BENEDETTO PAPA XIV.

22 Venerabili Fratelli, salute e benedizione apostolica.

23 Il matrimonio, perpetuo e indissolubile vincolo, la cui fermezza da Adamo tanto tempo prima stabilita Cristo Signore confermò con queste parole: «Quello che Dio ha congiunto, l'uomo non separi», e che con mirabile e evangelica grazia, onde è grande sacramento nella Chiesa, volle dignare, con tanta facilità, come se né dalla legge di natura, né dal Diritto Divino, né dai precetti evangelici e dalle Sanzioni Canoniche fosse stato istituito, il Connubio, in alcune parti del Cattolico Orbe, e in questo soprattutto fertilissimo Regno di Polonia, di giorno in giorno si ode sciogliersi; e non possiamo con lacrime, né con parole spiegare l'incredibile sollecitudine che da ciò Ci è concepita nel Pontificio animo Nostro, e la molestia ingenerata. Benché dunque Noi, dolorosissimamente, siamo facilmente indotti a credere che questa licenza di sciogliere i Coniugi, per la quale, non senza grave offesa dei beni, ora un uomo, ora una donna, si vede contrarre un terzo o quarto matrimonio mentre ancora vivono i coniugi a loro prima congiunti, sia nata dalla troppa libertà delle vostre Curie, come altrove abbiamo inteso, tuttavia non possiamo non ritenere che la causa principale non sia altrove;

24 BENEDETTO XIV.

For perpetual remembrance of the matter.

1 Often the minds of the Roman Pontiffs are vehemently troubled, and occupied with that care and concern, lest the graces, favors, and privileges, dispensed from the prudent administration of Apostolic governance for the salvation of souls and the spiritual progress and edification of Christ's faithful, especially those who serve the Lord under the sweet yoke of Religion, should be turned, through the fault of men, or the cunning of the infernal enemy, or the very unstable and fleeting nature of human affairs, to their destruction and detriment. Therefore, the Roman See, having only God before its eyes, not infrequently recalls and modifies those things which have been granted for just and compelling reasons, as experience in the course of time advises, and prudently interposes the study of provident solicitude, as, having maturely weighed the circumstances of persons, things, and times, it perceives to be salutarily expedient in the Lord. § 1. Indeed, formerly the Roman Pontiffs, and especially the late of happy memory Innocent III, in his constitution which begins: Inter opera; and Nicholas IV, in his, which likewise begins: Inter opera pietatis; and Sixtus IV, Our Predecessors, in one which begins: Et si universi; and also in another, which begins: Religione utique; in their respective Constitutions, the Regular and Hospitaller Order of the Holy Spirit in Saxia, on account of the various and praiseworthy works of Christian charity which are exercised by the Order itself toward the weak, the wounded, and the sick, have enriched with many graces, indults, and diverse privileges, accumulated in the times of their said Predecessors; among which privileges is that one by which all those expressly professed in the same Order, together with their Convents, Houses, and Goods, under the protection of the Apostolic See, and subject to it immediately, and from all manner of superiority, jurisdiction,

8 correction, and power of the Ordinaries are perpetually declared exempt, and are fully subject to the jurisdiction, superiority, and authority of the Preceptor General of the aforesaid Order, residing in this Our Beloved City at the Archihospital of the Holy Spirit.

9 § 2. But since, as We have learned, and long experience has made known, it is not sufficiently possible through the care, effort, and authority of the Preceptor General himself to provide for the due integrity of discipline of those who are found to be enrolled in the aforesaid Hospitaller Order, and especially those dwelling far off in remote Regions; We therefore, directing the principal parts of Our hidden solicitude and paternal providence toward a more salutary state of the said Order and its prudent governance, and that their charity may flourish more abundantly through the due cultivation of the other virtues and may exhibit before the Lord the fragrance of holy conversation, by the counsel of some of Our Venerable Brethren, Cardinals of the Holy Roman Church, We do hereby exempt and free all and each of the Hospitallers of the aforesaid Order of the Holy Spirit now existing within the Kingdoms of Spain and within the Kingdom of Poland, and for the time being to exist, even if they are called Priors, or Preposits, or Guardians of the said Order, and whether in Convents, or Hospitals, or Priories, or Preceptories, or outside Convents, Hospitals, Priories, and Preceptories, now dwelling or for the time being to dwell, from all manner of jurisdiction and obedience to the Master or Preceptor General of the Archihospital of the Holy Spirit in Saxia in the City, not however as regards the payment of the annual Canon from the Convents of the aforesaid Order customarily paid to the said Archihospital of the Holy Spirit, as the Head of the Hospitaller Order of this kind, which We will always to remain firm and unharmed, and to be paid just as if these present letters had not been issued by Us, by Our own motion, from certain knowledge, mature deliberation, and from the fullness of Our Apostolic power, by the tenor of these presents We exempt and free them, and We declare them exempt and freed from the visitation, correction, and all manner of jurisdiction of the Ordinaries of the Places in which the professed of the Hospitaller Order now dwell and for the time being shall dwell, and by the same Apostolic Authority also perpetually by these same presents We subject them and decree them always to be subject, We establish, and command. Moreover, We grant and impart to the aforesaid Order and their successors the faculty, that they themselves, as delegated by the Apostolic See, may freely and lawfully compel the rebellious and those refusing to be subject to them through Ecclesiastical Censures to be brought into subjection.

10 § 3. Moreover, the Nuns of the same Order of the Holy Spirit existing in the aforesaid Kingdoms of Spain and the Kingdom of Poland, both in spiritual and temporal matters, we subject to the care, government, and jurisdiction of the aforesaid Ordinaries, in whose Diocese their Monasteries are found to be situated, by the same Apostolic Authority in perpetuity, and we will them to be subjected; and we likewise exempt and free them in perpetuity by the said authority from any subjection and government of the Brothers Hospitallers of the aforesaid Order, entirely and completely; and to the same Brothers we by the Apostolic Authority aforesaid, by the tenor of these same presents also in perpetuity, forbid and strictly forbid that they dare henceforth to interpose themselves in any way in the government and direction of the aforesaid Monasteries, under excommunication, deprivation of both voices, and other penalties to be imposed at our discretion.

11 4. All and singular professed of the Order of Hospitallers aforesaid, existing now and for the time being in the Kingdoms of Spain and in the Kingdom of Poland, and in the same Kingdoms for the time being to be received, in virtue of holy obedience we admonish, that they venerate the same Ordinaries, as Delegates of the Apostolic See, with due reverence to Us and the Apostolic See, with fitting honor and becoming observance, as obedience demands; we also exhort the same Ordinaries in the Lord, and through the Bowels of the Mercy of our God we beseech, that they, cherishing the professed of this Order of Hospitallers with paternal love, treat them benevolently and govern them kindly, and show themselves liberal toward them with pious munificence, and in all the aforesaid matters as in the Field of the Lord receive them as cooperators and sharers in labor with fitting kindness, and guard and protect their rights with all zeal and care, so that they themselves, professed of this Order of Hospitallers, whose works, like burning lamps placed in a conspicuous place, ought to afford the light of charity to all Christ's faithful toward the poor and afflicted, suffering from wounds, sicknesses, and various bodily ailments, and likewise at the same time of the soul, to the praise of God and the exaltation of the Catholic Faith and the salvation of souls, in so sublime and excellent a virtue making progress from day to day, may thereby merit to obtain from the Lord, the most generous rewarder of good deeds, the reward of eternal life.

12 5. And finally, to the pious Constitution of Benedict, Pope of happy memory, likewise our Predecessor, issued under date of the Ides of February in the Year of the Incarnation of the Lord one thousand seven hundred and sixty-six, in the second Year of his Pontificate, and which begins, Summa: adhering to it, we prohibit transition from any Regular and Cloistered Order to the aforesaid Order of Hospitallers of the Holy Spirit called in Saxia, unless the form and tenor of the said Constitution of the aforesaid Predecessor Benedict be observed in all things and throughout all things and in all respects, which Constitution we extend and enlarge by the present also with greater force for the aforesaid Order of Hospitallers of the Holy Spirit called in Saxia, and we declare and ordain by our authority and much more by the tenor of these presents that it is to be observed in all respects.

13 § 6. Moreover, our letters at no time whatsoever, even on the ground that Preceptories, Priorates, and other benefices of the said Order of Hospitallers in the Kingdoms of Spain and Portugal aforesaid, being held and existing in the said Kingdoms, or whosoever else having any interest whatsoever in the aforesaid matters, have not expressly consented to the same aforesaid, nor been called to it, or required, and all causes on account of which the same aforesaid were issued, examined, verified, and approved, or on account of any enormous or most enormous and total lesion, or any other pretext whatsoever, and from whatsoever count or cause, or occasion howsoever notable and juridical, even necessarily to be expressed, of our intention, or any other whatsoever defect, be noted, impugned, in whole or in part rescinded, retracted, annulled, invalidated, brought into law or controversy, reduced to the terms of law, or against them any renunciation whatsoever of law, fact, or grace be obtained, any less under whatsoever revocations of similar or dissimilar graces, suspensions, limitations, modifications, derogations, and other contrary dispositions from Us, or from whatsoever other Roman Pontiffs our Successors, and the said See, even by motu proprio, knowledge, and fullness of power similar, and issued consistently for the time being, be comprehended in no way, nor be deemed comprehended, but always excepted from them, and against whatsoever other exceptions howsoever grave, altogether and always valid and efficacious be, and be, and their full and complete effects produce, and perpetually avail in all things and through all things, and as if truly all and each, whose concern it is, had emanated from their consent; nor the Ordinaries of Places aforesaid, now and for the time being existing, or any others whatsoever, be held at any time to verify or prove the aforesaid in whole or in part, nor be able to be compelled or forced to it by any necessity; but the narration of these presents alone suffice without any other verification or proof, and in judgment and outside it be stood by, nor any proof or exception whatsoever, of what kind or species it be or was, be brought or admitted to the contrary. Thus, and not otherwise, by whatsoever Judges Ordinary and Extraordinary, exercising whatsoever faculty, even the Auditors of the Cases of our Apostolic Palace, or the Cardinals of the Holy Roman Church even by commission, Legates, Vice-legates, and Nuncios of the said See, the authority of judging, defining, and interpreting otherwise being taken from them and from each of them in whatsoever cause and instance, be judged and defined, and whatsoever shall be attempted by anyone from whatsoever authority knowingly or unknowingly concerning these things, we decree to be null and void. Notwithstanding our and the Apostolic Chancery rule concerning law obtained not tolerated, and not the aforesaid of our Predecessors Innocent, Nicholas, and Sixtus as to the aforesaid only, and other Apostolic, and in universal, Provincial, and Synodal Councils, special or general Constitutions and Ordinances of the Apostles, as well as of the Order of the Hospitallers of St. Spirit in Saxia, and its Preceptories, Priorates, and Convents, and Monasteries of Nuns in Spain...

14 of the aforesaid Kingdom of Prussia, with the force of an Apostolic confirmation, or whatever other respective rubrics, statutes, consistorial establishments, uses, customs, erections, institutions, and exemptions, privileges also, indults, and apostolic letters, to those, and to their Preceptors, Priors, and Brethren, and to the Abbots of the aforesaid Monasteries, to their Nuns, and respectively to persons, under whatsoever tenors and forms, and with whatsoever derogatory clauses, derogations to these, and other such, and so forth, and firmer and inserted clauses, nor irritant clauses, and other things done through the aforesaid, and by whatsoever other Roman Pontiffs similarly Predecessors, by motu proprio, knowledge, and fullness of power equal, and with the causes then expressly set forth, even Commissorially proposed, and carefully examined, granted, approved, and renewed; to all which, even if for their sufficient derogation otherwise concerning these, and their whole tenors special, specific, express and individual, and word for word, but not through general clauses importing the same, mention, or any other expression had, or any other exquisite form to be observed for this, the tenor of this, and as if word for word, nothing whatsoever omitted, and the form delivered in them observed, inserted were, we presume for sufficiently expressed, and, inserted to be held, them otherwise in their strength remaining, this time only specially, and expressly, and most broadly we designate, with whatever contracts being contrary.

15 7. Moreover, since it would be difficult for these Our Letters to be carried to each place where it would be necessary, We will that by copies of them, even printed, subscribed however by a public Notary, or by some Person constituted in ecclesiastical dignity with seal affixed, the same faith be given, which would be given to these if they were exhibited or shown. Let no one of all men be permitted to infringe this page of Our Decree, Constitution, derogation, subjection, and will, or rashly act contrary to it by fraud; if anyone, however, shall presume to attempt this, let him know himself incurred the indignation of Almighty God, and of the Blessed Apostles Peter and Paul His. Given at Rome, at St. Mary Major, in the Year of the Incarnation of Our Lord one thousand seven hundred and forty-one, on the Nones of April, in the First Year of Our Pontificate.

ADMONITION XVI.

To the Bishops constituted in the Kingdom of Poland, that they proceed cautiously in admitting dissolutions of marriages.

21 To the Venerable Brethren Archbishops and Bishops of all Poland.

BENEDICT POPE XIV.

22 Venerable Brethren, greetings and apostolic blessing.

23 Marriage, perpetual and indissoluble bond, whose firmness from Adam so long ago established Christ the Lord confirmed, and with these words, "What God hath joined together, let no man separate," with admirable and evangelical grace, whence it is a great Sacrament in the Church, has deigned to strengthen; yet with such facility, as if neither by the law of nature, nor by Divine Right, nor by evangelical precepts and Canonical Sanctions was it instituted, behold the Bond of Matrimony in some parts of the Catholic world, and especially in this most flourishing Kingdom of Poland, is heard to be dissolved day by day; nor can we explain with tears, nor with words the incredible solicitude itself to Us, conceived in the Pontifical mind of Our ingrained trouble. Although indeed we grieve greatly, we are easily led to believe that the license of such Conjugal dissolutions, on account of which, not without grave offense to the good, we see now without one man or one woman, with several marriages still living before copulated to them, a third or fourth matrimony contracted, has arisen from the excessive liberty of your Curias, as we have heard is the custom elsewhere, we do not

24 BENEDICT XIV.

25 hesitate to cross over; since we turn our complaints to you, Venerable Brethren, with justice; and at the same time such license to be restrained, and within the bounds prescribed by the Catholic Church to be confined, we consider salutary Laws and manner.

26 ^ 1. To your priestly virtue therefore, and to your zeal for ecclesiastical discipline, we entrust pastoral cares with great joy of mind, so that from this we may seek aid in opportunely turning away and warding off this evil from the renowned Polish Nation, and in wiping away the stain unjustly impressed upon your name. For this reason we beseech your Fraternities in the Lord, and exhort you, mindful of the accounts to be rendered to Jesus Christ the Judge, Spouse of the heavenly Catholic Church, obeying our Apostolic voice, to fulfill your ministry with that vigilance which He teaches. And while we await success in these matters, equal to your office, piety, and religion, we most lovingly impart to your Fraternities the Apostolic blessing.

27 § We will moreover that by transcripts or copies of these same present letters, even printed ones, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, there shall be accorded to them the very same faith which would be accorded to these presents themselves, if they were exhibited or shown. Given at Rome at St. Mary Major under the Fisherman's Ring on the eleventh day of the month of April in the year one thousand four hundred and forty-one, in the first year of our Pontificate.
