Bull on the poverty of Christ and the Franciscan Order

Bull of Pope John XXII ·

him himself to regard, wherefore at the same time he forbids that syndics be henceforth appointed to administer these goods in the name of the church. 5 8 December 1322, at Avignon.

1 To perpetual memory of the matter.

2 It is beyond doubt that it pertains to the framer of the canons, when statutes made by himself or by his predecessors 1 Thus we read in Baluze, Vitae papp. Avin. I, 752, and Muratori, Antiqu. Ital. VI, 181 14. Cf. above p. 86 note 3 and Ehrle l. c. III, 457, who writes that these apostolic letters were finally condemned on 8 February 1326 and in the general chapter of the Friars Minor held at Teramo in 1500 these statutes were: "Moreover, according to the same ancient institutions, let no friar presume to hold the sum of Peter John on the Apocalypse and his other treatises under penalty of imprisonment." Sixtus V, however, is said to have granted permission to read the works of the said Peter John and to extract from them the rose with the thorns omitted. Cf. below n. 600 a.

3 4 The letters dated 30 November 1321 and 17 November 1322 differ from each other in this respect; the name of the inquisitor is expressed in those, omitted in these. 5 Reg. Vat. t. 74 ep. 6 de curia, in Baluze, Miscell. III, 221. — Regarding the bull Quia nonnunquam dated 26 March 1322 (n. 464), we have noted that the Supreme Pontiff sought the opinion on poverty of many prelates and learned men. Among these Ubertinus of Casale, frequently cited above (cf. n. 287), is numbered, who indeed held thus: "To the aforesaid question it is not to be answered simply affirmatively or negatively, but by a twofold distinction the truth of faith is to be chosen and heresy rejected. And first it is to be distinguished concerning Christ and the Apostles, because they were under a twofold state; for they were universal prelates of the Church of the New Testament: and in this way, as far as the authority of disposition for giving to the poor and ministers of the Church, as is written of the Apostles, they had goods in common; and to deny that they did not have them in this way would be heretical. But this question does not properly arise from this, because no one in this sense denied it. From this authority of prelacy Christ is said to have had purses Bullarii Franciscani t. V.

4 discovered to cause harm rather than benefit, to provide that they might not be able to cause further harm. For indeed the late Pope Nicholas III, our predecessor of happy memory (looking carefully to the fact that the rule of the blessed confessor Francis contains that his followers appropriate nothing to themselves, neither house nor place nor any thing of their order; and considering diligently that through the pious memory of Pope Gregory IX and certain other predecessors of the same it had been declared that this ought to be observed both in particular and in common; and also considering attentively that certain ones impinging upon the brothers themselves were detracting from them, claiming that they did not observe this rule and declaration; and also piously considering to close the mouths of those barking against the aforesaid brothers and to provide for the consciences of the professors themselves) among other things ordained and enacted that the ownership and dominion of all utensils and books and moveable things present and future, of churches also and oratories and cemeteries both present and future, and also of other things purchased from various alms and offered or granted to the said brothers, in which however those offering or granting them would hold nothing reserved to themselves in them, should belong fully and freely to itself and the Roman Church, the same receiving them into itself and the aforesaid Church, with the simple use of fact only in these things and goods being reserved to the aforesaid brothers. And because sometimes it is expedient that the aforesaid books and other moveable things be sold or also exchanged, the brothers themselves in the same ordinance had. Second, Christ and the apostles can be considered as individual persons, the foundations of religious perfection and perfect contemners of the world's glory and treading down the world's pomp and observing in themselves the counsels of Christ concerning the supererogation of perfection and giving to all wishing to be perfect clear examples; and if it is asked whether in this manner they had, a distinction must be made concerning a twofold manner of having. Of which the first is civil and worldly, which manner of having the imperial laws define, showing its two parts; and we say these words are in our goods, in which things had we have exception and defense and in things not had repetition. And thus it is plain that he who has something civilly and in a worldly manner can defend his thing from an invader and recover it from a detainer in judgment under an imperial judge. And in this manner to say that Christ and the apostles had worldly things is heretical, because contrary to the Gospel; for Christ the peaceful king, who made his apostles sons of peace, separated them from all human litigation, saying: "And to him who will contend with thee in judgment and take away thy coat, give him thy cloak also"; and "who taketh away thy garment, thy tunic also forbid him not, and who taketh what is thine, do not demand it back." In which words he removes from himself (because he himself did what he taught) and from the apostles (to whom he imposed this same thing) the twofold part of civil and worldly law, the defense of what is held and the recovery of what is lost. And this manner of having is properly said to have in a thing ownership and dominion. And because Christ and the apostles had nothing in this manner, therefore blessed Peter on behalf of himself and all the apostles says as a true pauper: "Behold we have left all things and followed thee." To say therefore that Christ and the apostles in this manner had in common or in particular ownership and dominion is heretical and blasphemous. And in this manner I concede what the brothers Minor understand, although they did not distinguish the various manners of having. In another manner temporal things can be had as to the necessary and common right of fraternal charity. And in this manner Christ and the apostles had temporal goods by natural right, which by some is said the right of the pole, for necessary sustenance, rejecting all things which savored of riches or smelled of delights or nourished the world's pomp. And in this manner they had loaves and fishes; and thus the apostle says: "having food and wherewith to be covered, with these we are content." Nor is there any profession nor any counsel of Christ which prohibits such a manner of having, namely as to the necessary use of life: and therefore to say that they did not have in this manner would be heretical. And thus I concede what the brothers Preachers would wish to say." But Vitalis of Furno, bishop of Alba (of the order of Minors), answered to the supreme pontiff inquiring those things which are read in Raynaldus Ann. eccl. at a. 1322, n. 07. The same was nearly pleasing to Bertrand of Torre, titled s. Vitalis presbyter cardinal (of the order of Minors) and to Berengarius Fredoli bishop of Tusculum.

5 There were other adversaries. Thus Peter of Arreblayo, cardinal priest of St. Susanna; thus Peter Textoris, cardinal priest of St. Stephen on the Caelian Hill; thus Peter of Colonna, cardinal deacon of the Holy Roman Church; thus Durandus of St. Porciano, bishop of Anicium (of the Order of Preachers); thus Hervaeus, master general of the Order of Preachers; thus the bishop of Sora (either James, who when he was a canon of Sora was promoted to bishop of Sora on 24 November 1323, or his predecessor named Andrew), concerning whom see Raynaldus in the place cited, nn. 56-64; thus the "response of the general study of Paris given by (Simon of Archiac) cardinal of Vienne, which Raynaldus reports in the place cited for the year 1323, nn. 38-50; and finally certain treatises composed on this matter, among which we praise those which the aforesaid master general of the Order of Preachers and Augustine, bishop of Lucera (of the Order of Preachers) composed (cfr. Rayn. in the place cited, nn. 58-60). "Subsequently," writes Rauzius in the place cited, "some cardinals [especially those two who were of the Order of Minors] and certain other notable men requested brother Michael, general minister of the Order of Minors, and the entire general chapter to be celebrated at Perugia on the feast of Pentecost [year 1322] in the near future, that they themselves should define and determine what they felt concerning the said question about the poverty of Christ and his apostles, and should reduce it to writing and send it to all the faithful of Christ." Those who followed these exhortations gave these letters: "To all the faithful of Christ inspecting these present letters, brother Michael, general minister of the Order of Friars Minor, William [of Nottingham] of England, Henry [of Talheim] of Upper Alamannia, Arnold of Aquitania, provincial ministers, masters in sacred theology, as well as Hugh of Newcastle and William of Alnwick, doctors of sacred theology, Nicholas minister of France and William Bloch, bachelors in sacred scripture, and all ministers and custodians, discretes and readers of general studies gathered at Perugia in general chapter and the whole general chapter of the aforesaid order, greetings and eternal peace in the Lord. Know that we in the year of the Lord 1322, in the fifth indiction, on the day before the nones of June, having heard and understood a certain question which is principally agitated in the Roman curia, in which it is asked whether to assert that Christ and the apostles had nothing in their own right nor in common is heretical; and being requested what we felt concerning that question and to cause it to be reduced to writing under our seals and our own subscriptions: having examined and considered the said question with the allegations which are made for and against, and having digested them with diligent and mature deliberation, adhering firmly and entirely to the determination of the holy Roman Church, we say and confess concordantly and unanimously that to say and assert that Christ, showing the way of perfection, and the apostles following the same way of perfection and wishing to derive it to others through example, living perfectly, had nothing by right of property and dominion or right of their own in particular and in common, is not heretical, but sound, catholic and faithful, especially since the holy Roman Church, which is proved never to have deviated from or erred in the path of apostolic tradition (XXIV, qu. I

6 JOHN XXII (Year VII - 1322)

7 granted that they could freely exchange those things with other things, the use of which it was permitted to the brothers themselves, provided that the authority of the general or of the provincial ministers intervened jointly or severally. But because the rule strictly forbade those brothers to receive money by themselves or through another, he willed and granted that if it should happen that the aforesaid movable things were sold at an estimated price, such price should be received by a procurator from the apostolic see or from a cardinal governor of the order appointed for this purpose, and by the same procurator should be expended in another lawful thing, the use of which was permitted to the brothers of the same order: with this addition, that the brothers themselves could, from things of little value or worth little, for the sake of piety or devotion or for another honest and reasonable cause (having obtained permission of their superiors on this matter) arrange within and outside the said order.

8 Although, however, our aforesaid predecessor, moved by pious consideration, ordained the aforesaid matters, thinking them profitable to the said order, yet the same (having regard to the manner of living of the brothers themselves and the patience of the said church which followed concerning the same) is known to have been declared by experience, the teacher of things, not to have been profitable, but rather to have been harmful both to the brothers themselves and to many others. Truly to the brothers themselves, as far as the state of perfection is concerned, the aforesaid reservation of dominion was in no way profitable. Since the perfection of Christian life consists principally and also essentially in charity, which is called by the Apostle the bond of perfection (cap. A reda and cap. Pudenda at the end), this the same expressly states, affirms and determines clearly (Extra de verb. sign. cap. Exiit lib. VI, § Porro) thus saying: "We say that the renunciation of the ownership of all things both in particular and in common for the sake of God is meritorious and holy, which Christ also, showing the way of perfection, taught by word and confirmed by example, which also the first founders of the Church militant, that is the Apostles, just as they had drawn from the same source, that is Christ, derived through the channels of their teaching and life to those willing to live perfectly." Which determination of the Church in book VI (of the Decretals) has been inserted by the same Catholic Church and by another decretal promulgated in the Council of Vienne and inserted in book VII under the title "of the signification of words" has been approved by the same universal and Catholic Church. And most recently by the most holy father, the Lord John by divine providence Pope XXII, in his said declaration issued upon the rule and state of the Friars Minor, which begins: "Quorumdam exigit", the same declaration has been greatly commended as having been issued wholesomely, solidly, clearly and digested with much maturity. And as the canon testifies (XIX dist. Si Romanorum), that which the Apostolic See has approved as sound doctrine ought always to be held as accepted nor is it permitted to anyone in any way to depart from it (X XIV, qu. / cap. Haec est fides). In testimony and support of this our opinion and the common and concordant judgment, we have deemed it fitting to strengthen the present series by the common consent of all of us with our seals and proper subscriptions of the General Minister and the aforesaid Masters and Bachelors in Sacred Scripture, as well as of four Provincial Ministers, namely Thomas of the Province of Bologna, Peter of the Province of St. Francis, Ferdinand of the Province of Castile and Simon of the Province of Tours. Given at Perugia, in the year, month and day mentioned above."

A reda e cap. Pudenda in fine), questo espressamente dica, affermi e determini chiaramente (Extra de verb. sign. cap. Exiit lib. Dato a Perugia, nell'anno, mese e giorno sopra ricordati ».
