Concordat between the Holy See and the Austrian Empire

Concordat of Pope Pius IX ·

APOSTOLIC LETTERS BY WHICH THE DISPUTE WITH THE AUSTRIAN EMPEROR KING APOSTOLIC IS CONFIRMED.

PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL MEMORY OF THE MATTER

1 God, the author of human salvation, who founded His Church upon a rock, works wonders in it daily, manifesting the spirit of counsel, wisdom and fortitude, so that it may never fear any adversities or hostilities, but rather be found more steadfast and firm in these, and be strengthened in the solidity of faith for the defense of justice.* Truly, led by this same spirit from Him, blessed Peter and the Roman Pontiffs, his Successors, exercising the office of Apostolic service, have turned tempests into calm, made rough ways into plain paths, and have continually worked those things which have profited the Christian people for peace and for eternal life. And We, whom God thus disposing, have been called to the governance of the universal Church in so great a movement and change of public affairs, which no one is ignorant of, not only has He Himself most mercifully been present in alleviating straits and tribulations, but has also often been a great cause of joy and consolation. It is a sign of Divine mercy that He has recently placed over the Austrian Empire a Prince in whom all things are supreme, and who is most firmly persuaded that mortal affairs have been thus composed and distributed by God, so that the priesthood and empire might be joined together for the benefit of mankind. But in truth, the grave and long-standing evils which the Church of God and the Catholic Religion have long experienced in the dominions of the Austrian Empire, Our Predecessors the Roman Pontiffs have never ceased to endeavor to repair. Yet by the grace of God, and through the singular piety and religion of Our most beloved Son in Christ Francis Joseph, Emperor and Apostolic King of Austria, it has at length come to pass that We have been able to arrange opportunely the ecclesiastical and religious affairs of that same illustrious empire. We have done this by solemn Convention, to which Our beloved Son Michael, Presbyter Cardinal of the Holy Roman Church, Viale Prela, Apostolic Nuncio at the Imperial Court of Vienna for many years past, honored with Our Plenipotentiary powers, and the Venerable Brother Joseph Othmar, Archbishop of Vienna, Plenipotentiary of the Emperor of Austria, subscribed on the eighteenth day of August last. It was established first in the same Convention that the Catholic Apostolic Roman Religion in the whole Austrian Empire, and in each of the dominions of which it consists, shall be preserved intact and unimpaired with those rights and prerogatives which by divine institution it possesses, and by the sanction of the sacred canons. And in spiritual matters and ecclesiastical affairs, the communication of Bishops, or Clergy, or people with this Apostolic See shall be entirely free and subject to no permission of the civil Government, nor shall the exercise of Our or Our Successors' pontifical authority in the same matters be hindered in any way. The power of Bishops to communicate freely with the Clergy and people of their own Diocese has been asserted and vindicated, and to exercise all things which are proper to the pastoral office. Seminaries are subject to their authority, into which adolescents called to the lot of the Lord shall be received, and to which they shall freely appoint rectors and masters. It is the office of Bishops to decree and regulate public prayers, sacred supplications, pilgrimages, and other ecclesiastical functions, the canons being observed, and it pertains to them to convoke and celebrate Diocesan Synods, or Provincial Councils, to enact in them what is opportune, and to publish and promulgate the statutes. The power of Bishops to exercise discipline in the Clergy of their own Diocese is likewise free, nor shall they ever be hindered from visiting with the censures of the Church even the laity who transgress the sacred laws and canons. And to defend the purity of Catholic doctrine, and to strenuously preserve the honesty and integrity of morals, it has been established that the same Bishops shall freely subject to ecclesiastical censure books adverse to religion or good morals, which the administrators of civil authority shall strive with all effort to turn away and repel from the dominions of the empire. We have also dealt in the same Convention with ecclesiastical causes, with matrimonial and spousal matters to be known and judged by ecclesiastical power on account of their religious nature. Concerning the families of Regulars, it has been provided that, the decrees of the Apostolic See being observed, those seeking admission to their own novitiate and to the profession of religious life shall be freely admitted throughout the whole Austrian Empire: nor shall there be any impediment there whereby the General Superiors here in Rome may communicate in matters pertaining to the regular institute with their brethren, or may institute their visitation in the dominions of the Austrian Empire. We have carefully provided for the Christian education of youth, and have striven to protect and defend the native power of Bishops in this most grave matter. Under their vigilance throughout the whole Austrian Empire, schools both public and private, instituted for the instruction of Catholic youth, are subject to them: the method of teaching shall be entirely in accord with the doctrine of the most holy religion; Bishops shall judge concerning books which may be more useful for youth in receiving religious instruction. The office of master or professor in gymnasia, or schools, which Catholic youth frequent, shall be filled by Catholic men: theology and the higher disciplines both publicly and privately shall be taught only by those whom the Bishops shall deem it right to permit, having known their science, faith and piety. And for preserving in each Diocese the faith and sound doctrine, for safeguarding the discipline of the Church, for protecting and preserving its sacred rites, ceremonies and institutions, the Imperial Government shall provide assistance to the Bishops when need be, and shall render it effective, when the same Bishops have visited punishment upon Clerics forgetful of their duty. For indeed the most religious Emperor shall command all the magistrates of his empire to show continual honor and reverence to the sacred Prelates and Clergy. Bishops shall commit the care of souls to worthy and suitable parish priests, by public competition announced, and the prescriptions of the Council of Trent being observed. Concerning the Collegiate Chapters of Cathedral Churches in which We have reserved to Our collation and that of the Apostolic See the first, and the second if it be of lay patronage, dignity, it has been provided, saving the right of the Most Serene Emperor and of Patrons to nominate, that access to these shall be open to ecclesiastical men who both have the qualities required by the sacred canons, and have been engaged with such praise in the office of the care of souls, or in teaching the sacred disciplines, or in conducting other ecclesiastical affairs. Bishops shall establish the prebends of Penitentiary and Theological Canons in Collegiate Churches, according to the manner prescribed by the same Council of Trent and pontifical decrees, as soon as it can be done, and shall confer them on more suitable ecclesiastical men. It shall be the right of Bishops to institute minor benefices, and having conferred them with suitable endowment of revenues in consultation with the Emperor and Apostolic King, to determine the limits of parishes, and to divide them, or to join them together. The right of the Church to possess and acquire whatever stable and productive goods has been so acknowledged and established in this Convention that those which it now possesses, or shall possess in future time in any regions of the Austrian Empire, shall be entirely and absolutely intact and inviolate. And concerning the tithes of the Church, which in most regions of his empire have been abolished by civil law in the past change of public affairs, it has been provided that, saving the right to exact them where they still exist in fact, those lost shall be compensated by stable goods and lands or money assigned upon the public treasury of the empire. And since there are many goods in the dominions of the Austrian Empire which constitute the endowment, or funds, as they say, of religion and studies, and which derive their origin from the Church, these ought to be administered in the name of the Church, and under the inspection of Bishops, with the further condition added that they may subsequently be divided by Our and the Most Serene Emperor of Austria's counsel, and may be assigned as a stable endowment to sacred buildings, Seminaries of Clerics, or to any other ecclesiastical institutions. But from the most pious Emperor's mind it is most certainly to be expected that the subsidies now provided from the public treasury for the necessities of Churches shall be increased, and that better provision shall be made for the support and dignity of poor parish priests. It has likewise been enacted that the number of Dioceses shall be increased, and a new circumscription of them established in the dominions of the Austrian Empire; and therefore, when We shall know that the good of souls demands it, having taken counsel with the same Emperor of Austria and Apostolic King, We shall provide with ready and willing mind. These, and other things, which for the protection of the most holy religion, for the increase of the Catholic faith in the dominions of the Austrian Empire, according to the circumstances of places and times, We have known to be more necessary and opportune in the Lord, have been agreed upon and promised in the same Convention. Since therefore all and singular the promises, agreements and concordats have been approved, confirmed, and ratified by Us and by Our most beloved Son in Christ Francis Joseph, Emperor and Apostolic King of Austria, in all and singular points, clauses, articles, and conditions, We have wished to add the strength of Apostolic firmness and to interpose a more solemn authority and decree for their more firm subsistence: By these, therefore, Our Apostolic Letters We make known that all things which have been established for the good of the Catholic religion, and for the increase of the orthodox faith and ecclesiastical discipline throughout the whole dominion of the Austrian Empire. The tenor of the Convention entered into is, however, as follows, namely:

CONVENTION BETWEEN HIS MOST HOLY LORD PIUS IX, SUPREME PONTIFF, AND HIS MAJESTY C. R. A.

FRANCIS JOSEPH I, Emperor of Austria

IN THE NAME OF THE MOST HOLY AND UNDIVIDED TRINITY

2 The Catholic Apostolic Roman Religion throughout the entire Austrian Empire, and in each and every dominion of which it is constituted, shall be preserved intact and protected always with those rights and prerogatives which it ought to have from the ordinance of God and the canonical sanctions.

Art. II.

3 Since the Roman Pontiff holds by divine right the primacy both of honour and of jurisdiction over the universal Church, which extends far and wide, the mutual communication of Bishops, Clergy, and people with the Holy See in spiritual matters and ecclesiastical affairs shall not be subject to any royal permission, but shall be entirely free.

4 Archbishops, Bishops, and all local Ordinaries shall communicate freely with the Clergy and people of their dioceses in the discharge of their pastoral office, and shall likewise freely publish their instructions and ordinances concerning ecclesiastical matters.

Art. IV.

5 It shall be free for Archbishops and Bishops to exercise all that which pertains to them for the governance of their dioceses, whether from the declaration or from the disposition of the sacred Canons according to the present discipline of the Church approved by the Holy See, and especially:

6 (a) To appoint Vicars, Counsellors and assistants for their ecclesiastical administration, whomsoever they shall have judged suitable for the aforesaid offices. (b) To admit to the clerical state and to promote to sacred Orders according to the Canons those whom they shall have deemed necessary or useful for their dioceses, and conversely to exclude from the reception of Orders those whom they shall have judged unworthy. (c) To erect minor benefices, and after taking counsel with the Imperial Majesty, especially regarding the suitable assignment of revenues, to establish, divide or unite parishes.

7 (d) To prescribe public prayers and other pious works, when the good of the Church or the State and people demands it; likewise to order sacred supplications and pilgrimages, to regulate funerals and all other sacred functions, with all canonical prescriptions being observed. .

8 (e) To convene and celebrate, according to the norm of the sacred canons, provincial Councils and diocesan Synods, and to publish their acts.

9 All instruction of Catholic youth in all schools, both public and private, shall be in conformity with the doctrine of the Catholic religion. Bishops, moreover, shall direct the religious education of youth in all places of instruction, both public and private, in the exercise of their pastoral office, and shall carefully watch over it, so that in any discipline being taught there shall be nothing contrary to the Catholic religion and to the honesty of morals.

10 No one shall teach sacred Theology, catechetical discipline, or the doctrine of religion in any institute, whether public or private, unless he shall have obtained a mission and authority from the diocesan Bishop, whose right it is to revoke it when he shall have deemed it opportune. Public professors of Theology and catechetical masters, after the sacred Prelate shall have examined the candidates regarding their knowledge and piety, shall be chosen from among those who shall have shown themselves ready to confer upon them the mission and authority to teach. Where, however, certain professors of the theological faculty are accustomed to be employed by the Bishop for instructing the students of his Seminary in Theology, such professors shall never be assumed except men whom the sacred Prelate shall have been accustomed to regard as suitable for discharging the aforesaid office. For the examinations of those who aspire to the degree of Doctor of Theology or of sacred Canons, the diocesan Bishop shall appoint one half of the examiners from among doctors of Theology or of sacred Canons.

Art. VII.

11 In gymnasia and in all schools called secondary schools destined for Catholic youth, only Catholic men shall be appointed as professors or teachers, and all instruction shall be composed according to the nature of the subject matter for inscribing the law of Christian life upon hearts. Which books shall be used in the same schools for teaching religious instruction, the Bishops shall determine after taking counsel with one another. Concerning the appointment of teachers of Religion for public gymnasia and secondary schools, those provisions which have been salutarily established in this matter shall remain in force.

Art. VIII.

12 The great schools of the elements destined for Catholics shall be subject to the inspection of the ecclesiastical magistrate. His Caesarean Majesty shall appoint diocesan school inspectors from men proposed by the diocesan Bishop. In the case where sufficient provision has not been made in the schools for religious instruction, the Bishop shall freely appoint an ecclesiastical man who may teach catechism to the pupils. In assuming a schoolmaster, unblemished faith and conduct are required. He shall be removed if he has deviated from the right path. Archbishops, Bishops, and all local Ordinaries shall exercise their own authority with complete freedom, so that they may subject to censure books harmful to religion and honest morals, and turn the faithful away from reading them. Moreover, the Government shall take every suitable precaution lest such books be spread throughout the Empire.

Art. X.

13 Since all ecclesiastical causes, and especially those which concern faith, sacraments, sacred functions, and the offices and rights annexed to the sacred ministry, pertain solely to the forum of the Church, the ecclesiastical judge shall know them, and shall likewise judge concerning matrimonial causes according to the sacred Canons and the decrees of Trent in particular, with only the civil effects of matrimony being remitted to the secular judge. As regards betrothals, the ecclesiastical authority shall judge concerning their existence, and as to their effects in impeding matrimony, observing what the same Council of Trent and the Apostolic Constitution Auctorem fidei establish.

14 It shall be free for the Bishops to inflict upon Clerics who do not wear honest clerical dress befitting their order and dignity, or who are otherwise worthy of reproof, the penalties established by the sacred Canons and others which the Bishops themselves shall judge fitting, and to keep them in monasteries, seminaries, or houses designated for that purpose. They shall in no way be hindered from exercising censure against any of the faithful who are transgressors of ecclesiastical laws and Canons.

Art. XII.

15 The ecclesiastical judge shall know concerning the right of patronage: nevertheless the Holy See consents that when lay patronage is in question, secular tribunals may judge concerning the succession as to the patronage itself, or when the controversies are between true and supposed patrons, or between ecclesiastical men who have been designated by the same patrons.

Art. XIII.

16 Having regard to the circumstances of the times, His Holiness consents that purely civil causes of Clerics, such as those concerning moveable property, debts, inheritances, secular judges may know and decide.

Art. XIV.

17 For the same reason the Holy See does not hinder that causes of ecclesiastical persons for crimes or offences which are punished by the penal laws of the Empire be brought before a lay judge; yet it shall be incumbent upon the Bishop to be informed of this matter without delay. Moreover, in apprehending and detaining the accused, those methods shall be used which the reverence due to the clerical state demands. If an ecclesiastical person shall be sentenced to death or imprisonment exceeding five years, the judicial acts shall always be communicated to the Bishop, and the condemned person shall be given the opportunity to be heard, insofar as it shall be necessary, so that he may know what ecclesiastical penalty is to be inflicted upon him. The same shall be permitted, at the request of the Bishop, that a milder penalty be decreed. Clerics condemned in a criminal case shall always serve their sentence in places separated for the purpose. But if they shall have been condemned for a crime or transgression, they shall be confined in a monastery or another ecclesiastical house.

18 In the disposition of this Article, major causes are in no way comprehended, concerning which the Holy Council of Trent, Session 24, Chapter on Reform, decreed. The Most Holy Father shall provide for their treatment under the Caesarean authority, if it shall be necessary.

Art. XV.

19 That the House of God, who is King of Kings and Lord of Lords, may be honored, the sanctity of sacred Temples shall be preserved, insofar as public security and what justice demands permit.

Art. XVI.

20 The Most August Emperor shall not permit that the Catholic Church, its faith, liturgy, institutions be contemned either in words, deeds, or writings; or that the Bishops of the Church or its ministers be hindered in exercising their office, especially in preserving the doctrine of faith and morals and the discipline of the Church. Moreover, he shall provide effective aid, if it be necessary, so that sentences pronounced by Bishops against Clerics negligent in their duties be carried out. Desiring furthermore that due honor, according to divine commandments, be shown to sacred ministers, he shall not permit anything to be done which might bring disgrace upon them or reduce them to contempt; rather, he shall command that all magistrates of his Empire show reverence and honor to the Archbishops or Bishops and to Clerics on every occasion, as is due to their dignity.

Art. XVII.

21 Episcopal seminaries shall be preserved, and where their endowment does not fully suffice for the purpose which, in accordance with the mind of the Holy Council of Trent, they ought to serve, they shall be augmented in a suitable manner. The diocesan prelates shall govern and administer the same according to the norm of the sacred Canons, with full and free right. Therefore the rectors and professors or masters of the aforesaid seminaries shall be appointed by them, and shall be removed whenever it shall seem necessary or useful to them. Young men and boys to be formed in them shall be received as the dioceses shall have determined to be expedient in the Lord. Those who shall have devoted themselves to studies in these seminaries may be admitted to the schools of any other institution, after a suitable examination of fitness, and likewise, with due observance, may compete for any chair outside the seminary.

Art. XVIII.

22 The Holy See, using its own right, shall erect new dioceses and shall make new circumscriptions of the same, when the spiritual good of the faithful shall demand it. However, when this shall occur, it shall confer with the Imperial Government.

Art. XIX.

23 His Caesarean Majesty, in selecting bishops, whom by virtue of an apostolic privilege devolved upon him by his Most Serene Predecessors, he presents or nominates to be canonically instituted by the Holy See, shall henceforth also make use of the counsel of the chief metropolitans.

24 Metropolitans and bishops, before they take up the governance of their churches, shall take an oath of fidelity before Caesarean Majesty expressed in the following words: "I swear and promise upon the holy Gospels of God, as befits a bishop, obedience and fidelity to the Caesarean-Royal Apostolic Majesty and to his successors; I likewise promise that I shall have no communication, and shall take part in no counsel that might harm public tranquility, shall maintain no suspect union either within or outside the limits of the Empire, and if I learn that any public danger is imminent, I shall omit nothing to avert it."

Art. XXI.

25 In all parts of the Empire it shall be free for archbishops, bishops, and all ecclesiastical men to dispose of those things which they shall leave at the time of death according to the sacred Canons, whose prescriptions shall be diligently observed both by their legitimate heirs and by those succeeding ab intestato. However, in both cases excepted shall be the ornaments and vestments of the diocesan bishops, which all, as belonging to the episcopal table, shall be held, and therefore shall pass to the successor bishops. The same shall be observed regarding books, where it has been customary.

Art. XXII.

26 In all metropolitan or archiepiscopal and suffragan churches, His Holiness shall confer the first dignity, unless local patrons have been deprived of it, in which case the second shall be substituted. As to the remaining dignities and canonical prebends, His Majesty shall continue to nominate, excepting those which remain of free episcopal collation, or are subject to legitimately acquired patronage rights. In the canons of the aforesaid churches there shall not be assumed except priests who both have the qualifications prescribed generally by the Canons, and have been engaged with praise in the care of souls, or in ecclesiastical business, or in teaching sacred disciplines. Moreover, the necessity of noble birth or titles of nobility shall be removed, saving however those conditions which are known to have been added in the foundation. The laudable canonical custom of conferring by public competition, where it prevails, shall be diligently preserved.

Art. XXIII.

27 In metropolitan and episcopal churches, where they are lacking, both a canonical penitentiary and a theological canon, and in collegiate churches a theological canon, according to the manner prescribed by the Council of Trent, Sess. 5, c. 1 and Sess. 24, c. 8 de Reform., shall be established as soon as it can be done, the bishops conferring the aforesaid prebends according to the sanctions of the same Council and the respective decrees of the Pontiff.

Art. XXIV.

28 All parish priests shall be provided for by public competition, and the prescriptions of the Council of Trent being observed. For parishes of ecclesiastical patronage, the patrons shall present one out of three whom the bishop shall have proposed in the form stated above.

Art. XXV.

29 His Holiness, as a testimony of singular benevolence toward the Apostolic Francis Joseph, Emperor and King, grants to him and to his Catholic successors in the Empire the privilege of nominating to all canonicates and parishes which are subject to patronage rights derived from a religious or educational fund, provided however that he select one out of three whom the bishop, after a public competition has been held, shall have judged more worthy than the others.

Art. XXVI.

30 To parishes which do not have a suitable (according to the nature of times and places) sufficient endowment, the endowment shall be increased as soon as it can be done, and Catholic priests of the Eastern rite shall be provided for in the same manner as those of the Latin rite. Moreover, the aforesaid do not apply to parish churches of patronage right either ecclesiastical or lay canonically acquired, the burden of which falls upon the respective patrons. But if patrons do not fully satisfy the obligations imposed upon them by ecclesiastical law, and especially when the endowment of the parish priest is constituted from the fund of religion, having regard to what must be considered according to the state of affairs, provision shall be made.

Art. XXVII.

31 Since the right in ecclesiastical goods is derived from canonical institution, all who shall have been nominated or presented to any benefices whatsoever, whether greater or lesser, shall be able to assume the administration of temporal goods annexed to the same only by virtue of canonical institution. Furthermore, in the taking possession of Cathedral Churches and their annexed goods, those things which are prescribed in the canonical sanctions, and especially in the Pontifical and Roman Ceremonial, shall be carefully observed, any contrary use or custom being abolished.

Art. XXVIII.

32 Religious, who according to the constitutions of their Order are subject to Superior Generals residing at the Apostolic See, shall be governed by them according to the norm of the aforesaid constitutions, saving however the authority of Bishops according to the Canons, and especially the sanctions of the Council of Trent. Therefore the aforesaid Superior Generals shall communicate freely with their subjects in all matters pertaining to the ministry incumbent upon them: they shall also freely exercise visitation over them. Moreover, religious shall observe the rules of their respective Order, Institute, or Congregation without impediment, and according to the prescriptions of the Holy See shall admit candidates to the novitiate and to religious profession.

33 All these things shall likewise be observed regarding nuns in those matters which concern them.

34 It shall be free for Archbishops and Bishops to establish in their own Dioceses Orders or Congregations of religious of either sex according to the sacred Canons; they shall, however, communicate on this matter with the Imperial Government.

Art. XXIX.

35 The Church shall have the right to acquire freely possessions by any just title whatsoever; and its ownership in all things which it now possesses, or shall acquire in the future, shall be solemnly inviolable. Therefore, regarding both ancient and new ecclesiastical foundations, no suppression or union can be made without the intervention of the authority of the Apostolic See, saving the faculties granted to Bishops by the Holy Council of Trent.

Art. XXX.

36 The administration of ecclesiastical goods shall be with those to whom it pertains according to the Canons. However, having regard to the subsidies which the Most August Emperor graciously provides and shall provide from the public treasury for meeting the needs of Churches, those same goods cannot be sold, or burdened with notable obligation, unless both the Holy See and His Caesarean Majesty, or those to whom this duty shall have been entrusted, shall have given their consent.

Art. XXXI.

37 Goods which constitute funds, as they are called, of Religion and Studies, from their origin pertain to the property of the Church, and shall be administered in the name of the Church, with Bishops exercising the inspection due to them according to the form which the Holy See shall agree upon with His Caesarean Majesty.

38 The revenues of the fund of religion, until, after consultation between the Apostolic See and the Imperial Government, the fund itself be divided into stable and ecclesiastical endowments, shall be expended for divine worship, for the building of churches, and for Seminaries, and for all things which pertain to ecclesiastical ministry. To supply what is lacking, His Majesty shall in the future also graciously assist in the same manner as hitherto; indeed, if the nature of the times permit, he shall provide even more abundant subsidies. In like manner the revenues of the fund of studies shall be expended solely for Catholic education, and according to the pious intention of the founders.

Art. XXXII.

39 The fruits of vacant benefices, insofar as it has been customary hitherto, shall be brought into the fund of religion, and His Caesarean Majesty also assigns of his own motion to it the revenues of Episcopates and secular Abbacies throughout Hungary and the Territories formerly annexed, which His Predecessors in the Kingdom of Hungary possessed in tranquility through a long series of centuries. In those provinces of the Empire where the fund of religion does not exist, for each diocese there shall be established mixed Commissions, which according to the form and rule which the Holy Father shall agree upon with Caesarean Majesty, shall administer both the goods of the Episcopal Table and of all benefices during the time of vacancy.

Art. XXXIII.

40 Since, during the time of the past vicissitudes, in many places of the Austrian Dominion ecclesiastical tithes have been removed by civil law, and given the particular circumstances it cannot be done that their payment be restored throughout the entire Empire, at the insistence of His Majesty and in view of public tranquility, which Religion is most concerned with, His Holiness permits and decrees that, saving the right of exacting tithes where in fact it exists, in other places in place of the same tithes, or by way of compensation, there be assigned by the Imperial Government endowments, either in stable goods and lands, or founded upon the debt of the Empire, and these to all and each who possessed the right of exacting tithes: and likewise His Majesty declares that these endowments are to be held entirely as they shall have been assigned, by title of burden, and are to be received and held by the same right as the tithes which they succeed.

Art. XXXIV.

41 All other matters pertaining to ecclesiastical persons and things, of which no mention has been made in these articles, shall be directed and administered according to the doctrine of the Church and its prevailing discipline approved by the Holy See. Art. XXXV.

42 By this solemn Convention, laws, ordinances, and decrees in any manner and form heretofore enacted in the Austrian Empire and in the individual Dominions which constitute it, insofar as they are contrary to it, shall be held as abrogated: and this Convention itself, as a law of State, shall henceforth be perpetually in force in the same Dominions. And for this reason each of the Contracting parties pledges itself and its Successors to observe faithfully all and each of the things which have been agreed upon. If, however, any difficulty should arise in the future, His Holiness and His Caesarean Majesty shall confer with each other to settle the matter amicably.

Art. XXXVI.

43 The ratification of this Convention shall be delivered within the space of two months from the day these articles are affixed, or sooner, if it can be done. In witness whereof the aforesaid Plenipotentiaries have subscribed to this Convention and have sealed it each with his own seal.

44 Given at Vienna on the eighteenth day of August in the year of restored Salvation one thousand eight hundred and fifty-five.

FRANCESCO GIUSEPPE I Imperatore d'Austria

IN NOMINE SANTISSIMO E INDIVIDUE TRINITÀ

Art. VIII.
