1 L'ufficio supremo di reggere la cattolica Chiesa, di cui per disposizione divina siamo investiti, esige in primo luogo che procuriamo con ogni studio tutto ciò che conduce al bene e all'utilità spirituale delle anime a Noi affidate. Grande gioia ha recato al Nostro animo la supplica dei Venerabili Nostri Fratelli Vescovi della provincia ecclesiastica di San Salvador nel Brasile, in un convegno provinciale da loro tenuto in tempo precedente e a Noi presentata, con la quale si chiedeva che l'amplissima regione denominata Piauhy, la quale è sottoposta alla giurisdizione spirituale del Venerabile Nostro Fratello vescovo di San Luigi di Maragnano, venisse eretta in diocesi propria e separata per una più conveniente amministrazione delle cose sacre e per il bene dei fedeli. E Noi, considerando bene come l'ampio territorio che la provincia denominata Piauhy comprende, la grande frequenza di popolo che la abita, l'eccessiva distanza dei luoghi che non permette facilmente al popolo fedele di accedere al pastore, rendono necessaria questa nuova erezione di diocesi, e come la facile cura dei cristiani fedeli e la comunicazione spirituale dei vescovi giova sommamente al bene e all'utilità delle loro anime, non abbiamo ricusato di prestare orecchio favorevole alle predette suppliche. Pertanto, con la cura del Venerabile Nostro Fratello attuale vescovo di San Luigi di Maragnano, alla cui giurisdizione la regione di Piauhy è sottoposta e dalla cui smembrazione deve essere stabilita l'erezione del nuovo vescovato sottoscritto, attenti ai voti del governo e del popolo, e agli uffici del diletto Nostro figlio Nunzio Apostolico nella regione brasiliana, il quale di buon grado e volentieri ha prestato il suo pieno consenso a ciò; e parimenti gli altri, ai quali interessava, vi hanno consentito; considerato tutto ciò che in simili affari deve essere preso in considerazione con maturo studio e deliberazione, e assolvendo e dichiarando assolti tutti e singoli coloro ai quali queste lettere giovano, da qualsiasi scomunica, sospensione e interdetto, e da altre sentenze, censure e pene ecclesiastiche, di qualunque modo contratte, al solo effetto di conseguire quanto contenuto nelle presenti, con moto proprio e certa scienza, e dalla pienezza della potestà apostolica, la città comunemente denominata Teresina, che è il capo e il principale di tutta la regione o stato civile denominato Piauhy, l'eleviamo e l'innalziamo con autorità apostolica alla dignità di città episcopale, affinché fruisca da ora innanzi di tutti e singoli i diritti, gli onori e le prerogative di cui fruiscono, usano e godono le altre città insignite di sede episcopale nella Repubblica brasiliana e i loro cittadini. Inoltre la chiesa parrocchiale esistente nella medesima città di Teresina e dedicata all'onore della Nostra Signora Addolorata, l'eleviamo e l'erigiamo con la medesima autorità apostolica allo stato e alla dignità di cattedrale, affinché essa, conservata la primitiva invocazione, fruisca di tutti i diritti, i privilegi e gli onori di cui fruiscono le altre chiese cattedrali nella Repubblica brasiliana; e in questa chiesa istituiamo e erigiamo perpetuamente la sede, la cattedra e la dignità episcopale per un vescovo da ora innanzi denominato di Piauhy, il quale presida alla detta chiesa, città e diocesi e parimenti al clero e al popolo di essa nel Signore, convochi il Sinodo, e abbia ed eserciti tutti e singoli i diritti, gli uffici e i compiti episcopali, con la sua mensa episcopale, capitolo, arca, sigillo e altri insegni cattedrali e pontificali, diritti, giurisdizioni, preminenze, prerogative, privilegi, grazie, onori, favori e indulti reali, personali e misti, di cui godono e potranno godere le altre chiese cattedrali esistenti nella ricordata Repubblica brasiliana e i loro presuli, non però da titolo oneroso o da indulto o privilegio particolare, con simile autorità perpetuamente istituiamo ed erigiamo.

2 Questa chiesa di Piauhy novellamente eretta come sopra, la dichiariamo suffraganea per il tempo dell'Arcivescovo attualmente esistente di San Salvador nel Brasile, e la sottoponiamo alla giurisdizione metropolitica del medesimo Arcivescovo.

3 Supplendo però con la medesima autorità apostolica, per quanto sia necessario, al consenso di tutti e di chiunque abbia o presuma di avere interesse, l'intera regione o territorio civile denominato Piauhy, che attualmente è sottoposto alla diocesi di San Luigi di Maragnano, e che comprende più di trenta parrocchie, dalla medesima diocesi di San Luigi perpetuamente stacchiamo, dividiamo e separiamo. Nel predetto territorio, parrocchie o luoghi così staccati e divisi, esistenti e che esistono, le chiese, i monasteri, i conventi e tutti gli altri, qualunque e di qualsiasi genere, benefici sia secolari che regolari, e tutte e singole le persone di ambo i sessi delle parrocchie suddette avulse dalla detta diocesi, abitanti e residenti, tanto laici quanto chierici, presbiteri, beneficiati e religiosi non però esenti, di qualunque stato, ordine e condizione, dall'ordinaria giurisdizione, potestà e superiorità del vescovo attualmente esistente, e da ogni diritto del capitolo e dei canonici della chiesa cattedrale di San Luigi di Maragnano esoneriamo e separiamo, e la medesima regione o territorio predetto di Piauhy, così come sopra staccato e separato, per diocesi del nuovo episcopato di Piauhy, dove il nuovo vescovo e i suoi legittimi successori dovranno sempre risiedere, perpetuamente assegniamo e attribuiamo; e inoltre gli abitanti e i residenti di ambo i sessi e i religiosi sopra espressi, alla chiesa episcopale di Piauhy novellamente eretta, e al suo futuro presule per sua città, territorio, diocesi, clero e popolo perpetuamente iscriviamo e sottomettiamo. Tutti i confini e i limiti della detta nuova diocesi di Piauhy siano esattamente gli stessi e i confini che la circoscrizione civile dello stato e della regione di Piauhy attualmente formano e costituiscono, e li formiamo e costituiamo in perpetuo con simile autorità apostolica. Tutti e singoli i documenti riguardanti le parrocchie e i luoghi staccati dalla diocesi di San Luigi di Maragnano e divisi e attribuiti e assegnati al nuovo episcopato di Piauhy, che attualmente si trovano nella cancelleria del predetto episcopato di San Luigi, ordiniamo che da questa siano estratti e consegnati nella forma opportuna alla cancelleria del novellamente, come sopra detto, eretto episcopato di Piauhy, affinché in essa siano perpetuamente conservati. Quanto alla dote della mensa episcopale di questa nuova diocesi, poiché alcuni beni stabili che si trovano e sono costituiti nel suo territorio possono al presente sembrare sufficienti per sostenere decorosamente la dignità del vescovo, questi perpetuamente attribuiamo e assegniamo a questa mensa episcopale come sua dote, confidando nel Signore che, quando il nuovo vescovo, con l'aiuto di Dio, avrà preso possesso della sua sede, dai pii doni dei fedeli, per la cui utilità spirituale questa nuova sede è stata costituita, e dalla pia liberalità di coloro che presiedono a questa provincia, più abbondanti sussidi saranno volentieri forniti alla mensa episcopale di questa nuova diocesi, per promuovere la gloria di Dio e le esigenze della religione. Per la conveniente abitazione del nuovo vescovo e dei suoi successori nel detto episcopato, l'edificio che nella città episcopale è annesso e congiunto alla chiesa stessa eretta in cattedrale, perpetuamente assegniamo e stabiliamo.

4 Poiché il decoro del culto divino deve essere massimamente caro al Nostro cuore, ingiungamo alla sollecitudine del nuovo futuro vescovo, che il Capitolo della cattedrale secondo le canoniche regole della Chiesa, nella sua diocesi, non appena sia possibile, provveda a erigere, costituendo prebende teologale e penitenziale, e conservando le medesime dignità, come nelle altre chiese cattedrali che esistono nella Repubblica Brasiliana; la collazione però della dignità dopo quella pontificale sia sempre e perpetuamente riservata alla Sede Apostolica. Nel frattempo, finché il detto Capitolo non sia canonicamente costituito, il vescovo si assuma un consiglio di uomini provati e prudenti, del cui consiglio si varrà nell'espedire i più gravi affari della sua diocesi. Dato poi il Capitolo, non appena esso sia stato canonicamente costituito, affinché possa farsi statuti, ordinazioni e decreti secondo le prescrizioni dei sacri Canoni e specialmente del Concilio di Trento, che però saranno soggetti alla cognizione e approvazione dell'Ordinario Antistite, affinché abbiano forza e efficacia di legge, facciamo e impartiamo facoltà; e al medesimo Capitolo inoltre, affinché anche di tutti i privilegi, diritti e prerogative, di cui similmente gli altri Capitoli delle altre chiese cattedrali nella ricordata regione Brasiliana usano, godono, possiedono e si gloriano (eccettuati però quelli concessi da peculiare indulto o acquisiti a titolo oneroso), similmente possa e valga usare, godere, possedere e gloriarsi, perpetuamente concediamo e indul­giamo. Inoltre, poiché per coltivare la vigna del Signore è necessario che il numero dei sacerdoti sia aumentato, a cui l'esperienza mostra che i Seminari conducono sommamente, e poiché la chiesa cattedrale di questa nuova diocesi contiene un ampio edificio annesso e adatto all'uso del Seminario, vogliamo che il nuovo vescovo, quando sarà possibile, impieghi sollecita opera nell'erigere il Seminario in quel­l'edificio, secondo i decreti del ricordato Concilio di Trento, affinché i giovani chierici siano accuratamente e diligentemente istruiti nella pietà e nella dottrina sacra, secondo le norme tramandate dalla Sede Apostolica, e si preparino ministri utili e zelanti per la Chiesa.

5 Inoltre a Noi e alla Sede Apostolica espressamente riserbiamo la facoltà di fare liberamente una nuova smembrazione o circoscrizione della predetta nuova diocesi, in qualunque modo parrà opportuno nel Signore, senza che sia necessario ricercare il consenso dell'Antistite e del Capitolo della cattedrale, né attribuire e costituire alcuna compensazione territoriale.

6 Vogliamo però che tutte quelle cose che riguardano le cose, i diritti e le persone ecclesiastiche, e di cui non è stata fatta espressa menzione nel Nostro presente motu proprio, rimangano ferme e ratificate secondo le canoniche regole e la disciplina della cattolica Chiesa; e se qualche difficoltà o controversia riguardo ai predetti punti sorgesse nella novellamente eretta diocesi di Piauhy, essa sarà deferita alla Sede Apostolica, la quale, accuratamente esaminate le cose, decreterà come di diritto.

7 La tassa canonica della suddetta chiesa di Piauhy eretta in cattedrale, tenuto conto dei tempi, l'abbiamo stabilita in fiorini d'oro di Camera trentatré con la terza parte di un fiorino simile, e così ordiniamo che sia iscritto nei libri della Camera Apostolica secondo il consueto. Queste presenti lettere, e tutto ciò che in esse è contenuto, in nessun tempo mai, per qualsiasi motivo o difetto, o per qualunque causa, per quanto giuridica, legittima, pia e privilegiata, anche per il fatto che le cause dalle quali i suddetti provvedimenti sono emanati non siano state addotte, verificate o giustificate, per vizio di surrezione o di obrepzione o di nullità, o di invalidità, o per difetto di Nostra intenzione o per qualsiasi altro difetto, per quanto grande, sostanziale, sostanzialissimo, inaspettato e inaspettabile e che richiedesse speciale e individuale menzione ed espressione, o anche per il fatto che nei suddetti provvedimenti e in alcuno di essi non siano state osservate e adempiute le solennità e tutte le altre cose che dovevano essere osservate e adempiute, o per qualsiasi altro motivo, colore o pretesto, o altra ragione o causa, anche tale che fosse necessaria per l'effetto della validità delle medesime presenti, potranno essere notate, impugnate, invalidate, ritrattate, portate in giudizio o in controversia, o ridotte alle vie e ai termini del diritto, o contro di esse potranno essere impetrati qualsiasi rimedi del diritto, del fatto, della grazia o della giustizia, o anche per moto proprio, scienza e pienezza di potestà concesso e impetrabile, alcuno potrà usarle o valersene in giudizio e fuori di esso, e le medesime presenti sotto qualsiasi revocazione di grazie simili o dissimili, sospensioni, limitazioni, derogazioni, o altre disposizioni contrarie per qualsiasi lettere e costituzioni Apostoliche o regole della Nostra Cancelleria Apostolica, anche consistorialmente, per qualsiasi cause e per qualsiasi espressioni, tenori e forme di parole e con qualsiasi decreti (anche se in essi delle medesime parti e del loro intero tenore sia fatta speciale menzione) edite in qualsiasi tempo, o da edirsi, non siano minimamente comprese, o se comprese, in nessun modo siano ritenute, ma sempre da quelle eccettuate, e quante volte quelle emanassero, altrettante volte siano restituite al loro pristino e validissimo stato, riposte e pienamente reintegrate, e di nuovo anche sotto qualsiasi data posteriore, da eleggersi in qualsiasi tempo, concesse siano e saranno, e sortiscano e ottengano i loro pieni e interi effetti, e così da tutti siano ritenute, e fermamente e inviolabilmente osservate, e così e non altrimenti da qualsiasi giudici ordinari o delegati, che esercitino qualsiasi autorità o splendano di qualsiasi dignità, anche gli Uditori delle cause del Palazzo Apostolico, e i Cardinali della Santa Romana Chiesa anche di Latere Legati, i Vicelegati e i Nunzi della suddetta Sede, tolta a essi e a ciascuno di essi qualsiasi potestà e facoltà di giudicare e interpretare diversamente, debbano essere giudicate e definite, e decretiamo pure irritum e inane, se diversamente su questi da alcuno con qualsiasi autorità consapevolmente o inconsapevolmente fosse tentato. Non ostante, per quanto sia necessario, la Nostra e della Cancelleria Apostolica regola di non togliere il diritto acquisito, e il Concilio Lateranense ultimamente celebrato, che proibisce le dismembrazioni perpetue se non nei casi permessi dal diritto, e altre anche nelle sinodali, provinciali, generali e universali Costituzioni edite o da edirsi, speciali o generali costituzioni od ordinazioni Apostoliche qualsiasi superiori e persone in genere o in specie, o altrimenti in contrario dei suddetti in qualsiasi modo forse concesse, approvate, confermate e rinnovate; di tutte le quali e di ciascuna, anche se per loro sufficiente deroga di esse e dei loro interi tenori fosse necessaria speciale, specifica, espressa e individuale menzione, o qualsiasi altra espressione, o dovesse osservarsi qualche altra forma ricercata a questo, i tenori di questo genere, come se da parola a parola nulla assolutamente omesso e la forma in essi tramandata osservata fossero inseriti, dalle medesime presenti per pienamente e sufficientemente espressi avendo, altrimenti nel loro vigore permanenti, latissimamente e plenissimamente e specialmente ed espressamente per l'effetto dei presenti e della validità di tutti e di ciascuno dei suddetti, per questa volta soltanto, per moto proprio, scienza e pienezza di potestà parimenti della serie di queste lettere deroga, e a tutti gli altri contrari qualsiasi.

8 Perciò affinché tutte queste cose da Noi sopra costituite il loro pieno effetto conseguano, al Venerabile Nostro Fratello Giuseppe Macchi, Arcivescovo titolare di Tessalonica, Nunzio Apostolico nella Repubblica Brasiliana, per mezzo di queste presenti affidiamo e ordiniamo che egli proceda all'esecuzione di tutti e singoli i predetti, impartendogli tutte e singole le facilitazioni ad ciò in qualunque modo necessarie e opportune, conferita inoltre a lui la potestà di subdelegare qualunque altra persona costituita in dignità ecclesiastica, così tuttavia che lo stesso Giuseppe Arcivescovo, o il suo subdelegato, possa definitivamente pronunciare su qualunque opposizione contro i predetti in qualunque modo sorgente. Vogliamo però che detto Giuseppe Arcivescovo entro sei mesi autentici esemplari degli atti tutti che all'affidata esecuzione da compiersi, egli dovrà emettere, a questa Sede Apostolica trasmettere sia tenuto. Vogliamo inoltre che dei traslati di queste lettere anche stampati, sottoscritti però da mano di qualche Notaio pubblico, e muniti del sigillo di qualche persona costituita in dignità ecclesiastica, la medesima interamente fede sia prestata in giudizio e fuori di esso, quale alle medesime presenti sarebbe prestata, se originalmente fossero esibite o mostrate. For perpetual remembrance of the matter.

1 The supreme duty of governing the Catholic Church, which by divine disposition We exercise, demands above all that We strive with all diligence to procure whatever conduces to the good and spiritual utility of the souls committed to Us. The petitions brought to Us by Our Venerable Brethren the Bishops from the ecclesiastical province of St. Saviour in Brazil in the provincial assembly which they held at an earlier time have brought great joy to Our mind, in which it was requested that the most extensive region called Piauhy, which is subject to the spiritual jurisdiction of Our Venerable Brother the Bishop of St. Louis of Maranhão, should be erected into a proper and separate diocese for the more convenient administration of sacred matters and for the good of the faithful. And We indeed, carefully considering how by reason of the vast territory which the province called Piauhy comprises, by reason of the great multitude of people by which that province is inhabited, by reason of the excessive distance of places, which does not permit the faithful people easily to approach their pastor, the erection of this new diocese is necessary, and that easy care of Christians and communication with bishops greatly conduces to the good and utility of their spiritual souls, have not refused to lend a ready ear to the aforesaid petitions. Therefore, with the care of Our Venerable Brother the present Bishop of St. Louis of Maranhão, to whose jurisdiction the region of Piauhy is subject, and from whose dismemberment the erection of the new bishopric hereinafter described is to be established, the wishes of the attentive government and people being considered, and the offices of Our beloved son the Apostolic Nuncio in the Brazilian region, who freely and willingly gave his full consent to this; and likewise others to whom it pertained have consented to it; all matters which are to be observed in such negotiations having been weighed with mature study and deliberation, and moreover absolving all and each to whom these letters are favourable from any excommunication, suspension and interdict, and other ecclesiastical sentences, censures and penalties, by which they are bound in any way whatsoever, and consenting that they be absolved for the purpose only of obtaining the effect of these presents, by Our own motion and certain knowledge, and from the fullness of Apostolic power, We raise and exalt by Apostolic authority the city commonly called Theresina, which is the head and principal city of the whole region or civil state called Piauhy, to the rank of an episcopal city, to enjoy henceforth all and singular the rights, honours and prerogatives which other cities in the Brazilian Republic marked with an episcopal see enjoy, use and possess. Moreover the parish church existing in the same city of Theresina and dedicated to the honour of Our Lady of Sorrows, We raise and erect to the status and dignity of a cathedral, so that it, retaining its former invocation, with all the rights, privileges and honours which other cathedral churches in the Brazilian Republic enjoy, by the same Apostolic authority We raise and erect; and in this church We establish the seat, chair and episcopal dignity for one bishop henceforth called Bishop of Piauhy, who shall preside over the said church, city and diocese and likewise its clergy and people in the Lord, convoke a Synod, and have and exercise all and singular the rights, offices and duties of a bishop, with his episcopal table, chapter, treasury, seal, and other cathedral and pontifical insignia, rights, jurisdictions, preeminences, prerogatives, privileges, graces, honours, favours and indults real, personal and mixed, which other cathedral churches existing in the aforesaid Brazilian Republic and their prelates enjoy and shall be able to enjoy, yet not however by title of burden or by indult or particular privilege, by like authority We erect and institute perpetually.

2 This church of Piauhy newly erected as above We declare to be suffraganean for the time being to the existing Archbishop of St. Saviour in Brazil, and We subject it to the metropolitan right of the same Archbishop.

3 Moreover, supplying by the same Apostolic authority, insofar as it may be necessary, the consent of all and of whosoever has or is presumed to have an interest therein, we perpetually dismember, divide and separate from the same diocese of St. Louis of Maragnano the entire region or civil territory called Piauhy, which is now subject to the diocese of St. Louis of Maragnano — 380 — and which comprises more than thirty parishes. In the aforesaid territory, parishes or places thus dismembered and divided, and existing therein, all churches, monasteries, convents and whatsoever other things, of whatsoever kind and quality, whether secular or regular benefices, and all and each of the parishes torn away from the said diocese, persons of either sex, inhabitants and residents, both lay and clerical, presbyters, beneficiaries and religious not however exempt, of whatsoever status, order and condition, we exempt and disjoin from the ordinary jurisdiction, power and superiority of the bishop now existing, and from all right of the chapter and canons of the cathedral church of St. Louis of Maragnano, and the same region or territory aforesaid of Piauhy, thus, as is aforesaid, torn away and separated, we perpetually assign and attach as a diocese of the new bishopric of Piauhy, where the new bishop and his legitimate successors shall always be bound to reside; and moreover we perpetually inscribe and subject the inhabitants and residents of either sex and the religious persons above expressed to the episcopal church of Piauhy newly erected and to its future prelate for their city, territory, diocese, clergy and people. Now all the boundaries and limits of the said new diocese of Piauhy shall be precisely the same as the boundaries which now form and constitute the civil circumscription of the state and region of Piauhy, and these we form and establish in perpetuity by like Apostolic authority. Moreover, all and singular documents concerning the parishes and places torn away and separated from the diocese of St. Louis of Maragnano and attributed and assigned to the new bishopric of Piauhy, which are now found in the chancery of the aforesaid bishopric of St. Louis, we order to be extracted from this, and to be delivered in appropriate form to the chancery of the newly erected bishopric of Piauhy, as is aforesaid, so that they may be preserved therein in perpetuity. As to the endowment moreover of the episcopal table of this new diocese, since certain stable goods now exist and are established in its territory which seem to be able to suffice at present for the decent maintenance of the bishop's dignity, we perpetually attribute and assign these to this episcopal table for its endowment, trusting in the Lord that when the new bishop, with God's help, shall have taken possession of his see, from the pious gifts of the faithful, for whose spiritual benefit this new see has been established, and from the pious liberality of those who preside over this province, more abundant assistance shall be freely supplied to the episcopal table of this new diocese — 381 — for the promotion of God's glory and the interests of religion. For the decent habitation moreover of the new bishop and his successors in the said bishopric, the building which exists attached and joined to the episcopal church itself erected as cathedral in the episcopal city, we perpetually assign and establish.

4 Since, however, the dignity of divine worship ought especially to be a matter of concern to Us, We enjoin upon the solicitude of the new future bishop that he take care to erect a cathedral Chapter in his diocese according to the canonical rules of the Church, as soon as it can be done, constituting theological and penitential prebends, and these dignities being preserved in the same manner as in the other cathedral churches which exist in the Brazilian Republic; the conferral of dignity after the pontifical, however, shall always and perpetually be reserved to the Apostolic See. In the meantime, however, until the said Chapter shall have been canonically constituted, the bishop shall assume for himself a council of approved and prudent men, by the prudence of whose assistance he shall make use in dispatching the more serious matters of his diocese. To the said Chapter, moreover, as soon as it shall have been canonically constituted, We grant and impart the faculty that it may be able to draw up statutes, ordinances and decrees according to the prescriptions of the sacred Canons and especially of the Council of Trent; these, however, shall be subject to the knowledge and approval of the Ordinary Bishop, so that they may have the force and efficacy of law; and to the same Chapter, moreover, We perpetually grant and indulge that it may be able and have power similarly to use, enjoy, possess and have the benefit of all the privileges, rights and prerogatives, by which the Chapters of the other cathedral churches in the aforesaid Brazilian region similarly use, enjoy, possess and have the benefit (those, however, excepted which have been granted by special indult or acquired by onerous title). Furthermore, since for cultivating the vineyard of the Lord it is necessary that the number of priests be increased, to which Seminaries are seen by experience to conduce greatly, and since the cathedral church of this new diocese contains a spacious building adjoining and suitable and appropriate for the use of a Seminary, We will that the new bishop, when it can be done, apply diligent effort to erecting a Seminary in that building, according to the decrees of the aforesaid Council of Trent, to the end that young clerics may be carefully and diligently instructed in piety and sacred doctrine, according to the norms handed down by the Apostolic See, and useful and vigorous ministers may be prepared for the Church.

5 Moreover, We expressly reserve to Ourselves and the Apostolic See the faculty of freely making a new dismemberment or circumscription of the aforesaid new diocese, in whatever manner it shall seem expedient in the Lord, without any need of seeking the assent of the Bishop and the cathedral Chapter — 382 — or of attributing and constituting any territorial compensation.

6 We will, however, that all those things which concern ecclesiastical matters, rights and persons, and of which express mention has not been made in this Our motu proprio, shall remain firm and ratified according to canonical rules and the discipline of the Catholic Church; and if any difficulty or controversy should arise regarding the foregoing in the newly erected diocese of Piauhy, it shall be referred to the Apostolic See, which, having carefully weighed the matters, shall decree as justice requires.

7 We have established the canonical tax of the aforesaid church of Piauhy, erected into a cathedral, having regard to the circumstances of the times, at thirty-three florins of gold of the Camera with a third part of a similar florin, and we command that it be inscribed in the books of the Apostolic Camera in the customary manner. Moreover, these present letters, and whatever is contained in them, we decree shall never at any time, on account of any ground or defect whatsoever, or for any cause whatsoever, however juridical, legitimate, pious and privileged, even on the ground that the causes on account of which the aforesaid matters proceeded have not been adduced, verified or justified, be noted, impugned, invalidated, retracted, brought into question or controversy, or reduced to the way and terms of law, or any remedy of law or fact, or grace, or justice be sought against them, or even by our own motion, knowledge and fullness of power granted and obtained, anyone be able to use or avail himself of the same in judgment and outside of it, on account of any vice of subreption or obreption or nullity or invalidity, or of our intention or any other defect whatsoever, however great, substantial, most substantial, unforeseen and unforeseeable, and requiring special and individual mention and expression, or even on the ground that in the aforesaid matters or any of them the solemnities and whatever else ought to be observed and fulfilled have not been observed and fulfilled, or on any other ground, colour or pretext, or other reason or cause, even such as would necessarily have to be tried for the effect of the validity of these same presents; nor shall these presents be comprehended under any revocations, suspensions, limitations, derogations, or other contrary dispositions whatsoever by whatever letters and Apostolic constitutions or rules of our Apostolic Chancery, even consistorially, on account of whatever causes and whatever expressions, tenors and forms of words, and with whatever decrees (even if in them special mention be made of the same parties and their whole tenor and date) issued at any time or to be issued, but shall always be excepted from them, and as often as those shall be issued, so often shall these be restored to their pristine and most valid state, replaced and fully reintegrated, and newly granted also under whatever later date, to be chosen at any time, and shall obtain and secure their full and complete effects, and thus be esteemed by all, and be firmly and inviolably observed, and thus and not otherwise by whatever ordinary or delegated judges, exercising any authority or bearing any dignity whatsoever, even the Auditors of the causes of the Palace of the Apostolic See, and the Cardinals of the Holy Roman Church, even Legates a Latere, Vice-Legates and Nuncios of the said See, with power and faculty of judging and interpreting otherwise taken away from them and from each of them, ought to be judged and defined, and we also decree void and null if anything contrary to these things shall be attempted by anyone whatsoever with any authority, knowingly or unknowingly. Notwithstanding, insofar as it is necessary, our rule and that of the Apostolic Chancery concerning acquired right not to be taken away, and the most recently celebrated Lateran Council, which forbids perpetual dismemberments except in cases permitted by law, and also whatever special or general constitutions or ordinances Apostolic issued or to be issued in synodal, provincial, general and universal Councils, granted, approved, confirmed and renewed to superiors and persons in general or in particular, or otherwise in any way contrary to the aforesaid; all and singular of which, even if for their sufficient derogation special, specific, express and individual mention of them and their whole tenors, and not through general clauses importing the same, or any other expression ought to be had, or any other exquisite form ought to be observed for this, we, having these tenors as if they were inserted word for word with nothing whatsoever omitted and the form transmitted in them observed, as fully and sufficiently expressed in these same presents, which would otherwise remain in their force, most broadly and fully and specially and expressly for the effect of these presents and the validity of all and singular the aforesaid, for this occasion only, by our own motion, knowledge and fullness of power, by the tenor of these letters also derogate, and to all other things whatsoever to the contrary.

8 Wherefore, in order that all these things constituted by Us above may obtain their full effect, We also commit and command to Our Venerable Brother Joseph Macchi, Archbishop with the title of Thessalonica, Apostolic Nuncio in the Brazilian Republic, by these present letters that he himself proceed to the execution of all and each of the foregoing matters, affording to him all and singular facilities necessary and opportune in any way for that purpose, and moreover granting to him power to subdelegate any other person constituted in ecclesiastical dignity, provided however that the said Joseph Archbishop, or his subdelegated person, may pronounce definitively upon any opposition arising in any way against the foregoing. We will, however, that the said Joseph Archbishop within six months shall be bound to transmit to this Apostolic See authentic copies of all the acts which he shall have issued for the completion of the execution committed to him. We will also that transcripts of these letters, even if printed, yet subscribed by the hand of some public notary and furnished with the seal of some person constituted in ecclesiastical dignity, shall receive the same full credence in judgment and outside of it as would be given to these same presents if they were exhibited or shown in the original. Let no man therefore be permitted to infringe this page of Our absolution, disjunction, dismemberment, exemption, liberation, formation, erection, evection, institution, declaration, subjection, constitution, faculty, impartition, concession, indult, precept, reservation, constitution, mandate, decree, derogation and will, or to dare to act contrary to it with rash presumption; if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul. Given at Rome at St. Peter's, in the year of the Lord's Incarnation one thousand nine hundred and one, on the twenty-second day of February, in the twenty-fourth year of Our Pontificate 1.
