Conditae a Christo
Costituzione apostolica sugli istituti religiosi con voti semplici
COSTITUZIONE APOSTOLICA
CONDITAE A CHRISTO*
Del Santissimo Signor Nostro Leone per Divina Provvidenza Papa XIII sui Istituti di Religiosi che professano voti semplici.
LEONE VESCOVO

CONSTITUTIO APOSTOLICA
CONDITAE A CHRISTO*
Sanctissimi Domini Nostri Leonis Divina Providentia Papae XIII de Religiosorum Institutis vota simplicia profitentium.
LEO EPISCOPUS
SERVUS SERVORUM DEI
Quia nimirum in dioeceses plures propagantur, eodemque ubique iure unoque utuntur regimine; ideo Episcoporum in illas auctoritatem opus est temperationem quamdam admittere certosque limites. Qui limites quatenus pertinere debeant, colligere licet ex ipsa decernendi ratione Sedi Apostolicae consueta in eiusmodi consociationibus approbandis, scilicet certam aliquam Congregationem approbari ut piam Societatem votorum simplicium, sub regimine Moderatoris generalis, salva Ordinariorum iurisdictione, ad formam sacrorum canonum et Apostolicarum constitutionum. — Iamvero perspicuum inde fit, tales Consociationes neque in dioecesanis censeri, neque Episcopis subesse posse nisi intra fines dioecesis cuiusque, incolumi t a men supremi earumdem Moderatoris administratione ac regimine.
4 Caput primum haec habet servanda:
6 II. Domus nulla novarum sodalitatum iusto iure fundabatur, nisi annuente probante Episcopo. Episcopus vero fundandi veniam ne impertiat, nisi inquisitione diligenter acta, quales sint qui id poscant: an recte probeque sentiant, an prudentia praediti, an studio divinae gloriae, suaeque et alienae salutis praecipue ducti.
7 III.
— Praeterea Episcopi religiosarum domus, ubi viris feminisve peregre advenientibus hospitium victusque accepto pretio suppeditetur, nequaquam permittant.
9 IV. Sodalitas quaevis dioecesana ad dioeceses alias ne transgrediatur, nisi consentiente utroque Episcopo, tum loci unde excedat, tum loci quo velit commigrare.
13 VIII. Episcopo alumnas sodalitatum dioecesanarum professas dimittendi potestas est, votis perpetuis aeque ac temporariis remissis, uno dempto (ex auctoritate saltem propria) colendae perpetuo castitatis. Cavendum tamen ne istiusmodi remissione ius alienum laedatur; laedetur autem, si insciis moderatoribus, id fiat iusteque dissentientibus.
14 IX. Antistitae, ex constitutionum iure, a Sororibus eligantur.
16 XI. Sacerdotes a sacris, a confessionibus, a concionibus designare, item de sacramentorum dispensatione statuere munus Episcoporum est, pro sodalitatibus dioecesanis pariter ac pro ceteris: id quod in capite consequenti (num. 8) explicate praefinitur.
XXV, cap.
20 III.
24 VII. In sodalitates, quae mendicato vivunt, ea Episcopis stent iura, quae habet decretum Singulare quidem a sacro Consilio Episcopis et Religiosorum ordinibus praeposito promulgatum die 27 martii anno 1896.
25 VIII. Horum igitur erit sacerdotes ipsis et a sacris designare et a concionibus probare. Quod si sodalitates muliebres sint, designabit item Episcopus sacerdotes a confessionibus tum ordinarios tum extra ordinem, ad normam constitutionis Pastoralis curae, a Benedicto XIV decessore Nostro editae, ac decreti Quemadmodum, dati a Sacro Consilio Episcopis et Religiosorum ordinibus praeposito, die 17 decembris anno 1890; quod quidem decretum ad virorum etiam consociationes pertinet, qui sacris minime initiantur.
26 IX. Talium igitur bonorum Episcopus rationes accepti impensique, quoties videbitur, expendet; idem ne sortes minuantur, redditus ne perperam erogentur, curabit.
27 X. Sicubi sodalitatum aedibus instituta curanda adiecta sint uti gynaecea, orphanotrophia valetudinaria, scholae, asyla pueris erudiendis, Episcopali vigilantiae ea omnia subsint quod spectat ad religionis magisteria, honestatem morum, exercitationes pietatis, sacrorum administrationem, integris tamen privilegiis, quae collegiis, scholis, institutisve eiusmodi a Sede Apostolica sint tributa.
28 XI.

APOSTOLIC CONSTITUTION
CONDITAE A CHRISTO*
Of Our Most Holy Lord Leo by Divine Providence Pope XIII concerning Religious Institutes professing simple vows.
LEO BISHOP
SERVANT OF THE SERVANTS OF GOD
For perpetual remembrance of the matter
1 Conditae a Christo the Church possesses such divine power and fruitfulness that in many times past, and in this present age, she has brought forth many families of both sexes, which, having undertaken the sacred bond of simple vows, strive to devote themselves holily to various works of religion and mercy. These indeed, for the most part, impelled by the charity of Christ, having transcended the narrow limits of a single city or diocese, and having obtained, by the force of one and the same law and common governance, a certain form of perfect association, are spreading more widely each day. — Moreover, their condition is twofold: some, which have obtained only the approval of Bishops, are for that reason called diocesan; others, however, concerning which the judgment of the Roman Pontiff has moreover intervened, either in that he has reviewed their laws and statutes, or in that he has further granted them commendation or approval.
2 Now concerning these two classes of religious Families, what the rights of Bishops ought to be, and what in turn their duties toward Bishops are, remains uncertain and disputed by those who consider it. — Indeed, as regards diocesan associations, the matter does not present itself as difficult to resolve; for they are introduced and maintained by the authority of the sacred Ordinaries alone. But a more serious question arises concerning the others, which have been strengthened by the approval of the Apostolic See. Because indeed they are spread through many dioceses, and everywhere use the same law and one governance; therefore the authority of Bishops over them must admit a certain moderation and fixed limits. What these limits ought to be can be gathered from the very manner of deciding customary to the Apostolic See in approving such associations, namely that a certain Congregation is approved as a pious Society of simple vows, under the governance of a General Moderator, with the jurisdiction of the Ordinaries preserved, according to the form of the sacred canons and Apostolic constitutions. — Now from this it becomes clear that such Associations can neither be reckoned among diocesan ones, nor can they be subject to Bishops except within the limits of each diocese, yet with the administration and governance of the supreme Moderator remaining intact. By what reasoning, therefore, it is unlawful for the supreme Heads of these societies to invade the rights and power of Bishops; by the same reasoning Bishops are prohibited from arrogating to themselves anything of the authority of the Heads themselves. For if it were otherwise, as many moderators would accrue to these Congregations as there are Bishops in whose dioceses their members dwell; and the unity of administration and governance would be destroyed. — The authority of the Heads of Congregations and of Bishops ought to be concordant and unanimous, but for this reason it is necessary that each know and preserve the rights of the other intact.
3 But in order that this may be fully accomplished in the future, with all controversy removed, and in order that the power of the sacred Ordinaries, which We, as is fitting, wish to remain unviolated everywhere, may suffer no harm anywhere; by deliberate counsel of the sacred Council presiding over Bishops and Religious orders, We have deemed it fitting to enact two chapters of prescriptions; one concerning sodalities which have not yet obtained the commendation or approval of the Apostolic See, the other concerning the rest, whose laws the Apostolic See has either reviewed or whose institute it has commended or approved.
4 The first chapter contains these things to be observed:
5 I. It is the duty of the Bishop not to receive into his diocese any newly born sodality before he has known and approved its laws and constitutions; namely, if they are in no way contrary to the faith, honesty of morals, sacred canons and the decrees of the Pontiffs, and if they are suitably adapted to the stated purpose.
6 II. No house of new sodalities shall be founded by just right unless the Bishop consents and approves. But the Bishop shall not grant permission to found unless, after diligent inquiry, he has ascertained what sort of persons they are who request it: whether they think rightly and well, whether they are endowed with prudence, whether they are led chiefly by zeal for the divine glory and their own and others' salvation.
7 III. Bishops, as far as it can be done, should rather than establish or approve a new sodality in any kind, more usefully adopt one of those already approved, which professes an institute of action similar to it. — Scarcely any sodalities, except perhaps in Mission regions, shall be approved which, with no certain and proper purpose established, embrace all manner of works of piety and beneficence to be exercised, even if wholly disconnected from one another.
8 Bishops shall not permit any confraternity to be established which lacks the revenues necessary for the sustenance of the members. — Confraternities which live by alms; likewise women's associations which attend to the sick in their own homes, day and night, let them approve most cautiously, indeed with difficulty. — If, however, any new women's confraternity should aim at opening infirmaries in their own houses to receive men and women indiscriminately; or similar houses to receive priests, so that they may be relieved of their infirmities by the care and work of the Sisters; bishops shall not approve such proposals unless mature and severe counsel has been employed. — Furthermore, bishops shall in no way permit religious houses where men or women arriving from abroad are provided with lodging and food for a price.
9 IV. Any diocesan confraternity shall not extend to other dioceses unless both bishops consent, namely the bishop of the place from which it departs and the bishop of the place to which it wishes to migrate.
10 V. If a diocesan confraternity should happen to be propagated to other dioceses, nothing of its nature and laws may be changed except by the consent of each bishop in whose dioceses it has houses.
11 VI. Confraternities once approved shall not be extinguished except for grave causes and with the consent of the bishops in whose jurisdiction they were. Individual houses, however, bishops may suppress in their own respective dioceses.
12 VII. Concerning girls seeking religious habit, likewise concerning those who, after probation is completed, are about to emit vows, the bishop shall be informed individually: it shall be his duty both to examine them in the customary manner and, if nothing stands in the way, to admit them.
13 VIII. The bishop has the power to dismiss professed members of diocesan confraternities, with both perpetual and temporary vows remitted, except one (at least by his own authority) to be observed perpetually, namely chastity. Care must be taken, however, lest such remission injure the rights of another; it would injure them if it were done without the knowledge of the superiors and against their just objection.
14 IX. Superiors, by the right of the constitutions, shall be elected by the Sisters. The bishop, however, either personally or by delegated authority, shall preside over the casting of votes: it is entirely within his power to confirm or rescind the completed election according to the duty of conscience.
15 X. The bishop has the right to visit the houses of any diocesan confraternity, and likewise to inquire concerning the pursuit of virtue, discipline, and economic matters.
16 XI. It is the duty of bishops to designate priests for sacred functions, for confessions, for preaching, and likewise to determine concerning the dispensation of the sacraments, for diocesan confraternities equally as for others: which is explicitly defined in the following chapter (no. 8).
17 The second chapter of prescriptions, concerning Confraternities whose laws the Apostolic See has reviewed or whose institution it has commended or approved, contains these things to be observed:
18 I. To coopt candidates, to admit them to sacred habit or to the profession of vows, are the functions of the presidents of confraternities; yet the full power of the bishop remains intact, granted by the Council of Trent (Sess. XXV, cap. XVII, de Regul. et Monial.), so that, when women are in question, he may examine them both before receiving the habit and before making profession ex officio. It is likewise the function of the presidents to arrange individual families, to dismiss novices and professed members, those things being observed which ought to be observed from the laws of the institute and pontifical decrees. — To assign duties and offices, both those pertaining to the universal confraternity and those exercised in individual houses, the Assemblies or Chapters and their own Councils have the right. In the assemblies of women's confraternities, however, for the assignment of offices, the bishop in whose diocese they are held shall preside, either personally or through another, as a delegate of the Apostolic See.
19 II. To remit vows, whether they be temporary or perpetual, belongs to the Roman Pontiff alone. To change the constitutions, inasmuch as they have been approved by the Apostolic See, no bishop has the right. Likewise, the governance which rests with the moderators, whether of the universal confraternity or of individual families, according to the norm of the constitutions, bishops may not alter or modify.
20 III. It is the right of bishops, in each diocese, to permit or prohibit new houses of confraternities to be built, likewise new churches to be erected by them, oratories whether public or semi-public to be opened, sacred functions to be performed in domestic chapels, the August Sacrament to be exposed openly for the veneration of the faithful. It is likewise the right of bishops to arrange public solemnities and supplications.
21 IV. If houses of such confraternities use episcopal enclosure, the rights which pontifical laws grant to bishops concerning this matter remain intact. If, however, they use what is called partial enclosure, it shall be the duty of the bishop to ensure that it is properly observed, and to prevent whatever defect creeps into it.
22 V. Members, male and female, of these confraternities, as far as the internal forum is concerned, are subject to the power of the bishop. In the external forum, however, they are subject to him as regards censures, the reservation of cases, the remission of vows which are not reserved to the Supreme Pontiff alone, the proclamation of public prayers, dispensations and other concessions which bishops of the faithful are able to grant.
23 VI. If anyone, however, seeks to be promoted to sacred orders, the Bishop, even if they are residing in the diocese, shall be careful not to initiate them unless under these conditions: that each be proposed by their superiors; that those things which are sanctioned by sacred law concerning letters dimissorial or testimonial, be duly fulfilled; that they not lack a title for sacred ordination, or at least be legitimately exempted from it; that they shall have applied themselves to the study of theology, according to the decree Auctis admodum, given on 4 November in the year 1892.
24 VII. In associations which live by begging, those rights shall stand with Bishops which the decree Singulare quidem has, promulgated by the sacred Council placed over Bishops and Religious orders on 27 March in the year 1896.
25 VIII. In those matters which pertain to spiritual things, associations are subject to the Bishops of the dioceses in which they are situated. It shall therefore be their duty to designate priests for them and to approve them for preaching. If the associations be of women, the Bishop shall likewise designate priests for confessions both ordinary and extraordinary, according to the norm of the constitution Pastoralis curae, issued by our predecessor Benedict XIV, and the decree Quemadmodum, given by the sacred Council placed over Bishops and Religious orders, on 17 December in the year 1890; which decree indeed pertains also to associations of men who are not initiated into sacred orders.
26 IX. The administration of goods which individual associations possess ought to be in the hands of the supreme Moderator or the highest Superior and their Councils: but the revenues of individual families ought to be administered by individual presidents, according to the laws of each institute. The Bishop can exact no account of these. Those funds, however, which are bequeathed to a certain house by legacy for the worship of God or for charity to be expended in that place; the administration of these the superior of the house shall indeed conduct, but shall report to the Bishop, and shall render himself entirely subject to him: in such a way, namely, that neither the Superior General nor the Superior of the entire association shall be permitted to conceal, alienate, or convert to other uses any of these goods from the Bishop. The Bishop shall therefore examine the accounts of receipts and expenditures of such goods as often as shall seem good to him; he shall likewise take care that the capital not be diminished, and that the revenues not be wrongly expended.
27 X. Wherever institutions for care have been attached to the houses of associations, such as women's residences, orphanages, hospitals, schools, asylums for the education of children, all these shall be subject to Episcopal vigilance as regards the teaching of religion, the honesty of morals, the exercises of piety, the administration of the sacraments, with the privileges nevertheless intact which have been granted to colleges, schools, and such institutes by the Apostolic See.
28 XI. In the houses of any associations professing simple vows, it is the right of the Bishops of each diocese to inspect the temples, sanctuaries, public oratories, places for the sacrament of penance, and to make appropriate decisions and give orders concerning them. — In associations of priests, the superiors alone shall have cognizance of conscience and discipline, and likewise of economic matters. In associations of women, however, and equally of men who abstain from the priesthood, it shall be the Bishop's duty to inquire whether discipline is maintained according to the norm of the laws, whether sound doctrine or the integrity of morals has suffered any harm, whether the enclosure has been violated by sin, whether the sacraments are received with equal and regular frequency. — If the Bishop should happen to find something worthy of reproof, let him not decree immediately: let him admonish the moderators to provide for it; if they have neglected to do so, let him himself consult. If, however, any matters of greater importance should occur which do not admit of delay, let him decree at once: but let him refer the decree to the sacred Council placed over Bishops and Religious orders.
29 The Bishop, especially in visitation, shall exercise his rights which we have mentioned above as regards schools, asylums and other institutions mentioned. — As regards the economic matters of associations of women and likewise of men lacking the priesthood, the Bishop shall not inquire except concerning the administration of funds or bequests which have been assigned to sacred purposes, or for the relief of the inhabitants of the place or diocese.
30 Moreover, in these things which we have hitherto decreed and sanctioned, we will that nothing whatsoever be derogated from the faculties or privileges, whether granted by our or any other decree of the Apostolic See, or confirmed by immemorial or secular custom, or also those which are contained in the laws of any Association approved by the Roman Pontiff.
31 We decree that these present letters and whatever is contained in them can never at any time be noted or impugned on account of subreption or obreption or defect of our intention or any other defect whatsoever, but shall always be valid and in their full force and effect, and ought to be inviolably observed by all of whatever rank and preeminence both in judgment and outside it: we also declare null and void if anything contrary to these things should happen to be attempted by anyone, by whatever authority or pretext, knowingly or unknowingly; notwithstanding any contrary provisions whatsoever.
32 We will, moreover, that copies of these letters, even printed ones, subscribed by hand by a Notary and furnished with the seal of a man constituted in ecclesiastical dignity, shall have the same faith as would be had in Our will signified by these present letters shown.
33 Given at Rome at St. Peter's in the year of Our Lord's Incarnation one thousand nine hundred, on the eighth day before the Ides of December, in the twenty-third year of Our Pontificate.
