1 Constitution of the Congregation of Clergy and Regulars of St. Maioli, otherwise of Somascha, under the Rule of St. Augustine, with the granting of privileges by Pius Pope V, for perpetual remembrance of the matter. We believe that we duly perform the office of apostolic service enjoined upon us in this regard, if we extend the attention of consideration to those matters by which congregations, especially those instituted for the sake of orphans, 4 may be more easily established and more firmly preserved. 4 Concerning the origin and other matters which concern it, see in the constitution xxix of Paul III, Ex intunclo, vol. vi, p. 285.
2 Bull. Rom. Vol. VII. 92 Indeed, our beloved sons, the priests, clerics and laymen of the congregation of the place of Somascha, of the diocese of Milan, canonically instituted some time ago, recently caused it to be set forth to us that our predecessor of happy memory, Pope Paul III, had formerly given the beginning to the aforesaid congregation, to which Hieronymus Emilianus, once a patrician of Venice, a man of outstanding and remarkable piety, inspired, as is piously believed, by the Holy Spirit, having set aside all the cares of the world, had given the beginning, and which many, led by his example, had embraced, and having been called in the cities and towns of Genoa, Milan, Ferrara and other cities and towns of Italy, had enlarged it, granted to it the facility of choosing a head for itself and of making constitutions; and exempted it from the superiority, jurisdiction and power of the ordinaries; and both he and afterwards our predecessor of pious memory, Pius Pope IV, also pursued the said congregation with certain other privileges and graces.
3 § 2. Moreover, successively our beloved son Charles, cardinal of the title of St. Praxedes, called Borromaeus, fortified with sufficient facility for this, as he asserted, donated to the said congregation the church of St. Maioli of Pavia, formerly accustomed to be held by the monks of the Cluniac Order, with certain annual revenues assigned to it. And we afterwards approved the aforesaid donation by apostolic authority, as is fully contained in the several letters patent of our predecessors and of Cardinal Charles aforesaid and of our letters made concerning this.
4 § 3. By the force of which letters, the aforesaid priests, clerics and laymen made the aforesaid church into a patrimonial house, and as the head of the other churches of the said congregation for the future superior who shall reside there and, together with other appointed [[fn:Paul III]] gave to this congregation the facility of choosing a head for itself.
5 Cardinal Borromaeus granted the church of St. Maioli of Pavia to the same congregation, and the Pontiff confirmed the said concession.
6 For which reason the said congregation made the said church the head of the others;
7 professed members, not only of that church but also of the other churches of the same congregation, have the care, governance and administration, as well as the professed members who render reverence and obedience to the said superior, delegated to themselves.
8 § 4. But the care, as the same exposition concerning orphans required, although the same priests, clerics and laymen live religiously and are instructed in good arts, and especially among other works of piety, undertake the care of orphans in Christian discipline and in good arts and letters, according to the capacity of each one's talent, and in certain places undertake the care of seminaries of clerics with the greatest zeal; and for this reason there is no doubt that this congregation will endure perpetually.
9 § 5. Nevertheless, because many of them, not having made profession, are considered from causes here.
10 truly religious, are rejected by that congregation and turn to another Religion; others, poor men, not having the title of a benefice and patrimony, contrary to the Council of Trent, are unable to be promoted to orders, or led by other reasons, choose another manner of living; many priests, clerics and laymen of the congregation itself, in order more firmly to establish such a congregation, and to obviate these and other inconveniences, greatly desire to emit three vows, namely of poverty, chastity and obedience, if our authority and that of the Apostolic See shall favour it. Wherefore these same priests, clerics and laymen humbly besought us that we should deign, from apostolic benignity, to grant them licence to emit the aforesaid vows in the hands of some ecclesiastical prelate, and otherwise to consult and provide opportunely for the perpetual utility of that congregation and the aforesaid orphans. § 6. We therefore, who are accustomed to grant a favourable assent in a manner pleasing and honourable to the pious and honest wishes of those who come before us, commending in the Lord the pious life, the excellent and most upright purpose of profession, and the manner of living under the clerical state and institution of the aforesaid priests, clerics and laymen, and each of them from any excommunication, suspension and interdict and other ecclesiastical sentences, censures and penalties, imposed by law or by man, for any occasion or cause whatsoever, if they are bound by any of them in any way, absolving them for the purpose of these presents only, and holding them as absolved; and likewise holding the tenor of the aforesaid letters and whatever followed therefrom as expressed in these presents, inclined to these supplications, to the aforesaid priests, clerics and laymen wishing to emit the aforesaid vows, we grant them licence to emit those in the hands of some ecclesiastical prelate, to be chosen by such congregation for this purpose, until six of them shall have made profession, and shall have elected and confirmed for themselves the general superior of the congregation itself, according to their constitutions made or to be made; and thereafter, with the said six professed and the elected superior, to all and each of the other faithful, even those educated and instructed in orphanages, wishing to enter the said Religion, in the hands of the superior himself or his vicar to emit and profess, and to live under the Rule of St. Augustine, in clerical and honest habit however and in places conformable to where they shall have lived; we likewise grant free faculty to the aforesaid prelate and superior and vicar to receive such vows in their hands: and that, within the next three years, those who shall have lived laudably for ten years in the said congregation, wishing to emit the aforesaid vows, not awaiting the year of probation; but when three years shall have elapsed, others wishing to emit the same vows, only after the sixteenth year of their age shall have elapsed, in the aforesaid church or elsewhere, where it shall seem more convenient to the superior or vicar, to emit and profess the aforesaid vows, so that there shall be no place for tacit profession, we grant the faculty of receiving and possessing in common; and that the aforesaid, and those existing for the time being, superior, priests, clerics and laymen under the said Rule, according to the constitutions made or to be made by them, shall live.
11 § 7. And all and singular whatsoever, howsoever many and of whatsoever kind, movable or immovable goods, left or to be left to the said congregation or to its places or churches by universities, communities and others, even private persons, of whatsoever status, degree, order, quality and pre-eminence they may be, by testament or codicils or other last will or donation, even between the living or otherwise in any manner whatsoever, as well as oblations left or to be left to it, they may and are able freely and lawfully to receive, exact and possess in common only.
12 § 8. And that henceforth the aforesaid congregation shall be called the Clerks Regular of St. Maioli or of Somascha, we likewise decree and ordain perpetually.
13 § 9. And moreover, whatsoever is left to the aforesaid congregation, and not otherwise expressed and declared as to place, from now as from then and conversely, to the church of St. Maioli, so that it shall be lawful for the superior existing for the time being, by himself or by another or others, freely and lawfully to convert the fruits and emoluments of the said bequests to such uses and utility as seem good to him and necessary for the church of St. Maioli and the aforesaid congregation, the licence of the diocesan of the place or of any other being in no way required thereupon, by the authority and tenor of the premises, and also perpetually, we apply and appropriate.
14 § 10. Decreeing that these present letters may be noted, argued against, and impugned and revoked, limited, moderated, suspended, or derogated from on account of subreptiousness or obreption or nullity or any other defect or deficiency of our intention, and may be comprehended under the revocation, derogation, limitation, moderation, suspension, or any other contrary dispositions of whatsoever similar grants; we decree that the congregation does not place its name; and the legacies being simply left, may be applied to the church of St. Maiolus; we appoint the preservative clauses of this constitution; and as often as they shall be issued forth, so often shall they be restored to their pristine and most valid state, and newly granted and perpetually valid and efficacious, and shall produce their full and complete effects.
15 § 11. And thus by whatsoever judges and commissaries, joined by any authority, the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, it ought to be judged and determined; and from now whatever shall be attempted otherwise concerning these things by anyone, by whatsoever authority, knowingly or unknowingly, shall be null and void.
16 § 12. Wherefore we command by these presents to our venerable brothers the Bishops of Amiens, Pavia, and Cremona, as executors, that they themselves or two or one of them, by themselves or through another or others, assisting the congregation and the future superior of this kind and each of its persons in the aforesaid matters with the protection of effective defense, shall cause the congregation and its superior and individual persons to enjoy peacefully and possess this concession, indult, statute, ordinance, application, approbation, and decree. Not permitting them to be molested in any way by anyone whatsoever contrary to the tenor of these presents. And compelling the contradictors and rebels and those not obeying the aforesaid through censures and ecclesiastical penalties and other remedies of law, appeal being set aside; and also, the legitimate processes being observed concerning these matters, declaring that they have incurred these censures and penalties; and also aggravating them even repeatedly, invoking also for this, if it should be necessary, the aid of the secular arm.
17 § 13. Notwithstanding the aforesaid and to the contrary the constitution of Boniface, Pope of blessed memory, the Eighth, on the one hand, and of the general council on two diets, provided that no one by virtue of these presents be summoned to judgment beyond three diets, and all other apostolic constitutions and ordinances; as well as the statutes and customs of the congregation itself and of whatsoever monasteries and Orders, even those strengthened by oath and apostolic confirmation or by any other firmness; privileges also, indults, and apostolic letters, those granted, confirmed, and renewed to them and their superiors and persons, under whatsoever tenors and forms, and with whatsoever, even derogatory clauses of derogations, and other more efficacious, most efficacious, reiterated, and unusual clauses, irritant and other decrees, in general or in particular and otherwise howsoever reiterated many times. All and each of which, even if otherwise, for their sufficient derogation, special, specific, express, and individual mention of them and their whole tenors, and not through general clauses importing the same, or any other expression, or some other exquisite form to be observed for this, should be had, we having the tenors of these present as sufficiently expressed and inserted, those otherwise remaining in their force, this time only, specially and expressly derogate from, notwithstanding anything to the contrary; or if to any, commonly or severally, it has been indulged by the same See that they cannot be interdicted, suspended, or excommunicated through apostolic letters not making full and express and word-for-word mention of this indult.

GXIX.
6 Perciò la detta congregazione costituì la detta chiesa capo delle altre;
