— II. Ut piissimi parentis memoria singulari honore commendetur, exoptat fundator, seminarium sancti Antonii Patavini titulo eognominari: quin vero omni ex parte exclusos velit convietores, qui propriis sumptibus alantur, illud maxime sibi obtinendum perficiendumque praestituit, ut hoc novum seminarium Tridentinis seminariis opem ferat, sacerdotii candidatos gratis educando. qui inopiae causa sumptus suppeditare nequeunt ad studia conficienda necessarios, quamvis alioquin ad sacerdotium se divinitus evocari sentiant. Unde iuvenes qui propriis sumptibus alantur, tum solum admittentur, quum experimento constet numerum alumnorum eratis alendorum insufficientem, nec -respondere magistrorum tanto. operi addictorum numero, neque amplitudini aedium in hunc finem extructarum. Quare Patrono de hac re prius praemonito ianua huie alumnorum generi tunc quidem pandetur. — IIT. Singulari indulgens amori, quo Pontificem romanum summum, in terris lesu Christi Vicarium, conditor prosequitur, illud erigit ae constituit sub. — VI. — VIII. — IX. — IIT. Simul eum his testimoniis petitio seminarium ineundi scripto dabitur moderatori; qua perspecta atque his investigatis quae oportere videbuntur, certior petitor fiet, quid sibi praestandum uti sui experimentum praebeat apud delectos ad id muneris viros. — IV. Supellectilem, libros, vietum et vestes seminarium suppeditabit ex quo die ad educationem gratuitam cooptatus fuerit alumnus; solummodo exigetur ut oppidum Comillas adveniat honesta indutus veste et tantum afferat pecuniae, quantum satis erit ut domum repetat, si id forte expedire iudicabitur; hae vero pecuniae in thesauro deponentur, data prius parentibus cautione. — V. Seminarium ingressis nunquam, nis] gravissima ex causa superiorum iudicio aestimanda, per totum educationis tempus exire licebit. Si qui vero ad militiam proficisc cogantur, praefectis integrum prorsus erit alios in eorum locum sufficere, quin egressos rursus admittere ulla ratione teneantur. — VI. Quibus mentis animique dotibus a Deo ditati sint, qua etiam vocatione praediti fuerint ad munus sacerdotale capessendum, alumni totis duobus primis annis probabuntur: quare per hoc tempus facilius dimitti poterunt. Si vero sexdecimum attigerint aetatis annum, menteque firma deliberaverint ad sacerdotalem dignitatem sibi comparandam serio adlaborare ut vocationi divinae talem viam demonstranti respondeant, tune quidem Deo promittent, scriptoque testimonio promissum firmabunt, se post sacros ordines acceptos per quatuor saltem annos propriae dioecesi inserviendae fore addictos sie ut per hoc temporis spatium nulli ordini re- Lj ligioso nomen dare possint sine peculiari ac expressa dioecesani Praelati facultate in hune finem concessa. — VII. Studiorum ratio, temporis partitio, ordo ae domestica disciplina singularibus statuentur legibus ad exemplar collegi Germanici, quarum crebra violatio causa habebitur justa ut dimittantur, quos dimittendos superiores existimabunt. — VIII. — IX. Diennio ante absoluta studia, doctrinaeque experimentis prius habitis, alumni ad sacerdotium evehi poterunt, si propriis eorum Episcopis expedire videatur ut iis assuescant sacris exercitiis, quibus in posterum vacabunt. Missarum vero stipendia, quas eo tempore celebrabunt, in seminarii aerarium conferentur, ipsius sumptibtis impendenda. — XII. 1 PROPPEN

2 FOR A PERPETUAL RECORD OF THE MATTER.

3 The health and spiritual and temporal welfare of the Lord's flock, by divine mandate entrusted to Us, though unworthy, in the office of Apostolic service day and night attending to all things which We know to be done in the Lord for this purpose, We approve with willing mind, and confirm by the supreme authority which We hold in the universal Church of God, and it is pleasing and agreeable to Us to testify publicly and openly that chosen men, who, moved by piety and Christian charity, have instituted salutary, useful and fruitful works for the Christian faithful from their resources, are worthy of all praise and have deserved well of the Catholic cause. Deploring the fierce war and the wicked impious men bound together in sacrilegious society in their machinations against God and the Church, the most pious man Anthony Lopez and Lopez, Marquis of Comillas, considering that the ministry of the priesthood chiefly and principally contributes to the refutation of errors, to the overthrow of the enemy's machinations and frauds, to the formation of the morals of civil society and to the prosperity of the Church, so that many priests might also be trained, nourished with sound doctrines and abundant robust sustenance, strong in vigor and equipped with excellent arms to conduct the cause of religion bravely and wisely, and to be the greatest help and protection to their Bishops, adopted the excellent plan of building in the native town of his people, which is situated in the diocese of Santander and is called by the common name "Comillas," a spacious seminary for those adolescents preferring ecclesiastical service, to receive, sustain and educate in the humanities and severer disciplines all and singular youths from the dioceses of Spain and from the dioceses of America formerly Spanish, who are unable to bear the expenses in their own seminaries. Death having intercepted Anthony, whose pious and religious conspicuous work will commend him to posterity, by his son Claude, Marquis of Comillas, adhering to the footsteps of his most illustrious father and obeying with singular zeal and ardor of piety his father's will, this excellent work conceived and begun by his father himself has been so perfected and completed in every respect, and endowed with rich resources, that now there stands forth a notable monument of Christian art for the honor and utility of religion. (In order that more abundant and choice fruits from this seminary may proceed into the future, by the same beloved son Claude it is requested that studies rightly completed in this seminary may enjoy the same rights and privileges as if they had been completed in other Spanish seminaries, and that We be willing to grant to those visiting the chapel of the same seminary on the feast day of St. Anthony of Padua a plenary indulgence of their sins. Furthermore, it is supplicated that the aforesaid pious institution be protected by Our patronage and that of Our successors, the Roman Pontiffs, and to exercise this patronage more effectively and to obtain firmer protection of the most salutary work, not only of the seminary buildings but also of all goods full right of dominion is perpetually transferred to Us and Our successors, the Roman Pontiffs. It is further requested that the laws and chapters of the same seminary, drawn up by the suffrage of the Venerable Brethren the Archbishop of Burgos and the Bishop of Santander, be approved by Us, and, as they are contained in these letters, be strengthened and confirmed by Our authority, as follows. — I. The Marquis of Comillas, complying with the wishes of his most excellent father, the Lord Anthony Lopez and Lopez, most pious parent, and acting in his name, founds in the town "Comillas" and in buildings constructed at his own expense a seminary, in which Spanish adolescents and those originating from Spanish America are to be nourished and formed, so that hereafter, under the direction of their respective Bishops, they may give themselves to the cultivation of the Lord's vineyard. Since, however, the good which is intended is not peculiar to one diocese alone, but is most universal for all of Spain, therefore from all and singular Spanish dioceses the same number of students shall be admitted. However, it shall be permitted to admit more from some particular diocese only when there are no students from other dioceses who seek admission, in which case candidates from the diocese of Santander shall be preferred to others. — II. In order that the memory of the most pious parent may be commended with singular honor, the founder desires that the seminary be named by the title of St. Anthony of Padua: and indeed, wishing in no way to exclude boarders who are sustained at their own expense, he has especially set before himself to obtain and perfect this, that this new seminary may bring aid to the Tridentine seminaries, educating candidates for the priesthood freely, who on account of poverty cannot supply the expenses necessary for completing their studies, although otherwise they feel themselves divinely called to the priesthood. Whence young men who are sustained at their own expense shall be admitted only when it is established by experience that the number of students to be sustained freely is insufficient, and does not correspond to the number of masters devoted to so great a work, nor to the amplitude of the buildings constructed for this purpose. Wherefore, the Patron having been previously warned of this matter, the door shall then be opened to this class of students. — III. With singular affection, with which the founder pursues the Roman Pontiff, the supreme Vicar of Jesus Christ on earth, he erects and constitutes it under the protection of the Supreme Pontiff and of his most excellent Nuncio exercising his place in Spain, who shall perpetually exercise the office of patron: which also seems more fitting, both on account of the universal end which the seminary proposes, and especially on account of the variety of students who shall come from the dioceses of Spain and Spanish America. — IV. The founder wills and desires that the government, discipline and entire administration of the seminary be placed in the hands of the Fathers of the Society of Jesus; in order to obtain this, he willingly transfers the ownership of the building constructed at his own expense in the town "Comillas" to the Roman Pontiff, the Vicar of Christ on earth. Whence the ownership and real dominion shall be with the Holy See, the usufruct, however, with the Society of Jesus perpetually. This building, however, cannot be destined for any other purpose than that which We have expressed in the first chapter. But if perchance the seminary, through the failure of the number of students, cannot proceed rightly or through poverty cannot sustain them, then it shall be permitted to the Society to destine the building for another purpose, either literary or religious, proper to its institute, the matter having first been communicated with the Supreme Pontiff and the surplus monies having been offered to the patron. Furthermore, if perchance, by force majeure, those placed in charge of the seminary cannot fulfill their committed duty and the students must be dismissed, the existing sum of money, increased by accumulated revenues, shall be expended for the free sustenance of more students, so that in the future, when the Society of Jesus is restored in Spain, the seminary can again be rightly constituted. — V. The Society likewise promises to supply as many masters as are required for the instruction of the students; and it shall deliver those disciplines which are necessary so that academic titles may be obtained in the Tridentine seminaries. For the same reason it may also associate other priests zealous for the right instruction of youth, provided it deems it opportune, to whom the seminary shall provide a decent stipend; the Society itself, however, shall require no reward for its labors, except sustenance and honest clothing to be provided for those who devote themselves to the students in any way: which all things and expenses for journeys undertaken for this cause shall be drawn from the seminary's treasury. — VI. If the Roman Pontiff be deprived of the dominion and possession of the seminary, whether by law, or by sentence of tribunals, or by any other means, then the ownership of the buildings with the lands and other subsidies donated by the founder shall revert to the same founder, or to his legitimate heir, who is decorated with the title of Marquis of Comillas: but if such title should cease to exist, the ownership shall revert to that heir who would have held the aforesaid title by right, if it existed, when the Holy See was despoiled of that property. But if it should happen, he who is called to possession by this reversion clause and his heirs shall destine the goods thus recovered to that use, whether temporal or perpetual, which the counsel of the Supreme Pontiff shall designate. — VII. The Marquis of Comillas and the heirs of the same title and in their default the pastor of the town of Comillas shall enjoy the right of presenting four young men, who, if found to be adorned with the requisite gifts, shall be admitted to free education in the seminary. Of these young men two shall belong to the kinship of the founder, and two shall be born in the same town of Comillas. — VIII. Although no disciplines shall be rejected which pertain to the fuller and more ornate instruction of ecclesiastical youth, those shall be especially taught which are demanded by the knowledge of the humanities, philosophy and theology. Canon law shall also be explained, provided there is a sufficiently ample number of students. As to doctrine, whether philosophical or theological, the masters shall follow the footsteps which the documents emanating from the Apostolic See in these recent times teach must be followed: finally, the order and distribution of classes shall be those by which the Gregorian Academy is governed today. — IX. The institutes and laws by which the students are to be directed so that they may be formed in those morals which the ministries of the priesthood require, shall be those by which the German college, protected by the patronage of the Supreme Pontiffs, has produced so many and such excellent priests. — X. The conditions required for the admission of students, the faculties of mind and body with which they ought to be adorned, the trials to which they shall be subjected, the obligations which they shall undertake toward their own diocese, the duties which, once admitted, they may expect from the seminary, are set forth in the following articles. — I. The age of those to be enrolled must have completed at least the twelfth year; the instruction which pertains to primary education must be complete in all respects; indeed, other things being equal, those shall be preferred who are commended by knowledge of higher disciplines and especially by skill in the Latin language. — II. Furthermore, in order for anyone to enter this seminary, it is not only necessarily required that he show himself to be called from heaven and confirm it by most upright morals, but also that he demonstrate by the testimony of the pastor that he is born of legitimate birth and honest parents. To this testimony three documents shall be added: first, one which attests to baptism and confirmation, another by which a physician testifies that neither he nor his parents labor under any contagious disease, third, the faculty of the diocesan Prelate to leave his own seminary, if he has previously devoted himself to studies in the diocesan seminary for some years. — III. Together with these testimonies a written petition to enter the seminary shall be given to the moderator; which having been examined and these things investigated which shall seem necessary, the petitioner shall be informed what he must do to present himself for his trial before men selected for this duty. — IV. The seminary shall supply bedding, books, food and clothing from the day on which the student is admitted to free education; only it shall be required that he arrive at the town of Comillas clothed in honest dress and bring only so much money as shall be sufficient for him to return home, if it should happen to be judged expedient; these monies, however, shall be deposited in the treasury, a receipt having first been given to the parents. — V. Those entering the seminary shall never be permitted to leave, unless for the gravest cause to be judged by the judgment of superiors, throughout the entire time of education. If any, however, are forced to depart for military service, it shall be entirely within the power of the prefects to supply others in their place, nor shall they be bound in any way to readmit those who have left. — VI. By what gifts of mind and spirit they are endowed by God, and by what vocation they are also endowed for undertaking the duty of the priesthood, the students shall be tested throughout the first two years: wherefore during this time they may be more easily dismissed. But if they have reached the sixteenth year of age, and with firm mind have deliberated to work seriously to obtain for themselves the sacerdotal dignity in response to the divine vocation showing them such a path, then indeed they promise to God, and by written testimony shall confirm the promise, that after receiving sacred orders they shall be devoted to serving their own diocese for at least four years, so that during this space of time they cannot give their name to any religious order without special and express faculty of the diocesan Prelate granted for this purpose. — VII. The method of studies, the division of time, the order and domestic discipline shall be determined by singular laws after the example of the German college, whose frequent violation shall be just cause for dismissal of those whom the superiors shall judge should be dismissed. — VIII. Likewise equal causes of dismissal shall be considered, if anyone is found less suited to studies, if he does not appear to be divinely called to the priesthood, if corrupted morals, or constant idleness, or a rebellious spirit toward moderators appear. — IX. Two years before studies are completed, and after trials of doctrine have first been held, students may be raised to the priesthood, if it shall seem expedient to their own Bishops that they accustom themselves to sacred exercises, in which they shall hereafter be occupied. The stipends of Masses, which they shall celebrate at that time, shall be contributed to the seminary's treasury, to be expended for its expenses. — X. After the students have completed philosophy, if the moderator has judged it profitable to their and the seminary's utility to interrupt studies for a year or more, they may be compelled to teach the lower disciplines there, and thus become more apt for receiving the higher ones. — XI. If anyone, led by the excellence of this work, wishes to contribute to its salutary end, he may easily be made to obtain his wish by supplying the expenses of one or more adolescents, either perpetually or for a certain time; but it shall be the sole right of the moderator to judge concerning the gifts which are required for admission to the seminary, and also so that they may persevere in it and make progress in studies. When, however, it is necessary that one of these depart from the seminary, the money donated for his instruction shall be attributed to others whom the same moderator shall judge worthy of the benefit. — XII. Finally, all students shall take care to beseech divine piety first indeed for the supreme benefactor, namely for Mr. Anthony Lopez and his children; then, however, for the others by whose aid their instruction is assisted. Therefore, besides those prayers which mindful affection may suggest, each one who is not yet a priest shall offer once a week one rosary of the Blessed Virgin, and once a month Holy Communion for this purpose. Of the priests, however, one, as the moderator shall designate each one, shall offer the sacred sacrifice once a week. — Since these things are thus, all and singular to whom these letters of Ours are favorable, We, absolving from any excommunication and interdict and other ecclesiastical censures, sentences and penalties in any way or for any cause inflicted, if they have perchance incurred any, for this reason alone, and holding them to be absolved, and wishing to exhibit to the same beloved son Claude a testimony of Our benevolence and the praise of his merits sought for his excellence, have deemed it necessary to accede to his wishes and supplications. Therefore, the statutes or laws of the seminary named from St. Anthony of Padua erected in the town "Comillas" in the diocese of Santander, comprehended in ten chapters, which above in these same letters are inscribed, We, by Our own motion, certain knowledge and mature deliberation, hold as ratified in all respects, approve and by Our supreme authority confirm, sanction and will to be inviolably observed, and all rights and faculties which the other canonically instituted seminaries in Spain use and enjoy, either by right, or by privilege, or by custom, We grant and impart to the same seminary by the force of Our authority in these letters: and the aforesaid seminary named from St. Anthony of Padua We receive into Our dominion and that of Our successors, the Roman Pontiffs, by these present letters, and likewise receive it entirely into the guardianship and patronage to be exercised through the Apostolic Nuncio of the Holy See in Spain. Finally, to the moderator of the aforesaid seminary, to the teachers, to the students, and to all others devoted to the same institute, and also to all the faithful who on the feast day of St. Anthony of Padua, truly penitent and confessed, and refreshed by holy communion, shall piously visit the chapel of this seminary from the beginning of Vespers until the setting of the sun on such day each year and shall there pour forth pious prayers to God for the concord of Christian Princes, the extirpation of heresies, the conversion of sinners, and the exaltation of Holy Mother Church, We mercifully grant in the Lord a plenary indulgence and remission of all their sins for perpetual future times. Notwithstanding, although worthy of special and individual mention and derogation, anything whatsoever acting to the contrary. These things We establish and grant: therefore We decree these letters of Ours to remain firm, ratified, effective as they are in the future, and that it be null and void if anything should be attempted against them by anyone.
