1 Per provvedere più opportunamente al retto governo dei cristiani fedeli e al loro bene spirituale, giova senza dubbio moltissimo una giusta circoscrizione delle Chiese. Considerando seriamente questo, il venerabile fratello Augusto Alvaro da Silva, Arcivescovo della Chiesa metropolitana di S. Salvador in Brasile, e soprattutto tenendo presente che la sua arcidiocesi è frequentatissima per il numero degli abitanti e si estende su un territorio vastissimo, ha supplicato con insistenza la Sede Apostolica affinché essa fosse divisa in due parti e da essa fosse eretta una nuova diocesi. Noi pertanto, consultati i venerabili fratelli Nostri Eminentissimi Cardinali preposti alla Sacra Congregazione Concistoriale, e avuto il favorevole voto del venerabile fratello Benedetto Aloisi Masella, Arcivescovo titolare di Cesarea in Mauritania, e Nunzio Apostolico presso la Repubblica brasiliana, dopo aver maturo considerato tutto, abbiamo ritenuto di accogliere le suppliche del suddetto Arcivescovo di S. Salvador. Perciò, supplito, per quanto occorra, il consenso di coloro che vi hanno interesse o che presumono di avervi interesse, con la pienezza della potestà apostolica, dalla arcidiocesi di S. Salvador in Brasile stacchiamo una parte di territorio, che comprende le seguenti parrocchie: Bomfim, Abaré, Bom Conceição do Conselho, Campo Formoso, Coite, Geremoabo, Itiuba, Jacobina, Cumbe, Capim Grosso, Morro de Chapéu, Monte Santo, Queimadas, Brachão di Jacobina, Brachão di Utinga, Sande, S. Antonio da Gloria, Bombai, Tucano, Vana. Tutto il territorio, formato da queste parrocchie, lo erigiamo in nuova diocesi, che vogliamo sia chiamata di Bomfim dal nome della città di Bomfim, nella quale stabiliamo la sede episcopale. La chiesa parrocchiale dedicata al Signore di Bomfim, che esiste nella medesima città, l'eleviamo al grado e alla dignità di chiesa cattedrale. A questa chiesa cattedrale della diocesi novellamente eretta e ai suoi Vescovi pro tempore attribuiamo tutti i diritti, gli onori, gli insegni, i privilegi, i favori e le grazie, di cui godono e si avvalgono secondo il diritto comune o la legittima consuetudine le altre chiese cattedrali e i loro Antistiti in America Latina; parimenti i Vescovi stessi e la loro chiesa cattedrale li assoggettiam a tutti gli oneri e alle obbligazioni, ai quali secondo il diritto comune sono assoggettati gli altri Antistiti e le loro Chiese. Decretiamo inoltre che questa nuova diocesi di Bomfim sia suffraganea della chiesa metropolitana di S. Salvador in Brasile; e perciò i suoi Vescovi pro tempore li sottoponiamo al diritto metropolitico dell'Arcivescovo di S. Salvador. Poiché però le circostanze del presente tempo non permettono che in questa nuova diocesi sia istituito subito un Capitolo di canonici, concediamo che per i canonici si eleggano intanto i consultori diocesani secondo le norme del diritto. Ordiniamo inoltre che un piccolo almeno Seminario diocesano, secondo le prescrizioni del Codice di diritto canonico e le norme trasmesse dalla Sacra Congregazione dei Seminari e delle Università degli Studi, sia eretto al più presto possibile; e parimenti che a spese di questa medesima nuova diocesi di Bomfim due giovani scelti, o almeno uno, siano inviati regolarmente al Pontificio Seminario Pio Latino dell'Urbe, dove sotto i Nostri occhi siano formati nella speranza della Chiesa. Per quanto riguarda il governo e l'amministrazione di questa diocesi, l'elezione del Vicario capitolare sede vacante, i diritti e gli oneri dei chierici e dei fedeli e altre cose di questo genere, ordiniamo che siano osservate rettamente le prescrizioni dei sacri canoni. Quanto poi specialmente riguarda il clero, stabiliamo che, non appena l'erezione di questa nuova diocesi sia mandata ad esecuzione, per ciò stesso siano considerati come ascritti a questa chiesa tutti i chierici che legittimamente dimorano nel suo territorio. La dote e la mensa episcopale saranno costituite da tutti gli emolumenti e dalle altre oblazioni che i fedeli, per il cui bene la diocesi è stata eretta, sono soliti offrire, eccetto quelle che già sono state raccolte a questo fine. Vogliamo infine e ordiniamo che tutti i documenti e gli atti riguardanti questa nuova diocesi, i suoi chierici e i suoi fedeli, siano trasmessi dalla cancelleria della arcidiocesi di S. Salvador in Brasile alla curia episcopale di questa nuova diocesi al più presto possibile, affinché siano rettamente conservati nel suo archivio. Affinché tutte queste cose sopra disposte e costituite siano mandate ad esecuzione, deputiamo il venerabile fratello Benedetto Aloisi Masella, che abbiamo menzionato sopra, Nunzio Nostro nella Repubblica brasiliana, e gli attribuiamo tutte le facoltà necessarie e opportune, sia per dirimere tutte e singole le controversie che in qualunque modo sorgessero nell'atto dell'esecuzione, sia per subdelegare a tale effetto qualunque uomo costituito in dignità o ufficio ecclesiastico; e gli imponiamo l'obbligo di trasmettere alla Sacra Congregazione Concistoriale un esemplare autentico degli atti dell'esecuzione compiuta entro sei mesi dal giorno della data di queste Lettere. Vogliamo infine che ai transunti di queste Lettere, anche se stampati, purché sottoscritti però da qualche Notaio pubblico e muniti del sigillo di qualche uomo costituito in dignità o ufficio ecclesiastico, sia attribuita la medesima fede, che sarebbe attribuita a queste Lettere, se fossero esibite o mostrate nell'originale. Non ostante, per quanto occorra, le regole edite nei Concili sinodali, provinciali, generali e universali, le costituzioni e ordinazioni apostoliche speciali o generali, e qualsiasi altra disposizione dei Nostri predecessori Romani Pontefici, e tutte le altre cose contrarie. A nessuno pertanto sia lecito infrangere questa pagina della Nostra dismembrazione, erezione, elevazione, concessione, statuto, deroga, mandato e volontà, o contravvenirvi. Se qualcuno invece, con temerario ardimento, presumesse di tentare ciò, sappia che incorrerà nell'indignazione di Dio onnipotente e dei beati Pietro e Paolo, suoi Apostoli.

S. SALVATORIS IN BRASILIA FROM THE ARCHDIOCESE OF S. SALVATORIS IN BRASILIA A PART OF THE TERRITORY IS DISMEMBERED AND THEREFROM A NEW DIOCESE TO BE CALLED «OF BOMFTM» IS ERECTED PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL MEMORY OF THE MATTER

1 To provide more suitably for the governance of the Christian faithful and to consult their spiritual good, without doubt the correct delimitation of Churches is most beneficial. Considering this seriously, Our venerable brother Augustus Alvarus da Silva, Archbishop of the metropolitan Church of St. Saviour in Brazil, and having especially before his eyes that his archdiocese is very populous in the number of its inhabitants and extends over a very wide territory, earnestly petitioned the Apostolic See that it be divided into two parts and a new diocese be erected from it. We therefore, having consulted with the venerable brothers, Our Eminences the Cardinals placed over the Sacred Consistorial Congregation, and having obtained the favorable vote of Our venerable brother Benedict Aloisi Masella, Archbishop with the title of Caesarea in Mauretania, and Apostolic Nuncio with the Brazilian Republic, having weighed all things carefully, have deemed it right to accede to the prayers of the aforesaid Archbishop of St. Saviour. Wherefore, having supplied, insofar as it is necessary, the consent of those to whom it pertains or who presume it pertains to them, by the fullness of Apostolic power, We separate from the archdiocese of St. Saviour in Brazil a portion of territory which comprises the following parishes: Bomfim, Abaré, Bom Conceição do Conselho, Campo Formoso, Coite, Geremoabo, Itiuba, Jacobina, Cumbe, Capim Grosso, Morro de Chapéu, Monte Santo, Queimadas, Brejo de Jacobina, Brejo de Itiúba, Sande, St. Anthony of Glory, Bombai, Tucano, Vana. All the territory formed by these parishes, We erect into a new diocese, which We will that be called the Diocese of Bomfim, from the city of Bomfim, in which We establish the episcopal see. The parish church dedicated to the Lord of Bomfim, standing in the same city, We raise to the rank and dignity of a cathedral church. To this newly erected diocese and to its cathedral Church and to its Bishops for the time being, We grant all the rights, honors, insignia, privileges, favors and graces with which the other cathedral Churches and their Prelates by common law or legitimate custom in Latin America enjoy and possess; likewise We bind the Bishops themselves and their cathedral Church with all the burdens and obligations with which other Prelates and their Churches are bound by common law. We further decree that this new diocese of Bomfim shall be suffragan to the metropolitan Church of St. Saviour in Brazil; and therefore We subject its Bishops for the time being to the metropolitan authority of the Archbishop of St. Saviour. Since, however, the circumstances of the present time do not permit that a chapter of canons be instituted in this new diocese in the usual manner, We grant that diocesan consultors be elected in place of canons for the time being according to the law. We further command that a small seminary at least of the diocese, according to the prescriptions of the Code of Canon Law and the norms handed down by the Sacred Congregation for Seminaries and Universities of Studies, be erected as soon as it can be done; and likewise that at its own expense from this new diocese of Bomfim two chosen young men, or at least one, be sent to the Pontifical Pius Latin Seminary of the City without interruption, who may be trained under Our very eyes as a hope for the Church. As regards the governance and administration of this diocese, the election of a Vicar Capitular when the see is vacant, the rights and duties of clergy and faithful and other such matters, We command that what the sacred canons prescribe be duly observed. As for what pertains especially to the clergy, We decree that, as soon as the erection of this new diocese is mandated for execution, all clergy who legitimately dwell in its territory shall by that very fact be considered enrolled in the same church. The endowment and episcopal mensa shall be constituted by all emoluments and other offerings which are accustomed to be provided by the faithful, for whose good the diocese itself has been erected, except those which have already been collected for this purpose. Finally, We will and command that all documents and acts concerning this new diocese and its clergy and faithful be transferred from the chancery of St. Saviour in the archdiocese of Brazil to the episcopal curia of this new diocese as soon as it can be done, so that they be duly preserved in its archive. All things being thus disposed and constituted as above, for mandating all the same to execution, We appoint the venerable brother Benedict Aloisi Masella, whom We mentioned above, Our Nuncio in the Brazilian Republic, and We grant to him all necessary and opportune faculties, both for settling all and singular controversies arising in any way in the act of execution, and for subdelegating for the purpose in question any man constituted in ecclesiastical dignity or office; and We impose upon him the duty of transmitting to the Sacred Consistorial Congregation an authentic copy of the acts of execution performed within six months to be reckoned from the date of these Letters. Finally, We will that to copies of these Letters, even printed ones, subscribed however by the hand of some public Notary and furnished with the seal of some man constituted in ecclesiastical dignity or office, the same faith be given as would be given to these Letters if they were exhibited or shown in the original. Notwithstanding, insofar as it is necessary, the rules established in synodal, provincial, general and universal Councils, special or general Apostolic constitutions and ordinances, and any other dispositions of Our predecessors the Roman Pontiffs and all other things to the contrary whatsoever. Let no one be permitted to infringe this page of dismemberment, erection, elevation, concession, statute, derogation, mandate and Our will, or to act contrary to it. If anyone, however, shall presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the blessed Peter and Paul, His Apostles.
