VIENE ERETTO UN VESCOVO SERVORUM MEMORIA PERPETUA DELLA COSA DI DIO

1 Il bene delle anime esige che le diocesi, le quali a causa della eccessiva ampiezza del territorio non possono essere rette da un solo Pastore, per quanto diligentissimo, vengano smembrate e da esse si costituiscano nuove circoscrizioni ecclesiastiche. Poiché dunque risulta che i fedeli della regione intorno al fiume Xingu nello Stato del Parà nella Repubblica Brasiliana si trovano a distanza lunghissima dalle sedi dei loro Ordinari e perciò sono quasi privi di sussidi spirituali, Noi abbiamo ritenuto di dover provvedere a tale necessità.

2 Perciò, consultati i venerabili Nostri fratelli Eminentissimi Cardinali preposti alla Sacra Congregazione Concistoriale, e avuto inoltre il consenso dei venerabili fratelli, tanto di Antonio Lustosa, Arcivescovo di Belém del Parà, quanto di Amando Agostino Bahlmann, Vescovo titolare di Argo, Prelato nullius di Santarém, quanto di Sebastiano Tommaso, Vescovo titolare di Plateia, Prelato nullius della Santissima Concezione di Araguaia, e avuto inoltre il parere del venerabile fratello Benedetto Aloisi Masella, Arcivescovo titolare di Cesarea in Mauritania, Nostro Nunzio presso la Repubblica Brasiliana, e supplito, per quanto occorra, il consenso di coloro che vi hanno interesse, o di coloro che presumono di averne interesse, dopo aver maturo esame di tutte le cose, con la pienezza della potestà apostolica stabiliamo e decerniamo quanto segue: Il territorio della regione di cui sopra intorno al fiume Xingu, che forma due municipi, cioè Porto de Moz e Altamira, dei quali il primo comprende due parrocchie, cioè Porto de Moz e Soîizet, il secondo invece una sola, dello stesso nome del municipio, cioè Altamira, dall'arcidiocesi di Belém del Parà e dalle prelature nullius di Santarém e della Santissima Concezione di Araguaia, per la parte che a ciascuna spetta, lo separiamo e lo dividiamo e lo erigiamo in una nuova e distinta prelatura nullius dal fiume Xingu, da chiamarsi Xinguense, e per mezzo delle presenti la dichiariamo eretta.

3 I confini di questa nuova prelatura saranno dunque gli stessi dei due municipi, dai quali, come abbiamo detto, essa è costituita, come attualmente esistono. La sede di questa nuova prelatura Xinguense la stabiliamo nella città di Porto de Moz; la chiesa poi dedicata a Dio in onore di san Biagio, che esiste nella medesima città, la eleviamo al grado di chiesa prelattizia, e a essa e ai suoi Prelati per il tempo concediamo tutti i diritti e i privilegi di cui godono per diritto comune le altre chiese prelattizie e i loro Prelati, con gli annessi oneri e obbligazioni.

4 Questa prelatura Xinguense la costituiamo suffraganea della Chiesa metropolitana di Belém del Parà, e i suoi Prelati li sottoponiamo al diritto metropolitico dell'Arcivescovo di Belém del Parà. Poiché però le circostanze del presente tempo e le condizioni delle cose non permettono che in questa nuova prelatura si istituisca subito un Capitolo di Canonici, concediamo che nel frattempo, in luogo dei canonici, si eleggano Consultori diocesani.

5 Per quanto poi riguarda il governo e l'amministrazione di questa prelatura, i diritti e gli oneri dei chierici e dei fedeli e altre cose di questo genere, da osservarsi debitamente, ordiniamo che si osservino le prescrizioni dei sacri canoni, salve le disposizioni del Concilio Plenario dell'America Latina celebrato a Roma nell'anno milleottocentonovantanove. Riguardo al clero in particolare stabiliamo che, non appena l'erezione della prelatura sia stata mandata ad esecuzione, per ciò stesso i chierici si considerino ascritti a quella chiesa nel cui territorio legittimamente si trovano. Come dote poi di questa prelatura assegniamo e attribuiamo le offerte, i sussidi e i beni qualunque che a questo scopo in futuro saranno conferiti, oltre a quelli che già sono stati raccolti. Stabiliamo inoltre che da questa prelatura ora eretta, e a sue spese, due giovani scelti, o almeno uno per il momento, siano inviati senza interruzione al Seminario Pontificio Brasiliano dell'Urbe, affinché ivi, quasi sotto gli occhi del Romano Pontefice, siano formati a speranza della Chiesa. Ordiniamo infine che tutti i documenti e gli atti che riguardano i territori dai quali questa nuova prelatura è formata, siano consegnati al più presto possibile dai cancellieri dell'arcidiocesi di Belém del Parà nonché dalle prelature di Santarém e della Santissima Concezione di Araguaia alla Curia della prelatura Xinguense, affinché nel suo archivio siano religiosamente conservati.

6 Poiché dunque le cose sono disposte come sopra, incartichiamo della loro esecuzione colui che abbiamo sopra nominato, il venerabile fratello Benedetto Aloisi Masella, Nunzio Apostolico nella Repubblica del Brasile, e per questo gli attribuiamo le facoltà necessarie e opportune, anche di subdelegare a tale scopo qualunque uomo costituito in dignità o ufficio ecclesiastico, e imponiamo l'obbligo alla Sacra Congregazione Concistoriale di trasmettere entro sei mesi, da computarsi dalla data di queste Lettere, un esemplare autentico degli atti dell'esecuzione compiuta. Vogliamo inoltre che ai transunti di queste Lettere, anche se stampati, purché sottoscritti di mano di qualche notaio pubblico e muniti del sigillo di un uomo costituito in dignità o ufficio ecclesiastico, sia attribuita la medesima fede che sarebbe attribuita a queste Lettere se fossero presentate o mostrate. Le presenti Lettere e tutto ciò che in esse è contenuto, anche per il fatto che chiunque abbia interesse, o coloro che presumano di avere interesse, non siano stati ascoltati o non abbiano consentito alle premesse, anche se degni di menzione espressa, specifica e individuale, non possono in nessun tempo essere notate, impugnate o messe in controversia per vizio di subreptizio o di obreptizio o di nullità, o per difetto di Nostra intenzione, o per qualunque altro difetto, anche sostanziale e inaspettato; ma esse, come fatte e emanate da certa scienza e da pienezza di potestà, rimangono e rimangono perpetuamente valide e producono e ottengono i loro pieni e interi effetti, e devono essere inviolabilmente osservate da tutti coloro a cui spetta; e se diversamente su queste cose da chiunque, con qualunque autorità, consapevolmente o inconsapevolmente fosse tentato, vogliamo e decretiamo che sia completamente irritum e vano. Non ostante, per quanto sia necessario, le regole edite nei Concili sinodali, provinciali, generali e universali, le Costituzioni e Ordinazioni Apostoliche speciali o generali e qualunque altra disposizione dei Nostri Predecessori Romani Pontefici e tutte le altre cose contrarie, alle quali tutte per queste presenti deroghiamo. A nessuno sia lecito infrangere queste Nostre Lettere di dismembrazione, erezione, evazione, subiazione, concessione, statuto, deroga, mandato e Nostra volontà, o contravvenire ad esse. Se qualcuno invece presumesse di tentare ciò con audacia temeraria, sappia che incorrerà nell'indignazione di Dio onnipotente e dei beati Apostoli Pietro e Paolo.

Blasii dicatam, in eadem urbe exstantem, ad gradum ecclesiae praelatitiae evehimus, eique eiusque pro tempore Praelatis omnia concedimus iura et privilegia quibus ceterae praelatitiae ecclesiae earumque Praelati iure communi gaudent, cum adnexis oneribus et obligationibus.

4 Hanc autem praelaturam Xinguensem suffraganeam constituimus metropolitanae Ecclesiae Belemensis de Para, eiusque Praelatos metropolitico iuri Archiepiscopi Belemensis de Para subiicimus. Quum vero praesentis temporis rerumque adiuncta haud permittant ut Canonicorum Capitulum in hac nova praelatura modo instituatur, indulgemus ut interim, pro cano-^ nicis, Consultores dioecesani eligantur.

5 Quod insuper attinet ad huius praelaturae regimen et administrationem, ad ipsorum clericorum et fidelium iura et onera aliaque huiusmodi, rite servanda, iubemus quae sacri canones praescribunt, sartis tectisque dispositionibus Concilii Plenarii Americae Latinae anno millesimo octingentesimo nonagésimo nono Bomae celebrati. Quoad clerum praecipue spectat statuimus ut, simul ac praelaturae erectio ad exsecutionem mandata fuerit, eo ipso clerici ecclesiae illi censeantur adscripti in cuius territorio legitime exstant. 6 Rebus itaque ut supra dispositis, ad eadem omnia exsecutioni mandanda deputamus quem supra diximus venerabilem fratrem Benedictum Aloisi Masella in Brasiliana Republica Nuntium Apostolicum, eidemque propterea necessarias et opportunas tribuimus facultates etiam subdelegandi ad effectum de quo agitur quemlibet virum in ecclesiastica dignitate vel officio constitutum, atque onus imponimus ad Sacram Congregationem Consistorialem intra sex menses, ab his Litteris datis computandos, authenticum exemplar transmittendi peractae exsecutionis actorum. A BISHOP IS ERECTED FOR AN ETERNAL MEMORIAL OF THE MATTER OF GOD

1 The good of souls demands that dioceses, which on account of the excessive extent of their territory cannot be governed by one, however diligent, Pastor, be dismembered and from them new ecclesiastical circumscriptions be established. Since therefore it is established that the faithful of the region around the river Xingu in the State of Para, in the Brazilian Republic, are situated at a very great distance from the sees of their Ordinaries and on this account are almost deprived of spiritual assistance, We have deemed it necessary to provide for so great a need.

2 Wherefore, having consulted with the venerable brothers Our Eminences the Cardinals presiding over the Sacred Consistorial Congregation, and having also obtained the consent of the venerable brothers, both Anthony Lustosa, Archbishop of Belem of Para, and Amandus Augustine Bahlmann, Bishop with the title of Argensis, Prelate nullius of Santarem, and Sebastian Thomas, Bishop with the title of Plataeensis, Prelate nullius of the Most Holy Conception of Araguaya, and having moreover obtained the suffrage of the venerable brother Benedict Aloysius Masella, Archbishop with the title of Caesariensis in Mauretania, Our Nuncio in the Brazilian Republic, and having supplied, insofar as it may be necessary, the consent of those to whom it pertains, or of those who presume it to pertain to them, all things having been maturely considered, by the fullness of apostolic power We establish and decree the following: The territory of the region which We have mentioned above around the river Xingu, forming two municipalities, that is Porto de Moz and Altamira, of which the first comprises two parishes, namely Porto de Moz and Soîizet, while the other comprises only one, of the same name as the municipality, namely Altamira, We separate and sever from the archdiocese of Belem of Para and from the prelatures nullius of Santarem and of the Most Holy Conception of Araguaya, each in the part pertaining to it, and We erect into a new and distinct prelature nullius to be called Xinguensian from the river Xingu, and We declare it erected by these presents.

3 The boundaries of this new prelature shall therefore be the same as those of the two municipalities by which, as We have said, it is constituted, as they now exist. We establish the see of this new Xinguensian prelature in the city of Porto de Moz; and the church dedicated to God in honour of St. Blaise, existing in the same city, We elevate to the rank of a prelatic church, and to it and to its Prelates for the time being We grant all the rights and privileges which other prelatic churches and their Prelates enjoy by common law, with the annexed burdens and obligations.

4 We constitute this Xinguensian prelature as suffragan to the metropolitan Church of Belem of Para, and We subject its Prelates to the metropolitan authority of the Archbishop of Belem of Para. Since, however, the circumstances of the present time do not permit that a Chapter of Canons be instituted in this new prelature at this time, We grant that in the meantime, in place of canons, diocesan Consultors be elected.

5 Moreover, as regards the governance and administration of this prelature, the rights and burdens of its clergy and faithful and other such matters, to be duly observed, We command that which the sacred canons prescribe, with the provisions of the Plenary Council of Latin America celebrated at Rome in the year one thousand eight hundred and ninety-nine being preserved intact. As regards the clergy in particular, We establish that, as soon as the erection of the prelature shall have been mandated for execution, by that very fact the clergy shall be considered ascribed to that church in whose territory they legitimately exist. Moreover, We assign and attribute to the endowment of this prelature the offerings, subsidies and whatever goods shall hereafter be contributed for this purpose, apart from those which have already been collected. We establish also that from this prelature, now likewise erected, and at its expense for support, two chosen young men, or at least one for the present, shall be sent without interruption to the Pontifical Brazilian Seminary in the City, so that there, almost under the eyes of the Roman Pontiff, they may be trained in hope for the Church. Finally, We command that all documents and acts which concern the territories from which this new prelature is formed shall be handed over as soon as possible by the chancelleries of the archdiocese of Belem of Para as well as of the prelatures of Santarem and of the Most Holy Conception of Araguaya to the Curia of the Xinguensian prelature, so that they may be religiously preserved in its archive.

6 Accordingly, with all things arranged as above, We appoint to carry out all these matters the venerable brother Benedict Aloisi Masella, Apostolic Nuncio in the Brazilian Republic, whom We mentioned above, and for this reason We grant to him the necessary and opportune faculties, even to subdelegate for the purpose in question any man constituted in ecclesiastical dignity or office, and We impose upon the Sacred Congregation of Consistorial Affairs the duty of transmitting to Us within six months, to be reckoned from the date of these Letters, an authentic copy of the acts of the execution accomplished. We further will that copies of these Letters, even if printed, subscribed however by the hand of some public notary and furnished with the seal of a man constituted in ecclesiastical dignity or office, shall be accorded the same faith as would be accorded to these Letters themselves if they themselves were exhibited or shown. But these present Letters and whatever is contained in them, even from the fact that anyone concerned, or those who presume their interest to be involved, have not been heard or have not consented to the foregoing, even if they should be worthy of express, specific and individual mention, can at no time ever be noted, impugned or called into question on account of the vice of subreption or obreption or nullity, or of Our intention, or any other defect, however substantial and unforeseen; but they, as made and emanated from certain knowledge and fullness of power, shall exist perpetually valid and shall be, and shall produce and obtain their full and complete effects, and ought to be inviolably observed by all to whom it pertains; and if otherwise anything contrary to these should at any time be attempted by anyone, by whatever authority, knowingly or unknowingly, We will and decree that it shall be entirely null and void. Notwithstanding, insofar as it may be necessary, the rules established in synodal, provincial, general and universal Councils, special or general Apostolic Constitutions and Ordinances and any other dispositions of Our Predecessors the Roman Pontiffs and all other things to the contrary whatsoever, all of which by these presents We derogate. Let no one be permitted to infringe these Our Letters concerning dismemberment, erection, evection, subjection, concession, statute, derogation, mandate and Our will, or to act contrary to them. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
