In hac sublimis
Bull on the election of the Roman Pontiff
PIUS, BISHOP
Servant of the Servants of God, for perpetual remembrance of the matter.
1 Placed in this sublime Chair of the Prince of the Apostles, certainly not by any merits of Our own, but by the inscrutable judgment of God, for five and twenty years and beyond, We have observed with the deepest sorrow of Our heart that most grievous reversals of affairs and times and disturbances have grown worse day by day, especially since the sacrilegious invasion of this beloved City and of all Our Pontifical dominion, so that We plainly fear lest, when the Apostolic See becomes vacant after Our death, graver storms may arise, which may disturb the Conclave for the election of Our Successor, or render the creation of a new Pontiff exceedingly difficult, or at least present most serious obstacles to the speedy dispatch of so great a matter. Therefore, since nothing is more important to Us, nothing more urgent, than to provide with all care and diligence for the safety and peace of the Catholic Church, We have wished to follow the footsteps of Our illustrious Roman Pontiff Predecessors Pius V, Pius VII, and Gregory XVI, and to emulate their examples, who, on account of the dangers of their times, judged that the customary rules concerning the election of the Roman Pontiff should be prudently modified.
2 Wherefore, having before Our eyes the calamities of Our times, with fervent and humble prayers addressed to God, with the light of His Holy Spirit humbly implored, and having also heard the counsel of certain of the Most Reverend Cardinals, and having weighed the matter with mature and serious examination, We have resolved by these new Apostolic Letters to establish and decree those things by which, God favourably assisting, the election of Our Successor, the Roman Pontiff, may be accomplished more easily and speedily, which indeed by full right pertains solely to the Cardinals of the Holy Roman Church, established and confirmed by the Apostolic authority of Our Predecessors, by the consent of the universal Church, and by the possession of so many centuries, and We will and command that it remain in its force exclusively, with any intervention whatsoever of lay power of any degree and condition entirely excluded and 1 removed.
3 Therefore by these Letters, by Our own motion and certain knowledge and from the fullness of Our Apostolic power, for the Conclave which shall be held for the election of the Roman Pontiff, Our first Successor, We have abrogated those rules which by Apostolic Constitutions of the Roman Pontiffs, issued also in general Councils, and by other whatsoever Sanctions have been decreed concerning the time and place of the election to be held, and concerning the Conclave and its closure, and indeed We decree and establish that the Cardinals of the Holy Roman Church, who shall be present in the Curia at the next vacancy of the Apostolic See, immediately upon it falling to Us to depart from this life, even before the funeral rites in suffrage for Our soul have been celebrated, and without waiting for the prescribed space of ten days for other Cardinals also sent as Legates a latere, or absent by any other mandate of Ours, shall immediately, having seriously considered the circumstances of this City and the times, deliberate whether the Conclave for the election of a new Pontiff shall be held in the same City or outside it.
4 We establish that the deliberation, whatever it may be, shall have full effect, into which the greater part of the Cardinals then present shall have consented.
5 The place of the Conclave having been determined, the Cardinals of the Holy Roman Church shall be able to accomplish the election of a new Pontiff either in the Curia itself or outside it, by secret ballot, two-thirds of the Cardinals present consenting in the scrutiny, or in the scrutiny and access, to the same Person, or by compromise, or as it were by inspiration, observing in these the customary necessary form. Moreover, although We have judged that nothing should be changed in the number itself of the votes, nevertheless We declare and decree that in an election which takes place outside the Conclave, it shall not be necessary that any account be taken of the Cardinals present in the place, who on account of grave infirmities or any other cause whatsoever shall not have been able to come to the Hall or Chamber designated for the Conclave. He therefore who shall be duly elected by the Cardinals, as aforesaid present, in the manner which We have established, in place of Us, shall be altogether a legitimate and true Roman Pontiff, the Vicar of Christ and the Successor of Blessed Peter, and as such shall be recognized and held by the universal Church. In accordance with these things, in order more fully to provide for the causes of the same first future election, We absolve all Cardinals from the bond of the oath by which they promise to observe the aforesaid Constitutions of Our Predecessors, for the election itself, and We have declared them to be absolved, not only in the aforesaid prescriptions of those Constitutions concerning the time and place of the Conclave and its closure, but also in other ceremonies and solemnities of lesser moment, where the observance of these might delay the outcome of the matter.
6 In other matters, however, which shall not hinder the election of a new Pontiff, which We earnestly desire to be swift, especially in things prescribed with a clause rendering an election otherwise made null, namely except those things from which We have expressly derogated, We command that the same Constitutions be observed also on this occasion.
7 If indeed any doubts should arise in this matter, or concerning any other chapter of this Constitution of Ours, We grant to the Cardinals themselves full power by which they may interpret Our Constitution and declare those very doubts. In which matter, just as in the rest concerning which it may fall to deliberate according to the course of this Constitution of Ours about the business of election (excepting of course the election act itself), it will be entirely sufficient if the greater part of the Cardinals gathered together, as above, consent to the same opinion.
8 We meanwhile, while in a spirit of humility and with a contrite heart we offer our life to the Creator of mankind, and humbly commend our soul to Him through His Only-Begotten Son, the Saviour of the world, earnestly imploring the most powerful patronage of the Most Holy Mother of God, the Immaculate Virgin Mary, do vehemently beseech and entreat Our Venerable Brethren, the Cardinals of the Holy Roman Church, who, when we have been called from this wretched life to the eternal peace which we hope for, shall survive us, that, setting aside all human consideration and looking solely to the glory of God, with most harmonious minds and will they may most diligently apply themselves to this one care, lest the ship of Peter, tossed about by so many and such great tempests, be longer without its Helmsman, and the Lord's flock be deprived of its Shepherd by so many wolves rushing in from all sides; holding before themselves this purpose, that from the best and speedy election of the Supreme Pontiff depend both the tranquility of the Church and the salvation of the faithful people, especially in these most difficult and harsh times, and that they themselves shall be punished by the severest judgment of God if through their fault and negligence it should come to pass that, in so great a crisis of affairs, this Apostolic See be vacant for a longer space than is fitting. For this reason also We command that these Apostolic Letters, witnesses of Our will, on the very day of Our death, if time permit, or if most grave difficulties stand in the way, in a particular congregation of Cardinals of any order, be read in full by the heads thereof, and then their reading, even if it has been made, be altogether repeated before the other Cardinals present in the place at the first general Congregation, whether ordinary or extraordinary, to be convoked.
9 To which Cardinals indeed, according to what We have established in these Letters, it shall be free, observing what We command to be observed, to complete the election of the new Pontiff either at their first meeting. We have therefore established this to remove or prevent dangers which might occur at Our death on account of seditions or other calamities. But since the condition of the times is such that it seems also to be feared lest We be forced to migrate from this beloved City to avoid greater evils or even be carried away by force from here, and then die outside Rome, We have thought it necessary to provide for this event as well. Wherefore by motu proprio likewise, and with certain knowledge and from the fullness of Our Apostolic power, We have established, decreed and commanded, that in this case the election of the new Pontiff may take place in any place whatsoever in the whole world, where so many Cardinals together may be, who exceed by one at least the half of the whole College of Cardinals then living, and that either in Conclave or outside the Conclave, not even awaiting the ten days from the day of the death of the Supreme Pontiff and not awaiting the other absent Cardinals. So that the Cardinals gathered there may freely and lawfully elect the new one, and he who shall have been duly elected by them shall be the true Roman Pontiff, the Vicar of Christ, the Successor of Blessed Peter, and as such ought to be recognized and held by the whole Church. But that the Cardinals may more easily assemble, We will that in the aforesaid case, from that place outside the Curia where Almighty and most merciful God shall will Us to depart from this life, any Cardinal who may be present, or if there be more, the more worthy of them, or, if all be absent, the Apostolic Nuncio, and in his default, the Ordinary of the place, or a Prelate, or any other person invested with ecclesiastical dignity (to whom We shall beforehand, God willing, make known this command of Ours) shall as quickly as possible inform the Dean of the Sacred College of Cardinals and the other Cardinals, of whose see he shall be informed, of the death of the Pontiff, so that they may immediately prepare themselves to hold the election.
10 But the Dean Cardinal, or if he be hindered, another Cardinal of greater dignity, as soon as he shall have received such a message, or in any other way shall have most certainly learned of the vacancy of the Apostolic See, together with three senior Cardinals of any order, and with the Cardinal Camerlengo of the Holy Roman Church, if they shall be together, or if they be absent, with any other Cardinals whatsoever, or finally he himself alone if all the rest be wholly absent, shall choose that place of any region which to them or to him shall seem more opportune for holding the election. Thence, with no delay interposed, the same Dean Cardinal, or if he be hindered, another Cardinal, as above, shall signify to the other Cardinals the vacancy of the Apostolic See, and shall call them to the election of the new Pontiff, and shall inform them of the place in which it has been decided that it be held.
11 We command and enjoin upon all Cardinals in virtue of holy obedience, that unless they be detained by legitimate impediment, they ought to obey the letters of convocation and forthwith betake themselves to the place duly designated therein for accomplishing the election of the Pontiff. Moreover, in whatever other place duly appointed the Cardinals shall have assembled, as We have above decreed and ordained, the election of the new Pontiff shall be altogether held to be legitimate, canonical and valid, provided that in that place so many Cardinals shall have been gathered as exceed by one at least the half of the Cardinals then living, and that they shall have fulfilled those things which are required for effecting a valid election, excepting those to which We have expressly made derogation.
12 Whatsoever things, moreover, have been decreed by Us in the foregoing letters for the first case, to accelerate or to render easier the election of Our Successor, We extend to this second case; and so all and singular things which in the former part of these letters We have indulged, commanded, commended, We will to be held in like manner, and We declare, as if for this second case also they had been specially indulged, commanded and commended.
13 Finally, although We are raised to good hope that Our Successor shall enjoy better times, and shall sit long in this supreme Chair of Peter, yet that We may also provide for the contrary event, which God forbid, by Our own motion likewise and from the fullness of Apostolic authority, all things which in these Letters have been sanctioned and constituted for either case, We extend for the elections first to take place after Our death, and in like manner We decree, for another election to be accomplished after the death of Our Successor, if namely, no new law being issued concerning these matters, Our Successor shall have died.
14 These things, therefore, the perils of Our times being gravely considered, and the whole matter of the cause, and being moved also by the examples of Our Predecessors Pius VI, Pius VII and Gregory XVI, We establish, prescribe, indulge, decreeing that the present Letters and whatsoever is contained therein, even from the fact that anyone having or pretending to have any right or interest in the foregoing matters in any way whatsoever shall not have consented to them, nor shall have been called to or heard concerning them, or from any other causes whatsoever, can in no wise be impugned, but that the same shall always and perpetually remain firm, valid, and efficacious, and shall produce their full and complete effects, and obtain them, and shall most fully avail those to whom it pertains and shall pertain for the time being, and ought to be respectively and inviolably observed by them, and shall be null and void if otherwise concerning these things by anyone whatsoever with any authority, knowingly or unknowingly, should happen to be attempted. Notwithstanding, insofar as it be necessary, without prejudice to acquired rights, and Our other rules and those of the Apostolic Chancery, and likewise both through Alexander III, Gregory X, Clement V, Pius IV, Gregory XV, Clement XII and other Roman Pontiffs Our Predecessors—
15 and also through Us, issued Constitutions and Apostolic Ordinances concerning the election of the Roman Pontiff, whose tenors We have present as fully and sufficiently expressed, and inserted word for word in the same, all and singular of them for the purpose of the foregoing only, those remaining in their value as to the rest and in their contents, most widely and most fully worthy of derogation, notwithstanding anything to the contrary whatsoever.
16 We will moreover, that to copies or exemplars of the present Letters, even printed, subscribed by the hand of some public Notary, and furnished with a seal of a person constituted in ecclesiastical dignity, the same faith shall be given as would be given to the present Letters themselves, if they were exhibited or shown. Let no man therefore be permitted to infringe this page of Our permission, dispensation, faculty, ordinance, decree, mandate, will and derogation, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul His.
17 Given at Rome at St. Peter's, in the year of the Incarnation of the Lord one thousand eight hundred and seventy-one, on the twenty-fourth day of August, in the twenty-sixth year of Our Pontificate.

Notes
- We believe it useful to set forth these interesting documents, which concern the election of the new Pontiff, both because they are not found in the Acts of Pius IX, and because they considerably modify the ancient procedure.

PIUS EPISCOPUS
