Testo inglese
1 Whereas of blessed memory Ferdinand, King of Aragon and Sicily, who even during his lifetime was Governor of the Kingdoms of Castile and Leon, for the praise and glory of Him to whom belong the earth and its fullness, and all who dwell therein, having already in the course of many years past assembled a most powerful fleet, and having sent it forth to seek new Islands in the Indian Ocean, and among others having discovered through this fleet Hispaniola, called Isabella, a most notable Island of this kind, and having subjected it to his temporal dominion, and having obtained that the Cathedral Churches of St. Dominic and of the Conception of the Blessed Mary be erected therein; shortly before he departed from human affairs, he sent a similar fleet, numbering about two thousand men, to seek other Islands in the same sea, and placed over it our beloved Son Peter de Arias as Captain; who, having sailed for many days, at length arrived at a certain region, commonly called Yucatan, of such magnitude that it is still uncertain whether it be an Island or a Continent, and he called it under the invocation of the same Blessed Mary of Remedies, and therein near the shore he built a town or village with a parochial Church under the same invocation: and whereas our Dearest Son in Christ Charles, illustrious King of Castile and Leon and of the other aforesaid Kingdoms, not only heir and successor of the same King Ferdinand, but also an imitator of his virtues, having learned that the said Land or Island has been explored by his men over many leagues in length and breadth and is inhabited by many thousands of men, and enjoys a healthful climate and fertile soil, and that its inhabitants and dwellers are capable of reason and humanity, and readily adhere to our Orthodox Faith, and willingly embrace its customs and precepts, and has subjected no small part of the said Land or Island to his dominion, and has caused many towns to be built therein, and has obtained that parochial Churches be erected in them, and hopes that a much greater part thereof will come under his dominion and, the darkness of errors having been dispelled, will come to the light of truth and will come to know Christ the Redeemer of all mankind: and for this reason greatly desires that the said town or village built near the shore of the sea, and it is said, to be erected into a City, which shall be called Carolensis, and its Church aforesaid under the said invocation of the Blessed Mary of Remedies to be erected. Having therefore taken mature deliberation upon these matters with our Venerable Brethren, by their counsel, the aforesaid King Charles humbly supplicating us hereupon, to the Praise and glory of Almighty God, and honor of the Most Blessed and Most Glorious Virgin Mary his Mother, with the rejoicing of the whole heavenly Court, by Apostolic authority, by the tenor of these presents, the town or village of the Island of the Blessed Mary of Remedies of this kind, in which a great number of the Faithful now dwell, into a City, which shall be called Carolensis; and its aforesaid parochial Church into a Cathedral Church under the said invocation of the Blessed Mary of Remedies for one Bishop, called Carolensis, who in the said Church, erected and in its City and Diocese shall preach the word of God, and shall convert the infidel inhabitants thereof to the worship of the aforesaid Orthodox Faith, and shall instruct and teach and confirm the converts in the same Faith, and shall bestow upon them the grace of Baptism, and to both those thus converted and to all other Faithful dwelling in the City and Diocese aforesaid for the time being, and resorting thereto, shall minister and cause to be ministered the Ecclesiastical Sacraments and other spiritual things, and shall cause the buildings of the erected Church to be enlarged, and to be reduced to the form of a Cathedral Church, and shall procure it, and in the Church and City erected, as well as in the Diocese aforesaid shall erect and institute Dignities, Canonries and Prebends, and other Ecclesiastical Benefices with and without cure, and shall confer and bestow other spiritual things, as he shall know to be expedient for the increase of Divine worship and the salvation of the souls of the inhabitants, with Seat and other insignia and Episcopal Jurisdictions, privileges also, immunities and graces, which other Cathedral Churches and their Prelates in Spain use, possess and enjoy by right or custom, or shall be able to use, possess and enjoy in any way in the future, we do perpetually erect and institute, and to the same Church the town or village erected by us into a City we grant and assign as a City, and a part of the land or Island of the Blessed Mary of Remedies of this kind, which the same King Charles shall have caused to be marked out and fixed by boundaries, as a Diocese, and their inhabitants and dwellers as Clergy and People, so that the same Bishop of Carolensis, who shall be for the time being, may freely exercise Episcopal Jurisdiction, authority and power therein, and from all things produced therein for the time being, except from gold and silver and other metals, gems and precious stones, which we decree to be free in this regard, may exact and receive the Tithes and First-fruits due by right, and other Episcopal rights, as it is lawful for other Bishops in further Spain to do in their Cities and Dioceses by right and custom: and also the right of Patronage and of presenting within a year, on account of the distance of the place, a suitable Person to the said Church of Carolensis, as often as its vacancy, except in this first instance, shall occur for the time being, to the Roman Pontiff existing for the time being by him to be appointed as Bishop and Pastor of the same Church upon this presentation, we grant and reserve in perpetuity to the aforesaid Charles and to the King of Castile and Leon existing for the time being. Let no one whatsoever be permitted to infringe this page of our erection, institution, concession, assignment, decree and reservation, or to dare to act contrary thereto with rash presumption; if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul His. Given at Rome, at St. Peter's, in the year of the Incarnation of the Lord one thousand five hundred and eighteen, on the 24th day of January, in the sixth year of our Pontificate.
