Apostolic Letter approving the Rule of the Third Order Regular of St. Francis

Apostolic letter of Pope Pius XI ·

ON THE APPROBATION OF THE RULE OF THE THIRD ORDER REGULAR OF THE SERAPHIC FATHER ST. FRANCIS. PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 The condition of affairs was such, especially in Italy, toward the end of the twelfth century and somewhat later, that although universal Christian society stood firm in the faith, yet very many men, distracted by desire for fleeting things and puffed up with the pride of life, burst forth into every depravity of morals; and as the charity of Christ grew weak, they fostered hatreds everywhere and drove cities into calamitous internal wars. Nothing therefore could have been more desirable at that time than that a singular man should be raised up by God who, excelling in the praise of all virtues, would bring fitting remedies to these evils and recall peoples to Christian spirit. Now no one is ignorant that the task of reforming the society of those times was divinely entrusted chiefly to Francis of Assisi, who, opposing study to unbridled vices through Christian humility and poverty, strove to unite all in mutual charity. And so when very many disciples from all sides flowed together to such a great man, the Franciscan Family indeed grew immensely, both from the members of the three Orders which Francis himself established, and thereafter from those tertiaries who, desirous of a more perfect life, living a common life, were called members of the Third Order Regular. With good reason therefore they also, in memory of the Seraphic Father, as the seventh century from his death drew to a close, celebrated it not only with pious supplications and solemn public sacred rites, but also with the proposals of a more fervent piety throughout this year. For all know how diligently, from the beginning of their institute, the regular tertiaries strove to put on the holy spirit of Francis, and have been accustomed to carry it forward in many works of religion and charity. Wherefore it came to pass that Our Predecessor Leo PP. X, by a Constitution given Inter alia, approved their Rule. Yet, as happens in human affairs, many things indeed, in the course of time, which had been decreed by Leo PP. X, either became wholly obsolete or do not entirely accord with certain prescriptions of the Code of Canon Law. For which reason it was necessary that that law of Leo X be adapted to these our times and also to the more recent decrees of the Church, so that the Regular Tertiaries, and other manifold families of religious with simple vows which, having brought the spirit of Francis into their own institute and using the Franciscan name, have Francis as Father in a certain way, taking new growth therefrom, might with greater eagerness continue to deserve well of Christian and civil society. And so We entrusted the task of amending such a law to the Sacred Congregation placed over the affairs of Religious, which, when it had drawn up a new Rule more fully imbued with Franciscan spirit and consonant with the law of the Church of today, submitted it to Us for approval in accordance with its duty; and the chapters of this Law are those which are set forth here.

RULE OF THE THIRD ORDER REGULAR OF THE SERAPHIC FATHER ST. FRANCIS

Summary

CHAPTER

2 OF RELIGIOUS LIFE 1. The form of life of the Brothers and Sisters of the Third Order Regular of St. Francis is this: to observe the holy Gospel of our Lord Jesus Christ, living in obedience, chastity and poverty.

3 2. The Brothers and Sisters, in imitation of the Seraphic Father, promise obedience and reverence to the Lord Pope and the Roman Church. They are also bound to obey their Superiors canonically appointed, in all things that pertain to the general and special purpose of their own Institute (From the Rule of the First and Second Order, cap. I).

CHAPTER

4 ON NOVITIATE AND PROFESSION 3. Brothers and Sisters to be received into this Third Order ought to be faithful Catholics, not suspected of heresy, firm in obedience to the Roman Church, not bound by matrimony, free from debts, sound in body, prompt in spirit, stained by no common infamy, reconciled with their neighbours. And concerning all these things, before they are received, they are to be carefully examined by him who has the faculty of receiving them (Rule of the Third Order approved by Leo X, cap. I), the sacred canons and proper Constitutions being observed. 4. The year of novitiate ought under the discipline of the Master to have this purpose, that the mind of the student be formed by study of the rule and constitutions, by pious meditations and assiduous prayer, by learning those things which pertain to vows and to virtues, by suitable exercises for rooting out the seeds of vices, for restraining the movements of the soul, for acquiring virtues. Lay brothers moreover are to be carefully instructed in Christian doctrine, with special instruction given to them at least once in the week (can. 565 § 1 and 2). 5. When the time of probation is completed, those who are found suitable are to be admitted to profession.

CHAPTER

5 ON CHARITY TOWARD GOD AND NEIGHBOUR 6. With the obstacles removed by the three sacred vows which hinder holiness, the Brothers and Sisters strive to fulfil the divine law, which depends entirely on charity toward God and neighbour. Charity is the form of all virtues and the bond of perfection. For moderating vices, for making progress in grace, for attaining the sum of all virtues, nothing is better, nothing is more powerful than charity.

6 7. A great sign and aid of love for Christ is frequent, indeed daily, access to the Most Holy Eucharist, which is at once a sacred banquet and a memorial of His Passion. Let it also be the care of devout souls to visit frequently and venerate devoutly the Lord Jesus, remaining with us under the wonderful mystery: for this is the greatest Sacrament in the Church and the inexhaustible source of all goods. 8. But the proof of love for God is the exercise of charity toward one's neighbor; therefore in a true disciple of Christ let charity toward one's neighbor shine forth most brightly; let all speech be ordered, useful and honest: that charity may abound in deed, it is necessary that it first abound in the heart.

CHAPTER

7 On the Divine Office, Prayer and Fasting 9. Brothers and Sisters, as their own Constitutions provide, let them perform the Divine Office worthily, attentively and devoutly. Lay Brothers and Sisters, however, shall say twelve Pater Nosters for Matins and Lauds, and five for each of the other canonical hours.

8 10. On every day, unless legitimately hindered, they ought to hear Mass, and should take care to have a pious priest approved by the Ordinary of the place, who may propose the word of God to them on certain days and lead them to penance and virtues (Reg. III Ord. cit., cap. IV).

9 11. They ought also every day to examine themselves within and before God, considering what they have done, said and thought, that is, to perform an examination of conscience; to humbly seek pardon for their own faults and to offer and commend to God their resolutions for amendment (Reg. cit., cap. IV).

10 12. Let all take care to nourish and foster the fervor of devotion daily through frequent meditation on the Passion of Christ; let them follow and be transformed by the Seraphic Patriarch, so that they too may be able to cry out with St. Paul: "I am crucified with Christ." "And I live, now not I; but Christ liveth in me."

11 13. Besides the abstinences and fasts to which all the faithful are bound, let them observe those which are ordained in their own Constitutions, especially the vigils of the solemnities of the Immaculate Conception and of the Seraphic Father Francis.

CHAPTER V

12 On the manner of living inwardly and outwardly 14. Since Brothers and Sisters of this Fraternity are called of Penance, let them daily bear the cross of mortification, as is fitting for those truly doing penance. 15. Moreover, they ought to abstain from all curiosity, both in clothing and in all other things whatsoever. And according to the salutary counsel of the Prince of the Apostles, blessed Peter, laying aside all other vain ornaments of this world, they ought to wear no bodily ornament except their own religious habit (Reg. cit., cap. VI). They are also bound to observe enclosure according to the sacred canons and their own Constitutions.

13 16. They ought also to be sparing in words and speech, which are rarely multiplied without sin.

14 Let the conversation of Brothers and Sisters be such that all may edify by word and example and let them be mindful that the Lord said: "So let your light shine before men, that they may see your good works, and glorify your Father who is in heaven" (Matt. V, 16). Let them announce peace to all, using a humble and devout greeting: and let them carry peace not on their lips only, but always in their heart (Reg. cit., cap. VI).

CHAPTER VI

15 On the care of the sick 17. If any Brother or Sister falls into sickness, let no one refuse to offer his or her helping hand; but it shall be the duty of the Superiors to arrange suitable service for the sick. Let the others, not assigned to such service, not hesitate to visit the sick and comfort them with consoling words. Not only to the sick but also to the elderly, or to those in need in any other way, let all render the offices of charity with a joyful spirit, as befits the children of the Seraphic Father.

16 18. Let the Superiors especially take care to admonish the sick man or woman to accept the sickness as a penance, to make a true conversion to God, and let them set before them the nearness of death and the severity of divine judgment, and likewise the divine mercy (Reg. cit., cap. VII). 19. After any Brother or Sister has departed from this life, let the Superiors take care that his or her funeral rites be celebrated with great piety (Reg. cit., cap. IX). For the soul of any deceased person, let the appointed suffrages be faithfully rendered.

CHAPTER

17 On labor and the manner of laboring 20. Those who have devoted themselves to the service of God, aided by the grace of the Holy Spirit, let them flee idleness and faithfully and devoutly apply themselves to divine praises or to works of religious observance or charity (cf. Reg. II Ord., cap. VII). 21. Let religious fulfill their duties for God's sake, and whatever the Superiors require of them, as their strength permits, let them perform devoutly and faithfully, as has been said. Let them not refuse even the lowlier tasks, if any are to be done; rather let them perform them more willingly than others, following the footsteps of the Seraphic Father.

18 22. Let all things be done in charity, and let the holy love of God so impel the hearts of religious to the performance of works that they are concerned to work only for His glory and honor; and let them fulfill the admonition of St. Paul the Apostle: "Whether you eat or drink, or do anything else: do all to the glory of God."

CHAPTER

19 On the obligation of observing what the Rule contains 23. All and singular things contained in the present Rule are counsels for more easily saving the souls of wayfarers, and none are binding unto mortal or venial sin, unless by human or divine law someone were already bound (Reg. cit., cap. X).

20 24. The Brothers and Sisters are, however, bound to perform penances imposed upon them by their Superiors, when they are required thereupon. They are also bound to three essential vows: to poverty, according to the limits of their own statutes; to chastity, binding themselves to observe celibacy and moreover by a new title, that is by the vow itself, to abstain from whatsoever act, both external and internal, opposed to chastity; to obedience, assuming the obligation of obeying the command of a legitimate Superior according to the norm of their own Constitutions (cf. Reg. cit., cap. X).

21 25. All both Brothers and Sisters shall establish and compose their life according to the prescription of the religious state which they have professed, and in the first place shall faithfully observe those things which pertain to the perfection of their vows. Let them especially make much of those things which lead to following the Seraphic Father's charity and poverty: for it is most fitting for a son to bear the image and virtues of his Parent.

CONCLUSION OF THE HOLY FATHER FRANCIS BLESSING

22 Whosoever shall observe these things, may they be filled in heaven with the blessing of the most high heavenly Father, and on earth be filled with the blessing of His beloved Son, with the most holy Spirit the Paraclete and all the heavenly Powers and all the Saints. And I, Brother Francis, your little one and servant, as much as I am able, confirm upon you inwardly and outwardly this most holy blessing, which you may have with all the heavenly Powers and all the Saints now and for ever and ever. Amen. (From the Seraphic Father's testament).

23 We indeed, utterly abrogating the old law of Leo PP. X, willingly, in the seventh century after the death of Francis drawing to a close, by Our apostolic authority approve and confirm this Rule of the Third Order Regular of the Seraphic Father St. Francis; being fully confident that it shall be so, that the Regular Tertiaries, and all those who, although they do not have solemn vows by their institute, nevertheless lead a religious life under the guidance of Francis, strengthened by the spirit of the new Law, just as Our Predecessor Benedict PP. XV wrote most excellently, shall be an example to the other members of the Third Order, who remain entangled in the affairs and cares of the world, in cultivating Christian perfection, and shall continue to go before them as guides in seeking eternal salvation.

24 We command this, decreeing that these Letters and the Statutes inserted and included in them shall always remain firm, valid and efficacious, and shall produce and obtain their full and complete effects, and shall most amply benefit those to whom they pertain or may pertain in the future, now and for the time being; and thus it is to be rightly judged and determined, and anything attempted otherwise concerning these matters by anyone, by whatever authority, knowingly or unknowingly, shall be rendered null and void from now on. Notwithstanding anything to the contrary, even those worthy of special and individual mention. We will, however, that copies and excerpts of these Letters, even printed ones, subscribed by the hand of some public Notary and furnished with the seal of a man constituted in ecclesiastical dignity, shall receive the same credence as would be given to these presents themselves, if they were exhibited or shown.

25 Given at Rome at St. Peter's, on the fourth day of the month of October, on the feast of St. Francis of Assisi, in the year nineteen hundred twenty-seven, in the sixth year of Our Pontificate.

X, Constitutione data Inter eetera, eorum Regulam comprobaret.

REGULA TERTII ORDINIS REGULARIS SERAPHICI PATRIS S. FRANCISCI

Summa

CAPUT

I et II Ordinis, cap. I).

CAPUT

I), sacris canonibus Constitutionibusque propriis servatis. 4. Conversi praeterea diligenter in christiana doctrina instituantur, speciali collatione ad eos habita semel saltem in hebdomada (can.

11 13. Praeter abstinentias et ieiunia quibus omnes fideles adstringuntur, ea observent quae in propriis Constitutionibus ordinantur, praesertim vigilias solemnitatum Immaculatae Conceptionis et Seraphici P. Francisci.

CAPUT V

15. Oportet insuper eos ab omni curiositate, tam in vestimentis quam in aliis quibuscumque abstinere. Et iuxta Apostolorum principis beati Petri salubre consilium, depositio ceteris vanis huius saeculi ornamentis, nullum ornamentum corporale portare debent, nisi proprium religiosum habitum (Reg. cit., cap. VI).

VI).

CAPUT V I

CONCLUSIO SANCTI PATRIS FRANCISCI BENEDICTIO

Amen.

I et II Ordinis, cap. I).

CAPO

LAURENT!
