Apostolic letter on the reform of the Ruthenian Basilian Order in Galicia

Apostolic letter of Pope Leo XIII ·

APOSTOLIC LETTERS

Concerning the Reform of the Order of St. Basil the Great of the Ruthenian Nation in Galicia.

LEO PP. XIII FOR THE FUTURE MEMORY OF THE MATTER

1 The Catholic Church has always felt that she received singular protection and glory from the work of those men who, seeking the perfection of Christian holiness and duty, generously abandoned human affairs and dedicated themselves to Jesus Christ. Although at first they inhabited places remote from cities so that they might serve God more freely, and preferred a manner of life without the burden of clerical duties, yet afterwards, impelled by charity toward their neighbors and sometimes also by the authority of Bishops, they did not refuse to go into cities and undertake the offices of the priestly ministry. — Among these men there shone forth most remarkably, from the earliest centuries of the Church, that great Basil, Bishop of Caesarea in Cappadocia, a theologian and orator comparable to few, who not only strove himself toward every praise of virtue, but called many to imitate him: whom he instructed with most wise precepts and gathered into monasteries for the common discipline of religious life. These men, accustomed to voluntary penances and labor, distributed their time usefully between divine praises and the study of sacred doctrines; and by these means, while they achieved many other things, they accomplished especially this: that they were able both to illustrate the Christian cause by their virtue and, where it was necessary, to defend it with deliberate effort. For which reason, at the time when that illustrious Order of religious men perished by the Photian calamity, no small source of benefits dried up along with it. But as soon as, with the Ruthenians received anew into the Catholic Church, it revived, and was recalled to its former dignity through the efforts of St. Josaphat, Archbishop of Polotsk, an unconquered martyr and likewise an alumnus of that Order, then the Ruthenians quickly felt the benefit of the reviving society. For it was the principal purpose of its members to preserve the union of the Ruthenians with the Roman Church, to instruct the people, in

2 in the formation of youth, to carry out parochial duties, and finally to fulfill all those offices which pertain to the cultivation of souls, especially if the number or diligence of the secular clergy had proved unequal to the times. For these reasons they had acquired such goodwill among all, such reputation and favor, that only Basilians were chosen to become either Bishops or Archimandrites 1. In the Synod of Zamość of the Ruthenian province, whose decrees the Apostolic See confirmed, it had been provided that no one could be a Bishop unless he had professed the Basilian institute, and no one could profess it unless within the walls of the monastery he had completed a year of regular probation and six weeks devoted to the laws and customs of St. Basil 2. And so not only the Bishops of the Ruthenians, but also the Roman Pontiffs, Our Predecessors, held the Basilian sodality in great honor, pursued it with commendations of mind, and embraced it with special care: for they knew well that it had greatly benefited the Catholic Church especially among the Ruthenians in the past and would benefit it no less in the future. Concerning Clement VIII 3 and Gregory XV 4, it is sufficiently evident how much labor and zeal they devoted to adorning the Basilians: whom Benedictus XIV 5 himself and in more recent memory Pius VII 6 commended in singular terms. To these there was added in recent times a most clear testimony of the blessed Pius IX 7 set down in those Apostolic Letters in which solemn honors among the saints of heaven were decreed for the blessed Josaphat.

3 But with the ancient union of monasteries broken apart, the Order, once most flourishing, weakened by various misfortunes, has been not a little afflicted by the hardships of human frailty: and this especially in this age, when Catholic doctrine is everywhere brought into disrepute amid such madness of opinions and corruption of morals. Moreover, with minds drawn away by desire for novelties to profane studies, the charity of many has grown cold, and few are found who, renouncing mortal things, set themselves to follow closely in the footsteps of Jesus Christ. — We meanwhile, grieving over the plight of the Basilian Order, and considering by what means it might be relieved

LETTERS

4 his condition ought to be, in Our consideration, it happened conveniently that not only We Bishops, but also members of the same Order have carefully instructed Us concerning the state of affairs. Indeed, what once in the crisis of the Oriental Churches St. Basil the Great did, they judged it fitting to do likewise for themselves, so that they might implore the aid of the Apostolic See, proposing also among other remedies those which the holy St. Josaphat wisely and usefully employed in a similar cause. The common will of the Bishops and Monks pleased Us greatly: and the sorrow of Our heart, undertaken for the cause of the Ruthenians, began to be eased, concerning whom whenever We think, so often are We troubled: for We can neither fail to lament the losses inflicted upon the Catholic faith nor fail to fear the present dangers. But We judge that hope for the future is rightly placed, if, with God as helper and patron, that great Order of Monks shall flourish completely, by whose vigor the Church of the Ruthenians flourished. For that Order is to be held as an ancient tree, whose root is holy: whence by the grafting of new shoots one may expect joyful and abundant fruit: and this all the more because cultivators are sought, whose industry in the same work is otherwise proven, namely members of the Society of Jesus, whom the holy St. Josaphat and Velaminus Rutski the Metropolitan experienced as most excellent helpers. — Therefore concerning so grave a matter of this kind, which justly claims singular care from Us, We have ordered several Venerable Brethren, Our Cardinals of the Holy Roman Church from the sacred Council set over Oriental affairs for the propagation of the Christian faith, to deliberate maturely. When We approved their opinions, to establish the Basilian community in the monasteries of Galicia, We decree by Our Apostolic authority the following, and We command that it be religiously observed.

5 We will that the illustrious Order of St. Basil the Great among the Ruthenians be restored in such a way that its members, properly trained for priestly duties, may strenuously labor in caring for the eternal salvation of their neighbors. And in this matter We desire nothing more than that they strive to imitate the holy Josaphat, as it were their second father, and to approach closely to his excellent charity. For this reason We will that a College of novices, or Novitiate, as it is called, be legitimately established by right in the Monastery of Dobromil within the bounds of the Diocese of Przemyśl: the temple of which monastery and the buildings contained therein together with all property, rights, and revenues shall pass to the College of novices or Novitiate.

6 We command that the Basilian Monks in Galicia in the future place their novitiate in the Monastery of Dobromil for the prescribed time: if they do otherwise, let their religious profession be null and void.

7 That the necessities of the failing Order may be more safely and firmly provided for, and that more young men may be stirred to profess so salutary an institution of life, the privilege renewed or granted for this same reason by Our Predecessor Pius VII through Apostolic Letters given on 30 July in the year 1822, whose beginning is Ea sunt ordinis, We confirm in such a way that it shall also be permitted to admit Latins, not yet initiated into sacred orders. It shall be lawful for them to conform themselves to the Ruthenian rite in all things before solemn profession: which being completed, not before, they are to be understood to have truly and completely passed over to the Ruthenian rite, with return to the Latin rite forbidden.

8 Since the undertaking of reforming this Order has many difficulties which demand the counsel and authority of the Apostolic See, We therefore reserve its governance to Us and to Our successors the Roman Pontiffs, with the sacred Council entrusted with the propagation of the Christian faith overseeing Eastern affairs acting in care, until otherwise it shall be decreed by the same Holy Apostolic See. To that same sacred Council We grant the right and power of nominating, after duly consulting the opinion of the Monks, and of electing the Protohegoumen or Superior of the Order in the Galician Province. This Basilian sodality We therefore wholly exempt from the ordinary authority and jurisdiction of the Bishops and even of the Metropolitan of the Ruthenians, and We declare it to be exempt: saving however the power which the Tridentine Synod attributed to Bishops in this kind of matter even as Delegates of the Apostolic See. The college of novices, which We have mentioned, following the examples of the ancients, namely of St. Josaphat and Velaminus Rutski the Metropolitan, We entrust to be established and governed by the Society of Jesus for so long as there shall not have come forth from the Basilian Order itself men to whom the Apostolic See might think fit to entrust the care of governing the Monastery of Dobromil. Therefore We command that as soon as possible certain chosen priests from the Society of Jesus undertake the direction and governance of the Coenobium of Dobromil and the Novitiate; who however, not only as regards religious discipline, but also as regards the change of office, shall remain in the power of their ordinary Superiors, as they now are, so shall they continue. To those same priests from the Society of Jesus let the Protohegoumen deliver, saving however the right of dominion to the Basilians, the aforesaid monastery, already voluntarily offered to Us, together with all its goods and revenues: and let a proper instrument be executed concerning that delivery. Let those priests of the Society of Jesus administer those goods and the fruits of those goods for the protection of the Coenobium and the Students, not with the Basilian Monks as authors, the sacred Council for the propagation of the Christian name being the author, to which in each year they shall render accounts of receipts and expenditures, likewise a report concerning the state of the novices and concerning those admitted among the novices in good faith. Let the Monastery of Dobromil, which We meanwhile release from the power of the Protohegoumen, receive as many as shall declare themselves willing to be admitted into the Basilian Order from either the Ruthenian or Latin rite. Yet let them not be admitted unless they shall be proved to be good and suitable not only by legitimate testimonies concerning life and morals, learning, and from both the Ordinaries of their origin and domicile, but also by a document of six months' probity and constant willingness, which they shall have produced within the walls of the Monastery before they assume the initial habit.

9 The students or Novices of Dobromil shall be formed for all piety and religious perfection according to the institute of the Basilian Order and the discipline ordained by St. Josaphat. And since We absolutely wish the rite of the Ruthenians and approved customs to be observed inviolate, let the rectors of the Monastery take care and provide that, with some assistance from priests of the Ruthenian rite, divine offices be performed in the sacred building and the Sacraments be administered according to the Ruthenian rite: likewise that the students diligently learn the Ruthenian liturgy and ceremonies. Let those same students become accustomed to perform divine praises properly: let them observe abstinences and fasts according to the prescriptions of St. Josaphat: yet it shall be permitted to the Prefect of the Coenobium to temper these prudently: and to him We also wish it to be permitted to release from ecclesiastical precepts, for just cause, those over whom he presides, and We grant to him the other faculties which the Apostolic See is accustomed to confer upon Superiors of religious Orders.

10 Let the sacramental confessions of the students, even for two years after they shall have pronounced simple vows, be heard by their master, even if perchance the same one holds the office of prefect of the monastery: yet in such a way that it shall be open to them, whenever they wish, to approach an extraordinary Confessor. After a novitiate of one year and six weeks, it shall be permitted for the Students to pronounce simple vows, if only they shall appear worthy and suitable for the offices of their Order in the judgment of the Superiors. Those whom it shall be ascertained to be less worthy or less suitable, the Prefect of the Coenobium shall order to depart, even if bound by vows which are called devotional. Those who shall have duly pronounced simple vows, it shall not be permitted to order to depart without the authority of the Apostolic See, except that evident necessity press, which admits of no delay.

11 The students after simple vows shall be instructed by the Priests of the Society of Jesus, the moderators of studies, in the humanities: soon let them receive philosophy and theology under the same teachers, and in those studies let them be exercised in the discipline of St. Thomas Aquinas.

12 To those same, after three years shall have been completed from the pronouncement of simple vows, it shall be permitted to profess the Basilian Order in solemn rite, observing the laws issued by Our Predecessor Pius IX, especially the Constitution Ad universalis Ecclesiae issued on 7 February 1861.

13 These matters we have indicated are to be decreed. In the meantime, diligent effort shall be given to writing out the laws of living, or Constitutions, and those drawing more closely to those which Basil and Josaphat so excellently established. These indeed we will by Our authority and that of this Apostolic See to be reviewed and approved. And by this final method we trust it will come to pass that the Basilian society of Ruthenians in Galicia, with God's help, shall revive in hope of its former glory, and, instructed in all virtue, shall easily attain that which both its founder Basil and its restorer Josaphat had proposed in mind: namely to preserve the Catholic name among some, to propagate it to others, to protect the ancestral union of his people with the Roman Church, to furnish to the Catholic Bishops of Ruthenians learned, industrious, and well-disposed helpers.

14 But while laboring for the safety of the Basilian family in Galicia, we do not fix Our cares in this alone, so that Our charity may not also embrace the other pupils of the same order existing outside Galicia. Who indeed are worthy of equal study and benevolence on Our part, especially on account of the benefits to the Catholic Church not only already brought forth, but also remaining and hoped for. Meanwhile we hold it for certain that they will not be wanting to themselves, and that all will wish to strive with every effort, so that the dignity of the Basilian Order may be retained, and the desired union of all monasteries may, by God's blessing, be obtained. — But the Venerable Brethren, the Bishops of Ruthenians, eminently deserving of the Basilian sodality, we shall judge will be willing, not because we have deemed them to be relieved of the burden in this matter, but because, with matters thus established by Our authority, those goods which were sought after by the common desire of all can rightly be expected from the Basilian Order.

15 May the prosperous outcome of these undertakings be obtained from God by Mary the Virgin herself, their mother, together with Michael the Archangel, the heavenly Patron of Galicians, and Basil the Great and Josaphat the martyr: by the grace of all of whom may God bring it to pass that many from every order of mankind resolve in their minds to experience the benefits of this reform.

16 These things we will, command, and grant, decreeing null and void if anything contrary to the foregoing should be attempted by any authority, knowingly or unknowingly. Notwithstanding any contrary provisions whatsoever, even those worthy of special and individual mention, all and each of which we derogate from by Apostolic authority for the purpose only of the present. We will moreover that copies of these Letters, even if printed by type, subscribed by the hand of some public Notary and furnished with the seal of a person established in ecclesiastical dignity, shall everywhere receive the same credence in judicial proceedings and outside them as would be given to these presents themselves, if they were exhibited or produced. Given at Rome at St. Peter's under the Fisherman's Ring on 12 May 1882, in the fifth year of Our Pontificate.

De Ordine s- Basilii M. Ruthenae Nationis in Gallicia reformando.

LEO PP.

His vero luculen" tum postremo tempore accessit testimonium f. r. Pii IX 7 iis consignatum litteris Apostolicis, in quibus b. Iosaphat© sanctorum caelitum solemnes honores decernebantur.

5 Inclytum Ordinem s.

6 Monachos Ordinis Basiliani in G-allicia futuros tirocinium in Monasterio Dobromilensi ponere rato tempore iubemus : si secus posuerint, professio religiosa irrita infectaque esto.

Eidem Sacro Consilio ius potestatemque tribuimus nominandi, rite perrogata Monachorum sententia, eligendique Protoegumenum seu Praepositum Ordinis in G-allicia Provincia.

12 Iisdem, exacto a nuncupatione votorum simplicium triennio, Ordinem Basilianum solemni ritu profiteri liceat, servatis legibus a f. r. Pio IX Decessore Nostro editis, inprimis Constitutione Ad universalis Ecclesiae edita die 7 Februarii 1861.

13 Haec quidem decernenda indicavimus.
