Ad apostolicae

Constitution re-establishing the Congregation for the Election of Bishops

Constitution of Pope Benedict XIV ·

1 To the burden of Apostolic service, raised by no merits of Our own but by the most merciful counsel of Divine providence, We have recently begun to consider how truly and deservedly the Fathers of the Council of Trent decreed1 that nothing is more necessary to the Church of God than that the Roman Pontiff should devote the solicitude owed to the universal Church by the duty of his office, especially to this end: that he should place good and suitable Pastors over individual Churches, and that error should not occur in the election of those who, like lamps set upon a candlestick, ought to shine upon all who are in the House of God, lest otherwise the state and order of the whole Family of the Lord should sorrowfully be shaken, if that which is required in the body should not be found in the Head. We were also urged and greatly troubled by that most grave consideration proposed to the Roman Pontiff by the same Sacred General Council, namely, that Our Lord Jesus Christ will require from his hands the blood of his sheep, which have perished from the evil governance of negligent Pastors and those unmindful of their office.2 § 1. Desiring therefore to provide for this matter, which pertains to the creation of Bishops, as safely and beneficially as possible, beyond those things which have already been wisely established concerning it both through the Decrees of the aforesaid Council and through the Constitutions of Our Predecessors, We by the tenor of these presents erect, institute, and specially depute a Particular Congregation, by whose counsel We wish to make use in this matter, and We trust in the Lord that Our Successors, the Roman Pontiffs, will likewise use it. To this Congregation We assign five (for We judged that neither fewer nor more would be expedient) of Our Venerable Brethren the Cardinals of the Holy Roman Church, outstanding in piety, learning, prudence, and experience of affairs, recently nominated by Us, and We depute as Secretary of the same Congregation Our beloved son, Our Auditor.

2 § 2. Moreover, the duties of this Congregation shall be, with all study and effort applied, and every human consideration set aside, to assist Us, so that in accordance with Our earnest desire, there may be assumed to govern the Patriarchal, Primatial, Archiepiscopal, and Cathedral Churches men endowed with integrity of morals, sacred learning, expertise in ecclesiastical matters, zeal for the House of God, and true concern for the salvation of souls, and who, understanding themselves to be called not to their own advantages but to labors and solicitudes for the glory of God, and seeking not what is their own but what is Christ's, shall laudably fulfill their ministry according to the venerable sanctions of the Blessed Fathers and the Sacred Canons; so that according to the quality and condition of the vacant Churches, those altogether more worthy and more apt for governing them fruitfully may be chosen, such as We always intend and hope, with the Lord's help, shall be elected by Us. Wherefore, We shall communicate to the same Congregation concerning which men We have thought upon for promotion to the Episcopate, as well as concerning the documents pertaining to their qualities and merits.

3 § 3. And lest the Churches be deprived of Pastors for a long time, if after their vacancy those who might worthily be promoted to them are sought: We will and command that immediately after this Our Constitution is published, and then every two years, through the Cardinal Prefect of the aforesaid Congregation, letters be written to the Bishops of various places according to the designation delivered by Us, commanding them in Our name that, under the law of secrecy and by seriously burdening their consciences, they faithfully report, after diligent investigation has been made beforehand, whether and which, whether Secular or Regular Priests exist in their Diocese or in nearby places whom they judge suitable for the Episcopal office according to God, explaining the origin, birth, age, previous conduct, exercise of ecclesiastical functions, degrees which they have obtained, offices which they have held, learning, piety, prudence, and other gifts of mind by which each one might be distinguished. Moreover, the letters which the Bishops shall write in this matter shall be kept secret, so that whenever any Church must be provided with a new Pastor, they may be resumed without delay, and from them it may be easy and expeditious to recognize which men might be judged by Us as more worthy and more suitable for the vacant Church. And since those who live a life in some Religious Family can be fully known, and are accustomed to be known by their Superiors, both General and Provincial, We also wish that they themselves be questioned under the same bond of secrecy for the aforesaid purpose. § 4. Furthermore, as soon as the vacancy of any Church becomes known, Our Auditor shall inform the aforesaid five Cardinals of it, so that they themselves may be able to think especially of men to be more usefully placed over such a Church and to be suggested to Us, and to employ a special investigation according to their prudence: which indeed shall be done especially by Us ourselves. Then, as soon as it can be done, a Congregation shall be held, which the aforesaid five Cardinals shall attend together with Our Auditor, and there, having weighed all the qualities and merits of the men whose knowledge shall have been received either by Us ourselves, or through the aforesaid letters of the Bishops, or through the investigation made by the said Cardinals, it shall be deliberated what counsel should be given to Us, so that Our Auditor may then report to Us whatever the aforesaid Cardinals shall have deemed fit to signify to Us for that purpose. But if the conditions of any man shall seem not yet sufficiently explored in one Congregation, the consultation shall be deferred to another, so that in the meantime a more accurate investigation may be made through appropriate means.

4 § 5. In this Congregation also appointed by Us, as aforesaid, We decree that henceforth the matter of Bishops to be transferred by Our authority from one Church to another shall be handled; examining with due maturity, whether grave, legitimate, and approved by the Sacred Canons causes intervene which might suggest such a transfer, having regard only to the necessity or utility of the Churches, to which indeed all those causes are reduced; lest otherwise, through inconsiderate facility, the cupidity and ambition of those who perhaps aspire to larger Churches or richer ones be fostered, and at the same time a way be opened to the spiritual inconveniences which are accustomed to befall flocks from the frequent change of Pastors. The counsel of the same Congregation shall then likewise be reported to Us through the same Our Auditor, so that it may be determined by Us what We shall judge to be more expedient.

5 § 6. And so that all these things may be accomplished more freely and more perfectly in the aforesaid Congregation, We enjoin upon each of the aforesaid Cardinals, as well as upon Our Auditor, secrecy after the manner of that which is observed for matters pertaining to the Holy Inquisition; with the faculty, however, of communicating concerning matters pertaining to the same Congregation, under a similar law of secrecy, with one Auditor or one assistant for studies of each of them, and one Clerk, as well as with those whom they shall be accustomed to question or consult concerning these same matters, in order to obtain information conducive to that purpose, whom We also decree ought to be bound by secrecy in like manner.

6 § 7. We trust moreover that all those who have any right whatsoever in any manner from the Apostolic See for the promotion of the aforesaid Bishops, or otherwise render their service (changing nothing in them for the present state of times), shall always keep before their eyes, and shall always have impressed upon their mind (as We believe has been done hitherto, according to their piety and Religion) that most weighty admonition which the aforesaid Council of Trent deemed should be inculcated, namely, that they can do nothing more useful for the glory of God and the salvation of peoples than if they strive that good Pastors and those suitable for governing the Church be promoted; and that they, communicating in the sins of others, sin mortally unless they diligently ensure that those whom they themselves judge to be more worthy and more useful to the Church are placed in office, not indeed by prayers or human affection or the suggestions of those who press their claims, but by their merits requiring it.

7 § 8. To no one whatsoever, etc.

8 Benedict XIV, const. Quod Sancta, 23 November 1749.

9 That the holy Synod of Sardica, taught by divine instruction, decreed it to be most excellent and highly fitting, if the priests of individual provinces should refer all matters to the head, that is to the See of the Apostle Peter, turning it over in careful consideration of mind, when the Lord first placed Us, though unworthy, in that same See with the special charge of His governance, there came upon Us such a thought, that the status of all the churches of the whole world should be referred to Our littleness, and the needs by which Christ granted to St. Peter the Apostle the necessity of treating all things, when He gave him the keys of opening and closing. Indeed, placed as we are in the watchtower appointed by God, and desiring to prove the diligence of Our vigilance for the duty of the office committed to Us before Him, we are solicitous night and day, that the spiritual care may not fail regarding any distant place, but may extend through all places where the name of God is preached, mindful of that rebuke of the Lord: that which was infirm, you did not strengthen; and that which was sick, you did not heal; that which was broken, you did not bind up; and that which was cast out, you did not bring back; and that which was lost, you did not seek; and my sheep were scattered, because there was no shepherd; and they became a prey to all the beasts of the field, and were scattered; my flocks have wandered upon all the mountains, and there was none that sought them; behold I myself will require my flock at the hand of the shepherds. Since therefore the Lord threatens such shepherds, through whom the sheep of the Lord are neglected and perish, what else ought We to do than to exhibit full diligence in gathering and cherishing the sheep of Christ, and to apply the medicine of paternal mercy to the healing of their wounds? For there is no greater or better care of those in authority than, with diligent solicitude and wholesome remedy, to provide for the cherishing and preservation of the sheep.

10 § I. Indeed, formerly Sixtus V, Pope of happy memory, seriously observing the ancient and praiseworthy custom, instituted of old by Our Predecessors, the Supreme Pontiffs, from the gravest causes and not without the instinct of the Holy Spirit, and observed for many ages with great benefit to the Church of God, Sess. XXIV, de ref., c. ).

11 that individual Patriarchs, Primates, Archbishops, and Bishops at certain fixed times, either by themselves or through a certain Nuncio of theirs, should pledge by oath that they would visit the Thresholds of the blessed Apostles Peter and Paul, who consecrated this Alma City with their blood, so that the Roman Pontiff, to whom the care of all churches is entrusted, through the coming of the Bishops to Rome and their assistance, might everywhere recognize the countenance of the flock committed to him, and might understand the diseases of the spiritual sheep and apply suitable remedies, and nothing whatsoever concerning them might be hidden from him, those things which it is necessary for him to know and to carry out for the increase of God's glory, for the propagation of the Christian Religion, for the procuring of the salvation of souls; partly through the fault of men, partly through the cunning of the ancient enemy of the human race, and also through various calamities of the times arising, this was being observed negligently by many, to the grave peril of their own souls and the detriment of the churches over which they presided, he grieved from the depths of his heart, and thought to meet this grave evil growing daily worse and to apply suitable remedies.

12 § 2. Accordingly, through his Apostolic Letters, whose beginning is: Romanus Pontifex, he constituted that all Patriarchs, Primates, Archbishops, Bishops established throughout the whole circle of the earth, and henceforth to be ordained, even if they should shine with the dignity of the Cardinalate, or if the consecrated Pallium taken from the body of the blessed Peter should be delivered to them, or if they should be transferred to another Church, before they should involve themselves in the governance and administration of that Church, if indeed they were present at the Curia, in the hands of the Deacon Cardinal of the holy Roman Church of the first rank, but if absent, in the hands of the Prelate delegated by the Apostolic See to discharge the aforesaid duty, or to deliver such a Pallium, they should bind themselves by oath that they would visit the Thresholds of the blessed Apostles Peter and Paul at the times fixed in those same letters, personally and by themselves, and would render an account to the Roman Pontiffs existing at the time regarding their entire pastoral office, and concerning all matters pertaining in any way to the status of the churches which they governed, to the discipline of the Clergy and People, and finally to the salvation of the souls entrusted to their faith, and conversely would receive Apostolic mandates and would execute them with the greatest diligence, as is contained more fully in those same letters.

13 83. But since no mention was made in the aforesaid letters of Sixtus concerning Abbots, Priors, and others who possess spiritual jurisdiction almost episcopal in their Monasteries and Churches, and their Territories completely separated from every other Bishops' Diocese, it came to pass that Abbots and others who presided over such Churches and Monasteries with spiritual jurisdiction and separated Territory, when visiting the Thresholds of the Blessed Apostles, never reported concerning those same Churches and Monasteries and the flock committed to their care to the Roman Pontiffs, so that the status and condition of such Monasteries and Churches, which are called Nullius, remained unknown to the Apostolic See, and thus the evils which ought to be remedied were ignored, and the good things which ought to be fostered and enlarged by Apostolic care and zeal lay hidden.

14 84. We therefore, desiring to consult and provide for the utility of all Churches and the salvation of souls, as much as we are able in the Lord, and since we shall have to render an account before the tribunal of God concerning all, and—which is fearful—even concerning one soul, and also wishing that those things which have been salutarily instituted by Our Predecessors be observed more exactly and diligently, do therefore approve and confirm the same letters of Sixtus V Our Predecessor, and whatever is contained in them, by Our certain knowledge and Apostolic Authority by the tenor of these presents, and also renew them, and command and enjoin all Patriarchs, Primates, Archbishops, and Bishops that they strive to observe them carefully and diligently, and to keep all things prescribed in them, and that they obey and comply with the admonitions and precepts of the Apostolic See in a matter of such importance with that reverence, care of mind, and readiness which is fitting, and keeping the examples of ancient tradition and mindful of ecclesiastical discipline, let them retain the vigor of sacerdotal religion no less in judging than in counseling, knowing what is owed to the Apostolic See, since all of us placed in this position desire to follow the Apostle himself, from whom the Episcopate itself and all the authority of this name has emerged.

15 85. Furthermore by the aforesaid knowledge and authority, by this Our constitution to endure in perpetuity, We sanction, decree, and command that all and each Abbots, Priors, Prepositi, and others by whatever name and title called, and adorned with whatever dignity even the honor of the Cardinalate, whether secular or Regular of whatever order, already promoted to the governance of Monasteries or Churches having particular and separated Territory, and hereafter to be promoted in the course of time, even by way of election, postulation, or in any other manner whatsoever, and holding or hereafter to obtain Monasteries or Churches of this kind in title, commenda, administration, or in any other manner whatsoever, who namely exercise spiritual jurisdiction almost episcopal, whether with temporal or without, in the aforesaid Monasteries and Churches, their Territories, Districts, and quasi-Dioceses completely separated and severed from every other Bishops' Diocese, by whatever right and title, whether from origin, or prescription, or from indult and Apostolic privilege, before they acquire possession of the same Monasteries or Churches, and involve themselves in any way in their governance and administration: if indeed the prelates shall be in the Curia, in the hands of the Senior Cardinal of the Holy Roman Church in the Diaconal order, but if absent, in the hands of the Nuncio or Legate of the Apostolic See, if present, otherwise in the hands of some Bishop or Archbishop to be chosen at their discretion, having however ecclesiastical communion with the Roman Church, as Delegates of the same Apostolic See, shall swear, according to the formula described below, that they will personally and by themselves visit the sacred memorials of the Blessed Apostles Peter and Paul, and moreover will render an account to Us and to Our Successors for the time being, the Roman Pontiffs, at the times established by this Our Constitution, concerning the care of the Monasteries and Churches committed to them; bringing to Our knowledge and that of Our Successors whatever pertains to the status of those Monasteries and Churches, and to the observance of ecclesiastical discipline in the Clergy and People, to the salvation of souls which are entrusted to their faith, and to Divine Worship and glory; and in turn receiving from the Apostolic See admonitions and mandates, whose censure and what things are to be corrected shall be cut away, and what things are to be observed shall be sanctioned, and what things have been well begun and instituted, by Our approval and confirmation and that of Our Successors shall be brought to their due completion.

16 § 6. But if they shall have been detained by a legitimate impediment, let them swear that they will accomplish all things through a certain Nuncio having special mandate for this purpose, and from among their own Monasteries and Churches, constituted in dignity in a Secular or Regular Church, or altogether through some Priest, Secular or Regular, of noted probity and religion, fully instructed in all the aforesaid matters: through whom also they ought to prove such impediment by legitimate proofs to be transmitted to the Cardinal Prefect of the Congregation of the Sacred Council of the Holy Roman Church.

17 § 7. Moreover, in order that the aforesaid duty of visitation and relation of their Monasteries and Churches may be duly and opportunely fulfilled, all the aforesaid Abbots, Prepositi, Priors, and all others by whatever name of dignity or office designated, both Regular and Secular, namely Italians or those from Italian stock, such as Sicilians, Sardinians, Corsicans, and others from the adjacent Provinces of Italy, shall be bound every third year; but the rest existing in other Provinces, Kingdoms, and parts and Regions of the Orb of Lands, both those who now are and those who shall be hereafter, in the fifth year, to accomplish diligently and to the best of their ability, and to exhibit to Us and our Successors, and let them take care that the same institution be repeated and observed every third and fifth year. But let these periods of years begin from the time of taking possession and undertaking the governance and care of the Monasteries and Churches.

18 § 8. But those who have already been provided with these Churches and Monasteries and are found in their peaceful possession for two years and more, or to whom the time prescribed by Us above from the day of taking possession has already elapsed, within one year, if they are in Italy and adjacent Islands, but within two years, if they are outside, from the day of publication of the present Constitution, ought to transmit to Us the aforesaid relation of their Churches, and thereafter at single triennial or other prescribed times according to the condition and distance of places, to Us, and to visit the Sacred Basilicas of the Apostles, and to present themselves to our sight, provided they have not been legitimately hindered, so that, refreshed in the embrace of the Holy Roman Church their Mother, and confirmed by the paternal discourse of our humility, they may return to their Monasteries and Churches to be governed with greater alacrity and instruction.

19 § 9. We therefore command in virtue of holy obedience all the aforesaid Abbots, Priors, Prepositi, and all others by whatever title or name designated, or shining forth by whatever dignity, both Regular and Secular, present and future, that the aforesaid visitation, and moreover the relation to be made at the times appointed by Us, so useful and necessary to themselves and their Monasteries and respectively Churches, they accomplish entirely according to the form prescribed otherwise to Bishops. But if they, which God forbid, shall have neglected to execute promptly what has been commanded and constituted by Us, We will that they be suspended by the Bishop or Archbishop, or by the Monastery or Church Nullius in the vicinity, from entrance into the Church and from the administration both of Spiritual and temporal matters, as well as from the receipt of the fruits of their Monasteries and respectively Churches, all exception and delay ceasing, to be freely exacted in the meantime and to be expended in the work of the fabric or for the purchase of ornaments of the Church of the Roman Pontiffs, as the greater necessity shall have demanded, ipso facto for so long until, repenting of their contumacy, they shall have merited to obtain relaxation of this suspension from the aforesaid See.

20 § 10. Notwithstanding privileges, absolutions, indulgences, and other concessions of not visiting these thresholds; and other things to be done, whatsoever granted to the Rectors of Churches and Monasteries and by whomsoever of the Roman Pontiffs, and also by Us and the said See from whatsoever causes perpetually or for a time, extended and renewed, all of which We do not will to avail against the aforesaid to anyone, and other things contrary whatsoever. But because it would be exceedingly difficult for the present letters to be carried wherever they are needed, We also will that copies of them, even printed, sealed by a public Notary and by the seal of a person constituted in Ecclesiastical dignity, be given the same faith which would be given to the same presents, if they were exhibited or shown.

21 I N. from this hour forward shall be faithful and obedient to B. Peter the Apostle, and to the Holy Roman Church, and to Our Lord Lord Benedict Pope XIV and his Successors canonically entering. I shall not be in counsel, or consent, or do, or cause that they lose their life, or limb, or be captured by evil capture, or that violence be done to them in any way whatsoever, or that any injuries be inflicted by any sought pretext. Moreover, the counsel which shall be entrusted to me, either by themselves, or by their Nuncios, or by letters, to their detriment, knowing it, I shall reveal to no one. The Roman Pontiff, and the Regalia of St. Peter I shall be a helper to them in retaining and defending, saving my order, against every man. The Legate of the Apostolic See in going and returning I shall treat honorably, and shall aid him in his necessities. The dignity, honors, privileges, and authority of the Holy Roman Church, of Our Lord the Pope, and of the aforesaid Successors I shall take care to preserve, defend, increase, and promote. Nor shall I be in counsel, or deed, or negotiation, in which against the same Our Lord, or the same Roman Church any sinister or prejudicial schemes against the persons, rights, honor, status, and power of the same be contrived. And if I shall learn that such things are being negotiated or procured by anyone, I shall impede this to the best of my ability. And as quickly as I am able, I shall make it known to the same Our Lord, or to another, through whom it may come to his knowledge. The Rules of the Holy Fathers, decrees, ordinances, or dispositions, reservations, provisions, and Apostolic mandates I shall observe with all my strength, and shall cause them to be observed by others. Heretics, Schismatics, Rebels against the same Our Lord, or the aforesaid Successors I shall pursue and impugn to the best of my ability. The sacred memories of the blessed Apostles I shall visit in person and by myself on each occasion, and to Our Lord and the aforesaid Successors I shall render account of the office committed to me, and of all things pertaining to the state of my Monastery, or Church, to the discipline of the Clergy and People, and finally to the salvation of souls which have been entrusted to my faith in any way. Or every five years, 670 Roman Pontiffs

22 and conversely I shall humbly receive Apostolic Mandates, and shall execute them with the greatest diligence. But if I should be detained by legitimate impediment, I shall fulfill the aforesaid through a certain Nuncio having special Mandate for this from the Convent of my Monastery, or another constituted in Ecclesiastical dignity, or otherwise having a Personatus, or, these failing me, through some Priest, whether Secular or Regular, of noted probity and religion, fully instructed in all the aforesaid matters. Concerning such impediment, however, I shall transmit through legitimate proofs to the Cardinal of the Holy Roman Church, Prefect of the said Congregation, through the said Nuncio. The Possessions pertaining to my Monastery I shall not sell, nor give, nor pledge, nor newly enfeoff, nor alienate in any way, even with the consent of the Convent of my Monastery, without consulting the Roman Pontiff. And if I should come to any alienation, the penalties contained in a certain Constitution published on this matter, I wish to incur by that very fact. So may God help me, and these Holy Gospels of God. § 12. To no one whatsoever is it permitted, etc.

23 Benedict XIV, encyclical letter Ubi primum, 3 December 1740

24 Ubi primum it pleased God, who is rich in mercy, to place our humility in the supreme See of blessed Peter, and to commit to Us, the Vicariate of Our Lord Jesus Christ's power, supported by no merit of ours whatsoever, for the governance of his universal Church; there has sounded in our ears that divine voice: Feed my lambs; feed my sheep, namely, the charge of ruling committed to the Roman Pontiff, the Successor of that same Peter, not only the lambs of the Lord's flock, which are the peoples dispersed throughout the whole circle of the earth, but also the sheep, namely the Bishops, who as mothers of lambs, beget peoples in Christ Jesus, and bring them forth again. Receive therefore also the exhortation of your Pastor, Brethren, through these our letters; and in the share of solicitude, the fullness of which has been divinely committed to Us, being called, understand from these very admonitions and exhortations of ours, how great a care presses upon Us not to neglect those things which are of our office, and how great likewise is the force of our paternal charity toward you, by which we are led to the greatest desire, that from the progress of the holy sheep there may be eternal joys for the Pastors.

25 § 1. First of all, however, take care, with all study and effort and aid, that integrity of morals and zeal for divine worship may shine forth in the Clergy, and that Ecclesiastical Discipline may be preserved intact, and where it shall have collapsed, may be restored. For it is sufficiently evident that there is nothing which instructs, stirs, and inflames the whole people more efficaciously to piety, religion, and the institution of Christian life, than the example of those who have dedicated themselves to divine ministry. Therefore with this in mind the Cardinals of my Church.

26 Venerable Brethren, Patriarchs, Primates, Archbishops, and Bishops, your attention must first be directed to this matter, so that with careful selection those may be enrolled in the clerical militia from whom it may justly be expected that, walking in the law of the Lord and advancing from virtue to virtue, their life may bring reverence to all, and their works may bring spiritual benefit to your Churches. For it is indeed better to have fewer Ministers, but good ones, but suitable ones, and truly worthy, than many who shall be of no avail for the edification of the Body of Christ, which is the Church. How much caution therefore the Sacred Canons require of Bishops in this matter, you are not ignorant, Brethren; but do not allow yourselves to be drawn away from their norm, which must be entirely observed, by any human consideration, or by the importunate suggestions of those seeking favor, or by the prayers of patrons. And the precept of the Apostles, that hands be not laid upon anyone too hastily, must be observed especially when it is a matter of promoting to the Sacred Orders, and to the Most Sacred Mysteries, than which nothing is more divine. For it is not enough that the age prescribed by the sacred laws of the Church for each Order should have been reached, nor should the way be open indiscriminately to all who have already been constituted in some lower Order, as it were by their own right, to a higher one; but it must be carefully and with great diligence investigated by you whether those who have undertaken the earlier ministries have had such a manner of living and such progress in sacred sciences that they may truly be judged worthy to be told: ascend higher; for otherwise it would be better that some remain in a lower grade rather than be promoted to a higher one with such greater danger and scandal to others. § 2. And since it is of the utmost importance that those who are called to the lot of the Lord be formed from their earliest years to piety, integrity of morals, and canonical discipline, as it were young plantings in their youth, it must be a matter of concern to you that where perhaps Seminaries of Clerics have not yet been established, they be established as soon as possible, or if already established, be enlarged, if a greater number of students is needed according to the condition of your Churches, employing for this purpose the means whose provision the Bishops have already been instructed in, and to which We shall also add others, if We are taught by you of their necessity. And these same Colleges must be fostered with singular solicitude on your part, namely by visiting them often, investigating the life, character, and progress in studies of each of the young men, assigning suitable Masters and men endowed with ecclesiastical spirit to their formation, sometimes honoring their literary exercises or ecclesiastical functions with your presence, and finally conferring some Benefices upon those who have given a clearer proof of virtue and have gained greater praise. You will not regret having provided such irrigation to these little trees while they grow, but your labor will then bear for you a most joyful fruit in an abundant supply of good workers. Bishops have been accustomed to grieve often that the harvest indeed is great, but the workers are few; and perhaps they too ought to grieve that they themselves have not employed the industry which they ought to have employed, so that workers might be formed equal and suited to the harvest; for good and industrious workers are not born, but made; and that they may be made pertains especially to the diligence and industry of Bishops. § 3. But it is also of the greatest importance that the care of souls be committed to those who are distinguished by doctrine, piety, chaste morals, and illustrious good works

27 and thus be able to shine forth to others by their examples, so that they may truly be the light and salt of the people, and be praised. These are indeed your principal helpers in the flock entrusted to you; in teaching, ruling, and purifying it; in directing it toward the way of salvation, and in spurring it on to the virtues of Christ. From which it is easy to understand how important it is that those be chosen for the office of pastor who are judged to be more suited to the fruitful governance of the peoples. In this matter, moreover, you should be especially diligent, so that whoever has the care of souls may feed the peoples committed to them, at least on Sundays and other feast days of precept, with salutary words according to their own and their capacity, teaching them those things which the faithful ought to know for their salvation, and explaining the precepts of Divine law and the dogmas of the Faith, and imbuing the children with the rudiments of the same Faith, with any evil custom to the contrary completely removed, wherever it might be. For how shall they hear without a preacher? Or how shall the peoples be able to attain to believing rightly and acting rightly, if the curators of souls are sluggish, remiss, and idle in such an office? Wherefore it cannot sufficiently be comprehended in mind, or explained in words, how great a danger to Christian society hangs over from the negligence of those to whom the care of souls has been entrusted, especially in instructing children in catechism. It will be of great benefit, moreover, if you shall have taken care that both those who have the care of souls and others who are appointed to receive the confessions of the penitent shall devote themselves for some days each year to spiritual exercises: in that pious retreat, indeed, they will be renewed in the spirit of their mind, and will be clothed with power from on high, to perform more earnestly and readily those things which are their duty for the glory of the Divine Majesty and the spiritual benefit and salvation of their neighbors.

28 § 4. Now you know, Brethren, that it has been commanded by Divine precept to all Pastors of souls to know their sheep, and to feed them by the preaching of Divine word, the administration of the Sacraments, and the example of all good works; and that they cannot satisfy these and the other duties of the Pastoral Office as is fitting, those who do not watch over their flock, nor assist it, and do not continually guard the vineyard of the Lord in which they are placed as custodians. Therefore it is necessary that you remain in your station, and observe personal residence in your Church or Diocese, to which you are bound by virtue of your office, as has been clearly declared and prescribed by the Decrees of many General Councils and the Constitutions of Our Predecessors. But beware lest you think it is permitted to Bishops to be absent for three months in each year at will, or for any cause whatsoever. For in order that this may truly be lawful for Bishops, it is clear that account must be had, so that such absence be required by a just cause, and at the same time it be provided that no detriment come to the flock. Remember, however, that there will be a Judge before whom all things are naked and open, and therefore see to it that such a cause be truly one which can be approved by right before the supreme Pastor of Pastors, from whom the blood of the sheep committed to you will be required in due time; in which judgment, in vain would a Pastor contend that he is defended by the fact that the wolf, in his absence and without his knowledge, carried off and devoured the sheep; for if the matter be thoroughly examined, it appears sufficiently that scarcely any evil or damage befalls a Diocese thus destitute which is not to be ascribed to him whose duty it was to recall his subjects from deviating from right conduct by admonitions, to attract them by the voice of example, to confirm them by authority and charity. Moreover, who does not know

7 § 8. A nessun uomo dunque, ecc.

8 Benedetto XIV, cost. Quod Sancta, 23 nov. 1749.

15 85. Inoltre, con la scienza e l'autorità predette, con questa Nostra costituzione che varrà in perpetuo, sancimo, decerniamo e ordiniamo, che tutti e singoli gli Abati, Priori, Preposti e altri, con qualunque nome e titolo denominati, e con qualunque dignità, anche insigniti dell'onore del Cardinalato, sia i secolari che i Regolari di qualunque ordine, già promossi al governo dei Monasteri o Chiese aventi Territorio particolare e separato, e che per il futuro, anche per via di elezione, postulazione o in qualunque altro modo saranno promossi, e che otterranno i Monasteri o Chiese siffatti in titolo, commenda, amministrazione o in qualunque altro modo, o che per il futuro li otterranno, i quali cioè esercitano la giurisdizione spirituale quasi episcopale, anche temporale o senza, nei Monasteri e Chiese predetti, nei loro Territori, Distretti e quasi Diocesi completamente separati e divisi da ogni altra Diocesi dei Vescovi, con qualunque diritto e titolo, sia per origine, sia per prescrizione, sia per indulto e privilegio Apostolico, prima che conseguano il possesso dei medesimi Monasteri o Chiese, e si immischino in qualche modo nel loro governo e amministrazione: se infatti i presuli saranno in Curia, giurino nelle mani del Diacono Cardinale della Santa Romana Chiesa di ordine più anziano, se invece saranno assenti, nelle mani del Nunzio o del Legato della Sede Apostolica, se presente, altrimenti nelle mani di qualche Vescovo o Arcivescovo da scegliersi a loro arbitrio, che tuttavia abbia comunione ecclesiastica con la Chiesa Romana, come Delegati della medesima Sede Apostolica, secondo la formula descritta qui sotto, che visiteranno personalmente e per se stessi le sacre memorie dei Beati Apostoli Pietro e Paolo, e inoltre renderanno conto a Noi e ai Nostri Successori per il tempo esistenti Romani Pontefici, nei tempi stabiliti da questa Nostra Costituzione, della procura dei Monasteri e Chiese affidati a loro; portando a Nostra conoscenza e a quella dei Nostri Successori tutto ciò che riguarda lo stato dei medesimi Monasteri e Chiese, e l'osservanza della disciplina ecclesiastica nel Clero e nel Popolo, la salvezza delle anime che sono affidate alla loro fede, e il Culto Divino e la gloria; ricevendo vicendevolmente dalla Sede Apostolica moniti e mandati, la cui censura e ciò che deve essere corretto sia eliminato, e ciò che deve essere osservato sia sanzionato, e ciò che è stato bene iniziato e istituito, sia condotto al dovuto fine dalla Nostra approvazione e conferma, e da quella dei Nostri Successori;

O ogni cinque anni, 670 Romani Pontifices

22 NIGRI EE MENT ROR fibus, e viceversa i Mandati Apostolici umilmente riceverò, e quanto diligentemente li eseguirò.

Pertanto in ciò mente Seu Cardinali Ecclesiae meae.

Come infatti ascolteranno senza chi predica?
