Clemens Episcopus, servus servorum Dei.

3 Primo.

5 Tertio. Documenta et lura producta servanda esse in distinctis fasciculis, facta super iis brevi, eorum quae continent, inscriptione, ac etiam mensis et Anni quo fuerunt producta: Quoties vero illa Parti instanti commodando forent, id vetitum sit, nisi causidicus requirens Notario fuerit probe notus et in libro Accomodatorum proprio charactere fassus fuerit illa recepisse sub restitutionis debito: Quod si eorum copiae tantum requirerentur, illae emolumento in Taxis praescripto, et a Clemente XII Praedecessore Nostro in eius reformatione approbato, concedi debeant.

6 Quarto.

7 Quinto. Absoluto Regesto, servari et reponi debeant Scripturae originales in fasciculis separatis, quibus singulatim titulus apponatur, verba continens: lura dtversa Causarum expeditarum Annis ... ut distinguantur ab aliis fasciculis scripturarum in causis nondum expeditis, et quarum lurium proinde adhuc non fit regestum ex officio sed tnstante alterutra ex litigantium parte, regestum confici poterit soluto solito iuxta taxas stipendio, et alter hic fasciculus notari poterit titulo : lura diversa Causarum pendentium annis . . .

8 Sexto, Ad praedictorum omnium complementum, iniungi debeat Notariis obhgatio bis saltem in anno iibrum Accomodatorum scrutandi, adnotando scripturas eatenus accomodatas quae subinde confestim erunt recuperandae.

9 Septimo.

Sub Datum 27 lanuarii 1740. Et a Notario omnium gestorum cum iura- 588 Soeculo X VIII mento Fides exhiberi debebit eiusdem Causae Ponenti, alias dubiorum subscriptio suspendenda erit.

Testo inglese

Clement, Bishop, servant of the servants of God. For perpetual memory of the matter.

1 Although it is the concern of the Supreme Pontiff that in the Christian Republic all matters be administered with the utmost good faith and integrity, it has nevertheless always been a matter of great concern to Our Predecessors that in judgments and Tribunals not only should all things be done rightly and in order in fact, but also that nothing should appear to be done otherwise than decorously and in order. And since this is constantly before Our mind and almost before Our eyes in such a way that We judge all Our counsel, effort, and diligence ought to be directed to this end, after We have established certain matters concerning the Auditory itself of the causes of Our Palace, which is the principal and most honorable Tribunal of the City before all others and in which We ourselves have sat among the Twelve Men, which We thought could contribute to its dignity: We have finally thought to restore the College of Notaries of the same Tribunal to its ancient state, and to strengthen it with certain other laws, lest We should be thought to have failed in any respect in the honor and protection of the Tribunal itself and of the litigants.

2 Indeed, upon the petitions presented to Us by the Notaries of the Auditory of Causes of the Apostolic Palace, We appointed a particular Congregation of two Cardinals of the Holy Roman Church and certain Prelates of the Roman Curia, to report to Us in what manner the rights of the same Notaries and their alleged burdens ought to be provided for, as well as the deficiency of a complete Register of all documents produced by them, entrusted to them by Our Predecessors, the Roman Pontiffs, which the Notaries themselves now contended was superfluous. After, however, the same Congregation had been convened several times, all expenses and individual circumstances having been seriously considered and the method examined by which original documents delivered to the acts are preserved by the Notaries, on the 28th of May last past, when the same Congregation was composed by Our beloved sons, Gaetano, of the Title of St. Augustine, called Cardinal of the Holy Roman Church, surnamed Elephantutio, and Cornelius, of the Sts. Cosmas and Damian, Deacon of the same Holy Roman Church, also surnamed Caprara, and also by Our beloved sons, the modern Treasurer General of the Apostolic Chamber, and Our Auditor, and Dean of the aforesaid Auditory, as well as the General Commissioner of the same Chamber, and likewise Master Paul Francis Antamoro, Votant of Our Signature of Justice, serving as Secretary of such a Congregation, it proposed certain articles of Resolutions and Ordinances, coordinated and arranged as below, to be approved by Us.

3 First. The Notaries are to be absolved from the omission of the making of Registers, and also from the neglect of the custody or recovery of Documents, without however prejudice to the Parties, if and insofar as it shall be of right: Likewise the common fund made among themselves from the year 1702 until now, ceasing therefore for the benefit of the litigants, with the occurrence of changes of turns, the necessity having been acted upon of transferring from one Notary to another, is henceforth also to be observed.

4 Second. The new method recently introduced with the approval of the whole Curia, of writing the acts of any cause according to order in separate leaves commonly called Quinterni, which after the completion of a year are reduced into books also commonly called Protocolliy and Broliardi, with distinct Indexes, is to be diligently continued: And in these all Commissions, even Subrogatory ones, sentences, definitive Decrees, appeals, renunciations, citations, intimations, interpellations, and all that pertains to the acts and order of judgment, are to be described at length.

5 Third. Documents and rights produced are to be preserved in distinct bundles, with a brief inscription made upon them of what they contain, and also of the month and year in which they were produced: Whenever, however, they should be lent to the requesting Party, this is forbidden, unless the advocate requiring them shall be well known to the Notary and shall have confessed in his own book of Loans by his signature that he has received them under obligation of restitution: But if only copies of them should be required, these ought to be granted for the fee prescribed in the Tariffs, and approved by Clement XII, Our Predecessor, in his reform.

6 Fourth. With causes expedited, within two months after the completion of each year, the Register is to be completed, beginning from the presentation of the Commission up to the sentence and appeal or renunciation inclusive, without, however, the judicial acts being referred to at length, but only indicating the commissions, citations, productions, protestations, and all other matters, relative to the leaves of the Broliardi, or Broliards, in which according to the aforesaid new method they shall be consecutively comprehended; and thus acting, the fees for Registers are to be exacted according to the norm of the Tariffs, just as if all had been registered at length.

7 Fifth. Once the Register is completed, the original documents shall be preserved and stored in separate bundles, to each of which a title shall be affixed containing the words: Various Documents of Cases Expedited in the Years ... so that they may be distinguished from other bundles of documents in cases not yet expedited, and for which a register is therefore not yet made ex officio but may be made at the instance of one of the litigating parties, upon payment of the customary fee according to the tariff, and this other bundle may be marked with the title: Various Documents of Cases Pending in the Years ...

8 Sixth. For the completion of all the aforesaid matters, there shall be imposed upon the Notaries the obligation to examine the Book of Loaned Documents at least twice in the year, noting down the documents thus far loaned which shall thereupon be immediately recovered.

9 Seventh. After the final Rota, which is held in Lent, namely during the days preceding Easter of the Resurrection, by the Dean and two Senior Auditors together with their Depositary, the Offices shall be visited every year, and on the occasion of the same visitation the Notaries shall be required to exhibit that they have recovered not only the loaned documents but also completed the Registers of expedited cases and fulfilled all other matters contained therein, and if any should perchance be found deficient in anything, they may be compelled by the same Auditors of the Rota to make good the deficiency, with pecuniary penalties imposed, by Royal Hand, and also by suspension from their Offices and the emoluments pertaining to them: But if the omission shall have been on the part of the Advocates, who when requested have refused to return the documents, then the same Visitors may proceed even against them with pecuniary penalties and by Royal Hand, as aforesaid.

10 Eighth. Lest henceforth both Sentences and Decrees and Rotal Decisions lack the production of preceding acts, it shall again be imposed that in cases of appeals directed to the Auditory of the Rota, doubts shall not be subscribed by the Ponentes unless extracts of the Process, Acts, and Documents of the first instance have first been transmitted to the Rotal Offices, and unless the customary citations have preceded: To be said against the commission and against the documents: according to the prescription of the Decree, emanated from the same Tribunal with the approval of Clement XII on 13 October 1759, which is read in print, and was confirmed by the same Pontiff in his Constitution which begins Romanus Pontifex, § 7. Given 27 January 1740. And by the Notary of all acts with oath, Faith shall be exhibited to the Ponens of the same Case, otherwise the subscription of doubts shall be suspended.
