2 Exordium a conservatione Ecclesiasticae disciplinae.
4 §. 2. Cum autem hujus generis pacta improba, reprobata, damnata sint, & gratiæ hujusmodi caffationis, feu extinctionis Pensionis, tanquam subreptitiae, & dolosa calliditate obtentæ, & quæ, rei veritate, & totius negotii serie expreffa, nunquam a Sede Apostolica concessa fuiffent, nullæ, irritæ, ac inanes fint, & in maximum animarum eas fraudulentiter impetrantium damnum, ac detrimentum tendant, & præterea scandalo simplicibus, & bonis abominationi, & pluribus æterno exitio fint: Siquidem gratiarum hujusmodi imperatores, qui Ecclesiastica Beneficia tali infami mercatu negotiantur potiùs, quàm resignant, non folum graviffimo peccato, quod præ oculis habere deberent, animas suas illaqueant, fed infuper palàm apud omnes in populo, non fine infamia Ecclesiastici ordinis, exsecrantur, & contemnuntur; Et si pro aliis Beneficiis obtinendis ad Datarium Apostolicam accedere aufi fuerint, tanquam Beneficiorum Venditores malè audiunt, & publicè redarguuntur; cum ftatim ipfis ab eorum competitoribus opponatur Resignatio facta, cum caffatione Pensionis per anticipatas, feu anticipandas solutiones, hoc eft, indigna Beneficii jam antea obtenti negotiatio, & clandestina fub ambagibus, & fraudulentis conventionibus deteftanda venditio.
5 §. 3. Nos igitur hoc execrabile malum, quo non leve Ecclesiastico Ordini dedecus, & infamiæ nota inuritur, prout neceffitas, & pastorale munus poftulat, coercere in futurum volentes, & longè a Sanctuario Dei profanam hujusmodi abominationem removere, Motu proprio, ac certa scientia, & matura deliberatione Noſtris, deque Apostolicae potestatis plenitudine ftatuimus, & declaramus, omnia hujusmodi pacta, & conventiones pro caffatione, feu abolitione Pensionum per anticipatas, vel anticipandas solutiones contemporaneè ad Resignationes Beneficiorum, cum refervatione Pensionis, per quascunque personas quavis dignitate, honore, ac præeminentia insignitas inita, tanquam à Sacris Canonibus, & Apostolicis Constitutionibus improbata, & simoniacam labem redolentia, nulla, caffa, ac irrita effe; & omnes caffationes, abolitiones, & extinctiones Pensionum hujusmodi, quas in postferum intra sex menses,à die captæ poffeffionis Beneficii per Resignatarium computandos, fieri contigerit, etiam fi nullum præcedens pactum interveniffe inter partes probari poffit, & caffatio prædicta fecura fit vigore Supplicationis manu nostra, vel Romani Pontificis pro tempore signatæ, quam nullatenus, tanquam per subreptionem, & fraudes obtentam, neque in judicio, neque extra, ad ullum effectum eis suffragari volumus, irritas, nullas, & inanes effe, ac omnibus viribus, ac effeetu vacuas, & quatenus opus fit, motu, scientia, & deliberatione fimili, deque Apostolica potestatis plenitudine, tenore præfentium damnamus, revocamus, annullamus, caffamus, & abolemus, & infuper tàm Resignantem, quàm Resignatarium ab omni jure Beneficii decidiffe, eosque ipfo facto, absque alia declaratione, vel Judicis fententia, privatos, & ad alia obtinenda inhabiles effe, ac fore, & à quocumque Beneficium hujusmodi, tanquam de jure, & de facto vacans, impetra-ri poffe; & præterea Resignantem ad restituendas pecunias pro caffatione Pensionis hujusmodi indebite, & simoniacè perceptas, quæ arbitrio Ordinarii erunt piis locis applicandæ, vel pauperibus perfonis distribuendæ, fub peccato gravi teneri, & Ecclesiasticis remediis, ac poenis, fi renuat, ipfo jure, absque alia fententia, & declaratione, cogi poffe, motu, scientia, & poteflate pari decernimus, & declaramus.
6 §. 4. Et quoniam multa malitia hominum eft in terra, ut omnis aditus fraudibus, & dolis, quos perverfa nonnullo-rum calliditas, & in exitium fui ingenio-fa excogitare confuevit, quoad fieri po-test, A. II. test, intercludatur, volumus, præcipimus, & declaramus, sub hac Nostra voluntate, constitutione, & dispositione comprehendendi omnes, & singulas cessiones, seu translationes in ipsum Resignatarium, aut in aliam personam, commodi, seu utilitatis percipiendi fructus pensionum hujusmodi, necnon alias quascumque cessiones, translationes, resignationes, extinctioniones, abolitiones, quovis modo, titulo, nomine, colore, & auctoritate, per anticipatas solutiones, seu præsentata pecunia facta intra dictum tempus sex mensem; & etiam ultra id temporis spatium, dummodo reprobum illud, & detestabile pactum præcessisse confiterit.
7 §. 5. Mandamus præterea, & jubemus, easdem præsentes literas perpetuo firmas, validas, & efficaces existere, & fore, & nullo unquam tempore sub quovis colore, & prætextu, etiam defectus nostræ intentionis, impugnari posse: Sicque, & non aliàs, in præmissis omnibus, & singulis, per quoscumque Judices Ordinarios, & Delegatos, etiam Causarum Palatii Apostolici Auditores, ac prædictæ S. R. E. Cardinales, etiam de Latere Legatos, & Sedis Apostolicæ præfatæ Nuncios, aliosque quoslibet quacumque præeminentia, & potestate fungentes, & functuros, sublatâ eis, & eorum culibet quavis aliter judicandi, & interpretandi facultate, & auctoritate, judicari, & definiri debere; ac irritum, & inane, si secus super his à quoquam quavis auctoritate scienter, vel ignoranter contigerit attentari: Non obstantibus Resignantium, seu Cedentium voluntatibus, conditionibus, protestationibus, & clausulis in ipsismet resignationibus, & cessionibus, seu Procuratorum constitutionibus, & Mandatis, ac aliis, etiam ad præservationem suorum jurium, & significationem, quod non aliter, nec alio modo resignant, seu cedunt, appositis, & quacumque verborum vi, formula, & multiplicatione, & amplitudine expressis; necnon quibuscumvis indultis, privilegiis, & gratiis Apostolicis tam generalibus, quàm particularibus, quantumvis speciali mentione, & nota dignis, quibuscumque Archiepiscopis, Episcopis, & aliis superioribus, & inferioribus Ecclesiarum Prælatis, etiam S. R. E. Cardinalibus, ac eorum, & nostris familiaribus continuis commensalibus, necnon Literarum Apostolicarum Scriptoribus, Abbreviatoribus, cæterisque Romanæ Curiæ Officialibus concessis, & confirmatis, cæterisque contrariis quibuscumque.
8 §. 6. Cœterum, ut faciliùs præsentes Literæ omnibus innotescant, & nemo prætextu illarum ignorantiae excusari possit, jubemus, easdem ad valvas Ecclesiæ Lateranensis, & Principis Apostolorum, necnon Cancellariæ Apostolicæ, Curiaeque generalis in Monte Citatorio, ac in Acie Campi Floræ de Urbe, aliisque locis solitis, & consuetis, ut moris est, publicari, eorumque exempla affigi: Volumusque, eas sic publicatas, omnes, & singulos perinde afficere, & obligare, ac si illis ipsis fuissent singulariter intimatæ. Exemplis quoque prædictis etiam impressis, manuque Notarii publici, & figillo Prælati Ecclesiastici, vel ejus Curiae obsignatis, eamdem prorsus fidem adhiberi, quæ ipsis præsentibus adhiberetur, si forrent exhibitæ, vel ostensæ.
9 §. 7. Nulli ergo omnino hominum liceat, hanc paginam Nostri decreti, constitutionis, declarationis, annullationis, infirmationis, prohibitionis, interdicti, ac voluntatis infringere, vel ei ausu temerario contraire; si quis autem hoc attentare præsumpserit, indignationem Omnipotentis Dei, ac Beatorum Petri, & Pauli Apostolorum ejus se noverit incurfurum. BENEDICT, BISHOP, SERVANT OF THE SERVANTS OF GOD.
1 For perpetual memory of the matter.
2 Beginning from the preservation of ecclesiastical discipline.
3 Placed in the sublime Chair of Blessed Peter by Divine dispensation, though unworthy, we are constrained by grave sorrow whenever we turn the eyes of our consideration to the more distinguished part of the Lord's Flock, that is to the ecclesiastical assembly, and we find it dishonored either by depraved morals or by unseemly acts; for we are not ignorant of how great a danger of corruption is to be feared among the peoples if that from which the rest ought to be ordered should vanish. §. I. It has indeed come to the ears of our solicitude that it not infrequently happens that certain Clerics constituted in minor or major orders, or decorated with ecclesiastical tonsure alone, possessing simple Benefices or Offices, or those with the burden of residence, resign them to others with an annual pension reserved to themselves under Apostolic approval, having made at the same time a pact with the Resignee to cancel and abolish the said pension, money being presented, namely by certain anticipated payments of sums of money to that amount which, for the abolition and extinction of the aforesaid pension, or rather for the wickedly accomplished concealed sale of the benefice itself, was established by express convention between the Parties. And because these profane dealers in Benefices are not ignorant that if such improper pacts should become known to the Ministers of our Apostolic Datary, or to Us, such resignations would never be admitted by the Datary, or our Pro-datary, or by Us, or by other Roman Pontiffs existing in time; in order to deceive the vigilance of the officials of the said Apostolic Datary, and of Ours, and of other Pontiffs, the cunning depravity of wicked men has devised this path and method of perdition: By secret and clandestine pact between the Resignor and the Resignee, agreed upon for the sum of money to cancel and extinguish the pension, and that sum sometimes also deposited with a public merchant or money-changer, they arrange that the Bull of resignation of the Benefice and another of the Pension reserved on the same Benefice in favor of the Resignor be expedited together and at the same time; yet in such a way that at nearly the same time, or not long after the time when the usual Supplication for the reservation of the Pension is dated, another Supplication is subscribed or signed for the cancellation and extinction of the same Pension to be made by anticipated or to-be-anticipated payments, no mention being made of the preceding abominable convention and pact reeking of simony, by which the resignation of the Benefice is transformed by execrable change into the concealed sale of the Benefice itself.
4 §. 2. Since, however, pacts of this kind are improper, reprobated, and condemned, and graces of such cancellation or extinction of the Pension, as having been obtained by subreptitious and fraudulent cunning, and which, in the truth of the matter and the entire series of the transaction expressed, would never have been granted by the Apostolic See, are null, void, and of no effect, and tend to the greatest harm and detriment of the souls of those fraudulently obtaining them, and moreover are a scandal to the simple and an abomination to the good and eternal ruin to many: Since indeed the obtainers of such graces, who traffic in Ecclesiastical Benefices in such infamous commerce rather than resign them, not only ensnare their souls in the gravest sin, which they ought to have before their eyes, but moreover are openly execrated and despised by all in the people, not without infamy to the Ecclesiastical order; And if they should dare to approach the Apostolic Datary for obtaining other Benefices, they are ill-spoken of as Sellers of Benefices and are publicly rebuked; since immediately their competitors oppose to them the Resignation made with cancellation of the Pension by anticipated or to-be-anticipated payments, that is, the unworthy transaction of the Benefice already previously obtained, and the clandestine concealed sale under ambiguities and fraudulent conventions to be detested.
5 § 3. We therefore, wishing to restrain in the future this execrable evil, by which no light dishonor and mark of infamy is inflicted upon the Ecclesiastical Order, and to remove far from the Sanctuary of God such profane abomination, as necessity and pastoral duty demand, by Our own motion, with certain knowledge, and mature deliberation of Ours, and from the fullness of Apostolic power, do establish and declare that all such pacts and conventions for the cessation or abolition of Pensions by anticipated or to be anticipated payments made contemporaneously with Resignations of Benefices, with reservation of Pension, entered into by whatsoever persons adorned with any dignity, honor, and preeminence, as disapproved by the Sacred Canons and Apostolic Constitutions, and smelling of the stain of simony, are null, void, and invalid; and all such cessations, abolitions, and extinctions of Pensions which shall happen to be made hereafter within six months, to be reckoned from the day of taking possession of the Benefice by the Resignatary, even if no preceding pact between the parties can be proved to have intervened, and the aforesaid cessation be secure by virtue of a Supplication signed by Our hand or by the Roman Pontiff for the time being, which in no way, as obtained by subreption and frauds, do We wish to avail them either in judgment or outside it for any effect, are invalid, null, and void, and insofar as it is necessary, by motion, knowledge, and similar deliberation, and from the fullness of Apostolic power, by the tenor of these presents We condemn, revoke, annul, void, and abolish; and furthermore both the Resignor and the Resignatary have forfeited all right to the Benefice, and they by that very fact, without any other declaration or sentence of a Judge, are deprived and rendered incapable of obtaining others, and the Benefice itself may be sought by anyone as vacant both by law and in fact; and moreover We decree and declare by motion, knowledge, and equal power that the Resignor is bound under grave sin to restore the monies improperly and simoniacally received for the cessation of such Pension, which by the discretion of the Ordinary are to be applied to pious places or distributed to poor persons, and if he refuse, he can be compelled by Ecclesiastical remedies and penalties, by that very law, without any other sentence and declaration.
6 § 4. And since the malice of men is great upon the earth, so that every access to frauds and deceits, which the perverse cunning of some, and ingenuity contrived for their own ruin, is accustomed to devise, may be cut off as much as possible, We will, command, and declare, under this Our will, constitution, and disposition, that there are to be comprehended all and singular cessions or transfers to the Resignatary himself, or to another person, of the benefit or utility of receiving the fruits of such Pensions, as well as all other cessions whatsoever, transfers, resignations, extinctions, abolitions, made in any manner, title, name, color, and authority, by anticipated payments or presented money made within the said space of six months; and even beyond that period of time, provided that the reprobate and detestable pact preceded it.
7 §. 5. We further command and enjoin that these same present letters shall be perpetually firm, valid, and efficacious, and shall be, and that they can never at any time under any colour and pretext, even on account of a defect of our intention, be impugned: And thus, and not otherwise, in all and singular the aforesaid matters, by whatsoever Ordinary and Delegated Judges, even the Auditors of the Cases of the Apostolic Palace, and the aforesaid Cardinals of the Holy Roman Church, even Legates a Latere, and Nuncios of the aforesaid Apostolic See, and any others whatsoever exercising or about to exercise any eminence and power, with the faculty and authority of judging and interpreting otherwise taken away from them and from each of them, judgment and definition ought to be made; and it shall be null and void, if otherwise concerning these things by anyone whatsoever with any authority knowingly or unknowingly should happen to be attempted: Notwithstanding the wills, conditions, protestations, and clauses of the Resigning or Ceding parties in the resignations and cessions themselves, or in the Procurators' constitutions and Mandates, and others, even those appended for the preservation of their rights and signification that they do not otherwise, nor in any other manner resign or cede, and expressed by whatsoever force of words, formula, and multiplication and amplitude; as also by whatsoever indults, privileges, and Apostolic graces, both general and particular, however worthy of special mention and note, granted and confirmed to whatsoever Archbishops, Bishops, and other superior and inferior Prelates of Churches, even Cardinals of the Holy Roman Church, and their and our familiar table companions, as well as to the Writers, Abbreviators, and other Officials of the Roman Curia, and by whatsoever other things contrary.
8 §. 6. Moreover, in order that these present Letters may more easily become known to all, and no one may excuse himself on the pretext of their ignorance, we command that the same be published at the doors of the Lateran Church and of the Prince of the Apostles, as well as at the Apostolic Chancery, and the general Curia on the Citatorio Hill, and in the Field of the Flower of the City, and in other places accustomed and customary, as is the manner, and copies thereof be affixed: And we will that these thus published affect and bind all and singular just as if they had been singularly intimated to them. And to the aforesaid copies also, even printed, and sealed by the hand of a public Notary and the seal of an Ecclesiastical Prelate or his Curia, the same faith altogether shall be given as would be given to these presents themselves, if they were exhibited or shown.
9 §. 7. Let no man whatsoever be permitted to infringe this page of our decree, constitution, declaration, annulment, invalidation, prohibition, interdict, and will, or to dare to act contrary to it with rash presumption; but if anyone should presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul His. Given at Rome at St. Mary Major in the year of the Incarnation of the Lord one thousand seven hundred and forty-one, on the fourth day before the Kalends of September, in the second year of our Pontificate.
