Qui Christi Domini vices
Bull on the reorganization of ecclesiastical circumscriptions in France
PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER.
1 He who is constituted to bear the place of Christ the Lord on earth and to govern the Church of God ought to seize every occasion and to use every opportunity that is offered to him, by which he may be able both to bring the faithful to the bosom of the Church and to avoid all those dangers which are feared, lest, the opportunity being lost, hope also be lost of obtaining those goods by which the Catholic religion may be aided. These were the causes which impelled us in the preceding months to enter into a Convention between this Apostolic See and the first Consul of the Gallic Republic, and these same causes now compel us to proceed to those other matters which, if they were deferred, we would have to grieve to see the Catholic religion affected by the gravest damages and that entire hope lost, in which we not rashly entered, of retaining Catholic unity in Gaul. In procuring so great a good for the Church, having determined that a new circumscription of dioceses in Gaul should be made, and in all those regions, however widely they extend, which now are subject to the temporal dominion of the Gallic Republic, ten Metropolitan Churches and fifty Episcopal Churches should be erected, to each of which suitable and worthy ecclesiastical men could be nominated by the first Consul of that same Republic within three months following the promulgation of our letters, whom we would canonically institute as Archbishops or Bishops of those churches in the customary forms as before, we did not at all think it would come to pass that we should be compelled to derogate from the assents of the legitimate pastors who previously held those Churches and dioceses, which now all, according to the new circumscription, are changed and are to be given to new pastors by us. Rather we hoped that all the old legitimate Prelates, especially being stirred by us with such zeal and love to increase by this new sacrifice those great and distinguished merits of theirs, which we most earnestly desired, would immediately respond and of their own accord and freely resign their Churches into our hands. But since now we are in great sorrow of heart in that on the one hand, although free resignations of many Bishops have come to us, yet those of many have not yet been brought, or letters that have been brought seek reasons by which this sacrifice might be deferred; on the other hand, since there is the greatest danger lest, if so great a matter be deferred longer, Gaul, despoiled for a long time of its pastors, not only the restoration of religion be deferred, but all things, which is most to be feared, be turned for the worse, and all our hopes come to nothing; the duty of our apostolic ministry demands that we, in so great a crisis of Christian affairs, all other reasons being set aside, however grave, the cause of unity and religion, which is to be judged the most important of all, being postponed, come to those things which are altogether necessary for accomplishing so praiseworthy a work and so salutary for the Church.
2 We therefore, having heard the counsel of many venerable brothers of ours, Cardinals of the Holy Roman Church, expressly derogate from any assent of the legitimate Archbishops, Bishops, and Chapters of their respective Churches, and of any other Ordinaries whatsoever, and we perpetually forbid to the same any exercise of any ecclesiastical jurisdiction, declaring of no force whatsoever anything that any of them shall attempt, so that those Churches and their respective dioceses, which, whether in their entirety or in part, according to the new circumscription to be carried out, ought to be and are truly altogether free; so that we may constitute and dispose of them in the form which shall be indicated below by us. Having therefore altogether as expressed and fully inserted all and singular things which by these letters would necessarily need to be expressed and inserted, we suppress, annul and perpetually extinguish the title, denomination, and the entire present state of the Archiepiscopal and Episcopal Churches written below, together with their respective Chapters, rights, privileges and prerogatives of whatsoever kind, namely the Archbishopric of Paris with its Episcopal suffragans of Chartres, Meaux, Orleans, and Blois. So that (also deleting all Metropolitan right of whatsoever existing), all the aforesaid Archbishoprics and Bishoprics with Abbeys, even if those were truly of no diocese with separate territory and jurisdiction, ought to be held henceforth as no longer existing in their first state, because they are either wholly extinguished or to be erected in a new form. We also derogate from any assent of those Archbishops, Bishops, Chapters and any Ordinaries whatsoever, whose Churches and dioceses, since they are contained in part in the aforesaid extent of Gallic dominion, from this time ought to be held perpetually exempt and separated from any jurisdiction, right and prerogative of the aforesaid Archbishops, Bishops, Chapters and other Ordinaries, to the end that their respective parts may be applied, united, and incorporated with the Churches and dioceses to be erected by new circumscription (as below): yet remaining firm the rights, privileges, and jurisdiction of those Archbishops, Bishops, Chapters and Ordinaries in that part of territory which is not subject to Gallic dominion (which same we decree relating to those Metropolitan and Cathedral Churches which above we have named and suppressed and extinguished, if those perchance have some part of their dioceses outside the boundaries of the present territory of the Gallic Republic), with care reserved to us to provide henceforth both for those parts of dioceses which formerly were governed by Gallic Bishops and are now constituted in the dominion of other princes, and also for Cathedral Churches which, existing outside the limits of the said Gallic territory, were formerly suffragans of the ancient Archbishops of Gaul, and which in this new order of things are found to lack their Metropolitan. Wishing now to execute the necessary constitution of ecclesiastical government of the Catholic subjects of the Gallic Republic, as also the first Consul of the same Gallic Republic has signified to us that he desires, by these apostolic letters of ours we newly constitute and erect ten Metropolitan Churches, and likewise fifty Episcopal Churches for so many Archbishops and Bishops, namely: . We therefore command our beloved son John Baptist, presbyter Cardinal of the Holy Roman Church, Caprara, to our most dear son in Christ Napoleon Bonaparte, first Consul of the Gallic Republic, and to the Gallic nation, our Legate from the Apostolic See, that he, proceeding according to these our aforesaid erections of both Archiepiscopal and Episcopal Churches, in constituting them with suitable assignment to be made to each Archbishop and Bishop, may decree both the holy titular patron saints, under whose invocation in each Metropolitan and Cathedral Church the greater temple shall be called, and the dignities and canons of each Chapter according to the prescription of the sacred councils to be formed, and the circuit of individual dioceses, new boundaries, all things being clearly and distinctly explained and constituted in individual decrees which ought to be issued by him in all acts to be made which shall pertain particularly to the individual Churches, both the ten Archiepiscopal and the fifty Episcopal, which we have mentioned. To accomplish which we impart to him the most ample faculties, even subdelegable, necessary and opportune for approving the statutes of the respective Chapters, for granting to them the choral insignia which he shall judge to be fitting for them, for old parishes either to be suppressed, or to be circumscribed within narrower limits, or to be enlarged with wider ones, and for new ones to be erected with new boundaries, and likewise for adjudicating all controversies which might ever arise in executing those things which by these our apostolic letters have been declared, and generally for accomplishing all those things which can be accomplished by us, so that through the erection of the aforesaid Archiepiscopal and Episcopal Churches, and likewise through the erection, as soon as it can conveniently be done, of seminaries, and through the constitution of necessary parishes with assignment of suitable stipend to each pastor, the spiritual necessities of all those Catholics may be provided for as quickly and opportunely as possible.
3 But in order that the aforesaid John Baptist Cardinal Legate may have the power to proceed by himself in all matters which shall be necessary for the constitution of the aforesaid Archiepiscopal and Episcopal Churches, before they are defined, as is customary, by the Apostolic See; we desire nothing else than that a matter of such importance be altogether completed with that speed which is most necessary, and thus we command the same Cardinal to take care to send to us authentic copies of all the acts of this constitution, which shall thereafter be completed by him. We are confident, moreover, on account of that praise of doctrine, prudence, and counsel with which the aforesaid John Baptist Cardinal Legate excels, that he will obey our most righteous studies, and will apply all his effort so that the whole matter may be brought to that outcome which we desire in the best manner that can be done, so that finally, with God's help, we may be able to obtain this one good which we strive with all zeal to prepare for the Catholic religion. And these present letters, and whatever is contained in them and whatever statutes, even from the fact that anyone having, or pretending to have, any right or interest in the aforesaid matters, or in any of them, of whatever status, order, preeminence, and ecclesiastical or worldly dignity, even though worthy of specific and individual mention and expression, shall not have consented to them, or because some of them were not called to the aforesaid matters, or were not heard at all, or not sufficiently or adequately, or from any other cause whatsoever, even of injury, or otherwise juridical, and privileged, and most privileged cause, colour, pretext, and ground, even in the body of law, at no time by reason of subreptiousness, or obreption, or nullity vice, or of our intention or the consent of those having interest, or from any other defect whatsoever, however great, unforeseen, substantial, and most substantial, or even from the fact that in the aforesaid matters solemnities and whatever other things, perhaps to be observed and fulfilled, were not observed and fulfilled, or the causes for which these present letters were issued were not sufficiently adduced, verified, and justified, or from any other causes or pretexts whatsoever, shall be noted, impugned, or otherwise infringed, suspended, restricted, limited, or called into controversy, or against them restitution in full, opening of the mouth, or any other remedy whatsoever of law or fact or justice be sought, and that they shall altogether not be comprehended under any contrary constitutions, revocations, suspensions, limitations, derogations, modifications, decrees, or declarations, whether general or special; even by motion, knowledge and fullness of power equal in any manner whatsoever, and for any causes made at any time, but shall always be excepted from them and shall be excepted, and as made and emanated from the office of Pontifical providence and our own motion, with certain knowledge, and from the fullness of apostolic power, shall exist and be perpetually valid and efficacious in all manner of firmness, and shall obtain and secure their full and complete effects, and shall be perpetually and inviolably observed by all to whom it pertains and shall pertain in any manner whatsoever in the future, and ought to afford the fullest suffrage to the Bishops, Chapters and Canons of the same Churches, as aforesaid, newly erected, and to others whose favour these our letters concern, for perpetual future times, and that the same persons cannot be molested, disturbed, disquieted, or hindered on account of all and singular the aforesaid matters, or on account of any of them by any authority whatsoever, nor shall they at any time be held to the proof or verification of any matters narrated in these same our letters, nor can they be forced or compelled to it in judgment or outside of judgment, and if otherwise concerning these matters it shall happen to be attempted by anyone whatsoever by any authority, knowingly or unknowingly, we will that it be null and altogether void, and we decree it to be so by equal authority, notwithstanding the law concerning acquired right not being taken away, concerning suppressions committed to the parties interested, and other rules of ours and of the apostolic chancery, as well as the statutes and customs, even immemorial, of the said Churches suppressed and extinguished by us, as aforesaid, and also privileges, indults, concessions, and donations to the same Churches, as aforesaid, suppressed and extinguished, or to any persons whatsoever shining with any ecclesiastical or worldly dignity, however worthy of specific and individual mention, even of our predecessors the Roman Pontiffs, under whatever forms and tenors of words, even by similar motion, and from the fullness of apostolic power, or by consistorial decision to the contrary of the aforesaid granted and emanated and exercised by the longest and immemorial use, possession, or quasi-possession, and prescribed. All and singular of which, even if special, specific, and individual mention of them, and of their whole tenors and forms, or any other expression ought to be had, or any other exquisite form ought to be observed for this, their tenors, as if they were inserted word for word, nothing whatsoever being omitted, and the form transmitted in them being observed, we have for expressed in these presents, to the effect of all and singular the aforesaid, most widely and fully, and specially and expressly, from certain knowledge by motion and by fullness of power equal, we derogate and will that it be derogated, and to other things contrary whatsoever we will also that to the transumpts of these same presents, even if printed, subscribed by the hand of some public notary, and furnished with the seal of some person constituted in ecclesiastical dignity, the same faith be given everywhere as would be given to these same presents if they were exhibited or shown. Let no man whatsoever be permitted to infringe this page of our suppression, extinction, erection, constitution, concession, impartition of faculties, subjection, commission, mandate, decree, derogation and will, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of almighty God and of the blessed Apostles Peter and Paul His.
4 Given at Rome, at St. Mary Major, in the year of our Lord's Incarnation one thousand eight hundred and one, on the third day before the kalends of December, in the second year of our pontificate.
