduced into that convent shall be entirely removed; under such prohibition, however, the study of the arts, which is supposed to have formerly flourished there for clerics, is in no way to be understood as comprehended.

18 [24] Since, however, it would profit little for the students to learn the language itself unless the spirit of missions and piety be fostered in them; therefore some religious man of great spirit and zeal shall be appointed, who shall deliver to them1 a sermon each month to the other brothers on the excellence of the office of missionaries, and on the particular functions of the same, so that the apostolic spirit may be kindled in them and remain, and they may be instructed in all things which pertain to performing that office fittingly and with the glory of God.

19 [25] The general of the Order, or his vicar, or the general commissary, shall visit this study entirely at least every four months, and, if he shall find any student making little progress, having imposed some penance by which others may be deterred from neglecting the assumed office,2 he shall order him to return to his own province, and shall inform the same sacred congregation of the removal, and shall substitute another in place of the one removed as soon as possible. Beyond the aforesaid visitation by the general, the secretary likewise of the sacred congregation, in its name, shall visit this study entirely twice in the year, by himself alone, without the intervention of superiors, so that he may be able to visit more freely the state and necessities of the college, taking with him only some expert in the Arabic language, by whom he may be able to examine the students and ascertain their progress.

20 [27] When their studies are completed, the students shall go where the sacred congregation has designated them; but if at that time there is no mission post readily available, they shall be sent by the general to serve in the Holy Land, so that they may be more firmly established in the Arabic language, prepared, when it shall be necessary, to serve the sacred congregation, unless the same congregation shall judge them to be legitimately prevented.

21 [28] Those who shall be removed from their studies through their own fault shall be sent back to their provinces with deprivation of both votes, which can be remitted only through the sacred congregation.

22 [29] This penalty shall not be imposed, however, unless there has been3 a prudent and discreet consideration of the causes of such fault.

23 [30] The guardian shall be bound to transmit to the sacred congregation within eight days a note concerning those departing after completing their studies, or for any other reason, as also concerning those who have newly arrived and have taken the oath, with [31] an express statement of the day and place to which they are directed.

24 [32] Moreover, so that the religious of this Order may be attracted by some temporal reward as well, and may direct their spirits more strongly to dedicate themselves more willingly to the sacred ministry of missions, and consequently also to the aforesaid study, as it were directed to the missions themselves, the missionaries and respectively the students shall enjoy the following privileges:

25 [33] When the study of the Arabic language has been completed, if the students shall be found to have made progress in the judgment of their readers and others appointed by the sacred congregation, and if at that time no occasion for a mission shall have presented itself for them, or if they shall not have been able to go to the Holy Places on account of some weighty reason, they shall return to their own provinces, and there remain until they are employed in the service of the sacred congregation, and meanwhile the provincial minister shall place them in the principal convent of the province, which shall be agreeable to them, from which they cannot be removed without consulting the general himself;

26 [34] But if in the meantime they shall be designated by the sacred congregation for some mission, or sent by the superior general to the Holy Places, they shall be bound to obey immediately by virtue of their oath; otherwise they shall be punished at the discretion of the sacred congregation.

27 [35] Those who shall have laudably discharged the office of prefect in some mission for six years shall be permitted upon their return to choose for themselves one of the principal convents of their own province, and to have precedence among the ex-provincials, provided that they shall have served for at least two years before, either in the same mission or in another, in the state of a simple missionary. Likewise, those who shall have commendably served the sacred congregation in missions for the space of twelve years shall be permitted, after their return, to choose for themselves one of the principal convents of their own province, and their place shall be after the last definitor and the others (if they be present there) who shall otherwise have been prefects of some mission.

28 [36] Furthermore, those brothers who shall have served the Holy Land for fifteen years shall also enjoy the faculty of choosing a convent for themselves upon their return.

29 [37] Missionaries of the same Order, who, with the permission of the sacred congregation or the prefect, departing from the mission places, betake themselves to the City on account of the business of those missions, shall remain in the convent of St. Peter on the Golden Mount, in which they shall be treated as if they were brothers of the household, until they shall be dispatched by the sacred congregation, which shall take care that this be done as soon as possible.

30 [38] In the same convent shall reside the procurator of the missions during his office, who shall have two associates agreeable to him to assist him in conducting the business of the missions, with the faculty of sending them outside the convent on account of the business of those missions, after first requesting the customary blessing from the local superior.

31 [39] Henceforth, no one shall be chosen for the office of procurator of the missions unless he shall have first served laudably in those missions for a complete period of six years with the title of prefect, or for ten years with the title of missionary.

32 [40] All these matters, by order of the sacred congregation, having been reported to our most holy lord through his secretary, His Holiness, to add the strength of greater firmness, ordered a Brief to be issued thereupon in audience on 9 June 1668. Formula of the oath to be taken by students learning the Arabic language in the convent of St. Peter on the Golden Mount of the City of the Order of Friars Minor of the Stricter Observance. An. C. 1668

33 [41] "I, brother N. of N., of the Order of Friars Minor, of the reformed province of N., do swear and promise in the hands of your most reverend paternity N. that I shall not depart from this seminary, nor shall I cause myself to depart, mediately or immediately, through myself or through an interposed person, except for a legitimate cause to be admitted by your most reverend paternity, or by your successors canonically entering office, and not otherwise, etc. Moreover, for the sake of propagating the Catholic faith and procuring the salvation of the infidels, I shall go without any reluctance or exception whenever to that place, province, or kingdom to which I shall be designated and sent by your most reverend paternity. So help me God and these holy Gospels of God. I, N. of N., affirm as above, in my own hand."

35 [43] Place of seal.

36 [44] I. Archbishop of Caesarea, Secretary. Since, however, decrees that are more firm and stable persist more securely when they are strengthened by the protection of apostolic confirmation: for this reason we, wishing to provide salutarily, as much as we can with the Lord, for the inviolable strength and efficacy of all and singular decrees and ordinances of this kind, do approve and confirm by apostolic authority, by the tenor of these presents, the aforesaid decrees and ordinances, with all and singular things contained in them, and we add to them the strength of inviolable apostolic firmness, and we supply all and singular defects of law and fact, if any have intervened thereupon in any way whatsoever; saving always, however, in the aforesaid matters the authority of the aforesaid congregation of cardinals. We add the voice in us (r t.). Derogation of contrary things.

37 [45] § 3. Decreeing that these same present letters and decrees and ordinances of this kind shall always be firm, valid and efficacious and shall be, and shall obtain and secure their full and complete effects, and shall most fully benefit those to whom it pertains and shall pertain for the time being, and shall be inviolably observed respectively by them, and thus in the aforesaid matters by whatsoever ordinary and delegated judges, even auditors of causes of the apostolic palace, it ought to be judged and determined, and null and void if otherwise concerning these things by anyone whatsoever, by whatever authority, knowingly or unknowingly, it should happen to be attempted. § 4. Notwithstanding apostolic constitutions and ordinances, and, insofar as it be necessary, those of the aforesaid assembly and Order, and any others whatsoever, even those reinforced by oath, apostolic confirmation, or any other firmness, statutes and customs, privileges also, indults and apostolic letters granted, confirmed and repeatedly renewed in contrary to the aforesaid in any way whatsoever; all and singular of which, holding their tenors in these presents as fully and sufficiently expressed and inserted word for word, those otherwise remaining in their strength, for the purpose of the aforesaid, on this occasion only, we specially and expressly derogate; and to all other contrary things whatsoever.

38 [46] § 5. We will, however, that of the same present letters the copies, even printed, subscribed by the hand of some public notary, and furnished with the seal of a person established in ecclesiastical dignity, the same faith altogether shall be had in judgment and outside of judgment as would be had in the same presents, if they were exhibited or shown.
