Catholicae religionis

LITTERAE APOSTOLICAE
Publicae preces commendantur et indicuntur ob infelicem religionis statum in Hispaniae regno, concessa plenaria indulgentia in forma Iubilaei '.
GREGORIUS PP. XVI.
5 Datum Romae apud s. Petrum sub annulo piscatoris die vigesima secunda februar. millesimo octingentesimo quadragesimo secundo , pontificatus Nostri anno decimo secundo.

APOSTOLIC LETTERS
Public prayers are commended and appointed on account of the unhappy state of religion in the kingdom of Spain, with a plenary indulgence granted in the form of a Jubilee.
GREGORY PP. XVI.
for perpetual remembrance of the matter.
1 The cause of the Catholic religion, entrusted by the supreme prince of pastors and most loving restorer of mankind, Christ Jesus, to Our humility, and that charity with which We regard all peoples, nations, and races, so intimately press upon Us and urge Us that We can never pass over anything which We understand pertains to keeping the deposit of faith whole and entire, and to warding off the destruction of souls. Now it is most certainly known in what state the affairs of religion are in Spain, and with how much sorrow of heart We have been compelled for many years now to mourn the most sorrowful vicissitudes of the Church in that kingdom. Indeed, that people, inasmuch as they have not departed from the most holy teachings of their fathers, are exceedingly devoted to the orthodox faith, and the clergy for the most part strenuously wage the battles of the Lord, and the sacred bishops almost all, although vexed in a pitiable manner, or even expelled, and afflicted with the gravest hardships, apply themselves with all their strength to the care of the salvation of their own flock. Yet there are found in that place men of perdition, not few in number, who, joined together in a nefarious association among themselves, like the fierce waves of the sea foaming forth their confusions, wage a most foul war against Christ and His Saints; and having already inflicted the greatest damages upon the Catholic religion, they impiously strive to overturn it, if it were possible. We indeed, by reason of the duty of Our ministry, raising up an apostolic voice, have not refrained from publicly lamenting the most grave wounds inflicted upon the Church by the Madrid government; and We have declared entirely null and void all things done by the civil power against the rights and laws of the Church itself. Moreover, with every expression of sorrow, We have vehemently complained of the most atrocious injuries and calamities inflicted upon the venerable brethren, the bishops of that kingdom, and upon the sacred persons of both orders of clergy, as well as of the abomination set up in the holy place, and of ecclesiastical goods sacrilegiously plundered, sold, and adjudged to the public treasury; recalling at the same time into memory the penalties and censures which the apostolic constitutions and ecumenical councils inflict as incurred by the very fact upon those who do not shrink from perpetrating such crimes. And this office of Our apostolic ministry We have taken care to perform once and again by means of two allocutions addressed to Our venerable brethren, the cardinals of the Holy Roman Church, held in consistory on the first of February in the year one thousand eight hundred and thirty-six and on the first of March in the year one thousand eight hundred and forty-one: which indeed We ordered to be published in print, so that, namely, there might exist a public and perpetual monument of Our apostolic solicitude and reprobation.
2 We were indeed raised to this hope that this voice of Ours, which burst forth from the most afflicted heart of the common father of all the faithful, would be heard; and that by Our repeated warnings and remonstrances, such harsh persecution against the Catholic religion would cease. For this reason certainly, prostrate day and night at the feet of the Crucified, we have never ceased to pray amid many tears and sighs in the humility of Our heart, that by His immense mercy He would extend a helping hand to the laboring Spanish nation, and show the light of His truth to those in error, so that they might return to the way of justice. But by an inscrutable divine judgment, no outcome has yet answered Our hope: rather, we see evils increasing day by day throughout those vast regions, so that the Catholic religion is openly threatened with utter destruction. Passing over in silence many other things sufficiently well known, which have been recently decreed or even accomplished there against the most sacred laws of the Church and the rights of this Apostolic See, we grieve that matters have reached such a pitch of wickedness that, by diabolical malice indeed, an execrable law has been proposed to the supreme assemblies of the kingdom, tending chiefly to the end that legitimate ecclesiastical authority be utterly abolished, and an impious opinion be established, that lay power by its supreme right dominates the Church itself and its affairs. And indeed in that law it is constituted that the Spanish nation is to have no regard for this Apostolic See; all communication with it is to be cut off for any ecclesiastical favors, indults, concessions, and those are to be punished entirely who oppose such a prescription. Likewise it is enacted that apostolic letters and other rescripts emanating from the Holy See, unless they have been requested from Spain, not only are in no way to be observed and are to have no effect; but also are to be reported by those to whom they come to the civil authority within the briefest interval of time, so that they may then be governed by it, and a penalty is also established for violators of this prescription. Furthermore it is decreed that impediments to marriage are to be subject to the bishops of the kingdom, until the code of civil laws places a distinction between the contracting of marriage and the sacrament; nor can any case concerning religious matters be sent from Spain to Rome, 1 and at no time will either a nuncio or a legate of this Holy See ever be admitted there with power to grant favors or dispensations, even gratuitous ones. What more? The most sacred right of the Roman Pontiff to confirm or reject bishops elected in Spain is plainly excluded; and indeed those are punished with exile both presbyters designated to some episcopal church who have sought from this Holy See either confirmation or apostolic letters; and metropolitans who have requested the pallium from it. After these things, it is truly remarkable that the Roman Pontiff himself is asserted in that law to be held as the center of the Church: yet with him no place is left for communication, except through the intervention of permission and inspection of the government. In this therefore so great a disturbance of the Catholic religion throughout Spain, with evils growing heavier there, we, as much as in Us lies, desire to restrain them, and to bring Our aid to those most dear faithful who have long been stretching suppliant hands toward Us, following the example of Our predecessors, we have determined to have recourse to the prayers of the universal Church, and most earnestly to stir up the piety of all Catholics toward that afflicted nation. And certainly since no one can be separated from participation in this sorrow, and in such great danger to religion and faith there must be one cause of grief for all, there must likewise be one way for all to help. Therefore, while by these letters of Ours we renew and confirm the complaints and remonstrances set forth in the aforesaid allocutions, we reprobate, abrogate, and declare to be of no force all acts done by the Madrid government against the rights and dignity of the Church and this Holy See up to now, and especially the law recently proposed, we exhort each and every venerable brother, patriarchs, primates, archbishops, bishops, throughout the extent of the Catholic world, having grace and communion with this Apostolic See, by that charity by which we are one in the Lord, and by that faith by which we coalesce into one body, again and again, that, mingling their tears with Ours, they strive unanimously to bend divine wrath and implore the mercy of almighty God for the unhappy Spanish nation, and earnestly endeavor to inflame the clergy and people committed to them to assiduous prayers to this end. We will and command that each and every venerable brother archbishops and bishops within Our pontifical dominion in their own dioceses, in that manner which they shall judge more expedient in the Lord, take care to perform public supplications to the Father of mercies, so that on account of the blood of His Son, which was shed for all, the days of temptation in the kingdom of Spain may be shortened. And so that God may more easily incline His ears to Our prayers, let all humbly approach the most powerful Virgin Mother of God, helper of the Church, our most loving mother and most faithful patroness of Spain; let them moreover seek the suffrage of the Prince of the Apostles, whom Christ made the rock of His Church, against which the gates of hell shall not prevail; and likewise of all the Heavenly Ones, especially those who have greatly illustrated Spain by virtue, sanctity, and wonders. So that individuals of every order, rank, and condition of the faithful may press forward with more fervent charity and more abundant fruit in prayers and supplications, we have determined to bring forth the treasures of heavenly gifts with a liberal hand. Hence we grant a plenary indulgence in the form of a Jubilee, to be gained by all Christ's faithful who, having been rightly expiated by sacramental confession and refreshed by the most holy Eucharist, shall have attended solemn supplications, to be established at the discretion of each one's own Ordinary, at least three times, and shall have prayed fervently in a church designated by the same Ordinaries three times within fifteen days for the aforesaid reason.
3 We are indeed confident that the angels of peace, holding golden phials and a golden censer in their hands, will offer up the fervent and humble prayers of Ourselves and of the whole Church for Spain upon the golden altar to the Lord, and that He Himself, who is rich in mercies, receiving them with a benign countenance, will deign to grant Our petitions and those common to the faithful, and at the same time will bring it to pass that by His right hand and the arm of His strength, adversities and errors being destroyed, holy Mother Church may at length find some respite from such great calamities, and may enjoy that peace and liberty with which Christ Himself endowed her.
4 Moreover, in order that these Our letters may become known more easily to all, and that no one may be able to allege ignorance of them, We will and command that they be published at the doors of the basilica of the Prince of the Apostles and of the Apostolic Chancery, as well as of the general Curia on the Mons Citatorius, and in the Acie of the Campus Florae of the City, by one of Our couriers, as is customary, and that copies thereof be left affixed in those places.
5 Given at Rome at St. Peter's under the Fisherman's ring on the twenty-second day of February in the year one thousand eight hundred and forty-two, in the twelfth year of Our pontificate.
