Testo inglese

LEO, BISHOP, SERVANT OF THE SERVANTS OF GOD.
To the perpetual memory of the matter.
To our most beloved son in Christ Emmanuel, King of Portugal and the Algarves, Illustrious.

1 When we weigh with careful consideration the steadfastness of faith and the exceptional affection of devotion by which you are clearly recognized in the sight of us and the Apostolic See, we willingly grant to you those things by which honor may accrue to your serenity, and so that you may be made more steadfast in the glorious memory of your Predecessors, Kings of Portugal and the Algarves, through the begun and by you happily continued conquest of infidelity, and through the foundation and construction of Churches to the glory of the Divine Name.

2 § 1. Indeed, a petition was recently presented to us on your behalf through our beloved son John of Faria, Knight of the Militia of Jesus Christ, your Orator sent to us and the aforesaid See for the rendering of obedience, containing that after your aforesaid Predecessors had subjugated to their dominion many Provinces, Lands, Cities, and Places in overseas regions occupied by infidels for the exaltation of the Catholic faith, certain Roman Pontiffs, our Predecessors, granted that all and singular Churches in Places and Lands from the Capes or headlands of Bojador and Naon as far as the Indies in overseas regions recovered from the same infidels should be built and constructed, and that all spiritual jurisdiction of the same Churches to be built should belong to the Militia, now called the Vicar of Tomar for the time being, as is more fully contained in the letters of those Predecessors of ours made concerning this matter.

3 § 2. Since, however, as the same petition further stated, you, as a good and intrepid Athlete of our Redeemer Jesus Christ, for the exaltation of the same Catholic faith, are always intent upon the recovery of other Lands and Provinces which are occupied by the enemies of the Cross of Christ, not without great expense and sparing no labors, and by the Lord's grace propose to be more earnestly intent, all and singular Churches in whatever parts of Africa and other overseas Provinces, Lands and Places, even in the City and Kingdom of Morocco and whatever other places recovered and acquired by you from the same infidels, erected or built, and also in those to be recovered and sought in the future, to be erected or built, should be subject to the same Militia according to the tenor of the aforesaid letters, and that henceforth the aforesaid Vicar in the Churches erected and to be erected, and in the Provinces and Lands recovered and to be recovered in this manner, may and ought to exercise all ecclesiastical and spiritual jurisdiction, and the same Churches applied to the same Militia should be deemed to be so. And to you and your successors, Kings of Portugal and the Algarves, who shall be for the time being, the Right of Patronage and of presenting suitable persons to whatever Churches and Ecclesiastical Benefices of whatever quality they may be, in Lands and Provinces of this kind recovered and acquired by you alone from the said infidels within the past two years, erected or built, and also in those to be recovered and acquired in the future to be canonically erected, whenever those shall happen to become vacant from that time forward in perpetual future times, are reserved and granted.

4 § 3. We, favorably assenting to your wishes in this matter and inclined by your supplications, subject by Apostolic Authority all and singular Churches in whatever parts of Africa and other overseas Provinces, Lands, and Places, even in the City, Kingdom of Morocco, and whatever other places recovered and acquired by you alone from the same infidels within the past two years, erected or built, and also in those to be recovered and acquired in the future to be erected and established, to the same Militia by the tenor of these presents, and that henceforth the aforesaid Vicar of Tomar in the Churches erected and to be erected, and in the Provinces, Lands, and Places recovered and to be recovered and acquired in this manner, may and ought to exercise all ecclesiastical and spiritual jurisdiction, and the same Churches applied to the same Militia shall be and are deemed to be so, according to the tenor of the letters of such Predecessors, by the same authority and tenor we establish and ordain. And nevertheless to you and your successors, Kings of Portugal and the Algarves, existing for the time being, the Right of Patronage and of presenting suitable persons to whatever Churches and Ecclesiastical Benefices of whatever quality they may be in the same Provinces, Lands, and Places, as aforesaid, acquired and recovered from the same infidels within the past two years, erected, and also in those to be acquired and recovered in the future to be erected, whenever those shall become vacant, by the authority and tenor aforesaid we reserve and grant.

5 8. 4. Wherefore to our Venerable Brethren the Bishops of Viseu and Egitania, and to our Beloved Son the Official of Lisbon, we command by Apostolic letters, that they, or two or one of them, by themselves or through another or others, assisting your Majesty and your aforesaid successors with effective defense and protection in the premises, shall cause you and the aforesaid successors to enjoy and possess peacefully by our authority the subjection, Statute, and Ordinance, as well as the reservation and concession aforesaid: not permitting you and your aforesaid successors, or any of you to be in any way unduly molested, disturbed, or disquieted by anyone whatsoever. Compelling those who contradict by Ecclesiastical censure, setting aside appeal.

6 § 5. Notwithstanding the constitutions and Ordinances of the Apostles, as well as any unions, annexations, and incorporations of whatever Churches, even Cathedral and Metropolitan ones, and Places in those parts of the infidels, even in the said Kingdoms of the Moors and city, and in all other places whatsoever, belonging to whatever Churches, even Cathedral and Metropolitan ones, Monasteries, and their tables, and persons of whatever quality, status, degree, order, or condition existing, and the provisions of Cathedral even Metropolitan Churches of the same to the same persons, even by whatever Roman Pontiffs our Predecessors, and We, and the same See, even at the instance of Kings, Queens, Dukes, Princes, and Ecclesiastical Prelates, and also of the Cardinals of the Holy Roman Church, and for whatever causes, even by reason of services rendered to Us and the Roman Church and the aforesaid See, even for the Catholic Faith, perpetually or for a time, and under whatever forms of words, without your express consent, heretofore made and granted, confirmed and renewed, and hereafter to be made and granted; all which and each of which, even if special, specific, and express mention of the names, surnames, Dignities and Titles of the Churches and Persons to whom and for what causes those things were granted or might have been granted ought to be made, or word for word, and not through general clauses importing the same, nor any other exquisite form observed, we hold the tenor thereof sufficiently expressed in these presents, and we entirely suspend the force and effect of all of them, and decree them to be suspended, and we specially and expressly derogate from them and from all other things contrary whatsoever; or if to any it has been granted in common or separately by the same See that they cannot be interdicted, suspended, or excommunicated by Apostolic Letters not making full and express and word for word mention of this indult.

7 § 6. Let no one whatsoever be permitted to infringe this page of our subjection, Statute, Ordinance, reservation, concession, mandate, suspension, decree, and derogation, or to dare to act contrary to it with rash presumption. But if anyone shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Peter and Paul, His Apostles. Given at Rome at St. Peter's in the year of the Incarnation of the Lord 1514, on the seventh day of June, in the second year of our Pontificate.
