Constitution on the reduction of prohibited servile works on feast days

Constitution of Pope Benedict XIV ·

1 To the Venerable Brother Charles Francis, Bishop of Nice.

2 BENEDICT POPE XIV.

3 Venerable Brother, greetings and Apostolic Blessing.

4 Among the anxious cares for all the Sheep of Christ, there come to Us most gratifying sources of consolation, which We receive, the Lord having mercy, from the Episcopal vigilance in which the appropriate safeguards of Canonical Discipline are placed; for not without great joy from this loftiest watchtower of the Apostolate do We perceive the Pastors standing watchful over their custody, and burning with zeal for tending the flock entrusted to them, directing all their thoughts and strength with such care and diligence toward the worship of Divine honor and the salvation of souls, that they strive to prove themselves faithful and prudent to the Prince of Pastors, who set them over His household. §. I. Your Fraternity therefore understands how willingly We have received your letters, filled with distinguished sentiments of observance and reverence toward this Holy See, and marked with signs of pastoral vigilance and charity, in which, as you strive in surveying this Diocese to require and arrange all things according to the norm of the Sacred Canons and the dignity of the House of God in accordance with the ministry enjoined upon you, you relate that complaints have been brought to you and are still daily being brought by Pastors and Confessors from all sides, through which the Faithful of this Diocese, alleging the great number of Feast days and putting forward the necessity of sustaining life, and objecting the examples of neighboring peoples, among whom the number of Feast days is not so increased, complain that they cannot abstain from forbidden labors. Since, however, you perceive that the remedies applied, though most present through the most salutary Edicts and Constitutions and healthful admonitions administered by your wisdom, are proving fruitless, and you foresee that the Bishops' Synod, which, as an eminent imitator of the ancient discipline, you appear to desire most earnestly, is being hindered by the greatly disturbed condition of the times, so that you might healthfully consult the security of consciences and the welfare of Ecclesiastical observance, from this Chair of Peter, which is the font and origin of all Sacerdotal dignity and authority, you seek and request the aid and assistance of Apostolic power and benevolence, so that, following in the footsteps of Our Predecessor Pope Benedict XIII, We might deign by Apostolic authority to permit and grant to this Diocese as well, just as has been done with others, that on certain Feasts the Faithful, having heard Mass, may labor, with the obligation of the precept remaining intact on all Sundays throughout the year, on the days of Christmas, St. Stephen, St. John, the Circumcision, Epiphany, Easter and the following day, the Ascension of the Lord, Pentecost and the following day, the Feast of Corpus Christi, St. John the Baptist, the SS. Apostles Peter and Paul, All Saints, and also the five Festivities of the Blessed Virgin Mary, namely the Purification, Annunciation, Assumption, Nativity, and Most Pure Conception, as well as the Patron of the Kingdom and the Titular Saint of any place, provided however that on the remaining days of precept, whether from vow of Communities, having heard Mass, the Faithful dwelling in your Diocese may with safe conscience labor publicly. §. 2. We indeed, commending the most wise counsel, most worthy of your Sacerdotal vigilance and charity, and assenting to your prayers and wishes, commit to you, Your Eminence, and command by these presents, that to all Faithful of both sexes existing in your Diocese, excepting all Sundays, Christmas, St. Stephen, St. John, the Circumcision, Epiphany, Easter and the following day, the Ascension of the Lord, Pentecost and the following day, Corpus Christi, St. John the Baptist, the SS. Apostles Peter and Paul, and the Commemoration of All Saints; furthermore the five Feasts of the Blessed Virgin Mary Immaculate, namely the Purification, Annunciation, Assumption, Nativity, and Conception, as well as the Saint Patron or Titular of any place, for the people of that place only, in which the obligation of the precept remains intact; on the remaining Feast days, whether prescribed by this Holy See, or by the Synodal Constitutions of this Diocese, or for any other cause whatsoever, even from the cause of a vow made by their ancestors, which as to this part We also wish to be commuted by your authority through Our Apostolic Authority, having heard Mass, you shall grant, indulge, and permit them to apply themselves to the labor of their hands and to engage in servile works without any scruple of conscience whatsoever by Our Apostolic Authority. §. 2. From this indeed lengthy and plainly Paternal will, by which We desire and care to comply with your wishes as much as We can with the Lord, you understand well how excellently We think of Sacerdotal virtue and the distinguished gifts of your mind. Go forward therefore, Venerable Brother, fulfill your ministry, and expend such pastoral solicitude and vigilance toward the Sheep of faith committed to you, that you may happily lead them to the pastures of eternal salvation. We meanwhile humbly beseech Christ Jesus, the Shepherd and Bishop of our souls, that He may prevent and follow your labors with the gift of His grace for a more abundant fruit of souls; and We most lovingly impart the Apostolic Blessing to your Fraternity. Given at Rome at St. Mary Major under the Fisherman's Ring on the eleventh day of April, 1745, in the Fifth Year of Our Pontificate.

1 Al Venerabile Fratello Carlo Francesco Vescovo di Nicea.

2 BENEDETTO PAPA XIV.

3 Venerabile Fratello, salute e Benedizione Apostolica.
