Sollicita catholici gregis

1 Annecii in the Kingdom of Piedmont.
2 Pius, Bishop, Servant of the Servants of God. For the future record. § 1. The solicitous care with which We are constantly impelled for the welfare of the Catholic flock compels Us to provide with attentive study those things which appear expedient for its more salutary governance; among which the constitution of bishops holds the first place, so that they may be able to bring timely assistance to the spiritual necessities of the faithful people. And therefore from the year one thousand eight hundred and seventeen, when the public affairs of Europe had been settled, and with the favor of the studies of Our most beloved son in Christ Victor Emmanuel, then the illustrious King of Sardinia, and also Duke of Savoy, Montferrat, and Genoa, and Prince of Piedmont, through Our apostolic letters under lead beginning "Beati Petri" given on the sixteenth day before the kalends of August, those episcopal sees in the Piedmontese province, which We had suppressed in the year one thousand eight hundred and three as the condition of those past times required, We again erected and newly instituted.
3 § 2. And whereas through the aforesaid Our letters of the year one thousand eight hundred and seventeen We erected only the see of Chambéry into a metropolitan see, assigning the church of Aix as suffraganean to it, so that in the meantime it might be considered with diligent and mature deliberation whether, and which other sees in the same duchy should be erected, now understanding that the actual circumstances of that kingdom after the disturbances especially stirred up in it and, by divine favor, suppressed there, do not at all permit all the churches formerly existing in Savoy to be restored. With a joyful heart and with the blessing of the Lord of all consolation We have received the petitions exhibited to Us in the name of Our most beloved son in Christ Charles Felix, the modern illustrious King of Sardinia, and Duke of Savoy, Montferrat, and Genoa, and also Prince of Piedmont, by Our beloved son the Count Joseph Barbaroux, decorated with an extraordinary mission to the Holy See, so that another episcopal see might be constituted in the duchy of Savoy, and thus the governance of sacred matters might be better divided between two prelates for the good and convenience of the Christian faithful dwelling there. This see, however, is deemed opportune to be erected in the city of Annecii, already distinguished by many titles, and especially on account of the glorious tomb of the holy Saints Francis of Sales and Jane Frances of Chantal, and on account of the safe and most ready refuge afforded to the Bishop and Chapter of Geneva, forced to be exiled from their own see, and to which new see the places and parishes hereinafter mentioned are to be assigned for its diocesan territory.
4 3. Having therefore regard to the cession already made by Our venerable brother Irenaeus Yves, archbishop and metropolitan chapter of Chambéry, with prior dismemberment and separation from the diocese of Chambéry of the places and parishes to be mentioned below, from certain knowledge and mature deliberation of Ours, and from the fullness of apostolic power, We erect Annecii into an episcopal city for one future Bishop of Annecii to be named, with the rights, honors, and prerogatives with which the cities of the duchy of Savoy formerly distinguished by a pontifical see, and their citizens enjoyed and used, so that in the same city for the glory of almighty God and the increase of the Catholic religion We elevate a parochial church under the invocation of St. Peter in Chains to the rank of cathedral church.
5 and there We establish an episcopal see and cathedral chapter consisting of ten canonries and as many prebends, comprehended in them three dignities, namely the provostship first after the pontifical, the archdeaconry second, and the cantorship third, and also two other honorary canonries for one bishop hereafter, who shall preside over the church, city, and diocese of Annecii, convoke a synod, and have and exercise all and singular the rights, offices, and duties of a bishop with his episcopal table, and all cathedral and pontifical insignia, jurisdictions, preeminences, prerogatives, privileges, honors, graces, favors, and indults real, personal, and mixed, with which the cathedral churches formerly existing in the duchy of Savoy, and their prelates enjoyed and were able to enjoy from similar apostolic authority, We erect and institute.
6 We raise to this rank, and there establish an episcopal see, and a cathedral chapter consisting of ten canonries, and as many prebends comprehended in them three dignities namely the provostship first after the pontifical, the archdeaconry second, and the cantorship third, and also two other honorary canonries for one bishop hereafter, who shall preside over the church, city, and diocese of Annecy, convoke a synod, and have and exercise all and singular the rights, offices, and duties episcopal with his episcopal table, and all cathedral and pontifical insignia, jurisdictions, preeminences, prerogatives, privileges, honors, graces, favors, and indults real, personal, and mixed, which the cathedral churches existing in the duchy of Savoy, and their prelates enjoyed, and were able to enjoy by similar apostolic authority, We erect and institute.
7 Furthermore, to establish and constitute the territory of the diocese of Annecy, besides the aforesaid city with the two parishes of St. Peter and St. Maurice existing in it, we assign two hundred eighty-two parish churches with the places, communes, and villages respectively comprised in them, namely: In the province of Genevois: Alby, Alex, Allèves, Allonzier, Annecy le Vieux, Argonnez, Aviernoz, Balme de Sillingy, Balme de Thuy, Bloye, Bluffy, Boussy, Bouchet, Cercier, Chapeiry, Charvonnex, Chavanod, Choisy, Clefs, Clusaz, Crempigny, Cuvat, Dingy-Saint-Clair, Doussard, Duingt, Entrevernes, Epagny, Etercy, Evires, Faverges, Giez, Grand Bornand, Groissy, Gruffy, Hauteville, Héry-sur-Alby, Leschaux, Lornay, Lovagny, Manigod, Marcellaz, Marigny, Marleus, Massingy, Menthon, Menthonnex, Mesigny, Montmin, Moye, Naves, Nonglard, Ollières, Poisy, Pringy, Quintal, Rumilly, Saint-Eusèbe, Saint-Eustache, Saint-Ferréol, Saint-Jean-de-Sixt, Saint-Jorioz, Saint-Martin, Saint-Sylvestre, Sales, Sallenôve, Seinod, Serraval, Settenez, Sillingy, Sion, Sovrier, Talloires, Thorens, Thorens, Thuile, Thusy, Vallières, Veaux, Versonnex, Veyrier, Vieugy, Villards-sur-Thônes, Villaz, Villy-le-Bouveret, Villy-le-Pelloux, Viuz-Faverges, Vinz-la-Chièsaz, Vouray. From the Archbishopric of Chambéry, moreover, the parish church of Étrembières united perpetually to the parish of Jonnex in Helvetia, from the diocese of Lausanne, and likewise another parish church of Seissel in the said province of Carouge from the metropolitan diocese of Lyon, we dismember, detach, divide, and separate; and those places and parishes with all churches, monasteries, prepositions, convents, and whatever ecclesiastical benefices both secular and of whatever orders regular, and persons of either sex, inhabitants and residents both lay and ecclesiastical, secular and regular, not however exempted, of whatever status, order, and condition, we perpetually exempt and free from the ordinary jurisdiction, power, and superiority of the aforesaid prelates; and we assign and grant those places and parishes, territories, communes, and villages above expressed as the perpetual territory of the new future diocese of Annecy; and we perpetually subject and submit the aforesaid inhabitants of either sex, both lay and ecclesiastical, to the ordinary jurisdiction, superiority, and authority of the new future and for the time being existing bishop of Annecy, reserving nevertheless to Us and to Our successors the Roman Pontiffs the faculty freely to effect in the future those dismemberments which shall be judged opportune, if and when the sees of Tarentaise and Maurienne shall again be able to be erected and restored.
8 § 5. Moreover, we assign the aforesaid newly erected episcopal church of Annecy as a suffragan to the metropolitan church of Chambéry, and we subject and subordinate it to the metropolitan jurisdiction and to the authority of the Archbishop of Chambéry existing for the time being.
9 § 6. For the dwelling of the new Bishop of Annecy and his episcopal successors, we assign and grant a palace adjoining the aforesaid cathedral church, sufficiently spacious and of common construction, already formerly donated in perpetuity to the Bishops of Gex from royal munificence; and moreover for the endowment of the episcopal table, so that the Bishop of Annecy may be able to maintain his dignity appropriately, we decree and establish for the same table an annual sum of twelve thousand livres in the currency of the realm, or francs of Gallic money at the rate of one thousand five hundred livres from the community and the men of the city of Annecy, as was formerly owed to Gex, for another portion seven hundred ninety livres and the fruits of minor ecclesiastical places pertaining to the bishopric formerly of Gex, and for the remaining portion twelve thousand sixty livres from public debt to be supplied from the royal treasury, as the aforesaid King Charles Felix of his piety and munificence freely offered to the same episcopal table of Annecy for perpetual future times, we assign, decree, and establish, commanding at the same time that authentic documents of the aforesaid revenues be delivered to the executor of the present letters of Ours hereinafter named, and that they be thereafter deposited and preserved in the episcopal archive of Annecy.
10 § 7. Coming now to the cathedral church of Annecy, which continues also to be a parish church, we establish a suitable endowment for the chapter, namely that both the prepositus, the first dignity in it after the pontifical rank, and the archdeacon, the second dignity, and the cantor, the third dignity, as well as the first three canonries, each of one thousand five hundred new livres of Piedmontese currency or Gallic francs, and each of the other four canonries one thousand two hundred similar livres for their respective prebends to be inscribed in public debt, shall freely receive annually from the treasury by the liberality of the aforesaid king.
11 § 8. We decree moreover that the present and future rectors of the parish churches of St. Peter in Chains together with the cathedral, and of St. Maurice of the city of Annecy shall be provided and ought to be appointed with an honorarium of one thousand five hundred similar livres without any obligation of servile duty, yet with the right of having a stall in the choir, and of enjoying voice and vote in the chapter.
12 § 9. We command moreover that the new future Bishop of Annecy shall be bound to erect theological and penitentiary prebends in the form of canonries according to the sacred canons, especially those of the sacred Council of Trent, as soon as it can be done according to the aforesaid canonical dispositions, burdening his conscience upon these matters. § 10. And since certain goods placed in the same diocese of Annecy are found to be no longer belonging to regular monasteries, the revenues and proceeds of which amount to eleven thousand six hundred thirty-three livres, or francs and centimes annually, we commit to the executor hereinafter named, that the same goods and revenues be declared partly for the maintenance of the fabric of the cathedral church and for the stipends of singers and servants, and partly for the augmentation of the endowment of a new canonry, the canon to be declared free from the obligation of service, and from the other proceeds of eight thousand otherwise provided, respectively grant and assign.
13 We repeat the concession of the right of nominating or of the erected or to be erected seminary from the other proceeds of eight thousand otherwise provided, respectively grant and assign.
14 § 11. We also grant to the chapter of the new cathedral church of Annecy the faculty that for the service of the choir, for the distribution and division of all other emoluments whatsoever, for the bearing of burdens, for the prosperous management and direction of things and rights both spiritual and temporal, it may make and issue whatever statutes, chapters, and decrees, provided they be lawful and honest and not contrary to canonical rules, under the presidency, inspection, and approval of its bishop; and moreover it may freely and lawfully use and enjoy all privileges, not however acquired by onerous title, which the chapters of the churches of Savoy formerly legitimately enjoyed, and may be able to do so.
15 § 12. To the aforesaid Charles Felix, King of Sardinia, Savoy, Montferrat, and Duke of Genoa, and Prince of Piedmont, and to his successors, subject to his and their temporal dominion in sincerity of faith and in integrity of obedience to the Holy Roman Church, persevering thus, We confirm the right of nominating within the time prescribed by law ecclesiastical persons approved, of good name and reputation, and according to the dispositions of the sacred canons and the decrees of the Council of Trent, suitable for the aforesaid episcopal church of Annecy, both for this first time and in future vacancies, just as the predecessors of the same king have been accustomed to nominate to the churches of Savoy, yet innovating nothing concerning what was observed both regarding the aforesaid nominations and regarding the examination, canonical provision, and consecration of those nominated before the year one thousand eight hundred and one, We confirm, and moreover newly grant in perpetuity and command, and in like manner to the aforesaid Charles Felix, king and his successors, the right of nominating to the second and third dignities, and to canonries of the cathedral church of Annecy, with prior formal competition as is customary regarding the theological and penitentiary prebends, suitable ecclesiastical persons to be canonically instituted by the ordinary; We reserve always to Ourselves and to Our successors the Roman Pontiffs the free collation of the first prepositorship after the pontifical dignity. Having moreover taken into account the revenues and income assigned to the endowment of the episcopal mensa of Annecy, as above, We order that it be taxed in the books of the apostolic chamber at four hundred florins.
16 § 13. Wherefore to the aforesaid Irenaeus Ivoni, present archbishop of Chambéry, whom We elect and appoint as executor of these Our letters, We grant all necessary and suitable faculties for fully obtaining the effect of the aforesaid matters, even to subdelegate one or more persons constituted in ecclesiastical dignity, and to define and pronounce freely and lawfully on any opposition whatsoever that may arise in the course of execution, with observance nevertheless of what is to be observed by law, even definitively and with any appeal removed.
17 § 14. To the same Irenaeus Ivoni, archbishop, We enjoin and command that he transmit copies of each of the acts to be drawn up in the execution of these Our letters as soon as possible in authentic form to the apostolic See, to be preserved in the archive of the congregation placed over consistorial matters.
18 § 15. These present letters, moreover, and whatever is contained in them, even from the fact that any persons having or pretending to have an interest have not been called and heard, and have not consented to the aforesaid matters, their consent, insofar as it is necessary, We supply from the fullness of apostolic power, so that at no time whatever can they be noted, impugned, or called into question on account of the vice of subreption or obreption, or nullity, or defect of Our intention, but We will and decree that they shall perpetually be valid and efficacious, and shall produce and obtain their full and complete effects, and ought to be inviolably observed by all to whom it pertains.
19 § 16. Notwithstanding acquired rights not to be taken away, suppressions to be made to the parties, those interested being called, and Our other rules and those of the apostolic chancery, and the special or general constitutions and ordinances issued in synodal, provincial, and universal councils, and all other things to the contrary whatsoever.
20 § 17. We will moreover that to copies of these Our letters, even printed, subscribed however by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith be given everywhere as would be given to these presents if they were exhibited or shown.
