IN THE PRUSSIAN CIRCUMSCRIPTION. • PIUS SERVANT OF THE BISHOPS SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 The care of our pastoral office and the solicitude for all Churches constantly demand of Us that we diligently strive to accomplish those things which appear to benefit the Lord's flock by more wholesome pasturing and easier governance. To achieve this, no small help is afforded by the correct circumscription of dioceses, which responds as much as possible to the circumstances of times and places. Since therefore a solemn Convention, or Concordat, has recently been entered into and confirmed between the Apostolic See and the Prussian State, by which the hierarchy and circumscription of dioceses are newly ordained in that State: We, desiring to commit to execution those things sanctioned by these pacts for the utility of ecclesiastical governance, having added certain small changes in diocesan boundaries, which nevertheless regard the local care of souls, all things having been maturely considered, with the consent of those to whom it pertains, or of those who presume it to pertain to them, insofar as it is necessary, by the fullness of Apostolic power we decree and establish the following:

2 I. In the Prussian State, besides the ecclesiastical province of Cologne already existing, we erect two new provinces, as follows, Wroclaw and Paderborn.

3 II. The Cologne province shall retain as before, besides the metropolitan Church, the suffragan churches of Münster and Trier. From the same we separate and sever the episcopal see of Paderborn, whose Ordinary we therefore exempt from the metropolitan right of the Archbishop of Cologne. On the other hand, it shall henceforth be increased by the sees of Aachen, newly to be erected as below, Limburg, hitherto suffragan to the metropolitan Church of Freiburg, and Osnabrück, hitherto immediately subject to the Holy See.

4 1) Archdiocese of the deaneries:

5 Alfter, Cologne shall be restricted to these Barmen, Bedburg, Benrath, which follow Bensberg, Bergheim, Beuel, Bonn, Brühl, Düsseldorf, Elberfeld, Essen, Euskirchen, Frechen, Godesberg, Grevenbroich, Gummersbach, Hersel, Kerpen, Köln, Königswinter, Lechenich, Lövenich, Meckenheim, Mülheim, Münstereifel (excepting the parishes of Bouderath and Nöthen), Neunkirchen, Neuss, Oberhausen, Opladen, Porz, Ratingen, Rheinbach, Siegburg, Solingen, Uckerath, Werden, Wipperfürth, Wissen, Zons, Zülpich (excluding the parishes: Berg, Disternich, Floisdorf, Sievernich, Vlatten); likewise to the following parishes: Elfgen, Commern, Füssenich, Kupferdreh, Largefeld, Pingsheim. The remaining territory hitherto pertaining to the Cologne archdiocese, we remove and dismember from the same. The metropolitan Chapter of Cologne shall preserve its constitution also in the future; we will, however, that one of its honorary members be chosen from among the master clerics in the Faculty of Theology, which exists in that same archdiocese. 2) Territory torn away from the archdiocese of Cologne, as we have said above, we erect into a new diocese, which we will to be named Aachen from the very celebrated city of Aachen. This new diocese shall comprise these deaneries: Aachen, Aldenhoven, Alsdorf, Blankenheim, Cornelimünster, Derichsweiler, Dülken, Düren, Erkelenz, Eschweiler, Gangelt, Geilenkirchen, Gemünd, Gladbach, Hasselsweiler, Heinsberg, Herzogenrath, Hochneukirch (excepting the parish of Elfgen), Jülich, Kempen, Krefeld, Kronenburg (excluding the parishes: Hallschlag, Ormont, Steffeln), Linnich, Lobberich, Mechernich (excepting the parish of Commern), Monschau, Nideggen, Nörvenich (excluding the parish of Pingsheim), Rheydt, Steinfeld, Stoiber, Uerdingen (excepting the parishes: Friemersheim and Kaldenhausen), Vettweiß (excluding the parish of Füssenich), Viersen, Wassenberg, Wegberg. To the same Aachen diocese we moreover assign the parishes mentioned above Berg, Bouderath, Disternich, Floisdorf, Nöthen, Sievernich, Vlatten and the parish of Hinsbeck, which we therefore separate from the territory of the diocese of Münster.

6 We establish the seat of this new diocese in the city of Aachen, from which the diocese itself takes its name, and we accordingly raise it to the rank and dignity of an episcopal city with all the rights and privileges which other episcopal cities enjoy by common law. We fix the Cathedral of the Bishop in the church of the Blessed Mary Virgin Assumed into Heaven, standing in the same city, and we accordingly raise it to the rank and dignity of a Cathedral Church; to it therefore and to its Bishops for the time being we grant all rights and privileges which other cathedral churches and their prelates enjoy by common law, and we impose upon them the same burdens to which other cathedral churches and their bishops throughout the world are bound. We constitute this new diocese as suffragan to the metropolitan Church of Cologne, and at the same time we subject the Bishops of Aachen for the time being to the metropolitan authority of the Archbishop of Cologne. The collegiate chapter, standing in the city of Aachen, we raise to the rank and dignity of a Cathedral Chapter with all the rights, insignia and privileges, burdens and obligations which are proper to cathedral chapters; and it shall be constituted with a single dignity, namely a Provost, and six titular canons, four honorary canons and six vicars. 3) The diocese of Limburg shall embrace within its bounds the deaneries:

7 Oamberg, Eltville, Hadamar, Höchst, Bad Homburg, Königstein, Limburg, Meudt, Montabaur, Oberlahnstein, Bansbach, Rennerod, Büdesheim, Bad Schwalbach, Wiesbaden; and likewise the parish of Limburg, enjoying the right of exemption; as well as the district of Frankfurt a. Main, with the parishes: Bockenheim, Eckenheim, Eschersheim, Fechenheim, excepting however the places: Bergen-Enkheim and Bischofsheim. This diocese of Limburg we withdraw from the metropolitan authority of the Archbishop of Freiburg, and, as we have already said, we constitute it suffragan to the metropolitan Church of Cologne. - 4) The diocese of Münster shall have for its territory the deaneries: Ahaus, Ahlen, Beckum, Bocholt, Borken, Bottrop, Buer, Burgsteinfurt, Calcar, Cleve, Cloppenburg (excluding the place Wachtum with its own church), Coesfeld, Damme, Datteln, Dinslaken, Dorsten, Duisburg, Dülmen, Emmerich, Freckenhorst, Friesoythe, Geldern (excepting the parish Hinsbeck), Gladbeck, Goch, Hamborn, Herten, Kevelaer, Ibbenbüren, Lüdinghausen, Moers, Münster, Nottuln, Oldenburg, Recklinghausen, Rees, Rheine, Rheinberg, Sterkrade, Telgte, Vechta, Vreden, Warendorf, Werne, Xanten; and moreover the following parishes: Kaldenhausen, Friemersheim, Tönisberg and the place Korte in Levinghausen.

8 The cathedral chapter of this diocese shall remain unchanged, but henceforth one of its honorary members shall be chosen from among the master clerics in the Faculty of Theology existing in that same diocese. 5) The diocese of Osnabrück shall retain its ancient deaneries, namely: Bentheim, Emsland I, Emsland II, Freren, Fürstenau, Gronenberg, Hümmling, Hunteburg-Vörden, Jburg, Lingen, Osnabrück, Ostfriesland, and also the place Wachtum with its own church; and at the same time there shall be perpetually joined to it a mission territory formed from the apostolic vicariate embracing the places Bremen, Hamburg, Lübeck, Schwerin, Mecklenburg-Strelitz, Oldenburgisch-Lübeck, Mecklenburg-Schaumburg-Lippe, and from the apostolic prefecture of Schleswig-Holstein; which mission territory was already under the administration of the Bishop of Osnabrück, as Vicar and Prefect Apostolic; we constitute and declare this diocese, hitherto immediately subject to the Apostolic See, suffragan to the metropolitan Church of Cologne. 6) The diocese of Trier shall extend through the deaneries: Adenau, Ahrweiler, Andernach, Bassenheim, Bernkastel, Birkenfeld, Bischofsdhron, Bitburg, Blankenrath, Burgbrohl, Carden, Clausen, Cobern, Cochem, Conz, Daun, Dillingen, Ehrang, Ehrenbreitstein, Engers, Gerolstein, Hermeskeil, Hillesheim, Illingen, Irrel, Kaisersesch, Kelberg, Kirchen, Koblenz, Kreuznach, Kyllburg, Linz, Manderscheid, Mayen, Merzig, Münstermaifeld, Neuerburg, Obergondershausen, Oberkail, Ottweiler, Perl, Piesport, Prüm, Remagen, Ruwer, Saarbrücken, Saarburg, Saarlouis, Schweich, Simmern, Sobernheim, Sulzbach, St. Goar, St. Wendel, Trier, Völklingen, Wadern, Wadgassen, Waxweiler, Wittlich, Zell; and moreover through the parishes Hallschlag, Ormont, Steffeln with the vicariates Jünkerath and Schüller.

A new province of Wrocław shall be formed from the Church of Wrocław itself, to be elevated to metropolitan dignity, from the suffragan dioceses of Berlin, to be newly erected, and Warmia, as well as from the suffragan prelature "nullius" of Schneidemuhl, to be newly erected as well. The diocese of Wrocław shall retain its territory, except for that part which has already been assigned to the Apostolic Administration of Berlin. This cathedral Church, hitherto immediately subject to the Holy See, we elevate to the rank and dignity of a metropolitan Church, and therefore we attribute and assign to it all and singular the rights, privileges and prerogatives which by law belong to other metropolitan sees, and at the same time we increase the Archbishops of Wrocław for the time being with the rights and privileges which other Archbishops enjoy, together with the faculty of having the cross borne before them, as well as of using the pallium according to the norms of the sacred canons, provided, however, that this shall first have been requested and obtained from the Apostolic See in the sacred Consistory. We bind the Church of Wrocław and its Ordinary with the same burdens and obligations to which other metropolitan sees throughout the world and their Ordinaries are bound. Likewise we elevate the cathedral Chapter of Wrocław to metropolitan rank and dignity, and we grant to it the honors and prerogatives which belong by law to metropolitan Chapters, with the suppression of the place which the Provost of St. Hedwig in the city of Berlin had hitherto reserved for himself. One of the canons shall be chosen for the honor of master among the clergy in the Faculty of Theology which exists in the same archdiocese of Wrocław. 2) Moreover, we suppress the Apostolic Administration of Berlin, and from its territory we erect a new diocese of the same name, which we declare to be suffragan to the metropolitan Church of Wrocław, and we subject its Bishops for the time being to the metropolitan authority of the Archbishop of Wrocław. We establish the episcopal see of this diocese in the city of Berlin, and we therefore elevate it to the rank of an episcopal city. We fix the cathedral of the Bishop in the Church of St. Hedwig existing there, and we therefore elevate it to the rank and dignity of a cathedral Church, and therefore we grant to it and to its Bishops for the time being all the rights and privileges which other cathedral churches and their Ordinaries possess, and we bind them at the same time with the burdens and obligations which pertain to cathedral churches and their Bishops according to the rule of law. In the same Church of St. Hedwig we erect a cathedral Chapter, which shall consist of one dignity, namely a Provost, five titular canons, one canon ad honorem and four vicars. This Chapter shall enjoy both the rights, insignia and privileges and shall be bound by the obligations which are established by law.

10 3) The diocese of Warmia shall be formed from the following deaneries: Allenstein, Braunsberg, Christburg, Elbing, Guttstadt, Heilsberg, Marienburg, Masuren I, Masuren II, Mehlsack, Rössel, Samland, Seeburg, Stuhm, Tilsit, Wartenburg, Wormditt, as well as Pomesania, whose territory we assign to the diocese of Warmia, and therefore the Apostolic Administration of that territory shall cease ipso facto;

11 We constitute this diocese of Warmia, hitherto immediately subject to the Apostolic See, to be suffragan to the metropolitan Church of Wrocław in the future, and we subject its Bishops for the time being to the metropolitan authority of the Archbishop of Wrocław.

12 The cathedral Chapter of the diocese of Warmia, existing in the city of Frombork, shall in the future be constituted with two dignities, namely a Provost and a Dean, six titular canons, four honorary canons and four vicars.

13 4) Moreover, by these present Letters we erect a new prelature "nullius" which we wish to be called Schneidemuhl. We constitute it to be suffragan to the metropolitan Church of Wrocław for the time being;

14 and we subject its Prelates to the metropolitan authority of the Archbishop of Wrocław.

15 The territory of this new prelature shall consist of the remaining western parts of the archdiocese of Gniezno and Poznań and the diocese of Kulm, namely from the deaneries: Betsche, Bomst, Deutsch Krone, Flatow, Fraustadt, Lauenburg in Pomerania, Schlochau, Schneidemuhl. This new prelature being thus erected, the Apostolic Administration under which these deaneries have hitherto been shall cease ipso facto.

16 IV. The new ecclesiastical province of Paderborn shall embrace the Church of Paderborn itself, to be elevated to metropolitan rank as set forth below, and the suffragan sees of Fulda and Hildesheim.

17 1) We elevate the Cathedral Church of Paderborn, which has hitherto been suffragan to the Church of Cologne and, as stated above, has been withdrawn from its metropolitan jurisdiction, to the rank and dignity of a metropolitan church with all the rights, privileges, prerogatives, honors and insignia, as well as the burdens and obligations which by law pertain both to metropolitan churches and to their Archbishops for the time being. For this reason we grant to the Archbishop of Paderborn the right to bear the cross before him and to use the pallium according to the norms of the sacred canons, after this has been requested and obtained in Consistory.

18 The territory of the Archdiocese of Paderborn shall be formed from the following deaneries:

19 Anröchte, Arnsberg, Attendorn, Beverungen, Bielefeld, Bigge, Bochum, Borgentreich, Brakel, Brilon, Büren, Castrop, Bauxel, Delbrück, Dessau, Detmold, Dortmund-Altstadt, Dortmund-Nordost, Dortmund-Süd, Dortmund-West, Egeln, Eisleben, Elspe, Gehrden, Gelsenkirchen, Geseke, Hagen (excepting the parish of Langerfeld), Halberstadt, Halle, Hamm, Hattingen (excluding the parish of Kupferdreh), Herne, Höxter, Iserlohn, Kamen, Letmathe, Lichtenau, Magdeburg, Marsberg, Medebach, Menden, Meschede, Olpe, Oschersleben, Paderborn, Bietberg, Büthen, Salzkotten, Siegen, Soest, Steinheim, Stendal, Sundern, Waldeck, Wanne-Eickel, Warburg, Wattenscheid, Werl, Wiedenbrück, Witten, Wittenberg, Wormbach.

20 We elevate the cathedral chapter of Paderborn to the honor and dignity of a metropolitan chapter with all the rights, prerogatives and privileges which are proper to metropolitan chapters.

21 2) We constitute the Diocese of Hildesheim, hitherto immediately subject to the Apostolic See, as suffragan to the metropolitan Church of Paderborn, and we declare its Bishops for the time being to be subject to the metropolitan jurisdiction of the Archbishop of Paderborn. The territory of this diocese shall comprise the deaneries:

22 Bockenem, Borsum, Braunschweig, Detfurth, Duderstadt, Förste, Gieboldehausen, Goslar, Gronau, Hannover, Harburg, Hildesheim, Lindau, Nörten, Peine, Verden; the parish of Einteln and the curacies of Obernkirchen and Bad Nenndorf. The cathedral chapter of this diocese shall henceforth consist of five titular canons. 3) We withdraw the Diocese of Fulda, hitherto subject to the ecclesiastical province of Freiburg, from the metropolitan jurisdiction of the Church of Freiburg, and constitute it suffragan to the metropolitan Church of Paderborn, and we subject its Bishops for the time being to the metropolitan jurisdiction of the Archbishop of Paderborn. The following deaneries pertained to the Diocese of Fulda: Amöneburg, Beuren, Bischoferode, Eiterfeld, Erfurt, Fritzlar, Fulda, Geisa, Grossenlüder, Hanau, Heiligenstadt, Hilders, Hünfeld, Kassel (excluding the parish of Rinteln with the vicariates of Obernkirchen and Bad Nenndorf), Kirchworbis, Küllstedt, Lengenfeld, Margretenhaun, Neuhof, Nordhausen, Orb, Rustenfelde, Salmünster, Weimar, Weyhers, Wiesenfeld; and moreover the places: Bergen-Enkhein and Bischofsheim. The cathedral chapter of this diocese shall henceforth be constituted of five titular canons.

23 These arrangements being made as stated above, we appoint to carry all these matters into execution our venerable brother Caesar Orsenigo, Archbishop of Ptolemais in Libya, Apostolic Nuncio in the German Republic, granting to him for this purpose the necessary and appropriate faculties, including the power to subdelegate for the purpose in question any man constituted in ecclesiastical dignity and to render a definitive judgment concerning any difficulty or opposition whatsoever that may arise in any way in the course of execution, and with the obligation of sending to the Sacred Consistorial Congregation within six months, to be reckoned from the receipt of this Letter, an authentic copy of the act of execution completed.

24 These present Letters, however, drawn up in triplicate original and in them also from the fact that anyone to whom it pertains, or those who presume that it pertains to them, have not been heard and have not consented to the foregoing, even if they should be worthy of express and individual mention, can at no time ever be noted, impugned or called into question on account of the vice of subreption or obreption or nullity or of Our intention, or any other defect however substantial and unforeseen; but they shall exist as made and emanated from certain knowledge and fullness of power, perpetually valid and shall be, and shall obtain and secure their full and complete effects and ought to be inviolably observed by all to whom it pertains; and if otherwise anything contrary to these should happen to be attempted by anyone, by whatever authority, knowingly or unknowingly, We will and decree that it be entirely null and void and shall be. We will finally that to copies of these Letters, even printed ones, subscribed however by the hand of some notary public and furnished with the seal of some man constituted in ecclesiastical dignity or office, the same faith be attributed as would be attributed to these Letters, if they were exhibited or shown in the original. Notwithstanding, insofar as it may be necessary, the rules issued in synodal, provincial, general, and universal Councils, special or general Apostolic constitutions and ordinances, and any other dispositions of the Roman Pontiffs, Our Predecessors, and all other things to the contrary whatsoever. Let no one, however, presume to infringe or act contrary to these Our Letters of dismemberment, assignment, erection, evection, concession, statute, derogation, mandate and of Our will. If anyone indeed presume to attempt this with rash boldness, let him know that he will incur the indignation of almighty God and of the blessed Peter and Paul, His Apostles.

NELLO STATO PRUSSICO. • PIO SERVO DEI VESCOVI SERVITORI DI DIO A PERPETUA MEMORIA DELLA COSA

1 La cura del nostro ufficio pastorale e la sollecitudine di tutte le Chiese ci esigono continuamente che ci adoperiamo con diligente studio a procurare quelle cose che sembrano giovare più salutarmente al pascere e al reggere il gregge del Signore. Per conseguire questo non poco giova la retta circoscrizione delle diocesi, che corrisponda il più possibile alle circostanze dei tempi e dei luoghi. Poiché dunque tra la Sede Apostolica e lo Stato della Prussia è stata di recente stipulata e confermata una solenne Convenzione, ossia Concordato, per il quale la gerarchia e la circoscrizione delle diocesi si ordinano nuovamente in quello stesso Stato: Noi, volendo mandare ad esecuzione quelle cose che in utilità del regime ecclesiastico sono sancite da questi patti, aggiunte alcune piccole mutazioni dei confini diocesani, che tuttavia riguardano strettamente la cura locale delle anime, dopo aver maturo esame di tutto, con la pienezza della potestà apostolica, decerniamo e stabiliamo quanto segue, con il consenso, ove sia necessario, di coloro che vi hanno interesse, o di coloro che presumono di averne interesse:

2 I. Nello Stato della Prussia, oltre la provincia ecclesiastica Coloniense già esistente, erigiamo due nuove province, come di seguito, Vratislaviense e Paderborense.

3 II. La provincia Coloniense, come prima, conserverà la Chiesa metropolitana di Colonia e le Chiese suffraganee di Monastero e di Treviri. Dalla medesima però separiamo e distacchiamo la sede episcopale di Paderborn, il cui Presule per questo esoneriamo dal diritto metropolitico dell'Arcivescovo di Colonia. Al contrario d'ora innanzi sarà aumentata dalle sedi di Aquisgrana, da erigersi nuovamente come di seguito, di Limburgo, finora suffraganea della Chiesa metropolitana di Friburgo, e di Osnabrück, fino ad ora immediatamente soggetta alla Santa Sede.

4 1) Arcidiocesi decanati:

5 Coloniense sarà ristretta a questi decanati: Alfter, Barmen, Bedburg, Benrath, Bensberg, Bergheim, Beuel, Bonn, Brühl, Düsseldorf, Elberfeld, Essen, Euskirchen, Frechen, Godesberg, Grevenbroich, Gummersbach, Hersel, Kerpen, Köln, Königswinter, Lechenich, Lövenich, Meckenheim, Mülheim, Münstereifel (eccettuate le parrocchie Bouderath e Nöthen), Neunkirchen, Neuss, Oberhausen, Opladen, Porz, Ratingen, Rheinbach, Siegburg, Solingen, Uckerath, Werden, Wipperfürth, Wissen, Zons, Zülpich (escluse le parrocchie: Berg, Disternich, Floisdorf, Sievernich, Vlatten); e inoltre alle seguenti parrocchie: Elfgen, Commern, Füssenich, Kupferdreh, Largefeld, Pingsheim. Il resto del territorio che fino ad ora apparteneva all'arcidiocesi Coloniense, da essa lo stacchiamo e lo separiamo. Il Capitolo metropolitano Coloniense conserverà anche in seguito la sua costituzione; vogliamo però che uno dei suoi membri onorari sia eletto tra i chierici magistri nella Facoltà Teologica, che esiste in quella medesima arcidiocesi. 2) Il territorio staccato dall'arcidiocesi di Colonia, come sopra abbiamo detto, lo erigiamo in nuova diocesi, che dalla celeberrimissima città di Aquisgrana vogliamo sia chiamata Aquisgranense. Questa nuova diocesi comprenderà questi decanati: Aachen, Aldenhoven, Alsdorf, Blankenheim, Cornelimünster, Derichsweiler, Dülken, Düren, Erkelenz, Eschweiler, Gangelt, Geilenkirchen, Gemünd, Gladbach, Hasselsweiler, Heinsberg, Herzogenrath, Hochneukirch (eccettuata la parochia Elfgen), Jülich, Kempen, Krefeld, Kronenburg (escluse le parrocchie: Hallschlag, Ormont, Steffeln), Linnich, Lobberich, Mechernich (eccettuata la parochia Commern), Monschau, Nideggen, Nörvenich (esclusa la parochia Pingsheim), Rheydt, Steinfeld, Stoiber, Uerdingen (eccettuate le parrocchie: Friemersheim e Kaldenhausen), Vettweiß (esclusa la parochia Füssenich), Viersen, Wassenberg, Wegberg. Alla medesima diocesi Aquisgranense inoltre assegniamo le parrocchie che sopra abbiamo ricordate Berg, Bouderath, Disternich, Floisdorf, Nöthen, Sievernich, Vlatten e la parochia Hinsbeck, che per questo motivo separiamo dal territorio della diocesi di Monastero.

6 La sede di questa nuova diocesi costituiamo nella città di Aquisgrana, dalla quale la diocesi stessa ha preso il nome, e la eleviamo perciò al rango di città episcopale con tutti i diritti e i privilegi di cui godono per diritto comune le altre città episcopali. La cattedra del Vescovo poi fissiamo nella chiesa della Beata Maria Vergine Assunta in cielo, che esiste nella medesima città, e la eleviamo perciò al grado e alla dignità di Chiesa Cattedrale; a lui dunque e ai suoi successori concediamo tutti i diritti e i privilegi di cui godono per diritto comune le altre Chiese cattedrali e i loro Presuli, e gli imponiamo gli stessi oneri ai quali sono vincolate per il mondo le altre Chiese Cattedrali e i loro Vescovi. Questa nuova diocesi costituiamo suffraganea della Chiesa metropolitana di Colonia, e nel medesimo tempo i Vescovi di Aquisgrana pro tempore sottomettiamo al diritto metropolitico dell'Arcivescovo di Colonia. Il Capitolo collegiale poi, che esiste nella città di Aquisgrana, lo eleviamo al grado e al rango di Capitolo Cattedrale con tutti i diritti, gli insegni e i privilegi, gli oneri e gli obblighi che sono propri dei Capitoli cattedrali; e sarà costituito da una sola dignità, cioè il Preposto, e da sei canonici titolari, quattro canonici onorari e sei vicari. 3) La diocesi di Limburgo comprenderà nel suo territorio i decanati:

8 Il Capitolo cattedrale di questa diocesi rimarrà immutato, ma in futuro uno dei suoi membri onorari sarà scelto tra i chierici magistri nella Facoltà di Teologia che esiste nella medesima diocesi. 5) La diocesi di Osnabrück conserverà gli antichi decanati, cioè: Bentheim, Emsland I, Emsland II, Freren, Fürstenau, Gronenberg, Hümmling, Hunteburg-Vörden, Jburg, Lingen, Osnabrück, Ostfriesland, nonché il luogo Wachtum con la propria chiesa; e nel medesimo tempo le sia perpetuamente unito il territorio di missione formato dal vicariato apostolico che comprende i luoghi Bremen, Hamburg, Lübeck, Schwerin, Mecklenburg-Strelitz, Oldenburgisch-Lübeck, Mecklenburg-Schaumburg-Lippe, e dalla prefettura apostolica di Schleswig-Holstein; quale territorio di missione era già sotto l'amministrazione del Vescovo di Osnabrück, come Vicario e Prefetto Apostolico; questa diocesi, finora immediatamente soggetta alla Sede Apostolica, la costituiamo e dichiariamo suffraganea della Chiesa metropolitana di Colonia. 6) La diocesi di Treviri si estenderà per i decanati: Adenau, Ahrweiler, Andernach, Bassenheim, Bernkastel, Birkenfeld, Bischofsdhron, Bitburg, Blankenrath, Burgbrohl, Carden, Clausen, Cobern, Cochem, Conz, Daun, Dillingen, Ehrang, Ehrenbreitstein, Engers, Gerolstein, Hermeskeil, Hillesheim, Illingen, Irrel, Kaisersesch, Kelberg, Kirchen, Koblenz, Kreuznach, Kyllburg, Linz, Manderscheid, Mayen, Merzig, Münstermaifeld, Neuerburg, Obergondershausen, Oberkail, Ottweiler, Perl, Piesport, Prüm, Remagen, Ruwer, Saarbrücken, Saarburg, Saarlouis, Schweich, Simmern, Sobernheim, Sulzbach, St. Goar, St. Wendel, Treviri, Völklingen, Wadern, Wadgassen, Waxweiler, Wittlich, Zell; e inoltre per le parrocchie Hallschlag, Ormont, Steffeln con i vicari Jünkerath e Schüller.

Una nuova provincia Vratislaviense sarà formata dalla stessa chiesa Vratislaviense, da elevare alla dignità metropolitana, dalle diocesi suffraganee Berlinese, da erigere di nuovo, e Varmense, nonché dalla prelatura suffraganea «nullius» Schneidemuhlense da erigere anch'essa di nuovo. ^La diocesi Vratislaviense conserverà il suo territorio, eccettuata quella parte che già fu attribuita all'amministrazione apostolica Berlinese. Questa chiesa cattedrale, finora immediatamente soggetta alla Santa Sede, l'eleviamo al grado e alla dignità di chiesa metropolitana, e perciò le attribuiamo e assegniamo tutti e singoli i diritti, i privilegi e le prerogative, che per diritto competono alle altre sedi metropolitane, e insieme aumentiamo i Vescovi Vratislaviesi pro tempore nei diritti e nei privilegi di cui godono gli altri Arcivescovi insieme con la facoltà di portare innanzi a sé la croce, nonché di usare il pallio, secondo le norme dei sacri canoni, dopo però che questo sia stato richiesto e ottenuto dalla Sede Apostolica nel sacro Concistoro. La chiesa Vratislaviense e il suo Presule li vincoliamo agli stessi oneri e obbligazioni ai quali sono tenute le altre sedi metropolitane nel mondo e i loro Presuli. Parimenti il Capitolo cattedrale Vratislaviese l'eleviamo al grado e alla dignità di Capitolo metropolitano e gli attribuiamo gli onori e le prerogative che per diritto spettano ai Capitoli metropolitani, soppressa la carica che finora il Preposto di santa Edvige nella città di Berlino si era riservata. Uno però dei canonici sarà eletto all'onore tra i chierici maestri nella Facoltà Teologica, che esiste nella stessa arcidiocesi Vratislaviese. 2) Inoltre sopprimiamo l'amministrazione apostolica Berlinese, e dal suo territorio erigiamo una nuova diocesi dello stesso nome, che dichiariamo suffraganea della chiesa metropolitana Vratislaviense, e i cui Vescovi pro tempore sottoponiamo al diritto metropolitico dell'Arcivescovo Vratislaviese. La sede episcopale di questa diocesi la costituiamo nella città di Berlino, che perciò eleviamo al grado di città episcopale. La cattedra del Vescovo la fissiamo nella chiesa di santa Edvige ivi esistente, che perciò eleviamo al fastigio e alla dignità di chiesa cattedrale, e perciò ai suoi Vescovi pro tempore concediamo tutti i diritti e i privilegi di cui godono le altre cattedrali e i loro Presuli, e insieme li vincoliamo agli oneri e alle obbligazioni che per norma di diritto appartengono alle chiese cattedrali e ai loro Vescovi. Nella stessa chiesa di santa Edvige erigiamo un Capitolo cattedrale, che consterà di una dignità, cioè il Preposto, cinque canonici titolari, un canonico ad honorem e quattro vicari. Questo Capitolo fruirà tanto dei diritti, degli insegni e dei privilegi, quanto sarà tenuto degli oneri che per diritto sono stabiliti.

10 3) La diocesi Varmense sarà formata dai seguenti decanati: Allenstein, Braunsberg, Christburg, Elbing, Guttstadt, Heilsberg, Marienburg, Masuren I, Masuren II, Mehlsack, Rössel, Samland, Seeburg, Stuhm, Tilsit, Wartenburg, Wormditt, nonché Pomesania, il cui territorio assegniamo alla diocesi Varmense, e perciò cesserà ipso facto l'amministrazione apostolica di quel territorio;

11 Questa diocesi Varmense, finora immediatamente soggetta alla Sede Apostolica, la costituiamo in avvenire suffraganea della chiesa metropolitana Vratislaviense, e i suoi Vescovi pro tempore li sottoponiamo al diritto metropolitico dell'Arcivescovo Vratislaviese.

12 Il Capitolo cattedrale della diocesi Varmense, esistente nella città di Frauenburg, sarà costituito in avvenire di due dignità, cioè il Preposto e il Decano, sei canonici titolari, quattro canonici onorari e quattro vicari.

13 4) Inoltre con le presenti Lettere erigiamo una nuova prelatura «nullius» che vogliamo sia chiamata Schneidemuhlense. La costituiamo suffraganea della chiesa metropolitana Vratislaviense pro tempore;

14 e i suoi Prelati li sottoponiamo al diritto metropolitico dell'Arcivescovo Vratislaviese.

15 Il territorio di questa nuova prelatura consterà delle parti residue occidentali dell'arcidiocesi Gnesnenese e Posnaniese e della diocesi Culmense, cioè dai decanati: Betsche, Bomst, Deutsch Krone, Flatow, Fraustadt, Lauenburg i. Pomm., Schlochau, Schneidemühl. Eretta così questa nuova prelatura, l'amministrazione apostolica sotto la quale questi decanati erano finora, cesserà ipso facto.

16 IV. La nuova provincia ecclesiastica Paderbornenese abbraccerà la stessa chiesa Paderbornenese da elevare al grado metropolitano come di seguito, e le sedi suffraganee Fuldense e Hildeshiense.

17 1) La Cattedrale Chiesa di Paderborn, finora suffraganea della Chiesa di Colonia e da essa, come sopra, sottratta al diritto metropolitico, l'eleviamo al grado e alla dignità di Chiesa metropolitana con tutti i diritti, i privilegi, le prerogative, gli onori e gli insegni, nonché gli oneri e gli obblighi che per diritto appartengono tanto alle Chiese metropolitane quanto ai loro Arcivescovi pro tempore. Per questo concediamo all'Arcivescovo di Paderborn il diritto di portare la croce davanti a sé e di usare il pallio secondo le norme dei sacri canoni, dopo che però ciò sia stato richiesto e ottenuto in Concistoro.

18 Il territorio dell'Arcidiocesi di Paderborn sarà formato dai seguenti decanati:

19 Anröchte, Arnsberg, Attendorn, Beverungen, Bielefeld, Bigge, Bochum, Borgentreich, Brakel, Brilon, Büren, Castrop-Bauxel, Delbrück, Dessau, Detmold, Dortmund-Altstadt, Dortmund-Nordost, Dortmund-Süd, Dortmund-West, Egeln, Eisleben, Elspe, Gehrden, Gelsenkirchen, Geseke, Hagen (eccettuata la parrocchia di Langerfeld), Halberstadt, Halle, Hamm, Hattingen (esclusa la parrocchia di Kupferdreh), Herne, Höxter, Iserlohn, Kamen, Letmathe, Lichtenau, Magdeburg, Marsberg, Medebach, Menden, Meschede, Olpe, Oschersleben, Paderborn, Rietberg, Rüthen, Salzkotten, Siegen, Soest, Steinheim, Stendal, Sundern, Waldeck, Wanne-Eickel, Warburg, Wattenscheid, Werl, Wiedenbrück, Witten, Wittenberg, Wormbach.

21 2) La diocesi di Hildesheim, finora immediatamente soggetta alla Sede Apostolica, la costituiamo suffraganea della Chiesa metropolitana di Paderborn, e i suoi Antistiti pro tempore li dichiariamo obbligati al diritto metropolitico dell'Arcivescovo di Paderborn. Il territorio di questa diocesi comprenderà i decanati:

22 Bockenem, Borsum, Braunschweig, Detfurth, Duderstadt, Förste, Gieboldehausen, Goslar, Gronau, Hannover, Harburg, Hildesheim, Lindau, Nörten, Peine, Verden; la parrocchia di Einteln e le curie di Obernkirchen e Bad Nenndorf. Il Capitolo cathedrale di questa diocesi sarà costituito in futuro da cinque canonici titolari. 3) La diocesi di Fulda, finora soggetta alla provincia ecclesiastica di Friburgo, la sottraiamo al diritto metropolitico della Chiesa di Friburgo e la costituiamo suffraganea della Chiesa metropolitana di Paderborn, e i suoi Antistiti pro tempore li sottoponiamo al diritto metropolitico dell'Arcivescovo di Paderborn. Alla diocesi di Fulda appartenevano i decanati: Amöneburg, Beuren, Bischoferode, Eiterfeld, Erfurt, Fritzlar, Fulda, Geisa, Grossenlüder, Hanau, Heiligenstadt, Hilders, Hünfeld, Kassel (esclusa la parrocchia di Rinteln con le vicarie di Obernkirchen e Bad Nenndorf), Kirchworbis, Küllstedt, Lengenfeld, Margretenhaun, Neuhof, Nordhausen, Orb, Rustenfelde, Salmünster, Weimar, Weyhers, Wiesenfeld; e inoltre i luoghi: Bergen-Enkheim e Bischofsheim. Il Capitolo cathedrale di questa diocesi sarà costituito in futuro da cinque canonici titolari.

23 Disposte dunque tutte queste cose come sopra, per mandare ad esecuzione tutto ciò, deputiamo il venerabile fratello Cesare Orsenigo, Arcivescovo di Tolomaide in Libia, Nunzio Apostolico nella Repubblica Germanica, al quale per questo attribuiamo le facoltà necessarie e opportune, anche di subdelegare per l'effetto di cui si tratta chiunque sia costituito in dignità ecclesiastica e di pronunciare sentenza definitiva su qualsiasi difficoltà o opposizione che sorga in qualunque modo nell'atto dell'esecuzione, e con l'obbligo di inviare alla Sacra Congregazione Concistoriale entro sei mesi, computati dall'accettazione di questa Lettera, una copia autentica dell'atto di esecuzione compiuto.

24 Le presenti Lettere, comunque tentate, redatte in triplice originale e in esse anche dal fatto che chiunque, a cui interessi, o coloro che presumano che loro interessi, non siano stati ascoltati e non abbiano consentito alle premesse, anche se degni di menzione espressa e individuale, non possano in alcun tempo essere notate, impugnate o chiamate in controversia per vizio di subreptizio o di obreptizio o di nullità o di Nostra intenzione, o per qualsiasi altro difetto, benché sostanziale e inaspettato; ma esse rimangono perpetuamente valide e saranno come emanate da certa scienza e da pienezza di potestà, e devono sortire e ottenere i loro pieni e interi effetti e essere inviolabilmente osservate da tutti a cui spetta; e se diversamente su queste cose da chiunque, con qualsiasi autorità, consapevolmente o inconsapevolmente fosse tentato, vogliamo e decretiamo che sia completamente irritum e vano e sarà. Vogliamo infine che ai transunti di queste Lettere, anche stampati, sottoscritti però di mano di qualche notaio pubblico e muniti del sigillo di qualche uomo costituito in dignità o ufficio ecclesiastico, sia tributata la medesima fede che sarebbe tributata a queste Lettere, se fossero esibite o mostrate originalmente. Non ostante, per quanto sia necessario, le regole edite nei Concili sinodali, provinciali, generali e universali, le costituzioni e ordinazioni apostoliche speciali o generali, e qualsiasi altra disposizione dei Nostri Predecessori Romani Pontefici e altre cose contrarie comunque.
