Pervetustum Cryptaferratae coenobium
Apostolic constitution erecting the Abbey of Santa Maria di Grottaferrata as an abbey nullius and entrusting it to Basilian monks of the Byzantine rite
THE COENOBIUM OF CRYPTOFERRATA NEAR THE CITY IS ERECTED INTO AN ABBEY "NULLIUS", OR EXARCHICAL MONASTERY, ENTRUSTED TO BASILIAN MONKS OF BYZANTINE RITE AND ITS BOUNDARIES, RIGHTS AND PRIVILEGES ARE ESTABLISHED. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER
1 The most ancient Coenobium of Crypta Ferrata, which, although situated among the Latin peoples and near the City itself, has nevertheless preserved the Byzantine rite from its very beginning even to the present day, has always afforded a splendid testimony to the most ardent disposition of the Roman Pontiffs toward the Eastern Churches. Turning this over in Our mind, from the time when by the inscrutable counsel of God We were raised to the Chair of Peter, We have rejoiced with no small joy to receive under Our particular patronage that Coenobium, which, founded at the beginning of the eleventh century by the blessed Nilus the Younger, has flourished increasingly with the passage of time, like a most brilliant gem of the East set in the tiara of the Roman Pontiff. For it could not escape Our notice that the history of that Abbey has always been most closely joined with that of the Roman Church, and that Our Predecessors have enriched it with many privileges and honors, by which it might become more venerable to the Christian faithful and more apt for promoting the desired union of the Eastern Churches with the Apostolic See. Not one example alone of this pontifical affection toward the Coenobium of Crypta Ferrata can be brought forward; but, to touch briefly upon matters of more recent times, We are moved to recall the illustrious memory of Leo, the Thirteenth Pope, who in that Abbey both restored the integrity of the Byzantine rite and restored monastic discipline more closely to the rules of St. Basil the Great, and was the author that the works of the liberal arts, with which the pious devotion of the faithful enriched the Basilica of St. Mary of Crypta Ferrata, should be made known everywhere among the nations, to which people from Rome, from Latium, and from the very remote regions of Byzantine East have at all times flocked in great numbers. Nor was the munificence of the blessed memory of Pius, the Tenth Pope, toward the Coenobium itself less great, nor the apostolic solicitude of the happy memory of Benedict, the Fifteenth Pope, who instituted in it the Pontifical Greek-Albanian Seminary and entrusted it to the diligent care of the Monks of St. Basil. Following in the footsteps of these Our Predecessors and moved by the same apostolic charity, We ourselves have determined to offer a solemn testimony of Our particular affection toward that Coenobium, so that it may be manifest to all that the Roman Pontiff, together with the universal Church, cherishes the certain hope that through the earnest study and diligent industry of the Monks of St. Basil of Crypta Ferrata, all the faithful of the Byzantine rite, once most closely bound to the Chair of Peter, but afterwards torn away from it by the most lamentable schism, may at length be brought to the unity of the Catholic Church. Let all know from this that We hold in high regard the distinguished scholarly works of those same Monks, their labors expended in the liberal arts and especially in Byzantine chant, to the investigation of which they apply themselves with such keen acumen of learning. From that Abbey itself, in which, as all know, there exists a most celebrated library, abundantly furnished with distinguished manuscripts illuminated with miniatures, many works are produced worthy of praise, both pertaining to the polyglot typographic art, and to Greek paleography, and to paintings executed in the Greek manner with miniatures; there indeed exists a great workshop, to the great utility of studies, for restoring codices and books corrupted by the injury of time and men. Having all these things before Our eyes, and attending especially to the good of souls, with the deliberate counsel of Our Venerable Brethren the Cardinals of the Holy Roman Church presiding over the Sacred Congregation for the Eastern Church, and having also heard Our venerable Brother Francis, Cardinal of the Holy Roman Church Marchetti Selvaggiani, Bishop of the suburban diocese of Tusculum, in which the town of Crypta Ferrata is situated, after mature consideration of the matter, We have determined to advance that Coenobium to a greater degree of dignity. Having therefore obtained the consent of those to whom it pertains or who presume that it pertains to them, from the fullness of Our apostolic power, the Coenobium of Crypta Ferrata which We mentioned above We elevate, erect and constitute as an Abbey nullius dioeceseos, or Exarchial Monastery, with the same name of St. Mary of Crypta Ferrata preserved, which We will and declare to be immediately subject to Us and the Holy See and entrust to the Basilian Monks of the Byzantine rite. The territory of this new Abbey nullius, already withdrawn from the diocese of Tusculum, is hereby delimited by the following boundaries, namely by the road called Iuliano Della Rovere, commonly called della Cartiera, by the bridge of Castri, by the walls of the valley, by the path between the property of the Franciscan Missionary Sisters of the Blessed Virgin Mary and the land of the Abbey, and by the olive grove now belonging to the Mazzanti family. We further decree that the Abbot of this Abbey shall be the Archimandrite for the time being of the Italian Congregation of Basilian Monks. To the new Abbey nullius of St. Mary of Crypta Ferrata, and to its Abbots or Archimandrites for the time being, although the Abbey itself lacks three parishes as required by law, by special grace, notwithstanding the prescription of canon 319, § 2, C.I.O., We grant all the rights, privileges, honors and powers which other Abbeys nullius and their Prelates enjoy by common law throughout the world, to whose offices and burdens they shall likewise be bound. The Abbatial Church, as before, shall be the Basilica of St. Mary of Graces of Crypta Ferrata, in which We establish the seat of the Abbot or Archimandrite, with all honors and privileges preserved to it which have been conferred upon it by the Supreme Pontiffs in the course of centuries. We further decree that the Italian Congregation of Basilian Monks mentioned above shall provide some support for the table of the Archimandrite or Ordinary to the extent of their ability, to sustain his burdens. We will, however, that it shall in no way be lawful to alienate or cede any part of the abbatial territory contained within the boundaries described above, whether by sale, or lease, or in any other manner without the faculty of the Apostolic See; so that if any cession of a part of that territory should occur without the permission of the Apostolic See, such cession shall be held to be entirely invalid and illicit. Nothing, however, shall be changed regarding the rights and burdens of the parish of the Byzantine rite of the aforesaid Church of St. Mary, according to which by the Decree Quanta Romanorum, issued by the Sacred Congregation for the Eastern Church on the nineteenth day of May in the year nineteen hundred thirty-one, We have established. We will, however, that the right remain firm for the Basilian Monks to conduct sacred processions three times a year through the public streets of Crypta Ferrata, if it please them, namely on the twenty-second day of August, that is on the feast of St. Mary of Leo, on the solemnity of St. Nilus the Younger, Founder and Protector of the town of Crypta Ferrata, and on the evening of the sixth day of Holy Week; the Archimandrite Ordinary, however, shall inform the Cardinal Bishop of Tusculum each year concerning these processions to be conducted. To execute all things as above disposed and constituted, We delegate the venerable Brother Peter Pisani, Archbishop by title of Tomis and Assistant to the Pontifical Throne, and grant to him the necessary and opportune faculties, even to subdelegate for the purpose in question any man constituted in ecclesiastical dignity, and with the burden of transmitting to the Sacred Congregation for the Eastern Church an authentic copy of the acts of the execution accomplished as soon as possible. We will and command that these present Letters and all things contained in them shall be valid and binding, notwithstanding any Apostolic Constitutions and Ordinances and other matters to the contrary. Let no one presume to infringe this page of erection, constitution, derogation, concession, statute, mandate and will of the Apostolic See and of Us, or to act contrary to it. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
2 Given from the Aree Gandulfi; in the year of Our Lord nine hundred and thirty-seven, on the twenty-sixth day of the month of September, on the feast of St. Nilus the Younger, in the sixteenth year of Our Pontificate.

CR Y PTOPERRATEN SE COENOBIUM PROPE URBEM IN ABBATIAM «NULLIUS», SEU MONASTERIUM EXARCHICUM, ERIGITUR, MONACHIS BASILIANIS RITUS BY- ZANTINI CONCREDITUR ET EIUSDEM FINES, IURA AC PRIVILEGIA STATUUNTUR. PIUS EPISCOPUS SERVUS SERVORUM DEI AD PERPETUAM REI MEMORIAM
1 Pervetustum Cryptaeferratae Coenobium, quod, licet inter latinas gentes ac prope Urbem ipsam positum, inde ab exordio byzantinum ritum adhuc usque servavit, Romanorum Pontificum erga orientales Ecclesias propensissimi animi praeclarum semper exhibuit testimonium. Quod quidem animo volvèntes, ex quo Nos inscrutabili Dei consilio ad Petri Sedem evecti sumus, non mediocri gavisi sumus gaudio sub per culiari Nostro patrocinio Coenobium illud recipere, quod, saeculo decimo primo ineunte a Divo Nilo Iuniore conditum, temporum decursu magis in dies floruit, veluti orientalis fulgidissima gemma in Romani Pontificis tiara inserta. Nos enim fugere non poterat Abbatiae illius historiam cum Romanae Ecclesiae arctissime semper coniunctam fuisse, eamque Praedecessores Nostros plurimis cumulasse privilegiis et honoribus, quibus et christifidelibus venerabilior redderetur et ad exoptatam Ecclesiarum orientalium cum Apostolica Sede unionem promovendam aptior fieret. Huius pontificiae erga Oryptoferratense Coenobium dilectionis non unum in medium proferri potest exemplum; sed, ut proximiores tantum aevi res breviter attingamus, memorare Iubet cl. m. Leonem Papam Tertium Decimum, qui in Abbatia illa et byzantini ritus integritatem instauravit et monasticam disciplinam ad S. Basilii Magni regulas propius restituit, et auctor fuit ut ubique gentium evulgarentur ingenuarum artium opera, quibus pia fidelium devotio S; Mariae Cryptaef erratae Basilicam ditavit, ad quam illi Roma, ex Latio, ex ipsis remotis Orientis byzantini regionibus omni tempore frequentes confluxerunt. Nec minor fuit in Coenobium ipsum tam s, m. Pii Papae Decimi munificentia, quam fel. rec. Benedicti Papae Quinti Decimi apo>- Sed%s - stolica sollicitudo, qui in illo Pontificium Seminarium Graecum-Albanense instituit ac sollertibus commisit S. Basilii Monachorum curis. Quibus Praedecessorum Nostrorum vestigiis Nos ipsi insistentes, eademque apostolica caritate permoti, peculiaris Nostrae in Coenobium illud dilectionis sollemne praebere testimonium statuimus, quo omnibus pateat Eomanum Pontificem una cum Ecclesia universa certam fovere spem, per incensum Monachorum S. Basilii Cryptaeferratae studium et sollertem industriam, omnes byzantini ritus fideles, quondam cum Petri Sede coniunctissime devinctos, postea vero ab ea lucrosissimo schismate avulsos, ad Catholicae Ecclesiae unitatem tandem aliquando adduci posse. Sciant inde omnes Nos magni facere eorumdem Monachorum praeclarae doctrinae opera, impensos in artibus ingenuis labores ac potissimum in byzantina melurgia, ad quam investigandam tanto doctissimi viri ingenii acumine intendunt. Ab ipsa namque Abbatia, in qua, ut omnes norunt, percelebris exstat bibliotheca, insignibus manuscripti^ codicibus minio pictis copiose instructa, plurima opera Laude dignissimi eduntur tum ad typographicam artem polyglottam, tum ad graecam paleographiam, tum ad picturas graeco more minio ductas pertinentia; illic demum magna cum studiorum utilitate officina existit ad codices librosque instaurandos, temporis hominumque iniuria depravatos. Quae omnia prae oculis habentes, at in animarum bonum praecipue intendentes, de Venerabilium Fratrum Nostrorum S. R. E. Cardinalium S. Congregationi pro Ecclesia Orientali praepositorum consulto, audito quoque venerabili Fratre Nostro Francisco S. R. E. Cardinali Marchetti Selvaggiani, suburbicariae dioecesis Tusculanae Episcopo, in qua Cryptaferrata oppidum exstat, re mature perpensa, Coenobium ipsum ad maiorem dignitatis gradum provehere statuimus. Suppleto igitur quorum intersit vel eorum qui sua interesse praesumant consensu, de apostolicae Nostrae potestatis plenitudine, Cryptoferratense quod supra memoravimus Coenobium in Abbatiam nullius dioeceseos, seu Monasterium Exarchicum, eodem servato S. Mariae Cryptaeferratae nomine, extollimus, erigimus et constituimus, quam Nobis et Sanctae Sedi immediate subiectam volumus ac declaramus et Monachis Basilianis ritus byzantini concredimus. Huius autem novae Abbatiae nullius territorium, iam e dioecesi Tusculana distrac tum, hisce in praesenti delimitatur finibus, nempe via Iuliano Della Rovere, vulgo della Cartiera nuncupata, ponte Castri, moenibus valli, semita inter praedium Sororum Franciscanum Missionariarum a B. M. V. et fundum Abbatiae, et oliveto ad familiam Mazzanti nunc spectante. Statuimus insuper ut Abbatiae istius Abbas sit Archimandrita pro tempore Congregationis Italicae Monachorum Basilianorum. Novae porro Abbatiae nullius S. Mariae Cryptaeferratae, eiusque pro tempore Abbatibus seu Archimandritis, quamvis Abbatia ipsa tribus saltem iure requisitis paroeciis careat, ex peculiari gratia, non obstante canonis 319, § 2, C- I. O. praescripto, omnia tribuimus iura, privilegia, honores et potestates, quibus ceterae Abbatiae nullius earumque Praesules iure communi per orbem fruuntur, quorum officiis et oneribus ipsi quoque erunt adstricti. Ecclesia Abbatialis sicut antea erit Basilica S. Mariae a Gratiis Cryptaeferratae, in qua Abbatis seu Archimandritae sedem Agimus, omnibus eidem servatis honoribus et privilegiis, quae saeculorum decursu a Summis Pontificibus ipsi conlata sunt. Decernimus insuper ut ad Archimandritae seu Ordinarii onera sustinenda Congregatio Italica quam supra diximus Monachorum Basilianorum mensam aliquam illi pro viribus praestet. Volumus autem ut nulla ratione fas sit quamlibet territorii abbatialis partem infra descriptos antea fines contenti alienare seu cedere, sive venditione, sive locatione, sive alio modo absque Apostolicae Sedis facultate; ita ut si aliqua illius territorii partis cessio sine Apostolicae Sedis venia evenerit, cessio ipsa invalida prorsus et illicita habeatur. Nihil vero innovetur quoad paroeciae ritus byzantini praefatae Ecclesiae S. Mariae iura et onera, iuxta quae Decreto Quanta Romanorum, a S. Congregatione pro Ecclesia Orientali die undevicesima Maii mensis, anno millesimo nongentesimo undetrigesimo edito, a Nobis statuta sunt. Firmum autem manere volumus ius Monachis Basilianis sacras ter in anno processiones ducendi per publicas Cryptaeferratae vias, si ipsis placeat, nimirum die vicesima secunda Augusti mensis, idest in festo leonis S. Mariae, in sollemnitate S. Nili Iunioris, Cryptaeferratae oppidi Fundatoris et Protectoris, et vespere feriae sextae maioris hebdomadae; Ordinarius attamen Archimandrita de ipsis processionibus ducendis Cardinalem Episcopum Tusculanum quotannis certiorem faciat. Ad quae omnia ut supra disposita et constituta exsecutioni mandanda venerabilem Fratrem Petrum Pisani, Archiepiscopum titularem Tomitanum et Pontificio Solio Adsistentem, delegamus eidemque facultates necessarias et opportunas tribuimus etiam subdelegandi ad effectum de quo agitur quemlibet virum in ecclesiastica dignitate constitutum et cum onere ad Sacram Congregationem pro Ecclesia Orientali authenticum peractae exsecutionis actorum exemplar quantocius transmittendi. Praesentes autem Litteras et in eis contenta quaecumque rata ac valida esse volumus et iubemus, Constitutionibus et Ordinationibus Apostolicis ceterisque contrariis minime obstantibus. Nemini autem hanc paginam erectionis, constitutionis, derogationis, concessionis, statuti, Apostolicae'Sedis - mandati et. voluntatis Nostrae infringere vel ei contraire liceat. Si quis véro ausu temerario hoc attentare praesumpserit, indignationem omnipotentis Dei et beatorum Apostolorum Petri ët Pauli se noverit incursurum. . ;
