Annus vero canonicus novitiatus, severa disciplina, in eremo peragatur.

OF THE HERMITS OF CAMALDOLI OF ETRURIA. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 Among the religious communities with which the Church of Christ flourishes, the Camaldolese Institute is numbered, which, under the authorship of St. Romuald, the restorer of the eremitical life in the West, has developed in such a way that the cenobium and the hermitage continually extend friendly hands to one another for the fostering of regular discipline. For the Camaldolese cenobium, by virtue of its very origin, is as it were a seminary of Hermits and a place of initial probation, in which those whom divine vocation leads to the hermitage, to be devoted solely to the contemplation of eternal things, ought gradually to be initiated into ascetic austerity, imbued with monastic institutions, and furnished with all the aids of spiritual life. Although in the course of time, for various reasons, it seemed good to the Apostolic See to permit that a monastic Congregation of Camaldolese Coenobites should arise entirely separate from the Hermits, yet with the circumstances of things and persons changed today, it appears more necessary that the unity of the family be restored, especially to this end, that the Camaldolese Institute, with all forces joined together, may be strengthened hereafter and, by the favor of God's grace, may increase day by day. Therefore, having weighed all matters of importance with attentive and careful study, having supplied, insofar as it is necessary, the consent of those to whom it pertains or of those who presume their interest to be involved, we decree and establish the following by the fullness of apostolic power, by the tenor of these presents: I) The Congregation of Monks Coenobites of Camaldoli is united to the Congregation of Hermits of Camaldoli of Etruria, which henceforth shall assume the title: Congregation of Monks Hermits of Camaldoli of the Order of St. Benedict. II) The Superior General, the name of Major being laid aside, shall be called Prior General, who shall assume the governance of the entire Congregation and of the Sacred Hermitage of Camaldoli, where he shall have his habitual residence. III) The Prior General, during his term of office, shall enjoy all the rights and privileges abbatial, which have hitherto been granted to the Major by the Supreme Pontiffs. IV) Henceforth let no candidates be admitted to the hermitage unless they have been diligently tested in the cenobium for a full year and imbued with monastic institutions. Moreover, the canonical year of novitiate shall be spent in the hermitage under strict discipline. V) That no doubt may arise hereafter, the Constitutions by which the Hermits of Camaldoli of Etruria are now governed shall be duly conformed to all things which these Our Letters and special instructions to be issued contain.

2 VI) Since the new manner of living which is being established is more austere, and since no burden ought to be imposed upon anyone which he has not willingly undertaken, it shall be permitted to individual Monks and Lay Brothers of the Camaldolese Monasteries who are unwilling to give the name of Congregation of Eremite Monks to that which we have mentioned above, to transfer, with the observance of what must be observed by law, to another religious community which will receive them; or, if anyone ordained in sacred orders is unwilling to transfer to another Institute, let him find a benevolent Bishop as receiver, who may wish to incardinate him to his own diocese. VII) If there are any, however, who neither wish to transfer to another religious Institute nor to be enrolled in the secular clergy, we decree that they be gathered together in a single house according to a manner to be determined. VIII) All the goods of the Congregation of Camaldolese Cenobitic Monks shall be transferred to the Congregation of Camaldolese Eremite Monks of the Order of St. Benedict. To execute all these matters, we appoint our beloved Son Raphael Charles, of the title of St. Praxedes, Cardinal Bossi, Priest of the Holy Roman Church, Protector of the Camaldolese Cenobitic Monks, and we therefore grant to him the necessary and opportune faculties, including the power to subdelegate for the purpose in question any man constituted in ecclesiastical dignity, as well as to settle all controversies arising in any way in the course of execution; and we impose upon him the duty of transmitting to the Sacred Congregation for Religious a report of the execution completed. These present Letters and all things contained therein can never at any time be noted, impugned, or called into question on account of any defect of subreption, obreption, or nullity, or of our intention, or any other substantial and unforeseen defect, but they shall exist as perpetually valid and shall be, having been made and emanated from certain knowledge and fullness of power, and shall obtain and secure their full and complete effects, and ought to be inviolably observed by all to whom it pertains, with any faculty of judging or interpreting otherwise removed; and if it should happen that anything contrary to these matters be attempted by anyone, of whatever authority, knowingly or unknowingly, we will and decree that it be entirely null and void. Notwithstanding, insofar as it is necessary, the rules established in synodal, provincial, general, and universal Councils, special or general Apostolic constitutions and ordinances, and any other dispositions of our Predecessors the Roman Pontiffs, and all other things to the contrary whatsoever. We will, moreover, that to copies of these Letters, even printed ones, subscribed, however, by the hand of some public Notary and furnished with the seal of some man constituted in ecclesiastical dignity, there be given in court and outside it the same full faith which would be given to these presents, if they themselves were exhibited or shown. Let no one, therefore, presume to infringe this page of our union, statute, concession, decree, mandate, derogation, and will, or to act contrary to it. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul.

3 Given at Rome at St. Peter's, in the year of the Lord one thousand nine hundred thirty-five, on the second day of the month of July, in the fourteenth year of our Pontificate.
