Bull on the observance of feast days

Bull of Pope Urban VIII ·

Canon of this Constitution.
For the observance of feasts. Urbanus, Bishop, servant of the servants of God, to the perpetual memory of the matter.

1 The whole Church throughout the world knows that it falls upon the supreme solicitude of the Roman Pontiff to direct the Lord's flock unto eternal salvation, and to expound the apostolic precepts in such manner that the faithful may be able to run in the way of the commandments and happily attain unto blessedness.

2 § 1. Indeed, by the report of many of our venerable brethren, archbishops and bishops established in various regions, it has come to our attention that the multitude of feasts throughout their individual dioceses and provinces has so increased, with new devotion and custom being introduced day by day, that many now seem to doubt which are to be observed by precept and which by the free will of each one, the fervor of piety growing tepid on account of the excessive number of the same. Moreover, the frequent cry of the poor has ascended to us, complaining that this same multitude is very harmful to them on account of the necessity of obtaining their daily sustenance by their labors, and—which is to be mourned with great sorrow of our heart—we have learned that so often the enemy of the saints has contrived that they do not use this very multitude for edification and for praising God in the churches of the people, but frequently do not fear to abuse it for idleness, vanities and base pursuits, so that what was originally instituted for glorifying the divine Name, the enemy man has corrupted in the course of time, and has turned it to great offense of Him 1 and grave loss of souls. Wherefore the aforesaid venerable brethren, archbishops and bishops, have humbly besought us that in the aforesaid matters we should undertake some suitable course from the fullness of apostolic power.

3 § 2. We therefore, wishing to provide according to the duty of our pastoral office, and to establish henceforth a certain precept concerning the sanctification of feasts, following the ancient custom of the Church in this matter, having first held frequent consultations through learned and pious men, whom we have specially deputed for these matters, as the gravity of the matter seems to demand, by our own motion, and from certain knowledge and mere deliberation of ours, and also from the fullness of the aforesaid apostolic power, with the vote also of our venerable brethren, the cardinals of the holy Roman Church presiding over sacred rites, by apostolic authority we decree and declare that the underwritten days alone are to be observed as feasts of precept, which namely either venerable antiquity consecrated from the beginning, or the universal custom of the Church approved, or the unanimous piety of all nations venerates; namely the Sundays of the whole year, the Nativity of Our Lord Jesus Christ, the Circumcision, the Epiphany, the Resurrection with the two following weekdays, the Ascension, Pentecost with the two likewise following weekdays, the Most Holy Trinity, the solemnity of the Body of Christ and the Finding of the Holy Cross, as well as the feasts of the Purification, the Annunciation, the Assumption and the Nativity of the Mother of God the Virgin, the Dedication of St. Michael the Archangel, the Nativity of St. John the Baptist, Sts. Peter and Paul, St. Andrew, St. James, St. John, St. Thomas, Sts. Philip and James, St. Bartholomew, St. Matthew, Sts. Simon and Jude, and St. Matthias, Apostles of Christ the Lord, likewise St. Stephen the Protomartyr, Sts. the Innocents, St. Lawrence the Martyr. The Pontiff has established that these days alone are to be observed as feasts of precept, which are here enumerated.

4 The Christian faithful are not bound to the observance of the remaining days.

5 St. Sylvester, Pope and Confessor, St. Joseph also Confessor and St. Anne, the Mother of God respectively the spouse and mother, the solemnity of All Saints, and one of the principal patrons in any kingdom or province, and likewise another of the principal patrons in any city, town or village, where it happens that these patrons are held and venerated.

6 § 3. As for the observance of the remaining feasts, which the Christian faithful have hitherto celebrated as festive days, whether in the universal Church or in any nation or kingdom, province, diocese or place, in whatever manner, whether by precept, custom, or devotion, we decree and declare by this authority, in the tenor of these presents, that they are by no means bound to observe them by precept. However, lest feast days be henceforth multiplied again excessively by the ordinaries of places through the undue compliance of some or the importunity of peoples, we admonish those same ordinaries in the Lord that henceforth in perpetuity they strive to abstain from the institution under precept of new feasts, in order to preserve ecclesiastical equality everywhere. Moreover, in order that those things which are expressed above may be honored with the fervent veneration and devotion which is fitting, we recall to the memory of those same ordinaries the observance of the ancient canons in granting licenses to labor on feast days; which licenses are to be granted in no other way than according to the form of the aforesaid canons, as is premised, and only freely, gratuitously, and without any price or agreement whatsoever, directly or indirectly, under also the more severe penalties to be inflicted at the discretion of us and our successors. We do not, however, intend by this our constitution to change in any way the feriae concerning judicial matters, which we leave in the same state and terms in which they were before its promulgation.

7 § 4. We command therefore in virtue of holy obedience, and under the penalty of our indignation and displeasure, to our vicar in spiritual matters general in the City and its district, and to all and each of the patriarchs, primates, archbishops, bishops, and other prelates, and ordinaries of places of whatever kind, even if they shine with the honor of the cardinalate, that they publish these present letters and all and each of the things contained in them, each namely in their respective dioceses, and cause them to be observed to the letter by all their subjects.

§ 5. Notwithstanding any apostolic constitutions contrary to these, of whatever kind, even those issued and to be issued in provincial, synodal and universal councils, special or general, and the statutes and customs of individual provinces, cities, towns and places, even those prescribed and observed for the longest time, even immemorial, and also privileges, indults, decrees, declarations and apostolic letters, and other favors, as much those granted by the Roman Pontiffs, our predecessors, and by us also in like manner, even in consistory, as by the ordinaries of places, of whatever quality, even those shining with the honor of the cardinalate, as aforesaid, legates also of the side and nuncios of the Apostolic See, to those same provinces, cities, towns and places, and to any others whatsoever, even to persons of however privileged a status, even in contemplation or regard of emperors, kings, queens, republics, dukes or other princes, and otherwise perhaps granted, approved and renewed in any way to the contrary; all and each of which, even if for their sufficient derogation special, specific, express and individual mention of them and their entire tenors, not however through general clauses having the same import, or any other expression or any other exquisite form to be observed for this purpose would be required, we having these tenors as if they were inserted word for word with nothing whatsoever omitted and the form transmitted in them observed, as fully and sufficiently expressed and inserted in these same presents, by our motion, knowledge and fullness of power in this series specially and expressly derogate; and all other things to the contrary whatsoever.

8 clauses having the same import, mention or any other expression or any other exquisite form to be observed for this purpose would be required, we having these tenors as if they were inserted word for word with nothing whatsoever omitted and the form transmitted in them observed, as fully and sufficiently expressed and inserted in these same presents, by our motion, knowledge and fullness of power in this series specially and expressly derogate; and all other things to the contrary whatsoever.

§ 6. We will, however, that to the transcripts of these same presents, even if printed and subscribed by the hand of a public notary and furnished with the seal of some person constituted in ecclesiastical dignity, the same faith be given everywhere, both in judgment and outside of it, as would be given to these same presents if they were exhibited or shown.

§ 7. Let no man therefore presume to infringe this page of our decrees, declarations, admonition, intention, mandate, derogation and will, or to act against it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
