3 1 Corp. iur. can. Clem. I, 1; cfr. supra n. 158, not. 1 (p. 65 not. 7), et Archiv fur Litt. - u. Kirchengeschichte III, 24. 8 Testimone Giacomo Stefaneschi s. Cfr. Ehrle in illo periodico: Archiv fur Litt . - u. Kirchengeschichte V, 579.

Cfr. litteras eorundem magistrorum ad Ioannem XXII scriptas, in Chart. U?iiv. Paris . t. II, p. 238, n. 790 relatas.

3 CLEMENTE V (An. VII - 1312)

196 . Sacro concilio Viennensi approbante definit quaedam circa fidem catholicam illa constitutione dogmatica, qua implicite damnantur nonnulli errores, qui vulgo dicuntur fuisse fratris Petri Ioannis Olivi ord. Min. 1 [1312, maii 6, Viennae.] !

3 1 Corp. iur. can. Clem. I, 1; cfr. supra n. 158, not. 1 (p. 65 not. 7), et Archiv fur Litt. - u. Kirchengeschichte III, 24. 8 Teste Iacobo Stefaneschi s. Cfr. Ehrle in illo periodico: Archiv fur Litt . - u. Kirchengeschichte V, 579.

2 8 Aliquot annis post, videlicet circa a. 1319, nonnulli magistri theologiae (Guido prior gen. ord. Carm., Bertrandus de Turre minister prov. Aquitaniae ord. Min., Guilelmus de Lauduno lector s. palatii ord. Praed., Nicolaus de s. Iusto decanus s. Quintini, Laurentius Anglicus ord. s. Ben., Simon Anglicus ord. Carm., Arnaldus Roiardi ord. Min., Petrus de Palude ord. Praed.) mandante Ioanne papa XXII postillam supra Apocalypsim a fr. 3 CLEMENS V (An. VII - 1312)

4 196 *. Instante et approbante concilio Viennensi cassat constitutionem Benedicti XI Inter cunctas et illam Bonifatii VIII Super cathedram innovat. 1 [1312, maii 6, Viennae.] Dudum a Bonifatio papa VIII praedecessore nostro infra scripta edita decretali, Benedictus papa XI praedecessor noster aliam illius revocatoriam promulgavit, quae, quia (ut probavit effectus) nedum pacis ab auctore ipsius speratae fructum non attulit, quin immo discordia, pro qua sedanda processerat, fomentum non modicum ministravit. Nos eam omnino cassantes, aliam a praefato Bonifatio editam sacro instante et approbante concilio innovamus; subiicientes tenorem illius, qui dignoscitur esse talis: « Bonifatius etc. Super cathedram etc. usque minime praeteriret ».

* 1312, maii 9, Viennae.

6 Dilecto filio Gerardino 8 electo Lunen. 4 Cura pastoralis officii etc. Dat. Viennae, VII idus maii, anno septimo.

196. The Sacred Council of Vienne approving, defines certain matters concerning the Catholic faith by that dogmatic constitution, in which implicitly are condemned certain errors, which are commonly said to have been those of Brother Peter John Olivi of the Order of Minors.1 [6 May 1312, at Vienne.]

1 Firmly adhering to the foundation of the Catholic faith, beyond which, as the Apostle testifies, no one can lay another, we openly confess together with holy mother the Church that the only-begotten Son of God, in all things in which God the Father exists, subsisting eternally together with the Father, took up into the unity of His hypostasis and person the parts of our nature united together, by which He Himself, existing as true God in Himself, would become true man, namely a human body capable of suffering and a rational or intellectual soul truly informing that body through itself and essentially, from time in the virginal chamber; and that in this assumed nature the Word of God Himself, for working the salvation of all, not only willed to be affixed to the cross and to die upon it, but also, having already given up His spirit, endured that His side be pierced by a lance, so that "from the waters flowing forth, water and blood" might form the unique and immaculate and virgin holy mother Church, the spouse of Christ, just as from the side of the first man in sleep Eve was formed for him as a spouse, so that thus the truth might correspond to the figure of the first and old Adam, who according to the Apostle is the form of the one to come, in our last Adam, that is Christ. This is, I say, the truth of that very great eagle surrounded by the testimony, which the prophet Ezechiel saw flying past the other evangelical animals, namely of the blessed John the Apostle and Evangelist, who, narrating the event of this sacrament and its order in his Gospel, said: "But when they came to Jesus, and saw that He was already dead, they did not break His legs; but one of the soldiers opened His side with a lance, and immediately there came out blood and water; and he that saw it hath given testimony, and his testimony is true. And he knoweth that he saith true, that you also may believe." We therefore, turning the keen attention of apostolic consideration, to which alone it pertains to declare these things, to so illustrious a testimony and to the common judgment of the holy fathers and doctors, with the sacred council approving, declare that the aforesaid Apostle and Evangelist John held the correct order of the deed done from the premises, narrating that when Christ was already dead, one of the soldiers opened His side with a lance. Moreover, we reprobate, with the sacred council approving, every doctrine or position rashly asserting or turning into doubt that the substance of the rational or intellectual soul is not truly and through itself the form of the human body, as erroneous and hostile to the truth of the Catholic faith, defining, so that the truth of sincere faith may be known to all and access be cut off to all errors lest they creep in, that whoever hereafter shall presume to assert, defend, or obstinately hold that the rational or intellectual soul is not the form of the human body through itself and essentially, shall be deemed a heretic. To this end baptism, the one baptism regenerating all the baptized in Christ, just as there is one God and one faith, is to be faithfully confessed by all, which we believe to be celebrated in water in the name of the Father and of the Son and of the Holy Spirit, a remedy equally perfect for salvation for both adults and infants. But because concerning the effect of baptism in infants certain doctors and theologians are found to have held contrary opinions (some of them saying that through the virtue of baptism guilt is indeed remitted to infants, but grace is not conferred, others on the contrary asserting that both guilt is remitted to them in baptism and virtues and informing grace are infused as to habit, even if not for that time as to use): we however, attending to the general efficacy of the death of Christ, which is likewise applied through baptism to all the baptized, have deemed it fitting, with the sacred council approving, to choose the second opinion, which says that informing grace and virtues are conferred in baptism to both infants and adults alike, as the more probable and more consonant and in accord with the sayings of the holy fathers and modern doctors of theology.

2 8 Some years later, namely about the year 1319, certain masters of theology (Guido prior general of the Order of Carmelites, Bertrand of Torre minister provincial of Aquitaine of the Order of Minors, William of Laudun lector of the sacred palace of the Order of Preachers, Nicholas of St. Just dean of St. Quentin, Lawrence the Englishman of the Order of St. Benedict, Simon the Englishman of the Order of Carmelites, Arnold Roiardi of the Order of Minors, Peter of Palude of the Order of Preachers) at the command of Pope John XXII examined the postil upon the Apocalypse written by Brother Peter John Olivi and rejected sixty theses from it. Cfr. the letters of these same masters written to John XXII, in Chart. Univ. Paris, t. II, p. 238, n. 790 cited.

3 CLEMENT V (Year VII - 1312)

4 196 *. At the urging and approval of the Council of Vienne he annuls the constitution of Benedict XI Inter cunctas and renews that of Boniface VIII Super cathedram. 1 [1312, 6 May, Vienne.] Whereas the following was issued by Boniface, our predecessor as pope, and set forth below in a decretal, Benedict, our predecessor as pope, promulgated another revoking it, which, because (as the outcome proved) it not only failed to bring forth the fruit of peace hoped for by its author, but rather furnished no small fuel to the discord which it had proceeded to settle. We, annulling it entirely, renew another issued by the aforesaid Boniface, the sacred council urging and approving; submitting the tenor of it, which is known to be as follows: "Boniface etc. Super cathedram etc. down to would by no means be passed over".

5 197 . Gerardinus, then pleban of the parish of Campo Lucan. of the diocese, who together with his brother William of the Order of Minors had been elected in discord as bishop of Lunen., both elections being annulled, from the fullness of apostolic power he appoints to the church of Lunen. as bishop. * 1312, 9 May, Vienne.

6 To our beloved son Gerardinus 8 elect of Lunen. 4 Pastoral care of the office etc. Given at Vienne, 7 May, in the seventh year.
