DECRETO SULLA EREZIONE DELLA NUOVA DIOCESI « DI ALAGOAS » NELLA REPUBBLICA BRASILIANA

1 In questi tempi presso la Sede Apostolica tanto il Presidente e il Governo, quanto i principali esponenti del Clero e del popolo dello stato civile comunemente detto di Alagoas nella Repubblica Brasiliana hanno insistito ripetutamente con istanze pressanti, affinché il medesimo stato o regione di Alagoas, che attualmente appartiene al territorio e alla giurisdizione spirituale della diocesi di Olinda, fosse da essa separato e eretto in diocesi propria e distinta. In questa materia fu rappresentato a Sua Santità il Nostro Signore Leone PP. XIII che da questa erezione sarebbe derivato un frutto salutare e copioso verso i fedeli della predetta regione, concorrendo anche gli uffici del R. P. D. Giuseppe Macchi, Arcivescovo titolare di Tessalonica, Internunzio Apostolico, il quale dichiarò che tale opera di provvidenza apostolica non solo era utile ma anche necessaria nella predetta regione. Sua Santità, dopo aver maturo considerato tutto, e volendo provvedere nel miglior modo possibile alla procurazione della cosa sacra e alla salvezza spirituale delle anime nel predetto stato civile, ha ritenuto di dover benignamente accogliere le istanze presentate, e ha decretato che una diocesi propria e distinta fosse eretta nel territorio dello stato civile di Alagoas nella Repubblica Brasiliana con la pienezza della potestà apostolica, nel modo che segue.

2 Innanzitutto dunque Sua Santità ha diviso, separato e disgiunto dallo stato civile comunemente detto di Alagoas, il quale, quanto alla procurazione spirituale, attualmente è sottoposto alla diocesi di Olinda, e che è contenuto entro i confini qui sotto descritti, dalla medesima diocesi di Olinda, erigendolo in diocesi nuova e distinta, e con questa dismembrazione e separazione ha perpetuamente assegnato e attribuito il predetto stato e il suo territorio alla diocesi del nuovo Episcopato di Alagoas, dove il nuovo Vescovo e i suoi successori nell'Episcopato dovranno sempre risiedere, e ha perpetuamente esentato, disgiunto e sottoposto alla Chiesa episcopale di Alagoas, da erigersi come infra, e al suo futuro Presule tutti gli abitanti e gli abitanti di ambo i sessi, tanto laici quanto chierici e religiosi non tuttavia esenti, che dimorano nel medesimo stato, nonché le Chiese, i Conventi, i Monasteri, i pii Istituti, se ve ne siano, e tutti gli altri benefici sia secolari che regolari dalla giurisdizione ordinaria dell'Antistitite di Olinda, nonché da ogni diritto del Capitolo e dei Canonici della medesima Chiesa cattedrale di Olinda, per sempre.

3 Inoltre Sua Santità ha decretato che la città Maceió comunemente così denominata, che è il capoluogo dello stato civile di Alagoas, sia eretta in città episcopale della nuova diocesi di Alagoas da denominarsi, con i suoi diritti, onori e prerogative, di cui godono e si avvalgono le altre città esistenti nella Repubblica Brasiliana insignite dalla Sede pontificale e i loro cittadini.

III.

4 La Chiesa matrice poi esistente nella suddetta città di Maceió, Sua Santità ha degnato di costituire in Chiesa episcopale e cattedrale della nuova diocesi sotto il titolo e l'invocazione della Nostra Signora dei Piaceri da denominarsi, e in essa la Sede e la dignità episcopale per un Vescovo di Alagoas da chiamarsi, il quale presiedesse alla medesima Chiesa e alla medesima città e diocesi, da costituirsi come infra, convochi il Sinodo, e abbia ed eserciti tutti e singoli i diritti, gli uffici e i compiti episcopali con il suo Capitolo, la mensa episcopale, e gli altri insegni cattedrali e pontificali, le giurisdizioni, le prerogative, i privilegi, gli onori, le grazie e gli indulti reali personali e misti, di cui godono e potranno godere le altre Chiese cattedrali esistenti nella Repubblica Brasiliana e i loro Presuli non tuttavia con titolo oneroso o da indulto particolare, di erigerla e istituirla con la pienezza della potestà apostolica.

5 A questa nuova diocesi da denominarsi di Alagoas Sua Santità ha assegnato e attribuito tutto il territorio dello stato civile, cioè di Alagoas, conservando l'ambito medesimo e i medesimi confini entro i quali il medesimo territorio è attualmente geograficamente e politicamente definito e circoscritto, la cui estensione territoriale si estende per quattrocentonovantuno chilometri quadrati oltre cinquecentottomila chilometri quadrati, nel quale gli abitanti secondo le più recenti tavole censuali si numerano quattrocentoquarantuno abitanti oltre cinquecentoundici migliaia, e le parrocchie matrici trentaquattro. Tutto infine il territorio è terminato a settentrione e a occidente dallo stato civile di Pernambuco, a meridione dagli stati di Bahia e Sergipe secondo il fiume di san Francesco fino alla sua foce atlantica, a oriente infine è terminato dall'oceano atlantico.

6 Poiché tuttavia è massimamente importante provvedere ai necessari proventi e redditi della mensa episcopale di Alagoas, Sua Santità lo desidera vivamente e confida che il Governo dello stato civile di Alagoas, nonché i fedeli di questa regione, la cui pietà e religione sono sommamente lodevoli, e per la cui utilità spirituale la Sede Apostolica si è impegnata con l'erezione di questo nuovo Vescovato, con pia liberalità e convenienti offerte forniscano aiuto e sussidi, affinché il nuovo Vescovo e i suoi Successori possano degnamente mantenere la dignità episcopale, e affinché si provveda opportunamente al culto divino, alle necessità dei ministri sacri e alle opere diocesane, dal momento che alla nuova diocesi non sono disponibili altri beni temporali, se non quelli che provengono dalla pietà e dalla buona volontà dei fedeli con massimo loro vantaggio spirituale.

7 Il nuovo Vescovo della Chiesa cattedrale eretta come sopra avrà cura di erigere il Capitolo secondo le sanzioni canoniche, non appena sarà possibile, osservato il numero dei canonici, osservate le medesime dignità delle altre Chiese cattedrali, che si trovano legittimamente costituite nella Repubblica Brasiliana. Nel frattempo, finché il Capitolo cattedrale non sia costituito, il Vescovo si assumerà un consiglio di uomini provati e prudenti, e si varrà dell'aiuto della loro prudenza nel disbrigo dei maggiori affari della sua diocesi.

8 Quando poi il Capitolo della Chiesa cattedrale sarà canonicamente eretto, Sua Santità gli conferisce la facoltà di redigere statuti, ordinazioni e decreti secondo le prescrizioni dei sacri Canoni e specialmente del sacro Concilio Tridentino, che tuttavia dovranno essere sottoposti alla cognizione e approvazione dell'Ordinario Antistite, nonché la facoltà di godere di tutti i privilegi alla stessa stregua degli altri Capitoli cattedrali esistenti nella Repubblica Brasiliana, non però acquisiti con titolo oneroso o da indulto particolare.

VIII.

9 Sua Santità desidera e comanda vivamente che il nuovo Vescovo della diocesi di Alagoas dia opera sollecita e diligente alla costituzione di un Seminario di alunni sacri secondo i precetti del Concilio Tridentino nella sua diocesi, non appena sarà possibile, adoperando ogni cura affinché in esso la pietà e la probità dei costumi degli alunni, che crescono nella speranza della Chiesa, vigore e fioriscano, e affinché sia loro insegnata la dottrina tanto filosofica quanto teologica, specialmente attinta dalle fonti del Dottore Angelico.

10 Inoltre Sua Santità ha voluto che tutti i documenti ecclesiastici riguardanti lo stato civile di Alagoas, eretto in propria e distinta diocesi con questo decreto consistoriale, come pure la parrocchia volgarmente chiamata Brejo Grande, divulsa dalla diocesi di Olinda e attribuita all'Arcidiocesi di san Salvador, siano estratti dalla Cancelleria cattedrale di Olinda, alla quale fino ad ora detto stato ha appartenuto, e siano consegnati alle Cancellerie tanto del Vescovato noviter eretto quanto dell'Arcidiocesi predetta di san Salvador, non appena sarà possibile, e in esse rispettivamente conservati.

11 Inoltre Sua Santità ha costituito la Chiesa Episcopale di Alagoas noviter eretta, come sopra, suffraganea dell'Arcivescovo di san Salvador in Brasilia, e l'ha sottoposta al diritto metropolitico del medesimo Arcivescovo.

12 Espressamente però Sua Santità in questa nuova diocesi da erigersi ha riservato a Sé e alla Sede Apostolica la facoltà di fare liberamente una nuova smembrazione o circoscrizione della medesima diocesi ogni qualvolta ciò parrà opportuno nel Signore, senza che sia richiesto alcun assenso dell'Antistite e del Capitolo cattedrale, né sia necessario costituire e attribuire alcuna compensazione territoriale.

XII.

13 Infine Sua Santità ha voluto che tutte le cose, i diritti e le persone ecclesiastiche, dei quali in questo decreto consistoriale non è fatta espressa menzione, rimangano fermi e ratificati secondo le regole canoniche e la disciplina della Chiesa cattolica. Se però sorga alcuna difficoltà o controversia riguardo ai predetti nella nuova diocesi eretta, essa dovrà essere deferrita alla Sede Apostolica, la quale, accuratamente esaminate tutte le cose, decreterà come di diritto.

XIII.

14 La nuova Chiesa cattedrale di Alagoas, che dovrà essere così denominata, Sua Santità comanda che, tenuto conto della condizione dei tempi, sia tassata in trentaquattro fiorini d'oro di Camera, e che tale tassa sia descritta nei libri della Camera Apostolica secondo l'uso.

XIV.

15 Come esecutore infine di questo decreto, in virtù di speciale grazia con valore eguale a quello che avrebbero le Lettere Apostoliche nella forma di Breve o sotto Piombo spedite, la medesima Santità Sua ha degnato di deputare il R. P. D. Giuseppe Macchi Arcivescovo titolare di Tessalonica, Internunzio Apostolico nella Repubblica Brasiliana, con le facoltà necessarie e opportune anche di subdelegare qualunque altra persona costituita in dignità ecclesiastica per l'effetto di cui si tratta, nonché di pronunciare definitivamente su qualunque opposizione contro i suddetti provvedimenti in qualsiasi modo sorgente, imposta al prefato esecutore l'obbligazione entro cinque mesi di trasmettere a questa sacra Congregazione Concistoriale gli atti e i decreti in forma autentica redatti dell'esecuzione compiuta, e ha ordinato che il presente Decreto Concistoriale sia spedito e riferito negli atti della medesima sacra Congregazione Concistoriale. 4 Ecclesiam autem matricem in supra dicta civitate Maceié existentem, Sanctitas Sua in episcopalem et cathedralem Ecclesiam novae dioecesis sub titulo et invocatione Dominae Nostrae dos prazeres nuncupandam constituere dignata est, et in ea Sedem et dignitatem episcopalem pro uno Episcopo de Alagoas appellando, qui eidem Keclesiae eidemque civitati et dioecesi, ut infra, constituendae praesit, Synodum convocet, et omnia ac singula iura, officia et munia episcopalia habeat et exerceat cum suis Capitulo, mensa episcopali, ceterisque cathedralibus et pontificalibus insignibus, iurisdictionibus, praerogativis, privilegiis, honoribus, gratiis et indultis realibus personalibus et mixtis, quibus ceterae in Brasiliana Republica existentes cathedrales Ecclesiae earumque Praesules non tamen titulo oneroso aut ex indulto peculiari gaudent et gaudere poterunt, de Apostolicae potestatis plenitudine erigere et instituere.

DECREE ON THE ERECTION OF A NEW DIOCESE OF ALAGOAS IN THE BRAZILIAN REPUBLIC

1 In these times, both the President and Government, and the leading men of the Clergy and people of the civil state commonly called Alagoas in the Brazilian Republic have repeatedly and earnestly petitioned the Apostolic See that the same state or region of Alagoas, which at present belongs to the territory and spiritual jurisdiction of the diocese of Olinda, should be separated from it and erected into its own separate diocese. In this matter it was represented to Our Most Holy Lord Leo XIII that a salutary and abundant fruit from this erection would arise for the faithful of the aforesaid region, with the assistance also of the Reverend Father Joseph Macchi, Archbishop with the title of Thessalonica, Apostolic Internuncio, who declared such a work of Apostolic providence to be not only useful but also necessary in the aforesaid region. His Holiness, having carefully considered all things and desiring to provide for the care of sacred matters and the spiritual salvation of souls in the aforesaid civil state in the best manner possible, deemed that the petitions should be benignly granted, and by the fullness of Apostolic power decreed that a proper and separate diocese should be erected in the territory of the civil state of Alagoas in the Brazilian Republic in the manner which follows.

2 First, therefore, His Holiness divided, separated and severed from the diocese of Olinda the civil state commonly called Alagoas, which, as regards spiritual administration, is at present subject to the diocese of Olinda and is contained within the boundaries described below, erecting it into a new and distinct diocese, and by this dismemberment and separation perpetually assigned and attributed the aforesaid state and its territory to the diocese of the new Bishopric of Alagoas, where a new Bishop and his successors in the Bishopric shall always be required to reside, and he perpetually exempted, separated and disjoined from the ordinary jurisdiction of the Bishop of Olinda, as well as from all right of the Chapter and Canons of the same cathedral Church of Olinda, all inhabitants and residents of both sexes, both lay and clerical and religious, though not exempt, dwelling in the same state, as well as Churches, Convents, Monasteries, pious Institutes, if any exist, and all other whatsoever secular and regular benefices, and perpetually subjected, attributed and submitted them to the episcopal Church of Alagoas newly to be erected as below, and to its future Prelate for his city, territory, diocese, clergy and people.

3 Furthermore, His Holiness decreed that the city commonly called Maceió, which is the capital of the civil state of Alagoas, should be erected into an episcopal city of the new diocese of Alagoas to be named, with its rights, honors and prerogatives, which other cities existing in the Brazilian Republic and their citizens enjoy and possess, being honored by the Apostolic See.

4 His Holiness deigned to constitute the mother Church existing in the aforesaid city of Maceió into the episcopal and cathedral Church of the new diocese under the title and invocation of Our Lady of the Pleasures to be named, and in it to establish the See and episcopal dignity for one Bishop to be called of Alagoas, who shall preside over the same Church and the same city and diocese to be constituted as below, convoke a Synod, and have and exercise all and singular the rights, offices and duties of a bishop with its Chapter, episcopal table, and other cathedral and pontifical insignia, jurisdictions, prerogatives, privileges, honors, graces and indults real, personal and mixed, which the other cathedral Churches existing in the Brazilian Republic and their Prelates, though not by burdensome title or by special indult, enjoy and shall be able to enjoy, and to erect and institute by the fullness of Apostolic power.

5 To this new diocese of Alagoas to be named His Holiness assigned and attributed the entire territory of the civil state, namely of Alagoas, preserving that same extent and the same boundaries by which the same territory is at present geographically and politically defined and circumscribed, the extent of which territory stretches to four hundred ninety-one square kilometers above five hundred eight thousand square kilometers, in which inhabitants according to the most recent census tables number five hundred eleven thousand four hundred forty, and thirty-four mother parishes are counted. The entire territory is finally bounded on the north and west by the civil state of Pernambuco, on the south by the states of Bahia and Sergipe according to the river of St. Francis as far as its Atlantic outlet, and on the east finally by the Atlantic Ocean.

6 Since it is of the greatest importance that the necessary revenues and income of the episcopal see of Alagoas be provided for, His Holiness earnestly desires and is confident that the civil government of the state of Alagoas, as well as the faithful of this region, whose piety and religion are most praiseworthy, and for whose spiritual benefit the Apostolic See has undertaken the erection of this new Bishopric, will offer aid and assistance through pious generosity and appropriate donations, by which the new Bishop and his Successors may fittingly maintain the dignity of the episcopate, and by which divine worship, the needs of the sacred ministers, and diocesan works may be appropriately provided for, since the new diocese has no other temporal goods at hand except those which proceed from the piety and good will of the faithful with the greatest spiritual gain to themselves.

7 Moreover, the new Bishop shall take care to erect the Chapter of the cathedral Church as above established according to canonical sanctions, as soon as it can be done, observing the number of canons, observing the same dignities of the other cathedral Churches which are found legitimately constituted in the Brazilian Republic. In the meantime, until the cathedral Chapter shall have been constituted, the Bishop shall assume for himself a council of approved and prudent men, and shall make use of their prudence in conducting the greater affairs of his diocese.

8 When, however, the Chapter of the cathedral Church shall have been canonically erected, His Holiness grants to it the faculty of drawing up statutes, ordinances and decrees according to the prescriptions of the sacred Canons and especially of the sacred Council of Trent, which, however, shall be subject to the knowledge and approval of the Ordinary Bishop, as well as the faculty of enjoying all privileges in the manner of the other cathedral Chapters existing in the Brazilian Republic, but not by burdensome title or acquired from a special indult.

VIII.

9 His Holiness earnestly desires and commands that the new Bishop of the diocese of Alagoas give diligent and assiduous attention to establishing a Seminary of sacred students according to the precepts of the Council of Trent in his diocese, as soon as it can be done, with all care taken that in it the piety and moral integrity of the students, who are growing up in hope for the Church, may flourish and thrive, and that to them doctrine both philosophical and theological, especially drawn from the fountains of the Angelic Doctor, may be transmitted.

10 Likewise His Holiness willed that all and singular ecclesiastical documents respecting the civil state of Alagoas erected into its own and distinct diocese by this consistorial decree, as well as the parish commonly called Brejo Grande separated from the diocese of Olinda and attributed to the Archdiocese of St. Salvador, be extracted from the Chancery of the cathedral of Olinda, to which the aforesaid state has hitherto belonged, and be delivered to the Chanceries both of the newly erected Bishopric and of the aforesaid Archdiocese of St. Salvador, as soon as it can be done, and be preserved in them respectively.

11 His Holiness moreover constitutes the Episcopal Church of Alagoas newly erected, as above, as a suffragan of the Archbishop of St. Salvador in Brazil, and has subjected it to the metropolitan authority of the same Archbishop.

12 His Holiness expressly reserves to Himself and to the Apostolic See in this new diocese to be erected the faculty of freely making a new dismemberment or circumscription of the same diocese whenever it shall seem expedient in the Lord, without requiring any assent of the Bishop and cathedral Chapter thereto, or the necessity of constituting and assigning any territorial compensation.

XII.

13 Finally, His Holiness willed that all things which respect matters, rights and ecclesiastical persons, of which express mention has not been made in this consistorial decree, ought to remain firm and valid according to canonical rules and the discipline of the Catholic Church. If, however, any difficulty or controversy regarding the foregoing should arise in the newly erected diocese, it shall be referred to the Apostolic See, which, having carefully considered all matters, shall decree as is right.

XIII.

14 His Holiness commands that the new cathedral Church of Alagoas to be named be taxed, having regard to the condition of the times, at thirty-three and one-third florins of gold of the Camera, and that such tax be described in the books of the Apostolic Camera in the customary manner.

XIV.

15 Finally, as executor of this decree, by special grace having the same force as if Apostolic Letters had been expedited in the form of a Brief or under the Leaden Seal, His Holiness has deigned to appoint the Reverend Father Lord Joseph Macchi, Archbishop titular of Thessalonica, Apostolic Internuncio in the Brazilian Republic, with the necessary and opportune faculties also of subdelegating any other person constituted in ecclesiastical dignity for the effect which is in question, as well as of pronouncing definitively upon any opposition arising in any way against the foregoing, with the obligation imposed upon the aforesaid executor of transmitting within five months to this sacred Consistorial Congregation the acts and decrees written in authentic form of the execution carried out, and he has commanded that this Consistorial Decree be expedited and reported in the acts of the same sacred Consistorial Congregation. Given at Rome on this day 11 July, in the year 1900.
