Sacramentum Poenitentiae
Constitution on the crime of solicitation in confession
BENEDICT BISHOP SERVANT OF THE SERVANTS OF GOD.
To the perpetual memory of the matter.
1 The Sacrament of Penance, which the holy Fathers aptly called a plank after the shipwreck of lost grace, We, though unworthy, being called by divine disposition to the care of the universal Church of the Lord, are bound to apply all diligence and pastoral solicitude to God, lest that which after the loss of baptismal innocence has been given as a refuge by Divine benignity, through the fraud of demons and the malice of men perversely using God's benefits, should become a disastrous ruin to the shipwrecked and miserable sinners, and lest that which has been instituted by God, who is rich in mercy, for the salvation and healing of souls, should be turned by the execrable wickedness of certain wicked priests into their destruction and perdition.
2 § 1. Formerly indeed by the happy memory of Pope Gregory XV, Our Predecessor, letters were sent to Us in the form of a Brief under the date given at Rome, at St. Mary Major on the 30th day of August in the year of Our Lord 1622, in the second year of his Pontificate, and it was prudently provided against all and sundry Priests appointed to hear Confessions, who were soliciting to turpitude and dishonesty; And thereafter in successive times, for the interpretation and declaration of those letters, several decrees were issued by the Congregation of Our Venerable Brethren, the Cardinals of the Holy Roman Church, against heretical depravity, by the Inquisitors General under the date of the 11th day of February in the year of Our Lord 1661. And likewise by Our Predecessor Pope Alexander VII, in the General Congregation of the Holy Roman Universal Inquisition held on the 24th day of September in the year of Our Lord 1667, among other matters, propositions alien from Evangelical truth and the doctrine of the Holy Fathers, namely the sixth and seventh, were condemned, prohibited, and forbidden; We therefore, carefully considering how great is the importance for the eternal salvation of souls that these matters be observed everywhere exactly, and how much it concerns the care of the infirm sheep and the preservation of the dignity of the Holy Church of God, lest any Priests, wickedly abusing the Sacrament of Penance, should offer to Penitents for the cure of a wound a stone, for bread a stone, for a fish a serpent, for medicine poison, but with a secure mind recalling that they are constituted by Christ the Lord as Judges and Judges of souls, should administer so venerable a Sacrament with that holiness which befits its sublimity and the dignity of the office: By Our own motion, and from certain knowledge, and mature deliberation of Ours, We approve and confirm by Apostolic Authority by the tenor of these presents those letters thus issued, and all and singular the aforesaid decrees emanating for their interpretation and declaration, and We add to them the inviolable strength of Apostolic firmness; And also, insofar as it is necessary, We again commit and command all Inquisitors of heretical depravity and the Ordinaries of places throughout all the kingdoms, provinces, cities, dominions, and places of the whole Christian world, in their respective dioceses, that they diligently and with all human respect set aside, inquire and proceed against all and singular Priests, both secular and regular, howsoever exempted and immediately subject to the Apostolic See, of whatsoever orders, institutes, societies, and confraternities, and of whatsoever dignity and preeminence, or by any privilege and indult furnished, who have solicited or provoked any Penitent, whatsoever person that may be, either in the act of sacramental confession, or before or immediately after Confession, or on the occasion or pretext of Confession, or even outside the occasion of Confession in the confessional, or in another place designated or accustomed for hearing confessions, with simulation of hearing confession therein, to turpitude and dishonesty, whether by words, or by signs, or by nods, or by touch, or by writing, either then or afterwards to be read, or have had with them illicit and dishonest conversations or dealings with rash presumption; And those whom they shall find culpable in any of such nefarious excesses, let them severely punish them for the quality of the crimes and the circumstances, by condign penalties, according to the aforesaid Constitution of Our Predecessor Gregory, which We wish to be held as inserted here word for word. Giving also, if it be necessary, and again granting the faculty, lest so enormous a crime and one injurious to the Church of God remain unpunished on account of lack of proof, already otherwise granted in the aforesaid Constitution, of proceeding even with singular witnesses, provided that confessional presumptions, indications, and other aids concur. § 2. Moreover, let all and singular Priests constituted to hear Confessions remember that they are bound and obliged to admonish their Penitents diligently, whom they know to have been solicited by others as above, according to the circumstances of the cases occurring, concerning the obligation binding them to denounce to the Inquisitors or to the Ordinaries of places the person whom they hear to have committed the solicitation, even if he be a Priest who lacks jurisdiction to impart absolution validly, or the solicitation was mutual between the Confessor and the Penitent, or the Penitent consented to the solicitation, or did not give consent, or a long time has elapsed after the solicitation itself, or the solicitation was carried out by the Confessor not for himself but for another person. Let Confessors moreover take care diligently lest they impart sacramental absolution to Penitents whom they know to have been already solicited by another, unless they first bring the aforesaid denunciation to completion, having indicated the delinquent to the competent Judge, or at least promise and undertake that they will report it as soon as they are able.
3 And since certain wicked men are found who, either from hatred, or anger, or other unworthy causes, or incited by the impious suggestions of others, or by promises, or by flattery, or by threats, or by any other means whatsoever, setting aside the dreadful judgment of God and contemning the authority of the Church, falsely accuse innocent priests before ecclesiastical judges of solicitation: In order therefore that such nefarious audacity and such detestable crime may be restrained by fear of the magnitude of punishment, whatever person who shall have defiled himself with this execrable wickedness, either by himself impiously calumniating innocent confessors, or wickedly procuring that it be done by others, shall by any priest whatsoever, furnished with any privilege, authority, and dignity, except by Us and Our Successors, unless at the end of life and except at the point of death, the hope of obtaining absolution being reserved to Us and Our aforesaid Successors, be perpetually deprived of absolution.
4 § 4. Finally, greatly desiring to remove from the Sacerdotal Judgment and Sacred Tribunal every occasion of turpitude, and contempt of the Sacraments, and injury to the Church, and to eliminate entirely such pernicious evils, and as far as we are able in the Lord to provide against the perils of souls, which certain sacrilegious men, ministers of the Demon rather than of God, place in the position of reconciling them to their Creator through the Sacrament, burdening them with a greater mass of sins, wickedly submerge in the abyss of iniquity, with the counsel of certain of Our Venerable Brethren, Cardinals of the Holy Roman Church, and of some Masters in Theology having been employed thereupon, and with the repeated supplications of several Bishops also concurring, by this Our Constitution to endure in perpetuity, just as We know has already been done by many Bishops through their Synodal Constitutions, to all and each of the Priests, both Secular and Regular of whatsoever Order and Dignity, otherwise approved for hearing confessions, and furnished with any Privilege and Faculty, even with special expression and most special note and mention, by Apostolic Authority and the fullness of Our Power, We interdict and prohibit, that any of them, outside the case of extreme necessity, namely at the very point of death, and then when no other priest who can perform the office of confessor is available, dare to hear the Sacramental Confession of a person who is an accomplice in the turpid and nefarious sin committed against the sixth Precept of the Decalogue; and for this reason that same person is deprived by the law itself of any authority and jurisdiction to absolve any person of such guilt; so much so that absolution, if he shall have attempted to impart it, is null and void and utterly invalid, as imparted by a priest who exists deprived of the jurisdiction and supreme Pontifical faculty necessary for validly absolving, which We intend to take away from him through these Our letters; and nevertheless, if any confessor shall dare to act otherwise
BULLARIUM.
5 § 5. Declaring also, and decreeing, that neither even by virtue of any Jubilee, Bull, or even Bull which is called the Holy Crusade, or any other whatsoever Indult, shall anyone be able to hear the Confession of such an accomplice of this kind, and to bestow sacramental absolution upon him; since for this effect, and in this case, no Confessor, as one who in such sin and kind of Penitent lacks jurisdiction, as aforesaid, and is deprived by Us of the power of absolving, shall be held for a legitimate and approved Confessor. Notwithstanding the Constitutions and Ordinances Apostolic, especially those which are called the Holy Crusade, or the Jubilee Universal and plenary, as well as any whatsoever of the Churches and Monasteries and Orders of any kind, of which the same Priests shall have been, even by oath, continuation Apostolic, or any other firmness strengthened, Statutes and Customs, Privileges also, Indults, and Apostolic Letters under whatsoever tenors and forms, and with whatsoever clauses and decrees, even by motu proprio, or otherwise howsoever granted, even repeatedly approved and renewed, all of which, their tenors being known beforehand as expressed, We derogate from by these presents specially and expressly, and from all others contrary whatsoever. § 6. We will finally, and command, that all Ordinaries of places, both present and future existing in time, in the approval of Confessors, both the Confession practice Constitution of Gregory Our Predecessor, and this present one of Ours, shall cause to be carefully read and accurately observed by all Priests to be approved, and shall admonish them in the Lord, and exhort them, that they perform their Sacred Ministry committed to their faith with the utmost innocence of soul, purity of morals, integrity of judgment, and exhibit themselves as Ministers of Christ, and Dispensers of the Mysteries of God; let them moreover be mindful that they hold the place and perform the office of the Supreme and eternal Priest, who Holy, innocent, undefiled, through the Holy Spirit offered Himself immaculate to God, that He might cleanse our conscience from dead works, to serve the living God: let them therefore study diligently, and carefully beware, lest by their fault the door be shut to those seeking and knocking; lest the lost Sheep hastening to return to the Fold of the Lord be delivered to be torn by the teeth of beasts by their hands; lest prodigal Sons needy and wounded, returning to the heavenly Bread, be pierced by their wicked dishonesty with graver wounds of sins, while they are still on the way. § 7. But that these present Letters may more easily come to the knowledge of all, and no one may allege ignorance of future matters, We will that they, or copies thereof be affixed and published at the doors of the Lateran Church, and the Basilica of the Prince of the Apostles, as well as at the Chancery of the Apostolic Palace, and the General Curia on the Citatorio Hill, and in the Field of Flowers in the City, as is the custom; and thus published and affixed, all and each to whom they concern shall stand and be affected just as if to each of them individually and nominately and personally intimated they had been: and that copies of these present Letters, or examples, even printed, subscribed by the hand of some public Notary, and furnished with the seal of some Person constituted in Ecclesiastical Dignity, the same faith shall be given everywhere, as well in judgment as outside it, which would be given to these presents if they were exhibited or shown. § 8. Let no one therefore whatsoever be permitted to infringe this page of Our will, sanction, precept, mandate, and derogation, or to act against it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of Almighty God, and of the Blessed Peter and Paul His Apostles. Given at Rome near

Dato a Roma presso...
