Constitution on the good direction of the conclave and matters to be handled while the Apostolic See is vacant

Constitution of Pope Clement XII ·

LXXVI.
Constitution containing various ordinances for the good direction of the conclave, and for matters to be done when the Apostolic See is vacant.
Clement, bishop,
servant of the servants of God, for perpetual memory of the matter.

1 The office of the Apostolate, which the inscrutable height of divine wisdom and clemency has deigned to commit to our humility, albeit without the support of our merits, demands that we, not only looking to the present but also providing for the future, in those matters also which shall come to pass after the day of our dissolution and the completion of the course of this mortal pilgrimage undertaken by us, should interpose the parts of our pastoral solicitude by directing and ordaining through laws opportune and consonant with the glory of God and the utility of the Church, just as, all things having been weighed in the balance of prolonged consideration, we judge it to be expedient in the Lord.

2 § 1. Indeed, very many predecessors of ours in this constitution...

3 for canonical law, and especially of blessed memory, whom we have not omitted. Symmachus, Nicholas II, Alexander III, Gregory X, Clement V, Clement VI, Julius II, Paul IV, Pius IV, Gregory XV, and Urban VIII, well understanding how great the weight and moment is for the provident governance of the Lord's flock and of the Catholic Church the election of the Roman Pontiff, who is the vicar of our Lord and Saviour Jesus Christ on earth, and the successor of blessed Peter, and the father and pastor of all the faithful; and not reckoning the safety of one member, but of the whole body, when consultation is made concerning the head, have at various times, even in general councils, issued most salutary constitutions, by which, with every cupidity, ambition, simony, and any other depravity, turpitude, deformity, and dissensions barred from access to such election, with the greatest prudence and equal counsel they provided that this so holy and so grave work should be performed piously and rightly, and that in it neither flesh and blood nor any human affection should claim any place for itself, but that all things should be directed and governed by the grace of the Holy Spirit, and thus that none but he who should be called by God as Aaron should be assumed to the care and administration of the heritage of Christ, which He sought by His precious blood: and also, being anxiously solicitous concerning the perilous and dangerous time of the Roman and universal Church, when she remains widowed of her visible head and pastor, the aforesaid predecessors did not omit to provide opportunely those things which seemed to conduce to hastening the happy outcome of her election, and to decree what should meanwhile be done and observed; and otherwise, as is more fully contained in the aforesaid constitutions, whose tenor we wish to be held as fully and sufficiently expressed and inserted word for word in the present.

4 § 2. But since it often happens that the memory of laws, or especially the most salutary ones, if they are frequently called into question, gradually flows away from the minds of men, and experience teaches that some of those things which have been prescribed when the Apostolic See is vacant or which use has introduced, ought, according to the variety of times, by which human counsels also must often be varied, to be changed and supplemented, so that provision may be made and care taken more abundantly, in the first place for the right order of matters so difficult to be done in such a time, for the administration of justice, and for the indemnity of the pontifical treasury, just as we ourselves, who have been placed in minor positions and have spent the greater part of our age in the Roman Curia, and, while we were serving in the dignity of the cardinalate, attended the conclaves, have sufficiently perceived, and several of our venerable brothers, the cardinals of the Holy Roman Church, endowed with distinguished piety and circumspection, have not omitted to indicate and signify to us:

5 § 3. Hence it is that we, on account of the apostolic office divinely committed to us, having first taken mature deliberation upon the aforesaid matters with certain of the said cardinals of the Holy Roman Church, and by their counsel, and also by our own motion and from certain knowledge, and from the fullness of apostolic power, by this our constitution to endure perpetually, have deemed it necessary to establish, decree, and ordain the things which follow.

The constitutions of predecessor Pontiffs are confirmed.

Exhortation to the cardinals of the Holy Roman Church, that they regard only God and the utility of His Church in electing the Pontiff.

CLEMENT

6 § 4. First therefore we confirm, approve and renew by the tenor of these letters the constitutions of our predecessors which have been recounted, and all and singular things contained and disposed in them, which however are not contrary to the present letters, and we strictly command and mandate that they be observed inviolably and without wavering. § 5. Moreover, although we trust in the Lord that there is no need, yet being urged by the duty of our pastoral office, and by that special concern for the common good to which we are bound, we earnestly beseech, exhort, implore and admonish the cardinals now and for the time being existing, through the bowels of the mercy of our same Lord Jesus Christ and through the outpouring of his precious blood, that they above all, namely when the matter of creating a Roman Pontiff is being treated, seriously weigh the gravity of the matter which they handle, the magnitude of the ministry which is conducted through them, and the dignity of the person whom they sustain in the Church of God; and let them carefully reconsider that in designating the supreme rector of the Church itself they are constituted interpreters of the divine mind, and that all things are naked and open in the eyes of him to whom they are about to pledge and bind their faith by the religion of a solemn and most strict oath; nor can there perhaps be any other deed in all their life concerning which it will be so difficult and arduous for them to render an account to the eternal and just judge, who will decree eternal rewards or punishments. Therefore also under the threat of divine judgment we likewise command and mandate to the same cardinals, that in casting their votes, and in all and singular matters concerning the election in any way whatsoever, having only God before their eyes, and seeking not their own things but those which are Christ's, they conduct themselves religiously, sincerely and freely, with all human arts, factions, partisan zeal, and every affection of the flesh removed, and private advantages and desires set aside, and also the intercessions of secular princes, and other worldly considerations, and likewise not attending to or regarding the title of gratitude or any other obligation, daring or presuming by themselves or through another, directly or indirectly, under any color, pretext or device, to do, permit or consider anything which is alien from this purpose, or by which the election might be delayed, or by which the liberty of voting might be hindered in any way whatsoever.

7 § 6. Moreover, it has been established by the authority of the same predecessors and cardinals that, during the vacancy of the Apostolic See, the college of cardinals shall have no power or jurisdiction whatsoever in those matters which pertained to the Supreme Pontiff while he lived, neither in granting grace nor in administering justice, nor in executing deeds performed by the deceased Pontiff; but all things shall be reserved for the future Pontiff: nor shall they be able in any way to dispose of the temporal dominion of the Holy Roman Church or of the monies of the Camera or of the Apostolic Dataria, even for the payment of debts contracted before the death of the Pontiff, or for any other cause whatsoever (except only in certain cases expressly excepted), nor to receive anything for their own benefit, nor to contract debt. We, approving the foregoing, under the penalties imposed by the said constitutions, do further establish and declare that the same college of cardinals shall not issue or release mandates for the payment of such monies (except in the aforesaid excepted cases and others to be expressed below) in favor of any person whatsoever, whether existing in the conclave or outside it, even under the title of remuneration, reward, labor, and also of supplementary wages, in such manner that both the cardinals who shall have attempted anything contrary to the foregoing, and the camerlengo, treasurer, depositary and other officials who shall have obeyed them in such matters, shall be compelled by the future Pontiff to make full satisfaction from their own property to the Apostolic Camera, and to restore the monies expended, and to make good all damages; nor shall they even grant license under such title to extract grain from the Ecclesiastical State (unless extraction be compelled by a truly burdensome cause, and then only provided it does not exceed the amount owed, and the time at which extraction is customarily permitted has arrived), nor confer upon anyone immunity or exemption from office or service incumbent upon him, commonly called jubilation, nor absolve any guilty parties and delinquents, or even secure them for a time through tables of safe conduct, which they call a safe-conduct, unless they have committed lighter offenses during the vacancy of the See itself, nor remit, pardon or moderate exile or any other punishment whatsoever, even pecuniary, for them. If anything, however, be done contrary to this prohibition, anyone whatsoever, and even an official who shall have been forced to execute it, shall be bound to report the matter to the future Pontiff, so that he may be able to proceed to the revocation of the acts, and to take action against the transgressors according to the prescription of this our constitution and that of our predecessors. The general treasurer shall also be bound, under penalty of deprivation of his office, to exhibit to the new Pontiff, within a month to be reckoned from his election, accurate and distinct accounts or statements of all expenditures made during the vacancy of the See, with specific and express statement of each sum, cause and person to whom the monies shall have been paid, to the end that the Pontiff himself may appoint several cardinals well-disposed toward him, who shall not, however, be fewer than three in number, to examine those accounts or statements, and to examine and report to him whether anything has been expended uselessly or more than is proper, or whether in any way the present or the constitutions or chirographs of the predecessors, to be named even below, have been contravened in this matter.

8 § 7. And whereas during the time of the vacancy of the See a twofold congregation of cardinals is held, namely a general one, or of the whole college, and a particular one consisting of three Cardinals senior in rank, one namely from each order, with the camerlengo, whose office expires entirely on the third day after entrance into the conclave, and in their place three others following in order in each order succeed on the third day together with the same camerlengo: We will that in the said particular congregation, whether before or after the comitia have begun, business of lighter moment only, and matters occurring daily or from time to time, shall be dispatched. If anything, however, be of graver moment and requiring investigation, all such matters shall be referred to the general congregation or college of cardinals; and further, those things which in one particular congregation shall have been decreed, resolved or denied, cannot in another be revoked, changed or granted; but the right of doing this shall belong to the general congregation itself alone by plurality of votes.

9 § 8. We decree that the custom, long established from this time, of proposing for confirmation in the first general congregation of the Roman Curia and of the whole governance of the venerable City, shall likewise be retained hereafter. And as regards the other officials and ministers of the Apostolic See, the Roman Curia, and the ecclesiastical governance, of whatever quality, rank, order and condition they may be, we permit that all of them be confirmed together and at once in the second general congregation, in the same manner, and by a single turn of the urn or ballot-box, as they call it, according to ancient custom; otherwise we will that they be held as confirmed. If, however, any one of the said officials and ministers shall be believed to have so gravely failed or been deficient in his office, or to have conducted himself badly, that he be deemed wholly unworthy to be retained in the exercise of his office, we decree that the cardinals senior in order shall set forth the whole matter and the proofs which are available against such official or minister distinctly and in order in one general congregation, so that each cardinal may recognize their substance and relevance: and after three days thereafter it shall be proposed and debated in another general congregation likewise, whether the said official or minister to be confirmed should come, or should be suspended from the exercise of his office until the election of the future Pontiff. And that shall obtain and be firm which shall have been resolved by the greater part of secret votes. And, if suspension shall have been decreed, several persons able and suitable for the office in question shall be proposed by the cardinals in the first place, and from those who shall have appeared more apt than the rest, one shall be substituted in place of the suspended official or minister by a plurality of votes likewise, until the Pontiff be elected.

10 § 9. Since, however, with the name and greater coat of arms of the Pontiff excepted, cardinal legates in the States of the Church are forthwith invited to the conclave, with the charge meanwhile imposed upon them to hand over the administration of their legation to pro-legates, to whom it is commanded that they undertake it in the name of the sacred college, provide for the security of the peoples, and carefully ensure that no tumults be stirred up: to remove any occasion of dissension and controversy which might easily arise between the cardinal legates and their pro-legates, we decree that edicts which in the aforesaid provinces, the Apostolic See being vacant and the cardinal legates absent, shall happen to be promulgated, shall be freely published by the same pro-legates with their own subscription, with the name nevertheless affixed to the same edicts, and those which shall be printed also with the coat of arms of the absent cardinal legates. The cardinal legates, however, so long as they shall be absent from their legation and the vacancy of the See shall endure, shall command nothing to any subordinate minister or official in the legation, or to any other person, without the knowledge of the pro-legates, nor shall they cause it to be carried out.

11 § 10. Furthermore, we decree that three cardinals hereafter to be chosen from among those who shall be present at the conclave are to be elected by the College, who shall have charge and care of the enclosure of the conclave and its custody, and who shall execute with all diligence and care the arrangements made by our predecessors concerning the enclosure and such care: let them visit the cells of the cardinals twice each week, and other places of the conclave itself, frequently, preside over its cleanliness, and carefully inquire lest any holes be made in the walls, windows, ceilings or pavements of the conclave itself, or windows be opened or enlarged, whence opportunity and means of conversing or communicating with outsiders might be given: and if they shall discover any holes made, or windows thus opened and enlarged, let them cause them to be immediately closed and stopped up, and restored to their former state: let them also prohibit the arms or coat of arms of any cardinal, in whatever office he may be serving, from being placed, hung and painted anywhere except in his own cell: and if they shall find them in any other part of the conclave, let them cause them to be immediately removed and effaced: moreover, let the cardinals existing in the conclave not occupy the cells of absent cardinals, whether furnished and adorned with movables or not, but let it pertain to the said three cardinals placed in charge of the enclosure and care of the conclave to assign the use and convenience of the same cells to the cardinals who have their cells nearby, with proper proportion observed among them, until the aforesaid absent cardinals shall have arrived: we will that the office of these three cardinals shall last for the whole time of the conclave, and we hereby decree to them whatever necessary and ample power in the foregoing matters and concerning them.

12 § 10. Furthermore, we decree that three cardinals, to be chosen from among those who are suitable for this office, shall be elected by the College to preside over the enclosure of the conclave and to have and exercise care of the conclave, who shall execute with all diligence and care the arrangements made by our predecessors concerning the enclosure and such care: let them visit the cells of the cardinals twice each week and other places of the conclave itself frequently, let them oversee its cleanliness, and let them carefully inquire lest any holes be made in the walls, windows, ceilings or pavements of the same conclave, or windows be opened or enlarged, whence opportunity and means of communicating or conferring with outsiders might be given: and if they discover any holes made, or windows thus opened and enlarged, let them take care that they be immediately closed and stopped up and restored to their former state: let them also prohibit the arms or coats of arms of any cardinal, whatever office he may hold, from being placed, hung and painted anywhere except in his own cell: and if they find them in any other part of the conclave, let them cause them to be immediately removed and taken down: moreover, let not the cardinals present in the conclave occupy the cells of absent cardinals, whether furnished and adorned with movables or not, but let it pertain to the said three cardinals placed in charge of the enclosure and care of the conclave to assign the use and benefit of the same cells to the cardinals who have their cells nearby, maintaining proper proportion among them, until the aforesaid absent cardinals arrive: we will that the office of these three cardinals shall last throughout the entire time of the conclave, and we hereby decree to them whatever necessary and ample power in the foregoing matters and concerning them.

13 § 11. The scrutinies also, which are called for the election of the Pontiff, and the other two senior from the supernumeraries, shall be admitted into the conclave.

14 § 14. In the constitutions also of those same predecessors of theirs it is provided among other things that the sacristan with one cleric as assistant in the office of sacristan, and one secretary of the College only shall enter the conclave, and there shall be present one carpenter and one mason: likewise eight or ten servants for public utility and the convenience of all, as for carrying wood, for coming to the conclave, and for ministering similar necessities, who shall be chosen by the college of cardinals, not however from the household of any cardinal, by secret ballot, in such a way however that he obtains it who has received more votes, and to those salaries shall be paid from public funds. We to the same sacristan, beyond the cleric of this kind and the subsacristan, another who to the same number of servants to be chosen, or to be received by prohibition of the Pontiff twice a day by the cardinal sacristan and masses to be celebrated are deserted. ... and whether they shall have been, whether manuscripts or printed, way or assist; master of ceremonies, who in the conclave as above are admitted, sent and announced, and retained by them, one servant, not indeed for each one, but for all thus we command under penalties against those sending to be admitted; to the secretary however of the College from the conclave, and thence respectively received two assistants, who him constantly, whom pious letters, writings, messengers, notes, or signs, even if they shine forth with cardinal honor, from the said predecessors expressly sanctioned, by this very fact by transgressors to be incurred. Then especially is he burdened, by labor to be relieved, and one also servant, who however by the cardinals deputed ought to be approved, into the conclave to lead and to have we permit. And whereas eight of Frugality and 8 12. And ment of predecessors in conclave publicly serving the aforesaid likewise insisting, to the same cardinals we command, that frugality and temperance in food they observe, far from all luxury and pomp, and also, in delivering to the conclave food, more refined taste ostentation. 8 13. Lest of the masters of ceremonies, secretary of the college in that number commended, and masters who in the elections are employed, too much should grow in number, in the future not more than six at the most, two namely participating, and as many not participating, who, just as of those eight or ten by the predecessors disposed, not shall be from the household of any cardinal; by no means attending or favoring any contrary custom or declaration, even repeatedly by the same college of cardinals issued. As to the carpenters and mason, no one shall be received who truly those arts does not know, and publicly does not profess and exercise them, nor shall the college have any power of dispensing concerning the said qualities, and other aforesaid matters. Concerning the election § 15. By the death of the Pontiff, neither the camerlengo, nor penance the greater penance nor penance of the greater penance from the said predecessors cautioned also we find it ceases. Truly, because it can happen another, as in the most recent elections it happened, and also of either office of this kind vacancy before the creation of the new Pontiff; the form therefore then to be observed wishing to establish, we decree, that, if and when it shall happen, a general congregation three days after the vacancy of either of the aforesaid offices shall be held, and the votes or suffrage of the cardinals, after the completed scrutiny together to the congregation, for the deputation of him, who the camerlengo or greater penance shall supply the place until the election of the new Pontiff, shall be sought and given by schedules secret and printed, by the masters of ceremonies also from the infirm cardinals to be collected, and before three cardinals at that time in order first, the same masters of ceremonies and the secretary of the college being present, to be opened; and he deputed shall be held, into whom the greater part of the votes or suffrage aforesaid shall have come together; and thus to the deputed all faculties, which the same camerlengo or greater penance could exercise, as long as the See was vacant, we attribute. penance § 16. To these things, since according to the statutes of the said predecessors the same greater penance and his officials that only, at the time of the See being vacant, can do and dispatch pertaining to the forum of conscience only, which they could exercise while the Pontiff lived, and in the rest their duty rests, so that from any whatsoever matrimonial and other dispensations and absolutions and declarations, as well as any other dispatches the forum of the mixed or separate forum in any way whatsoever respecting, altogether they ought to abstain; but some are ecclesiastical censures, by which them bound, except in the article of death constituted, by none other than the Roman Pontiff for the time being existing can be absolved, taken away namely from the greater penance the power of doing this; and very often it happens, that by such censures ensnared, truly penitent and their errors with sincere mind detesting, the benefit of absolution the See being vacant earnestly beseech: to which of ecclesiastical discipline preservation at the same time also of the souls of the faithful, whom God's mercy to penance shall have called, to the welfare consulted, to the same greater penance, or to him, who in his place shall have been substituted, as is aforesaid, faculty we give, from these also censures the See being vacant the faithful aforesaid, the matter however first in the signature of the office itself of the Apostolic Penitentiary examined, the other things to be observed being observed, to absolve, for a time namely and with relapse into the said censures; so that, who shall have been absolved, to the new Pontiff, within the term for the distance of places to be defined, to recur and from him the benefit of full absolution to seek and to obtain they are bound; nor to the greater penance, or in his place substituted, the prefixed term after the election of the Pontiff to enlarge or to prolong is it permitted.

15 § 17. And, if the Vicar of the Pontiff in the nourishing City and its district in spiritual matters, the Vicar of the City, this one dying, the See being vacant, from the living, we find it necessary, lest the souls of the Christian faithful of the City and aforesaid district receive some harm therefrom in these same spiritual matters, then to the existing vicar-general of the said vicar, as long as the See shall have been vacant, all and singular faculties, authority and power, which to the same vicar for the exercise of the office of vicariate in any manner whatsoever belonged, and which the Pontiff himself, when the vacancy of the vicariate occurs, the See being full, to the aforesaid vicar-general sometimes for some time, until namely he shall have appointed a successor vicar, is accustomed to assign, by the tenor of these presents we grant and impart.

16 Concerning the needs also of the inferior churches, especially those immediately subject to the Apostolic See, which occur when the See is vacant, desiring in some way to provide for them, since not rarely through Catholic bishops especially and local Ordinaries, and other Christian faithful, at the instance or pressing need at that time of the said inferior churches or otherwise of ecclesiastical matters, opportune and prompt remedy is required from the college of cardinals, which the Pontiff, if he were present, would by no means omit to provide; we will that, if the matter be such as can be deferred to another time, it be altogether reserved to the future Pontiff; but if it admit no delay, then to the same college we grant that it may commit the matter to the prefect and some other cardinals of that Congregation to which the Pontiff would probably have remitted it for examination; who, the matter having been carefully discussed, shall decree thereupon, by way of provision however, until namely the Pontiff be elected, which according to the prudence given to them by the Lord, in preserving and defending the rights and reasons of the Church, they shall have judged to be fitting and consonant. § 19. And because, the See being vacant, the jurisdiction of him who held the office of auditor of the deceased Pontiff is entirely expired, and the course of justice and the prosecution of the many forensic causes, which were pending before the auditor, are hindered not without great loss to the litigants repeatedly. To the auditor for the time being existing of the signature of justice, whose prefecture we held while we were resplendent with the dignity of the cardinalate, of the same causes by the tenor of these presents we commit and mandate, giving to him for this the necessary and opportune faculties, that the citations and appeals, which shall be found pending before the auditor of the deceased Pontiff, as the law shall require, he may expedite.

17 § 20. To the expenses of the Apostolic Camera, we confirm as much as can be done, desiring moreover to provide against expenditures, the chirograph of the blessed memory of Alexander, Pope VIII, our predecessor also, concerning the moderation of expenses when the See is vacant and the manner of conducting the conclave, issued on 29 November 1690, even if heretofore it has not been committed to execution in every respect, in all things and throughout, which by these presents likewise and by the chirograph also by us as below being issued are not opposed, we command to be observed.

18 § 21. Moreover, moved by just and reasonable causes affecting our will and mind, we, the office of governor of the conclave and of either borough or city of the Leonine City, with the same office's title, denomination, essence and rights, privileges, faculties, jurisdiction, stipends, honors and all burdens annexed to it, by the tenor of these presents, perpetually suppress, remove, extinguish and abolish, and declare to be suppressed, removed, extinguished and abolished and perpetually to be so. The government moreover of the said borough or city of the Leonine City during the time of the vacancy of the See by the governor of the nourishing City in.

An. C. 1735 CLEMENT

19 to be administered and exercised in the future we decree in exactly the same manner and form in which it is administered and exercised by him while the Pontiff lives. The governance of the conclave, however, together with a cohort of soldiers, to be maintained at the expense of the Apostolic Camera, which the governor of the conclave himself was accustomed to have, and the other rights, privileges, faculties, jurisdiction (not however in either of the boroughs or the Leonine city in this manner), honors and burdens, which and what belonged to the said governor of the conclave in any way and were incumbent upon him respectively, or could belong and be incumbent, we likewise demand and commit to the prefect of the apostolic palace for the time being when the See is vacant in perpetuity, and this beyond and in addition to the faculties and jurisdiction in the same palace, or otherwise, granted to him through certain letters in the form of a Brief of the late Pope Benedict XIII, our predecessor also, which we decree to endure and remain in force when the See is vacant, and, insofar as it is necessary, we extend and enlarge for that time; commanding therefore through the Apostolic Camera that there be supplied to the said prefect of the apostolic palace in each month during which the See is vacant one thousand scudi of Roman currency, from which he may prepare and provide food and a frugal table for the prelates assisting in the conclave; for which purpose he may use the linens and furnishings, also of silver, of the aforesaid palace destined for the use of guests, or outsiders, commonly called the foresteria, as well as the work and ministry of the officials of the aforesaid palace, whose duties do not cease by the death of the Pontiff. To the same prefect of the palace we also wish to belong the care of preserving and guarding the pontifical rings, and that furnishing of silver which ought to be prepared and made ready for the future Pontiff.

20 § 22. The office likewise of the keeper of the fountains, and whatever other office is entrusted in the conclave, as being superfluous, we perpetually suppress, extinguish and abolish, most fully derogating from the contrary dispositions of the aforesaid Gregory XV and other predecessors.

21 superfluous, we perpetually suppress, extinguish and abolish, most fully derogating from the contrary dispositions of the aforesaid Gregory XV and other predecessors.

22 § 23. And whereas the letters of the late Pope Innocent XII, our predecessor, of blessed memory, are confirmed, when he removed the venality of offices from the auditor, treasurer, and clerks of the Apostolic Camera and its emoluments and the treasurers general, and twelve presidents of clerks and one president, all and singular emoluments, both ordinary and extraordinary, rights, goods, revenues, local payments, regalia and any other certain and uncertain income, which when the See was full or vacant were owed and paid to the same officials in compensation for the price paid to them, he decreed to cease entirely; and both those and subsequently all which the cardinal camerlengo was likewise accustomed to receive when the See was full or vacant, except those proceeding from the seal of the office of camerlengo, which indeed were reserved to the camerlengo himself, and certain others which were assigned to the public apothecary or medicinal shop established for the poor in the City, he reunited, applied and incorporated generally and perpetually to the Apostolic Camera itself, as is evident from two letters of the same Innocent, our predecessor, issued under lead in the year of the Lord's Incarnation 1692, on the tenth day before the Kalends of November, and in the year 1698, on the fourth day before the Ides of August, the tenor of which we wish to be held as fully and sufficiently expressed and inserted in the present: therefore we, perpetuating the reunion, application and incorporation in this manner, and likewise confirming the said letters of Innocent, our predecessor, and, insofar as it is necessary, renewing them, and revoking and abrogating any custom, use, interpretation, favor, declaration or concession made in any way to the contrary subsequently, respecting emoluments at the time of the vacancy of the See, we prohibit that henceforth the aforesaid auditor, treasurer, presidents, clerks and president, and the cardinal camerlengo, now and for the time being likewise existing, touch, exact or receive anything from the emoluments and other aforesaid matters whatsoever, thus reunited, applied and incorporated, when the See is vacant; the burden of their expenses being transferred in turn to the same Camera, which burden the said cardinal camerlengo sustained by reason of the aforesaid emoluments, while they were received by him, at the time of the vacancy of the See.

23 § 24. We have moreover decreed that a chirograph be issued soon for arranging especially certain less necessary or superfluous matters, and other expenses to be arranged, which when the See is vacant are known to be made no less through the said Apostolic Camera than through the Camera Capitolina, or in its name, and certain other matters to be wholesomely directed at that time, which we wish the present letters to have the same force, strength and efficacy. § 25. Nor however, while we turn our mind to the poor...

24 to be distributed. We adduce relief to the papal treasury, we do not forget Christ's poor and needy, knowing well that especially at that time when the creation of a Pontiff is being considered, divine aid must be sought more earnestly through constant prayers and other works of Christian piety and charity, and must be striven for to be merited; and therefore, just as we greatly commend it, so also we wish to be retained the praiseworthy custom observed in the three most recent councils, namely that the deceased Pontiff's almoner 1 continue to exercise that office with due subjection to and dependence upon the college of cardinals, until and as long as a new Pontiff is elected, and that the same sum of money be dispensed and distributed by the same almoner for the support of the said poor and needy during the vacancy of the See, which is customarily distributed while the Pontiff lives; for which purpose the customary mandates shall be expedited by the three cardinals first in order or appointed.

25 § 26. Finally, by strict command we mandate all and singular cardinals present and whenever in the future, lest against this our constitution and the prescriptions and contents therein, they presume to dispose, ordain, establish, make, treat, contrive or attempt anything, or in any way correct, alter or change it under any pretext, cause or contrived colour.

26 § 27. And in order that this our constitution may be observed more inviolably, the three cardinals who for the time being constitute the aforesaid particular congregation, and are commonly called the heads of orders, together with the cardinal camerlengo, shall ensure and cause the same constitution to be observed exactly in all and through all, as also the dispositions of the said predecessors, which are not repugnant to this our constitution; concerning which we establish and mandate that an account be rendered to the future Pontiff by them and the same camerlengo.

27 § 28. We decree likewise that these present letters themselves, and whatever is contained in them, even from the fact that the cardinals of the same Holy Roman Church, and their college, and any others whatsoever having or in any way pretending to have right or interest in the foregoing matters, have not consented to them, nor have been called upon or heard in these matters, or from any other cause whatsoever, colour, pretext and ground, even one closed in the body of law, shall at no time ever be noted, impugned, broken, retracted or brought into controversy on account of the vice of subreption or obreption or nullity, or of our intention or that of those having interest, or any other defect, even formal and substantial, nor shall restitution in full, opening of the mouth, or any other remedy whatsoever of law, fact or grace be attempted or obtained against them, or, even obtained, or also by our motion, knowledge and fullness of power granted or issued, be able to be used by anyone in judgment or outside it, or to avail themselves of it; but these same present letters shall always and perpetually be firm, valid and efficacious and shall produce and obtain their full and complete effects, and shall most fully benefit those to whom it pertains and shall pertain from time to time, and shall be inviolably observed respectively by them; and thus and not otherwise in the foregoing matters by any judges ordinary and delegated, even auditors of causes of the apostolic palace, and the same cardinals, and their college, and any others whatsoever exercising and about to exercise any preeminence and power, the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, ought to be judged and defined, and shall be null and void if otherwise anything be attempted in these matters by anyone whatsoever, by any authority, knowingly or unknowingly. § 29. Notwithstanding the foregoing, and, insofar as it be necessary, our and the Apostolic Chancery's rules concerning acquired right not being removed, and that cardinals are not comprehended in constitutions and rules to be issued from time to time unless those concern the favour of the same cardinals or have emanated from their counsel or that of the greater part of them, and of the same Pope Pius IV our predecessor concerning graces, the said Apostolic Camera having interest in any way, to be presented and registered within a certain time in the same Camera, so that these present letters shall never be necessary to be presented or registered there, and other apostolic constitutions, and those issued in universal councils, general or special, as well as decrees of consistory, and of the said college, and any others whatsoever, even those strengthened by oath, apostolic confirmation, or any other firmness, statutes, styles, uses and customs even immemorial, privileges, indults and apostolic letters, granted to the same college and cardinals, and to each of them, and to others, under whatsoever tenor of words and forms, and with whatsoever even derogatory clauses and other more efficacious, most efficacious and unusual clauses, and irritant and other decrees, even by our motion, knowledge and fullness of power similar, and also by consistory, and otherwise in any way, and from any cause even one perhaps necessarily to be expressed, granted, issued, edited, and many times and as many times as you will confirmed, approved and renewed; all and singular of which, even if for their sufficient derogation specific, express and individual mention, or any other expression of them and their whole special tenors, and word for word, and not by general clauses importing the same, ought to be made, or any other exquisite form to be observed for this, we having the tenors of all and singular of them present as fully and sufficiently expressed and inserted word for word, which would otherwise remain in their force, for the effect of the foregoing only,

28 specially and expressly and most fully and most amply we derogate and will and command to be derogated; and all other things to the contrary whatsoever.

29 Preamble § 30. We also will and by apostolic authority decree that these our letters be reduced into a book and joined to the other constitutions of our predecessors, which are read in the first general congregation after the death of the Pontiff, and then in the conclave, and be read together with them, and likewise that an oath be taken by the cardinals concerning the observance of these our letters, just as these same letters are also to be inscribed together with the said constitutions in the register of the Apostolic Chancery, and published at the doors of the Lateran church, the basilica of the Prince of the Apostles, the said Chancery, and in the square of the Campus Florae of the City; we also will that to the transcripts or copies of these present letters, even printed ones, subscribed by the hand of some public notary and sealed with the seal of a person established in ecclesiastical dignity, the same faith be given in judgment and outside it as would be given to these present letters themselves if they were exhibited or shown.

30 § 31. Let no one whatsoever be permitted to infringe this page of our confirmation, approbation, admonition, exhortation, mandates, precepts, decrees, statutes, ordinances, suppression, extinction, abolition, prohibition, will and derogation, or to act against it with rash presumption; but if anyone shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul. LXXVI.

An. C. 1735 CLEMENS

§ 25. Né tuttavia, mentre l'animo a questo povero...

24 erogandis.

28 espressamente e pienissimamente e amplissimamente derogatoriamente e derogatoriamente vogliamo e ordiniamo; e a tutte le altre cose contrarie in qualsiasi modo.

29 Presoiici § 30.
