Religiosam vitam eligentibus
Amen, amen.

clauses. — Subscriptions of Pope Honorius and the cardinals of the Holy Roman Church.
1 Honorius, bishop, servant of the servants of God, to our beloved sons Dominic, prior of St. Roman of Toulouse, and his brothers, both present and future, professed in the regular life, greeting and apostolic blessing. Preamble. Since it is fitting to provide protection for those who choose the religious life, lest perchance the assault of any recklessness should turn them from their purpose, or (God forbid) should break the strength of sacred religion.
2 § 1. For this reason, beloved in the Lord, we have graciously assented to your just petitions regarding the Priory of St. Roman of Toulouse, and we take under the protection of St. Peter and our own the church of St. Roman of Toulouse, in which you are bound to divine service, and we strengthen it with the privilege of this present writing. First of all, we decree that the canonical order, which is known to have been instituted in that same Church according to God and the rule of St. Augustine, shall be inviolably observed there in perpetuity.
3 § 2. Moreover, whatever possessions, whatever goods that same Church justly and canonically possesses at present, or shall be able to acquire in the future through the grant of Pontiffs, the generosity of kings or princes, the offering of the faithful, or by other just means, with the Lord providing, shall remain firm and unimpaired for you and your successors.
4 § 3. In which matters we have deemed it necessary to express these things in our own words, namely: the place itself in which the aforesaid church is situated, with all its appurtenances. The Church of Prullian, with all its appurtenances. Villani of Cassenolio, with all its appurtenances. The Church of St. Mary of Lescura, with all its appurtenances. The Hospital of Toulouse, which is called that of Arnald Berard, with all its appurtenances. The Church of the Holy Trinity of Lobens, with all its appurtenances. The tithes granted to you with pious and prudent liberality by our venerable brother Fulco, bishop of Toulouse, with the consent of his chapter, as is more fully contained in their letters.
5 § 4. Truly, concerning your newly cultivated lands, which you till with your own hands or at your own expense, or for the nourishment of your animals, let no one presume to demand or extort tithes from you.
6 § 5. It shall be lawful for you also to receive into your order clerics or laymen, free and absolved, fleeing the world for conversion, and to retain them without any contradiction. § 6. We further prohibit that it be lawful for any of your brothers, after making profession in your Church, to depart from that place without the licence of his prior, unless it be for the sake of a stricter religious life. And let no one dare to retain one departing without the common letter of security from you. § 7. In the parochial churches which you have, it shall be lawful for you to elect priests and present them to the diocesan bishop, to whom, if they shall be suitable, the bishop shall commit the care of souls, so that they should answer to him concerning spiritual matters, and to you concerning temporal matters.
7 § 8. We further decree that it shall not be lawful for anyone to impose new and undue exactions upon your Church, or to promulgate sentences of excommunication or interdict against you or the aforesaid Church of yours, without manifest and reasonable cause. But when there shall be a general interdict of the land, it shall be lawful for you, with doors closed, the excommunicated and interdicted excluded, bells not rung, with suppressed voice, to celebrate divine offices.
8 § 9. The chrism and holy oil, the consecrations of altars or basilicas, and the ordinations of clerics who shall be promoted to sacred orders, you shall receive from the diocesan bishop, if he shall be catholic and shall have the grace and communion of the most holy Roman See, and shall be willing to provide these things to you without any malice. Otherwise it shall be lawful for you to approach whatever catholic bishop you shall prefer, having the grace and communion of the Apostolic See, who, relying on our authority, shall furnish to you what you request.
9 § 10. We also decree that the burial of that place shall be free, so that to the devotion and last will of those who shall have decided to be buried there (unless perchance they be excommunicated or interdicted) no one shall offer opposition. The justice of those Churches, however, from which the bodies of the dead are taken, being preserved.
10 § 11. But when you, the present prior of that place, or any of your successors shall pass away, let no one be placed there by any subterfuge of deception or violence, except whom the brothers by common consent, or the part of the brothers of greater and sounder counsel, shall have provided to be elected according to God and the rule of St. Augustine.
11 § 12. We also hold as valid the liberties and immunities, ancient and reasonable customs, granted to your Church and hitherto observed, and we decree that they shall remain unimpaired in perpetuity.
12 § 12. We also hold as ratified the liberties and immunities, both ancient and reasonable customs, granted to your Church and hitherto observed, and we decree that they remain inviolate for all time.
13 § 13. We decree therefore that it shall be lawful for no one of any condition or rank of men to rashly disturb the aforesaid Church, or to take away its possessions, or to retain those taken away, to diminish them, or to harass them with any vexations whatsoever; but all things shall be preserved intact, to be of use in every way for those for whose governance and sustenance they have been granted, saving the authority of the Apostolic See and the canonical justice of the diocesan bishop. If therefore any ecclesiastical or secular person in the future, knowing of this page of our constitution, shall attempt to come rashly against it, being admonished a second and third time, unless he shall correct his guilt by fitting satisfaction, let him be deprived of his power and honour and dignity, and let him know himself to be guilty before divine judgment of the iniquity perpetrated, and let him be separated from the most sacred Body and Blood of God and of our Lord and Redeemer Jesus Christ, and in the final examination let him be subject to strict punishment.
14 § 14. But to all who preserve their rights to the same place, be the peace of our Lord Jesus Christ: so that both here they may receive the fruit of good action, and before the strict Judge they may find the rewards of eternal peace. Amen, amen.
