Instaurandae
12 § 9. Vogliamo però che i presenti Presenti siano affissi e pubblicati sulle porte della chiesa Lateranense e della basilica del Principe degli Apostoli, nonché della cancelleria apostolica, e nella piazza del Campo di Fiore della medesima Città, i quali, dopo che saranno stati affissi e pubblicati, vincolino e colpiscano tutti e singoli coloro che riguardano, allo stesso modo come se fossero stati loro intimati nominatamente e personalmente;

and the application of honors, and the prohibition of erecting new regular houses in Italy and the adjacent islands. Innocent, Bishop, servant of the servants of God, for the remembrance of the matter in perpetuity.
1 The Work of Restoring Regular Discipline, Preamble. This work, long since undertaken by our Roman Pontiff predecessors with many labors and vigils, we, considering more and more in our days why it has not been able to be brought to the desired end up to now, and why so many most salutary decrees and ordinances have fallen almost into nothing, finally that principal cause of the origin presented itself to us: that very many religious communities are constituted from small convents and houses, in which, whether on account of the meagerness of revenues and alms, or on account of the unhealthiness of the air, or on account of some other cause, there are not nourished, nor can be nourished, so many religious as are necessary for performing divine worship and regular duties according to the prescription of each Order.
2 § 1. For indeed, with so small a number of religious dwelling there, they are not able to celebrate the divine office, both nocturnal and diurnal alike in choir, nor to devote themselves to mental prayer and spiritual conferences and exercises and studies in common, nor to observe silence, enclosure, common life, and the other institutions which are ordained toward the three principal vows, and without which the bases and foundations of regular life can scarcely stand. For which reason, immersed in oil, they present no specimen of religious life; they walk alone through cities and places, they wander with seculars, and involve themselves in worldly affairs. Whence it comes to pass that religious of proven life and discipline refuse to be stationed there, and superiors are compelled to constitute a family there from brothers of looser life, who become worse by the license of the place: and if at any time they are recalled to coenobia or monasteries of regular observance, abhorring the cloister as if from the squalor of a prison, they can scarcely be brought to observe common discipline in their conduct, and to conform themselves to the institutions of others, but rather they turn away others or certainly make them more sluggish by their example. Whence relaxations are derived into the Orders, and gradually prevail to the dishonor and ruin of the religions themselves. Moreover (which we report with sorrow) to such convents, especially in infrequent and solitary places, as to an asylum, criminal men and contumacious or proscribed members of the curia flee daily; and there, made safe by the immunity of the place, living shamefully and dissolutely, and departing thence in time, they perpetrate graver crimes to the greatest scandal of the people. And since such small convents or places have grown as it were into an unbridled multitude, from this let all understand what remedies of reform would be vain and null, so long as they have not been cut off from the religions. For what hope can there be of reducing a sickly and infirm body to health, if a great part of it is incapable of cure, but rather infects and contaminates the remaining part; these indeed are the tares which, when they have already grown unto the harvest, are to be bound into bundles and separated from the wheat of the religions. These are the little foxes that destroy the vineyards. This is the leaven that corrupts the whole mass.
3 § 2. All these things and many others besides, which we have long and carefully turned over in our mind for the sake of our pastoral solicitude, so that the sacred religious orders, spread more widely throughout the whole Church with the increase of fruitfulness, being cleansed of briars and thorns, may bring forth abundant fruit, we, also being urged by frequent prayers from the superiors of the religious orders themselves zealous for reform, and moved by the frequent complaints of the people, have decreed to apply a salutary remedy by deliberate ordinance. Accordingly, by the vote of a congregation of certain venerable brothers of ours, cardinals of the Holy Roman Church, and beloved sons, prelates of the Roman curia, appointed by us over the state of regulars, to whom we have entrusted this matter to be carefully and maturely examined, by our own motion, certain knowledge and mature deliberation, and from the fullness of apostolic power, we perpetually extinguish, suppress and abolish by the authority of the apostolic office, by the tenor of these presents, all and singular convents of whatsoever monks and regular men, possessing or not possessing immovable property, of whatsoever Order, Mendicant or non-Mendicant, congregation, society and whatsoever other institute, even of the Society of Jesus, even if the care of souls of secular persons should be incumbent upon them, whether they be hospices, or granges, or members of another monastery, existing within the bounds of Italy and the adjacent islands, to be expressly named in letters to be expedited shortly by the same congregation, in which on account of the small number of religious persons regular discipline according to the particular institutes of each Order cannot be observed, together with all their dignities, offices and ministries, and we exempt and totally free them from all property, jurisdiction and any other whatsoever right of regulars, and entirely extinguish in them all conventual character, title, essence and regular denomination, reducing them to the secular state; saving however to the same congregation the faculty of preserving for some religious orders some of the convents expressed in the aforesaid letters, if it should judge this to be expedient from some reasonable cause; saving also the rights which belong to the founders of the convents thus suppressed, or to others in any way by the prescription of the sacred canons, or by apostolic privilege.
To each one to whom it pertains, we send mandate and command to the superiors of the Orders of regulars.
It prohibits celebrating masses in the churches of the said convents.
4 § 3. Wherefore to the beloved sons, superiors of all regulars, both general and provincial and local, by whatsoever name and title they are called, in virtue of holy obedience we strictly command and mandate, that each one to whom it pertains, within the term of six months to be reckoned from the day of the presentation of the letters to be expedited from the aforesaid congregation, as aforesaid, to be made in the Roman curia to the procurator general of each Order or congregation or society, shall really and with effect surrender before the Ordinaries of the places, under public testimony to be exhibited to the same congregation by the same regular superiors, the corporeal possession of the convents expressed in the same letters, and, saving to them the faculty of carrying away with them profane only, not however sacred furnishings, shall remove the religious therefrom, and shall place them in other monasteries of the same Order or congregation or society, otherwise they shall incur by the very fact, without any other declaration, the penalties of privation of active and passive voice, as well as of dignities and offices which they shall then hold, and of perpetual incapacity to obtain those or others hereafter.
5 § 4. And when that term has elapsed, it shall not be lawful for regulars to celebrate masses and divine offices in the churches of the said convents, to hear sacramental confessions, or to administer other sacraments, and to exercise parochial functions, or to preach the word of God, or to bury the dead. And if they act otherwise, the churches shall by that very fact remain subject to ecclesiastical interdict. And nevertheless the local Ordinaries, when they shall have been required by letters of the same congregation, shall eject the rebellious and refractory religious from the aforesaid convents, even invoking, if need be, the aid of the secular arm, and from thence shall undertake the governance, care, custody and administration of the churches, houses, and all goods in any way pertaining to the convents thus suppressed, and shall take care that from their revenues and all proceeds, first and before all else, the burdens of masses, both those hitherto not celebrated and those to be celebrated hereafter, and all other things whatsoever from the law of foundation, or from the gift of the faithful, or otherwise in any way incumbent upon them, be fulfilled, to which we in no way intend to derogate; and the care of souls, if any should be incumbent upon them, shall be laudably exercised through secular priests suitable and approved by the same Ordinaries, and the churches shall not be defrauded of their due service.
6 § 5. Desiring to provide salutarily for the rest of the aforesaid goods of Debonisfeboni, after the burdens mentioned above have been deducted, by the tenor of these presents We apply the same and decree and declare them to be applied to pious uses in those same places where the convents are situated, and if those places have no need, in other places of the same diocese, according to the designation and distribution which the same congregation, having first heard the opinion of the individual bishops with their chapters and having obtained a full report of the entire matter, shall make by Our mandate in its letters to be written to the same bishops, and to be registered in the episcopal chancery for perpetual memory of the matter.
7 § 5. Verily, because it is of little avail to cut off evils unless also the cause and root of evils be torn out, the constitutions of blessed memory Boniface VIII, which begin Cum Particulam and We add (r. t.), punish and renew the constitutions of other Roman Pontiffs
Preservative clauses.
8 from that time, as well as those of Clement VIII beginning Quoniam ad institutam, and of other Roman Pontiffs Our predecessors, issued concerning the erection of new convents, renewing the tenor of the same and adding to them, We perpetually prohibit by this edict that henceforth no one of the regular Orders, whether Mendicant or non-Mendicant, congregation, society, and any other institute whatsoever, even the Society of Jesus, in any city, castle, village or place shall presume to receive anew houses or any places for dwelling, or to begin or found monasteries, convents or colleges without the special license of the Apostolic See, full and express, making mention in writing of this prohibition and to be granted freely, after examination by the congregation entrusted with the affairs of bishops and regulars: if they act otherwise, by that very fact they incur the penalties of privation and disqualification inflicted as above, and nevertheless the receptions, foundations and erections shall be null and void by the law itself, and the houses and places themselves and the persons dwelling in them shall be fully subject in all respects to the jurisdiction, visitation, and correction of the Ordinary of the place. We intend, however, in the aforesaid matters also beyond Italy and the adjacent islands, as it shall seem expedient to Us, to provide.
9 § 6. Decreeing that these present letters, even from the fact that the superior regulars and all others whatsoever having or in any way pretending to have an interest in the aforesaid matters did not consent to them, nor were called and heard concerning them, at no time ever on account of the vice of surreption, obreption, nullity, or invalidity, or of Our intention, or any other defect whatsoever, however great, unforeseen and substantial, or even from the fact that in the aforesaid matters or any of them the solemnities and any other things to be observed and fulfilled 1 were not observed and fulfilled, or from any other ground arising from law or fact or statute or any custom whatsoever, or even from enormous, most enormous and total loss, or any other color, even in the body of law closed, or occasion or cause, however just, reasonable and privileged, even such as would necessarily have to be expressed for the effect of the validity of the aforesaid, or that nothing of Our will in this matter and the other things expressed or related above should appear anywhere, or could be proved otherwise, noted, impugned, invalidated, retracted, brought into law or controversy, or reduced to the terms of law, or that against them the remedy of restitution in full, opening of the mouth, reduction to the way and terms of law, fact, grace or justice be sought, or in any way granted and obtained that anyone be able to use or avail himself of them in judgment or outside, nor these present letters under any whatsoever similar or dissimilar revocations of grants, suspensions, limitations, or other contrary dispositions, to be made from time to time in any way, be comprehended, but always excepted from them, perpetually valid, firm and efficacious to be, their full and complete effects to have and obtain, and by all and each to whom it shall pertain and in any way shall pertain in the future, inviolably to be observed,
10 § 7. Thus and not otherwise in the aforesaid matters with all clauses in all and singular by whatsoever judges ordinary and delegated, even auditors of causes of the sacred apostolic palace, as well as cardinals of the holy Roman Church, even legates a latere and nuncios, and others exercising any authority and power, now and for the time being existing, in any cause and instance, the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, to be judged and defined, and also to be null and void if otherwise concerning these things by anyone whatsoever, by any authority, knowingly or unknowingly, should happen to be attempted, especially al-
11 § 8. Notwithstanding, insofar as this rescript is necessary, our rule concerning not taking away acquired right, and other rules of the apostolic chancery, and other constitutions and ordinances of the apostles, even those issued in general councils, even specially in favor of any persons and Orders, both Mendicant and non-Mendicant, congregations, societies and any other institute, even the Society of Jesus, and monasteries, colleges, houses and places of any regulars, as well as those, even confirmed by oath, apostolic confirmation, or any other firmness, statutes or customs, even immemorial, exemptions also, indults and privileges, even granted for cause and onerous title, or at the threshold of foundation and in the Great Sea, or called by Golden Bull, or otherwise named, under whatsoever tenors and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious and unusual clauses, as well as irritant and other decrees, even by motion, knowledge, deliberation and fullness of power similar, even granted at the regard of emperors, kings, queens, republics, and any other princes and persons shining forth in whatsoever ecclesiastical or secular dignity, or granted in their regard and contemplation, and also consistorially, and otherwise in any manner, even by way of communication or extension, conceded, and approved and renewed at repeated times; all and singular of which, insofar as they in any way are adverse to those things which are present, even if for their sufficient derogation special and individual mention of them and their whole tenors and forms, and word for word, ought not to be made through general clauses importing the same, or any other expression or any exquisite form to be observed, we regard these tenors as if word for word, nothing whatsoever omitted, and the form transmitted in them being observed, they were inserted into the present, otherwise remaining in their force, by motion, knowledge, deliberation and equal fullness of power, we specially and expressly derogate; and all other things contrary whatsoever.
12 § 9. We will, however, that these presents, these letters affixed to the doors of the Lateran church and the basilica of the Prince of the Apostles, as well as of the apostolic chancery, and in the square of the Campo Fiore of the same City be published and affixed, which, after they have been affixed and published, shall bind and affect all and singular, whom they concern, in the same manner as if they had been intimated to each of them nominally and personally;
13 § 10. And that of the same presents transumpts...
14 transumpts, even printed, subscribed by the hand of some public notary, and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith altogether shall be given in judgment and outside it everywhere, which would be given to these same presents, if they were exhibited or shown.
15 § 14. Let it be lawful for no man whatsoever to infringe this page of our ordinance of erection, extinction, suppression, abolition, exemption, liberation, reduction, precept, mandate, intention, reservation, application, declaration, prohibition, declaration, and will, or to dare to act contrary to it with rash presumption; if anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of almighty God and of the blessed Peter and Paul his apostles.
