On the Observance of the Franciscan Rule
1 In the Year of Christ 1312, of the Religion of Minors 105, of Henry VII Emperor Year 5, of Clement V Year 8
2 Clement V Pope, Bishop, servant of the servants of God
3 1. I went out of Paradise, I said, I will water the garden of plantations, saith he, that heavenly husbandman, who is truly the fountain of wisdom, the Word of God, remaining in the Father in the Father, begotten from eternity, in these last days (the Holy Spirit working) made flesh in the womb of the Virgin, went forth man to accomplish the arduous work of the redemption of mankind: giving himself as an exemplar of heavenly life, offering himself to men. But because mortal man, pressed down by the cares of this life, often turned the gaze of his mind away from the contemplation of such an exemplar: our true Solomon on the throne of the militant Church made a certain garden of delights, set apart from the tempestuous waves of the world, in which one might devote oneself more quietly and securely to contemplating and keeping such works, the exemplar himself entered into this world, that he might water it with the fruitful waters of grace and doctrine. This garden indeed is the holy Religion of the Friars Minor, which, firmly enclosed on all sides by the walls of regular observance, adorned within itself, content with God alone, abounds with new plantations of sons. Coming to this garden, the beloved Son of God gathers the myrrh of mortifying penance with spices, which by their wondrous sweetness spread around all the fragrance of sanctity drawing to itself. This is that heavenly form of life and rule, which that eminent Confessor of Christ, St. Francis, described; and he taught it to be observed by his sons both by word and by example.
4 The Pontiffs declared the rule.
5 2. But because the professors of the said holy rule, and its devoted emulators, as also the disciples and true sons of so great a Father, desired, as they also fervently desire, to observe the aforesaid rule purely and fully and firmly: observing that certain matters which could bring doubt were contained in the series of the rule itself, for the clarification of these matters they prudently had recourse in former times to the apex of Apostolic dignity, that, certified by the same, to whose feet they are also subject through the rule itself, they might serve the Lord (all doubts cast aside) with full clarity of conscience. To these pious and just supplications, many of our predecessors, the Roman Pontiffs, succeeding one another (as was fitting) applied their ears and attention, and declared those things which seemed doubtful: they added certain things, and granted some, as they saw fit for the consciences of the Friars and the pure observance of this state. But because scrupulous consciences, which fear guilt where there is none, and which tremble at any deviation in the way of God, are not fully quieted by the said declarations of all the said Friars, but concerning certain matters pertaining to the rule and their state, some waves of doubt are generated and arise in them, as has been reported to our ears many times and concerning very many matters in public and private consistories. Wherefore by the said Friars it has been humbly supplicated to us, that we should apply appropriate remedies of declaration to the aforesaid doubts which have occurred and which may occur in the future, and should take care to do so from the benignity of the Apostolic See.
6 The affection of the Pontiff toward the professors of the rule.
7 3. We therefore, whose mind has been fervent from tender age with pious devotion toward such professors of the rule and toward the entire Order itself: but now from the common pastoral care of the governance which we undeservedly sustain, are moved to foster them more sweetly and attentively and to pursue them with gracious favors all the more ardently, the more frequently we have revolved in intent mind the abundant fruits which from their exemplary life and salutary doctrine we continually see proceeding to the whole universal Church, moved by the pious intention of those supplicating, we have deemed it right to turn our efforts to performing diligently what is requested: and we have caused the said doubts to be examined carefully by many Archbishops and Bishops and Masters in Theology and other learned and discreet men.
8 The Friars are not bound to all the evangelical counsels. The Friars are bound to all things which pertain to the three vows.
9 4. Since therefore in the first place from that which is contained in the beginning of the said rule: The rule and life of the Friars Minor is this: namely to observe the holy Gospel of our Lord Jesus Christ, living in obedience, without property, and in chastity. Likewise below: But when the year of probation is finished, let them be received to obedience, promising to observe this life always and the rule. Likewise near the end of the rule: Let us observe poverty and humility and the holy Gospel of our Lord Jesus Christ, which we have firmly promised: there was hesitation whether the Friars of the same Order are bound by their profession of their rule to all things, both the precepts and the counsels of the Gospel: some saying that they are bound to all things; but others asserting that they are bound only to those three counsels, namely, to live in obedience, in chastity, and without property, and to those things which are placed under obligatory words in the rule. We, adhering to the footsteps of our predecessors concerning this article, and pursuing the same article somewhat more clearly, have deemed it necessary to respond to the said hesitation, that since a determinate vow of anyone must fall under something certain, one making a vow of the rule cannot be said to be bound by the force of such a vow to those evangelical counsels which are not placed in the rule, and indeed this is proved to have been the intention of blessed Francis, the founder of the rule, from this, that he placed certain evangelical counsels in the rule, passing over others. For if by that word: The rule and life of the Friars Minor is this, etc., he had intended to bind them to all evangelical counsels, he would have expressed some of them superfluously and vainly in the rule, suppressing the rest. Since, however, the nature of a restrictive term has this property, that it thus excludes from itself what is foreign to it, that it concludes all things pertaining to it: we declare and say that the said Friars are bound not only to those three things taken simply and absolutely from the profession of their rule, but also are held to fulfilling all things which pertain to the three aforesaid, which the rule itself places. For if to these three aforesaid things only precisely and simply, promising themselves to keep the rule by living in obedience, chastity, and without property, and not also to all things contained in the rule which modify these three, they were to be restricted, these words would be professed for nothing and in vain: I promise always to observe this rule: from which no obligation would arise from these words. Nor yet should it be thought that blessed Francis intended the professors of this rule to be equally bound, as to all things contained in the rule modifying the three vows, or to other things expressed in it; but rather he openly distinguished that as to certain of them the transgression is mortal by force of the word, and as to certain others, it is not: since to certain of them he adds the word of precept, or equivalent to the same, and as to some others he is content with other words.
10 5. Likewise, because besides those things which are placed in the rule expressly by the word of precept and exhortation or admonition: certain such things are inserted by the imperative mood placed negatively or affirmatively, it has hitherto been doubted whether they would be bound to these, as to things having the force of precept. And because, as we have understood, this doubt is not diminished, but is increased by that which our predecessor of happy memory, Pope Nicholas III, is known to have declared, that the Friars themselves are bound by the profession of their rule to those evangelical counsels which in the same rule are expressed preceptively or prohibitively, or under equivalent words; and nevertheless to the observance of all of them which are indicated to them in the same rule under obligatory words; the aforesaid Friars have supplicated that we deign to declare for the preservation of their consciences, which of these ought to be reckoned as equivalent to precepts and obligatory. We therefore, who delight in the sincere consciences of these men, considering that in those things which regard the salvation of the soul, the safer part is to be held in order to avoid grave remorse of conscience: say that although the Friars are not bound to the observance of all things which are placed under the words of the imperative mood in the rule, as to precepts or things equivalent to precepts: it is nevertheless expedient for the Friars themselves, for the observance of the purity of the rule and its rigor, that they know themselves to be bound to those things, as to things equivalent to precepts, which are noted below here.
11 But in order that these things, which may appear to be equivalent to precepts by force of the word itself, or at least by reason of the matter with which it is concerned, or from both together, may be held in summary: We declare that what is set down in the rule concerning not having more than one tunic with a hood, and another without a hood; likewise concerning not wearing shoes, and not riding except in case of necessity; likewise that the Brothers be clothed in vile garments. Likewise that they fast from the feast of All Saints until the Nativity of the Lord, and on the sixth days of the week they are bound: Likewise that the Clerics perform the divine office according to the order of the Holy Roman Church: Likewise that the Ministers and custodians exercise careful concern for the necessities of the sick and for clothing the Brothers: Likewise that if any of the Brothers should fall into infirmity, the other brothers ought to serve him: Likewise that the Brothers shall not preach in the bishopric of any Bishop, when it shall have been forbidden to them by him: Likewise that no one dare at all to preach to the people, unless he shall have been examined, approved, and instructed for this by the General Minister, or by others to whom, according to the aforesaid declaration, this pertains:
12 Likewise that the Brothers who should know themselves unable to observe the aforesaid rule spiritually, ought and are able to have recourse to their Ministers: Likewise that all things which are set down in the rule concerning the form of habit both of Novices and also of the professed; as well as those pertaining to the manner of reception and profession, unless it should seem otherwise to those receiving them regarding the habit of Novices (as the rule said) according to God. All these things (I say) are to be observed by the Brothers as binding: Likewise the Order commonly feels, holds, and has held from of old, that wherever this word is placed in the rule, they are bound, it obtains the force of a precept: and it ought to be observed by the Brothers as such.
13 Whether Brothers can licitly receive from the goods of those entering religion, if it be given to them. Caution to be observed by Brothers concerning the reception of offerings from those entering religion.
14 6. Moreover, because the aforesaid Confessor of Christ, providing to the Ministers and Brothers the manner of things to be done and observed concerning receiving into the Order, said in the rule that the Brothers and their Ministers beware lest they be solicitous about their temporal things, so that they may freely do with them whatever shall have been inspired to them by the Lord: yet let the Ministers themselves have permission to send them to some God-fearing persons if counsel be required, by whose counsel their goods may be distributed to the poor: many of the Brothers have doubted, and do doubt, whether it be lawful for them to receive anything from the goods of those entering if it be given: and whether they can induce them to give to persons and communities without fault: Whether also the Ministers or Brothers ought to give counsel concerning the disposition of such things, where they can find suitable persons other than those from among themselves to whom those about to enter are sent for counsel. But We, carefully considering that St. Francis intended his rule to be professed by those whom he had founded in the greatest poverty, to remove them specially and totally from affection for the temporal things of those entering by the aforesaid words, so that, as far as pertains to the Brothers themselves, reception into the Order might appear holy and most pure, and lest in any way they might be seen to have an eye toward their temporal goods, but to be devoted to divine service alone: We say that henceforth both the Ministers and the other Brothers ought to abstain from the aforesaid inducements to give to themselves and persuasions, as well as from giving counsel concerning distribution, since by this those fearing God ought to be sent, not to the Brothers: so that truly to all it may be evident that they are zealous, solicitous, and perfect lovers of so salutary a paternal Institute. But since the rule itself wishes that doing with their things what the Lord shall inspire be free to those entering, it does not appear why it should not be lawful for them to receive, considering namely their necessities and the moderations of the aforesaid declaration, if anything from their goods the one entering, like and with other poor persons by way of alms, should wish to give freely: yet the Brothers ought to beware in the acceptance of such offerings, lest from the notable quantity of things received, a sinister eye against them might be presumed.
15 7. Furthermore, since it is stated in the rule that those who have already promised obedience shall have one tunic with a hood and another without a hood, if they wish to have one; and also that all the Brothers shall be clothed in humble garments: and we have declared the aforesaid words to be equivalent to precepts: wishing these matters to be determined more fully, we say as to the number of tunics that it is not permitted to use more than one, except in necessities which may be had from the rule, according as our aforementioned predecessor declared this passage more fully. But as to the humility of garments, both of the habit and of the inner tunics, we say that this should be understood as that which, according to the custom or condition of the region, ought to be reckoned as humble in respect to the colour of the cloth and its price: for it is not possible to assign one fixed manner in such things for all regions. We have also committed the judgment of such humility to the Ministers and Custodians or Guardians, burdening their consciences in this matter: yet so that they observe humility in garments, and we likewise leave to the judgment of the same Ministers, Custodians and Guardians, for what necessity the Brothers themselves may wear footwear.
16 Declaration concerning fasting.
17 8. Then, since in the two seasons noted in the rule, namely from the feast of All Saints until the Nativity of the Lord, and especially in Lent, in which they are bound to fast, it is stated in the same rule: but in other times they are not bound except to fast on Friday: and from this some have wished to say that the Brothers of the said Order are not bound, except by propriety, to other fasts than these: we declare that they should be understood to be bound to fast in other times only in the fasts established by the Church: for it is not likely that either the Institutor of the rule or even its confirmer intended to absolve them from observing those fasts to which other Christians are bound by the common statute of the Church.
18 Prohibition. Chests. Brothers cannot have recourse to money except for causes expressed by Nicholas III. Precautions to be observed by Brothers concerning money both when it is deposited, and concerning deposited money, and concerning the depositary.
19 9. Moreover, since the said Saint, wishing his Brothers to be wholly removed from money and coins above all things, firmly commanded all Brothers that they in no way receive coins or money through themselves or through an interposed person: and our predecessor, declaring this article, set forth cases and modes which, being observed by the Brothers, they cannot be said, nor ought they to be, receivers of money through themselves or through another, against the rule or the purity of their Order. We say that Brothers are bound to take the greatest care that for other causes and under modes other than those which our said predecessor's declaration sets forth, they do not have recourse to those giving money or to appointed messengers, lest (if otherwise attempted by them) they may be rightly said to be transgressors of the precept and rule: for where something is generally prohibited to anyone, what is not expressly granted is understood to be denied. Wherefore all gain of money and reception of offerings and monies in the Church or elsewhere, chests or trunks arranged for the deposit of monies of those offering or giving: and likewise any recourse to monies or those having them, which is not granted by that declaration: all these things, we say, are simply forbidden to them. Since also recourse to spiritual friends is expressly granted only in two cases according to the rule: namely for the necessities of the sick and for clothing the Brothers: and this, piously and reasonably considering the necessity of life, our often-mentioned predecessor has often extended to other necessities of the Brothers occurring from time to time (when alms cease) or even arising: let the aforesaid Brothers attend to this, that for no causes other than the aforesaid or similar ones, in the way or elsewhere, is it permitted them to have recourse to such friends, whether they be those giving money or appointed by them, or messengers or depositaries, or called by any other name: even if the modes concerning money granted by the same declaration were fully observed. Finally, since the same Confessor greatly desired that the professors of his rule be wholly abstracted from affection and desire for earthly things, and especially from money repeated often in the rule: it is necessary that the Brothers take careful heed that when from the aforesaid causes and modes they must have recourse to those having monies appointed for their necessities, to those holding them, whoever these may be, principals or messengers, in all things they so conduct themselves that they show themselves to all to have absolutely nothing in the said monies (as indeed they do not have). Wherefore to prescribe what and how money is to be spent, to demand an account of the expenditure, to recover it in any way or to deposit it or cause it to be deposited, to carry the money chest or its key, these acts and similar ones the Brothers should know are unlawful to them: for the aforesaid things pertain to the Lords alone who gave them, and to those whom they appointed for this very purpose.
20 The Supreme Pontiffs have received into themselves and the Roman Church the dominion of those things whose use the Friars are permitted to have. The Friars Minor are not capable of successions, since in these dominion passes to heirs. The Friars cannot receive annual revenues nor possessions nor their use.
21 10. Therefore, since the holy man, expressing in the rule the aforesaid mode of poverty, said in the same: Let the Friars appropriate nothing to themselves, neither house, nor place, nor any thing: but as pilgrims and strangers in this world, serving the Lord in poverty and humility, let them go confidently for alms: and thus it has been declared by some of our Roman Pontiff predecessors, that this expropriation ought to be understood both in particular and also in common, for which reason also the ownership and dominion of all things granted, offered and given to the Friars (which and whose use it is permitted to have, namely to the Order or to the Friars themselves) have been received into themselves and the Roman Church, leaving to the Friars themselves in them only the use of simple fact. There were brought to our examination things which were said to be done in the Order, and appeared to be repugnant to the aforesaid vow and purity of the Order: namely, that we pursue these from among those things which we believe require remedy, in that they not only sustain themselves as instituting heirs but procure it:
22 Likewise, that they receive annual revenues sometimes in so notable a quantity, that Convents having them live entirely from them: Likewise, that when their affairs are also agitated in courts even for temporal things, they assist advocates and procurators, and to instigate the same they present themselves there personally: Likewise, that they undertake executions of last wills, and manage them, and interpose themselves sometimes in the dispositions or restitutions of usurious or badly taken things to be made: Likewise, that in some places they have not only excessive gardens, but also large vineyards, from which so much is gathered both from vegetables and from wine to be sold: Likewise, that at times of harvests or vintages grain and wine are so copiously gathered by the Friars through begging or otherwise buying, and stored in cellars and granaries, that for the remainder of the year and without their begging they are able to pass their life: Likewise, that they make or procure to be made Churches or other buildings in quantity and curiosity of figure, and form, and expense notably excessive, so that they do not appear to be dwellings of the poor, but of the great:
23 Ecclesiastical vestments also in most places they have so many, and so notably precious, that they exceed in these great Cathedral Churches: moreover horses and arms offered to them they receive indiscriminately at funerals: yet the community of Friars and especially the Rectors of the Order itself asserted, that the aforesaid, or more of them were not done in the Order, and if any are found guilty in such things they are rigidly punished: and also against such things being done, very strict statutes have been made many times from of old in the Order. Wishing therefore to provide for the consciences of the Friars themselves, and to remove all doubts (as much as is possible for us) from their breasts, to the aforesaid, in the manner which follows we respond. Since indeed it pertains to the truth of life, that what is done outwardly represent the inner disposition and habit of the mind: the Friars, who have abstracted themselves by such expropriation from temporal things, must abstain from all that by which the said expropriation would be, or could appear to be contrary.
24 Because therefore in successions there passes not only the use of a thing, but also dominion in its time to heirs: but the aforesaid Friars can acquire nothing to themselves in particular, or to their Order, even in common: declaring we say, that successions of this kind, which also by their own nature extend indifferently to money, and also to other movable and immovable things (the purity of the vow being considered) are in no way capable: nor is it permitted to them to make, or so to receive the value of such inheritances, or so much of their parts, that it could be presumed this is done in fraud, as it were under the mode and form of a legacy left to them: but rather we simply prohibit such things from being done by them. And since annual revenues are reckoned among immovable things by law, and to obtain such revenues is repugnant to poverty and mendicancy, there is no doubt, that it is not permitted to the aforesaid Friars to receive or have any revenues whatsoever, just as also possessions or even their use (since it is not found to have been granted to them) (their condition being considered).
25 Furthermore, since not only what is known to be evil, but also everything that has the appearance of evil, must be specially avoided by perfect men: from such assistances in courts, and instigations, when matters are being handled for their own advantage, it is credibly believed from those things which are manifest outwardly (concerning which men outside have judgment) that the assisting Brothers in these very matters seek something as their own: in no way ought such vow and rule professed to involve themselves in such cares and litigious acts: so that they may also have testimony from those who are outside, and may satisfy the purity of their vow, and scandal to neighbors be avoided hereby. But truly, since the Brothers of the said Order are not only from the reception, property, dominion, or use of money itself, but also from any handling of it, and are entirely removed from it, just as our aforesaid predecessor often plainly said in the declaration of this rule: and since the professed of the said Order can seek nothing temporal in judgment, it is not lawful nor fitting for the aforesaid Brothers, but rather, considering the purity of their state, they ought to know it is forbidden to them, that they expose themselves to such executions and dispositions, since these often cannot be carried out without litigation and handling or administration of money.
26 Nevertheless, in executing these things, to give counsel does not oppose their state, since from this itself no jurisdiction or action in judgment or dispensation concerning temporal goods is granted to them.
27 Brothers cannot have gardens, vineyards, nor similar things. Let them not have Churches excessive in size. Let them have temperate and humble buildings.
28 11. Although it is not only lawful, but also very fitting to reason, that Brothers who are diligently occupied in spiritual labors of prayer and study should have suitable gardens and areas for recollection or recreation, and sometimes to refresh themselves bodily after such labors, as well as for having necessary garden produce for themselves: yet to have certain gardens so that they be cultivated, and vegetables and other garden produce be sold for profit, as well as vineyards, is contrary to their rule and the purity of the Order, according as the said predecessor declared and also ordained: and if such things were bequeathed to Brothers for the uses just mentioned, such as a field or vineyard to be cultivated and similar things, Brothers ought in every way to abstain from receiving such things, since even to have the aforesaid things so that the price of fruits be had in their seasons approaches the nature and form of revenues. Again, since the aforesaid Saint, both in the examples of life and in the words of the rule, showed that he wished his Brothers and sons to rely on divine providence, to cast their cares upon God, who feeds the birds of the air, which neither gather into barns, nor sow nor reap: it is not credible that he wished them to have granaries or storerooms, where they ought to hope to pass through life by daily begging.
29 And for this reason they ought not to relax themselves from fear, however slight, to make and preserve such gatherings: but only then when it would be very credible from already proven experience that they could not find the necessities of life otherwise. We have deemed this matter to be left to the judgment of the Ministers and Custodians together and separately in their administrations and custodies (with the counsel and assent of the Guardians and two of the discreet Priests and elders of the Order of Brothers of the place), burdening their consciences specially over these matters. Hence it is that, since the holy Man wished to found his Brothers in the greatest poverty and humility, as much in affection as in effect, just as the whole rule cries out: it is fitting for them that in no way henceforth they cause to be made, or permit to be made, Churches or any other buildings whatsoever, which (considering the number of Brothers dwelling in them) ought to be reckoned excessive in multitude and size. And therefore we will that everywhere in their Order henceforth they be content with temperate and humble buildings, lest to this so great promised poverty, which is evident to the eyes, something contrary cry out from without.
30 Although ecclesiastical vestments and vessels are ordained for the honor of the divine Name, for which God himself made all things: yet He who is the knower of hidden things, looks principally to the intention of those serving Him, not to the hand: nor does He wish to be served by those things which would be discordant with the condition and state of His servants: for which reason decent ecclesiastical vessels and vestments, sufficient in number and in size competently sufficient, ought to suffice them. Superfluity, however, or excessive preciousness, or any curiosity in these or any other things whatsoever cannot be fitting to their profession or state: since these things savor of hoarding or abundance, they manifestly derogate from so great poverty in human judgment: wherefore we will and command that the aforesaid things be observed by the Brothers. Concerning the offerings of horses and arms, we decree that this be observed in all things and throughout, which through the aforesaid declaration is known to be defined in monetary alms.
31 12. From the foregoing, however, there has arisen no small scrupulous question among the Brethren: namely, whether from their profession of the rule they are obliged to a strict and meager, or poor use of things: some of them believing and saying that just as regarding dominion of things they have from the vow a most strict renunciation, so also regarding use a greatest strictness and meagerness is imposed upon them: others asserting to the contrary, that from their profession they are obliged to no poor use which is not expressed in the rule, although they are bound to a moderate use of temperance, as it were more from propriety than other Christians. Wishing therefore to provide for the peace of conscience of the aforesaid Brethren, and to put an end to these disputes, declaring we say, that the Friars Minor from the profession of their rule are specially obliged to strict uses or poor uses, which are contained in their own rule: and in that mode of obligation, under which the rule contains or sets forth the said uses.
32 13. To say, however, as some are reported to assert, that it is heretical to hold that poor use is included or not included under the vow of evangelical poverty, we judge to be presumptuous and rash. 14. Finally, because from the fact that the said rule, in treating of how and where the election of the Minister General ought to be made, makes no mention whatsoever of the election or institution of the Provincial Ministers, a doubt could arise on this matter among the Brethren: we, wishing that they may be able to proceed clearly and securely in all their affairs, declare, establish also and ordain in this constitution to be valid in perpetuity, that when provision is to be made for any Province of a Minister, the election of that Minister shall rest with the Provincial Chapter, which the same Chapter is bound to make on the day following that on which it shall have been convened. The confirmation of that election, however, shall pertain to the Minister General, and if indeed the election of this kind shall proceed by the form of scrutiny, and votes being divided in different ways, several elections should happen to be celebrated in discord, that which shall have been celebrated by the greater part of the Chapter in number (no consideration or regard being had for zeal or merit or any other consideration), notwithstanding any exception or contradiction of the other part, shall be confirmed or even disaffirmed by the said Minister General with the counsel of the discreet members of the Order (having first, however, from his Office, as pertains to him, made diligent examination): as it shall seem to him expedient according to God: and if it shall have been disaffirmed, the election of this kind shall revert to the Provincial Chapter.
33 15. Moreover, if the Provincial Chapter on the aforesaid day shall neglect to elect a Minister: from that time the provision of the Provincial Minister shall freely devolve to the Minister General. But if to the aforesaid Minister and the General Chapter it should seem at some time expedient in the Provinces beyond the Sea, Ireland, Greece, or Romania, in which hitherto another mode of providing is said to have been observed from a certain and reasonable cause, that a Provincial Minister be appointed by the Minister General, with the counsel of the worthy members of the Order rather than by the election of the aforesaid Chapter: in the Provinces of Ireland also beyond the Sea irrefragably, but in Romania or Greece whenever the Minister of that Province should die or be removed this side of the Sea; that which the said Minister with the counsel of the said worthy members shall have deemed to be ordained on this matter shall be observed that time without guile, partiality, and fraud (upon which we burden their consciences on this matter).
34 16. In the removal, however, of the said Provincial Ministers we wish that to be observed which has hitherto been observed in the Order itself on this matter. Moreover, if it should happen that they lack a Minister General, through the Vicar of the Order let that be done which would have to be done by the same Minister until provision is made of a General Minister.
35 17. Furthermore, if anything concerning such a Provincial Minister should happen to be attempted otherwise, that itself shall be null and void by that very fact.
36 Let no one whatsoever be permitted to infringe this page of our declarations, sayings, commission, mandate, constitutions, judgments, and will, or to dare to act rashly against it: but if anyone should presume to attempt this, let him know that he will incur the indignation of Almighty God, and of the blessed Peter and Paul His Apostles.

2 Clemens V Papa Episcopus servus servorum Dei
4 Pontifices declararunt regulam.
6 Affectus Pontificis in regulae professores.
Cautela a Fr. observanda circa receptionem oblatorum ab ingredientibus religionem.
18 Prohiben. cippi. Fr. nequeunt recurrere ad pecun. nisi pro causis expressis a Nicol. III. Cautelae observandae a Fr. circa pecuniam tam cum deponitur. quia, circa depsotatam, & circa depositar.

I Fr.
