Pastoralis Romani Pontificis

Bolla di Urbano VIII che scomunica coloro che impediscono la giurisdizione ecclesiastica

Bolla di papa Urbano VIII ·

1 gulis annis solent publicari.

4 An.

4 An. 1 are accustomed to be published every year. Urban, Bishop, servant of the servants of God, for perpetual remembrance of the matter.

2 The pastoral vigilance and solicitude of the Roman Pontiff is constantly engaged in procuring peace and tranquility for the whole Christian commonwealth in the discharge of his office, but especially in matters concerning the Catholic faith, without 1 1 Concerning the matters contained in a Bull of this kind, you have most fully in the Constitution of Paul V, Pastoralis (in the new edition, vol. xi, p. 617). Against heretics dwelling in places of Italy and adjacent islands under any pretext whatsoever, and their supporters, Gregory XV issued a constitution, Romani (in the new edition, vol. xii, p. 708). He also revoked in Constitution xcv, Apostolati (ibid. p. 779) all licenses granted to whatsoever persons and by whatsoever persons, even by Roman Pontiffs, for reading and possessing books prohibited in any way. And finally this same Pontiff prohibited in Constitution Sanctissimus that books be carried elsewhere or transmitted for printing without the license of the Cardinal Vicar and the Master of the Sacred Palace in the City and outside it without the Ordinary and Inquisitor of the place or those deputed by them.

3 Concerning the burden of Roman Pontiffs and their predecessors and the case here set forth by the Pontiff.

4 In the year 1627 Urban [reigns]. For it is impossible to please God without retaining unity and integrity, which is especially evident; namely, that the faithful of Christ may not be little children tossed about, nor carried about by every wind of doctrine in the wickedness of men unto circumvention of error, but that all may come together in the unity of faith and knowledge of the Son of God unto a perfect man, and may not injure themselves in the society and communion of this life, nor give offense to one another, but rather joined together in the bond of charity, as members of one body, under Christ the head, and his Vicar on earth, the Roman Pontiff, successor of blessed Peter, from whom the unity of the whole Church flows forth, may grow unto edification, and thus, with divine grace assisting, may so rejoice in the peace of the present life that they may also enjoy the future beatitude. For these reasons indeed the Roman Pontiffs our predecessors on this day, which is the solemn anniversary commemoration of the Lord's Supper, have been accustomed solemnly to exercise the spiritual sword of ecclesiastical discipline and the salutary weapons of justice through the ministry of the supreme apostolate for the glory of God and the salvation of souls. We therefore, to whom nothing is more desirable than to protect, with God as author, the inviolate integrity of the faith, public peace and justice, following this ancient and solemn custom:

5 § 1. We excommunicate and anathematize by the authority of God almighty, the Father, and the Son, and the Holy Ghost, and also by the authority of the blessed Apostles Peter and Paul, and by our own authority, whosoever Hussites, Wicliffites, Lutherans, Zwinglians, Calvinists, Huguenots, Anabaptists, Trinitarians, and apostates from the Christian faith, and all and singular other heretics, by whatsoever name they may be known, and of whatsoever sect they may be, and those who believe in them, and their receivers, supporters, and generally whosoever defenders of the same, and their books containing heresy, or concerning the excommunication of all heretics by whatsoever name they may be known, and their supporters, etc., and those reading, keeping, or printing their books, schismatics, etc.

6 religion, knowingly reading or retaining without our authority and that of the Apostolic See, printing, or defending in any way whatsoever from any cause publicly or secretly, by any device or pretext, and also schismatics, and those who pertinaciously withdraw themselves from or depart from obedience to us and the Roman Pontiff existing for the time being.

7 § 2. Likewise we excommunicate and anathematize all and singular, of whatsoever status, rank or condition they may be (but universities, colleges and chapters, by whatsoever name they may be called, we place under interdict), appealing from our ordinances or mandates and those of the Roman Pontiffs existing for the time being to a universal future council: and also those by whose aid, counsel or favor the appeal shall have been made.

8 § 3. Likewise we excommunicate and anathematize all pirates, corsairs and maritime robbers, ranging over our sea, especially from Monte Argentario as far as Terracina, and all their supporters, receivers and defenders.

9 § 4. Likewise we excommunicate and anathematize all and singular, who shall steal goods of whatsoever kind from the ships of Christians whatsoever, tossed about by tempest, or turned sideways, as it is said, or suffering shipwreck in any way, whether in the ships themselves, or cast out from the same and found in the sea or on the shore, in our Tyrrhenian and Adriatic seas as well as in other regions and shores of any sea; so that they cannot be excused on account of any privilege, custom, or possession even of immemorial time, or any other pretext whatsoever.

10 § 5. Likewise we excommunicate and anathematize all who in their lands shall impose new tolls or taxes, except in cases permitted to them by law, or by special [authority of the See

11 Those appealing from the mandate of Pontiffs to a future Council;

12 Pirates and brigands of the sea, and their receivers, etc.

13 Those stealing the goods of Christians that have suffered shipwreck, cast away, or found on the shore.

14 Those imposing tolls, or new customs duties, or increasing them.

15 Those by Apostolic licence, permissions, impose or increase, or exact those forbidden to be imposed or increased.

16 Forgers, etc. § 6. Likewise we excommunicate and anathematize all forgers of apostolic letters, even in the form of a Brief, and of the seals and signatures of petitions concerning grace or justice, signed by the Roman Pontiff, the vice-chancellors of the holy Roman Church, or those acting in their stead, or by mandate of the same Roman Pontiff, as well as those falsely fabricating apostolic letters even in the form of a Brief, and also those falsely signing such petitions under the name of the Roman Pontiff or vice-chancellor, or those acting in the aforesaid stead.

17 Those transmitting § 7. Likewise we excommunicate and anathematize all those who to the Saracens, arms or other things Turks and other enemies of the Christian name or other enemies of Christians and heretics, by our sentences expressly and nominally declared concerning the affairs of this holy See and the Christian commonwealth, convey or transmit to them or inform them of such things, or who

19 horses, arms, iron, tin, lead, bronze, and all other kinds of metals and instruments of war, timber, hemp, ropes, both from hemp itself and from any other material whatsoever, and the same material and other things of this kind, by which they assail Christians and Catholics, as well as those who by themselves or through others concerning matters affecting the state of the Christian commonwealth inform the Turks and enemies of the Christian religion, as well as heretics, to the detriment of the Catholic religion, and provide to them aid, counsel or favour in any way whatsoever. Notwithstanding any privileges whatsoever, granted by us or the aforesaid See to any persons, princes, or commonwealths heretofore, which do not make express mention of this prohibition.

20 Those disturbing § 8. Likewise we excommunicate and anathematize all those impeding or invading or invading them.

21 those who bring victuals or other things necessary for the use of the Roman Curia, and also those who, lest they be brought or conveyed to the Roman Curia, prohibit, impede or disturb them, or defend those doing this by themselves or through others, of whatever order, pre-eminence, condition and status, even if they shine forth with pontifical or royal, or any ecclesiastical or worldly dignity.

22 § 9. Likewise we excommunicate and anathematize all those who, coming to the Apostolic See and departing from it, kill, mutilate, despoil, capture, or detain by their own or others' action, as well as all those who, not having ordinary or delegated jurisdiction from us or our judges, rashly claiming it for themselves, dare to perpetrate similar things against those dwelling in the same curia.

23 § 10. We likewise excommunicate and anathematize all those killing, mutilating, wounding, detaining, capturing or plundering pilgrims or travellers to the City coming for the sake of devotion or pilgrimage and dwelling in it, or departing from it, and those giving aid, counsel or favour in these things.

24 § 11. Likewise we excommunicate and anathematize all those killing, mutilating, wounding, striking, capturing, imprisoning, detaining or hostilely pursuing the cardinals of the holy Roman Church, patriarchs, archbishops, bishops, legates or nuncios of the Apostolic See, or those casting them out from their dioceses, territories, lands or dominions: as well as those commanding these things, or ratifying them or providing aid, counsel or favour in them.

25 § 12. Likewise we excommunicate and anathematize all those who by themselves or through others, any ecclesiastical or secular persons, coming to the Roman Curia concerning their cases and business, and similar necessary things bring to Rome.

26 Those harming those coming to the Apostolic See, or departing from it, and judges without jurisdiction vexing those dwelling in the curia.

27 Pilgrims and travellers even dwelling in the City, or departing from it, being harmed.

28 Those offending the cardinals of the holy Roman Church and other prelates.

29 Those offending those coming to the Roman Curia for the dispatch of their business, and the managers of business.

30 Those appealing from grievance, or future execution of apostolic letters, even in the form of a Brief to secular courts.

31 tes, and those pursuing or procuring matters in that same court, managers of business, advocates, procurators and agents, or also auditors or judges appointed over the said cases or matters, who on the occasion of such cases or matters kill, or in any way strike, despoil of goods, or who through themselves or others directly or indirectly do not fear to commit such offences, or to procure them, or to provide aid, counsel or favour in the same, of whatever preeminence and dignity they may be.

32 § 13. Likewise we excommunicate and anathematize all both ecclesiastical and secular persons, of whatever dignity, who, pretending some frivolous appeal from grievance or future execution of apostolic letters even in the form of a Brief, concerning both grace and justice, as well as citations, inhibitions, sequestrations, monitions, processes, executorial decrees and other decrees emanating from us and from the aforesaid See, or from legates, nuncios, presidents of our palace and the apostolic chamber, auditors, commissioners, and other judges and apostolic delegates, and which shall emanate from time to time, or otherwise, have recourse to secular courts and lay power, and by it, even at the instance of the fiscal procurator or advocate, cause such appeals to be admitted, and cause letters, citations, inhibitions, sequestrations, monitions and other aforesaid matters to be taken and retained, or who cause those to be executed simply, or without their consent and approval or examination, or prevent or prohibit that notaries and notaries public should make instruments or acts concerning the execution of such letters and processes, or that those made should be delivered to the party interested, and also seize, strike, wound, imprison, detain the parties themselves, or their agents, blood relations, affines, familiars, notaries, executors and sub-executors of letters, or citations, monitions and other aforesaid matters, cast them out from cities, places and kingdoms, despoil them of goods, terrify, shake, threaten them, through themselves or another, or others, publicly or secretly, or who otherwise in any way prohibit, decree or command to any persons whatsoever in general or in particular, that for the prosecution of any of their business, or for obtaining favours or letters, they should approach the Roman court, or have recourse, or obtain those favours or letters from the said See, or use those obtained, directly or indirectly, or presume to retain them with themselves, or with notaries or notaries public, or otherwise, in any manner whatsoever.

33 § 14. Likewise we excommunicate and anathematize all and singular, who through themselves or others, by their own authority and in fact, under the pretext of any exemptions, or other favours and apostolic letters, avoke beneficiary and tithe cases and other spiritual or spiritually annexed causes from our auditors and commissioners, and other ecclesiastical judges, and impede their course and hearing, and persons, chapters, convents, colleges, the cases themselves wishing to pursue them, and interpose themselves in the cognition of those as judges; or who compel the acting parties, who have committed and commit those, to revoke and cause to be revoked citations or inhibitions, or other letters decreed in them, and to cause or consent that those against whom such inhibitions were issued be absolved from the censures and penalties contained in them, by statute or otherwise, or impede in any manner whatsoever the execution of apostolic letters or executorial decrees, processes and aforesaid decrees, or provide their favour, counsel or assent to this, even under the pretext of preventing violence or other pretensions, or also until those impeding the execution of apostolic letters, or other expeditions and otherwise avoke causes from ecclesiastical judges, or impede their course, or interpose themselves in them as judges.

34 themselves have supplicated us, as they say, or caused supplication to be made, unless such supplications are legitimately pursued before us and the Apostolic See, even if those committing such things shall have been presidents of chancelleries, councils, parliaments, chancellors, vice-chancellors, counsellors, ordinary or extraordinary, of whatever secular princes, even if they shine forth with imperial, royal, ducal or any other dignity whatsoever, or shall have been archbishops, bishops, abbots, commendataries or vicars;

37 § 16. As also those who archbishops, bishops whatsoever . . .
