Sacrosancta Redemptionis

Constitution on the Congregation of Loreto

Constitution of Pope Innocent XII ·

The constitutions of Clement VIII and Paul V concerning the governance of the Holy House and the city of Loreto are reformed. Innocent, Pope XII, Servant of the Servants of God,
to the perpetual memory of the matter.

1 The most sacred mysteries of human redemption, by which both the beginning of Christian religion, and the dignity of the universal Church throughout the world, and the very apostolic majesty of the Roman Pontiff, the Vicar of Christ, are exalted, do in the same way that they move us to an intimate sense of sorrow through the consideration of the holy places in which our Lord deigned to work, under the tyranny of infidel nations (for it is now long since the nations came into the inheritance of the Lord, they have defiled His holy temple, and have made the holy city Jerusalem a reproach and a desolation); so also the sacred monuments of that same redemption of ours, which, by the bounty of divine grace, are found under the power of Christians, and especially under the temporal dominion of the Holy Roman Church, do stir and impel our pontifical solicitude to guard them with the greatest care and to venerate them with the utmost devotion. Indeed, since that sacred chamber, or Holy House called Lauretan, where first the most glorious Mother of God and ever-virgin Mary, like the dawn arising, announced the joy of her illustrious nativity to the whole world, and where she conceived the Only-begotten Son of God by the overshadowing of the Holy Spirit, was by a remarkable miracle and the ministry of angels transported to our province of Piceno, and the whole Christian world, as the first tabernacle of God with men, has venerated it on earth now for many centuries, and almighty God from heaven has not ceased to illustrate it with the constant frequency of miracles: we, turning the gaze of our mind and the affection of our heart toward so most sacred a House, most willingly undertake the care thereof, so that, removing those things which might in any way produce discord and offense, we may consult with apostolic providence for the happy and prosperous governance of the aforesaid Holy House and of our city of Loreto, which is placed as it were in the courts of that House of the Lord, the constitutions of our predecessors, the Roman Pontiffs, heretofore issued thereupon, being reformed and changed where it shall be necessary.1

2 § 4. Indeed, many of Our predecessors, the Roman Pontiffs, on account of their zealous devotion to religion and their affection of reverence toward the Mother of God, the Blessed Virgin, have adorned the same Holy House with jurisdiction, privileges, indults, graces and prerogatives, and especially Clement, Pope of happy memory, Our predecessor, among other things subjected and entrusted the castle of Loreto and its inhabitants, with all their rights and appurtenances, to the care, governance, administration and rule, with full and mixed authority and the power of the sword, of a commissioner or protector of the said House; and most recently Paul, Pope of revered memory, also Our predecessor, wishing 2 3 to prevent in the future the various lawsuits and contentions which had arisen and might arise between the bishop of Loreto and the protectors of the aforesaid House, and in order that the same Holy House of Loreto, its officials and ministers of whatever kind, as well as the goods, things and rights pertaining to it might be better and more easily governed, to the same Holy House, or holy chamber of Loreto, the sole floor or pavement, both of the same holy chamber or holy chapel, and all around as far as the columns and stairs inclusive, he perpetually constituted and assigned as a territory proper, distinct and separate, of no diocese, in which henceforth the protector alone of the same Holy House existing for the time being, and its governor, exclusively as regards the bishop of Loreto, even if he were a cardinal of the Holy Roman Church, might have and exercise full and quasi-episcopal jurisdiction; and the same house or chapel, both great and small so called, and the aforesaid pavement and territory, its governor, officials, ministers, and all others both lay and clerical and regular serving the same Holy House, or chapel, and its goods in any manner whatsoever, as well as the families, servants and attendants of the same officials, ministers and others serving, and all pilgrims of whatever kind, condition and eminence flowing together to the same holy chapel or church of Loreto, as well as the palaces, buildings, possessions and lands of the same Holy House whatsoever, and other goods, both stable and movable and living, wherever existing, precious furnishings also, monies, alms, donations, and whatever bequests, he perpetually, most fully, completely and entirely exempted and freed from all and any superiority and jurisdiction, dominion and power of the bishop of Loreto, and received under the special protection of blessed Peter and the Apostolic See; and subjected and adjudged to the same protector for the time being all manner of ecclesiastical and spiritual and quasi-episcopal jurisdiction in the aforesaid Holy House, its territory, ministers, officials and others serving, and pilgrims, and the aforesaid things, goods and rights, with various privileges and faculties attributed to the same protector, both concerning the appointment of a vicar curate, and concerning the granting of dimissorial letters, and many other matters, as is more fully contained in the letters respectively issued by the aforesaid Clement in the form of a Brief under the date of 13 January 1524, in the 1st year of his pontificate, and Paul, predecessors, under lead, in the year of the Lord's Incarnation 1620, on the day before the Ides of July, in the 16th year of his pontificate.4

3 § 2. We, however, prudently considering that from such a form of governance not that utility which was hoped for has resulted, but rather experience, and being made more certain by the complaints and appeals of many brought to Our apostolate, that with the power of the bishop too much diminished, ecclesiastical discipline has gradually been dissolved, and the morals of clergy and people, with the number of the exempt increased, have been relaxed, not without frequent disturbances of prelates and subjects, so that what had been salutarily constituted by the same Clement and Paul, Our predecessors, for the honor and benefit of the aforesaid holy chapel, now through the variety of times, and perhaps the wickedness of men, is seen to be turning to its detriment, having held mature deliberation upon these matters with certain venerable brothers of Ours, cardinals of the Holy Roman Church, and beloved sons, prelates of the Roman Curia, the aforesaid letters of Our predecessors, having their true tenor also present before Us as fully and sufficiently expressed and inserted word for word, by Our own motion, and from certain knowledge, and from the fullness of apostolic power, by this Our constitution to endure perpetually, We moderate, reduce, restrict and alter to the form and terms expressed below. The privileges granted to the Holy House by Paul V are confirmed.

4 § 3. And first indeed, desiring that the aforesaid holy chapel or house, where the Word was made flesh, may retain all preeminence, honor and dignity, and be diminished in no way, but rather be amplified with more abundant graces and privileges, for we love the beauty of the house of God, and we strive to bring the greatest possible glory to His name in the court of His holiness, to that same holy House we confirm and approve by the tenor of these presents a territory proper and separate, and exempt from all jurisdiction of the Ordinary, and as it were episcopal, assigned in the aforesaid letters of Paul, our predecessor, Pope Paul V; and the same territory together with all the ministers and officials of the aforesaid holy House, and other persons intervening in any way whatsoever, or flowing together to it from any part of the world by reason of devotion, and its members existing anywhere whatsoever, according to the form of the aforesaid letters of Paul our predecessor, we again and most fully and completely exempt from all and every jurisdiction of the Ordinary (the office of protector, which, by the death of Paluzzo of blessed memory, while he lived, bishop of Porto and cardinal of the holy Roman Church, called of Alteris, is now vacant, being perpetually suppressed and entirely removed from consideration), we take under the special and immediate protection of blessed Peter and our own and of the Apostolic See.

5 § 4. All and every jurisdiction, both ecclesiastical and spiritual and as it were episcopal, which in the same Holy House, its territory, officials, ministers, pilgrims, and goods aforesaid, as well as secular or lay jurisdiction in our city of Loreto and its county and district, as above, belonged to the protector for the time being of the same Holy House, whether from the constitutions and indults, privileges of the aforesaid Clement and Paul, or of any other whatsoever of our Roman Pontiff predecessors, or in any other way whatsoever, since the Roman Pontiffs, being themselves weighed down by the cares of apostolic service and the solicitude of all churches, cannot be free to exercise it, we decree and command that it be exercised henceforth through a Congregation of certain venerable brothers of ours, cardinals of the Holy Roman Church, and beloved sons, prelates of the Roman Curia, to be called the Lauretan, which we erect, institute and specially depute for this purpose by the tenor of these presents. And to the same Congregation, that once and repeatedly and as often as it shall seem good and pleasing to it, it may make whatsoever statutes and ordinances for the happy governance of the aforesaid Holy House and its goods and persons serving the same, not however contrary to the sacred canons and decrees of the Council of Trent, and especially concerning the number of ministers and officials of the same Holy House enjoying privileges and exemptions, which number we wish to be entirely reformed through the same Congregation and restricted to those alone who are necessary; to be inviolably observed by all to whom it pertains, we grant and indulge that it may enact, issue and publish, and change, alter, correct and amend as it shall prudently judge to be expedient in the Lord.

INNOCENTIUS XII PP.

6 to direct and correct, as He shall judge it to be salutary in the Lord to expedite, We grant and allow. In order that the government of the aforesaid Holy House and city may be better, more distinctly, and with every danger of litigation and contention removed as far as possible administered, and that all things may be done honestly and in order, We will and command that the aforesaid Congregation, in spiritual matters indeed, which namely pertain to the worship of the church, the service of the choir, the celebration of divine offices, the care of souls, the administration of the sacraments, the correction of morals, and other things of this kind, shall make use of the operation and ministry of the Bishop of Loreto for the time being, as a delegate of the Apostolic See; but in those matters which concern the temporal administration of the goods of the same holy chapel, as well as the secular government of the said city of Loreto and its county and districts, both in civil causes and in criminal or mixed cases, shall make use of the operation and ministry of a prelate of the Roman Curia, to be appointed as governor by Us and by the Roman Pontiff for the time being. And for this reason both the construction and maintenance of all houses and buildings, and the custody of furnishings of every kind, vestments, gems, and other valuables, which are called by the name of treasure, as well as alms and donations of every sort, and also the superintendence of the pawn bank, the hospital, the hospice and dining hall for poor pilgrims, are to be committed to the care of the aforesaid governor; but the ministers serving in the aforesaid places and things, if they shall be clerics, in matters concerning only their ministry, to the aforesaid governor, but in other matters to the Bishop of Loreto as a delegate of the Apostolic See; finally the organist and

7 and all others whatsoever of the same Holy House, as regards the correction of morals and the servants of the church, we decree and declare ought to be subject to the bishop, and in other matters to the governor.

§ 5. Since moreover certain churches or benefices, even those with cure of souls, united, annexed or dependent upon the said Holy House or chapel, are found not only in the Diocese of Loreto but also in very many other dioceses, subject to the jurisdiction of the Ordinaries with dependence upon the Congregation:

8 in order that the good governance of the same churches and benefices and their right administration may be provided for, we will and command that these same churches, their rectors, and all other ministers whatsoever be subject to the jurisdiction, visitation and correction of the bishops and other ordinaries in whose respective dioceses they are situated, as delegates of the Apostolic See, yet under the governance and complete dependence of the Congregation erected by us as aforesaid; and we likewise decree that the same shall be observed regarding all and each of the colonists or officials of the same Holy House existing anywhere outside the Diocese of Loreto, to be reduced however to the proper number as aforesaid. Moreover, the aforesaid benefices and all others whatsoever, with cure and without cure, secular and of whatever Orders regular, howsoever qualified, and existing wheresoever, which in any way pertained to the collation, provision, presentation, election and any other disposition of the aforesaid Holy House by the protector for the time being, we perpetually reserve to our ordinance, disposition and provision and that of the Apostolic See.

§ 6. If moreover anything concerning the observance of this our constitution, its interpretation or declaration, should at any time come to be disputed or doubted, all such matters:

9 are to be declared, decided and defined by the judgment of the aforesaid Congregation instituted by us as aforesaid, to which for this reason we grant and impart all necessary and fitting faculty from above, and we strictly command and mandate that it be observed by all, with any appeal, recourse or claim of nullity wholly removed.

§ 7. Decreeing that these present letters, even for the reason that the bishop, chapter and clergy or the community and people of our aforesaid city of Loreto, and all others whatsoever having or pretending to have any interest in the premises, have not consented to the same, or have not been called or heard, and for any other cause whatsoever, however legitimate and juridical, can in no way be noted with any defect of subreption or obreption or nullity, or of our intention or any other defect whatsoever, impugned, or called into controversy, or reduced to the terms of law, but shall always and perpetually remain firm, valid and efficacious, and be inviolably observed by those to whom it pertains and shall pertain in the future, and thus ought to be judged and defined everywhere by whatsoever ordinary and delegated judges, exercising any authority whatsoever, even the auditors of causes of the apostolic palace, and the cardinals of the Holy Roman Church, even legates a latere, with all faculty and authority to judge and interpret otherwise being removed from them and from each of them; and should anything contrary to all and each of the premises, or concerning them, be attempted by anyone whatsoever, with any authority whatsoever, knowingly or unknowingly, it shall be null and void.

10 § 8. Notwithstanding, as far as those things which are contrary to the present are concerned, the aforesaid constitutions and ordinances of Clement and Paul, our predecessors, and all other apostolic constitutions and ordinances whatsoever, even those issued, renewed and confirmed in synodal and provincial and universal councils, and our [right] of not taking away acquired right, and other rules of the Apostolic Chancery, and the statutes and customs of the said Holy House and church and city of Loreto, even those strengthened by oath, apostolic confirmation, or any other firmness whatsoever, privileges also and indults granted to the aforesaid Holy House and to its protector existing for the time being, and all others whatsoever, under whatsoever tenors and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious and unusual clauses, and irritant and other decrees, in general or in particular, as well as all other things which in the aforesaid letters our predecessors wished in no way to hinder; all and singular of which, even if for their sufficient derogation special and individual and express mention of them and their whole tenors, and word for word, and not through general clauses importing the same, or any other expression, or some other exquisite form to be observed for this purpose, were to be required, the tenors of these things, as if word for word, nothing whatsoever being omitted, and the form delivered in them being observed, were expressed and inserted, we hold as fully and sufficiently expressed and inserted for the purpose of the present, otherwise remaining in their force, we derogate by the tenor of these; and to all other things contrary whatsoever.

11 § 9. Let no one whatsoever be permitted to infringe this page of our moderation, confirmation, exemption, suspension, erection, concession, declaration, reservation, decree and derogation, or to contravene it with rash presumption; if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul his. Given at Rome, at St. Mary Major, in the year of our Lord's Incarnation 1697, on the 12th day of August, in the eighth year of our pontificate.
