Bull confirming the Maronite Synod of 1736
1 Having set forth those matters which preceded the provincial Synod celebrated by the Prelates of the Maronite nation on Mount Lebanon, He approved the same Synod, with the matter of episcopal sees defined in the Appendix to the Synod being reserved to the Apostolic See by way of providential consideration (1).
BENEDICT PP. XIV, for the record of future times.
2 The singular solicitude, care and foresight of the Roman Pontiffs and of Our predecessors in the supreme governance of the Catholic Church has always been most carefully preserved, both toward declaring, sustaining, confirming, defending, and restoring to their original observance—or to some minimal degree of error or corruption into which they may have fallen—the most sacred dogmas of the orthodox Religion and the precepts of ecclesiastical discipline handed down, in which it is especially commended that they never permitted all the opportune and necessary remedies of charity, wisdom, vigilance and apostolic authority to be desired, wherever on earth and among the nations where the Catholic faith was cultivated, to be applied gently and firmly. For often through apostolic letters they reproved those who erred; often indeed from the apostolic font they gave responses to those seeking in all provinces; sometimes they entrusted to others, when they were absent at a distance, the conduct of their care, causes to be examined and defined; sometimes also they decreed that distinguished men, through whom their authority might be represented there where they could not be present, should be sent; at other times they mandated that assemblies and synods be convoked, so that by the brethren and Co-bishops gathered there causes might be discussed with canonical and apostolic integrity and defined with equity pleasing to God; not infrequently also they sent their legates, who would convoke assemblies and synods, whether general or merely national or provincial, in which they presided in the name of the Apostolic See or distinctly, after all things had been discussed and defined with equity and canonical integrity, they strove to bring them to the knowledge of these same predecessors of Ours, so that by them a congruent judgment might without doubt be rendered and confirmed.
3 § 1. But as much as for illustrating and confirming the truth of the Catholic Religion, as much as for procuring the observance of ecclesiastical discipline, as much as for promoting the study of Christian piety and sanctity (1) Cf. Bull. P. da 1701, Fide vol. III, pag.
HR. PONT. DE P. P. PARS I.
4 And commended by the Council of Trent.
5 A national Council was necessary for the affairs of the Maronites.
6 Therefore they had recourse to it.
7 to the promotion of the Sees, experience itself has sufficiently and more than sufficiently proved that such assemblies and synods are beneficial. For this very reason, as St. Cyprian, Martyr and Bishop, says, it is necessarily the case with us that the elders and prelates come together each year to arrange those things which have been entrusted to our care, so that if there are any more serious matters, they may be directed by common counsel. For this reason the Council of Trent decreed that provincial councils, if they had been omitted anywhere, for moderating morals, correcting excesses, settling controversies, and other matters permitted by the sacred canons, should be renewed at least every three years; but diocesan synods should be renewed every year.
8 § 2. Although indeed the venerable brethren Patriarchs, Archbishops, Bishops and others existing in their time of the renowned nation of the Maronites, which from its very origin having professed the orthodox Roman faith always kept it intact from infidels, heretics, schismatics besieging it on all sides, and has striven and continues to adhere most closely to this Apostolic Holy See and to render due obedience and submission, have not ceased to celebrate assemblies and synods of this kind as it were among themselves, yet it is established that never among them has a provincial council or one of the whole nation been held. Whence it came to pass that, when certain matters pertaining especially to ecclesiastical discipline seemed gradually to decline from their primitive institution and splendor, to sustain and repair the same there were consulted as constantly as could be done the decrees issued by the Congregations of our venerable brethren the Cardinals of the Holy Roman Church, both of the general Inquisition against heretical depravity and of the Propagation of the Faith, upon the matters proposed and controversies arising. Which providence indeed long since undertaken and observed, although in some manner salutary, did not yet seem sufficiently so to the modern venerable brethren Joseph Peter Patriarch of Antioch and the other Archbishops and Bishops of the same nation of the Maronites, that they might become possessed of their desires. For which reason through suppliant letters, distinguished by marks of singular reverence and obedience toward this Apostolic Holy See, given again and again, they signified not only that abuses gradually creeping in and controversies and confusions disturbing peace for the most part should be removed from their midst; but also with earnest prayers finally petitioned that, to accomplish so grave a matter with the honor and advantage of the same nation, the Apostolic See would deign to send the beloved son Joseph Simon Assemani of the same nation, a man prefect of the first custody in our Vatican Library, canon of the Basilica of the Prince of the Apostles of the City, master in both our signature and referendary, a domestic prelate and our intimate chamberlain, whom we have known and approved for nearly thirty years now, both on account of the services laudably rendered by him in expediting the affairs of the Congregations of the Inquisition and Propagation of the Faith for the Oriental nations, and so many volumes on Oriental matters especially and other subjects already published by the press, which we greatly esteem.
9 § 3. Therefore our predecessor of happy memory Pope Clement XII, inclined by the counsel of the same Congregation of the Propagation of the Faith to such supplications, deigned to send the aforesaid Joseph Simon, furnished both by his apostolic letters in similar form of Brief, and by decree and instruction upon certain articles worthy of particular reform, and with faculty to convoke a provincial synod or one of the whole nation, if it should be necessary. He indeed, obeying the supreme commands of the same predecessor Clement with the obedience that was fitting, made his way to the East. After he had come to Mount Lebanon, he set forth the apostolic mandates, decrees and instruction of the said Congregation contained in the apostolic letters and decrees, as aforesaid, to the same Joseph Peter Patriarch and the other Maronite Prelates. When all these things had been received and read with the veneration due to the Apostolic See, it was established by unanimous consent that such a Synod should be held, in which not only the decrees and ordinances of the said Congregation of the Propagation of the Faith should be recited and proposed for observance; but also other decrees and canons, if in any way it should seem necessary and opportune for reforming and illustrating ecclesiastical discipline with the honor of the same nation, should be enacted.
10 § 4. Meanwhile, after various preliminary discussions and meetings had been conducted, this Synod, which had now been convoked, was held in the church under the invocation of the Blessed Virgin Mary Immaculate of the monastery of Loaisa of the beloved sons the monks of St. Anthony of the Congregation of Mount Lebanon in the province of Chesroan in Phoenicia. In it indeed, besides the Patriarch and this Legate, there attended Archbishops and Bishops, namely fourteen Maronites, two Syrians and as many Armenians, the general abbots of the monks both of St. Anthony's Congregation of Mount Lebanon and of St. Isaiah, each with four definitors, and other local abbots both of the same Congregation of Mount Lebanon and of monasteries of the ancient institute, the lieutenant of the custody of Jerusalem and of all the Holy Land, apostolic missionaries of all Orders who dwell in Syria and Palestine, namely of St. Francis of the Minors of the Observance and Capuchins, of St. Mary of Mount Carmel of the Discalced so called, and the regular clergy of the Society of Jesus, and very many archpriests, parish priests, priests, theologians, alumni of the pontifical college of the City, and other clergy, monks, princes and magnates of Gazeni, Hebaiscii, and other distinguished families of Mount Lebanon and Anti-Lebanon.
11 § 5. Accordingly, in sessions held both matutinal and vespertinal on the thirtieth of September and the first and second days of the month of October of the year 1736, all convening together, after the decrees, canons and articles had been recited and proposed in accordance with the instruction of the said Congregation of the Propagation of the Faith, as is premised, drawn up and contained in this Synod, not only did they all and severally approve and praise all and each of them, and all and each who had suffrage and vote, as well as others, subscribed to them; but also letters, by which they signified both those things which had been done, and the Ablegate himself on account of his zeal, prudence, learning, piety, and the wise manner observed in matters conducted, they commended most highly, dated on the third, fourth, fifth, seventh, and fifteenth days of the same month and year, they took care to convey these to Clement the aforesaid predecessor and to the said Congregation often mentioned, to be borne; humbly beseeching that this Synod, with prior examination, censure and correction by this Apostolic Holy See, insofar as necessity should require, being approved and confirmed by apostolic authority, should also come forth into the light through the Arabic press of the said Congregation of the Propagation of the Faith. § 6. Meanwhile, while Joseph Simonius himself, the Ablegate, being about to obey the instruction of the aforesaid Congregation and of the good memory of Felix Cardinal Zondadari, while he lived, protector of the nation and of this Ablegate to Mount Lebanon, and being about to comply with those who had voted in the said Synod, immediately took care to mandate to execution certain things contained in certain articles, as is premised, and first here at Rome, then in the aforesaid Synod already discussed and decreed, and especially every manner of separation of nuns from monks, no light dissension emerged between the same Ablegate and the Patriarch regarding the manner of separation. There followed then a controversy concerning the prohibition of any sum of money, however modest, or other things to be contributed both in the distribution of sacred oils, and in the conferral of sacred orders, to be paid and exacted from the Patriarch or Bishops as was formerly customary. Finally, concerning the firm incardination of each one's own church by the Bishop, and the reduction of Bishoprics to a certain number, in accordance with a document subscribed by the Patriarch himself, Archbishops and Bishops, a dispute broke out. Concerning all these things the same Patriarch, and by his letters written in the year 1737, and by his nuncio in the year 1738, having reached this venerable City, consulted the Apostolic See.
§ 7.
12 § 7. Now, having been narrated and related beforehand in the same Congregation of the Propagation of the Faith, not once but many times, both regarding the points contained in the aforesaid articles and regarding the authority and legitimacy of the aforesaid Synod, with reasons and considerations brought forth on both sides and weighed most carefully, having heard both the venerable brother Gabriel Eva, Archbishop of Cyprus of the Maronites, and the learned sons Thomas Budi, abbot general of the monks of St. Anthony of the said Congregation of Mount Lebanon, and Pompilius Rodatus, a Greek writer in our Vatican Library and not ignorant of oriental matters, to whom the aforesaid Synod had been entrusted to be reviewed and examined, by their relation; a particular Congregation of the same venerable brothers of ours of the Propagation of the Faith already appointed by us, we ordered to be held before us on the twenty-seventh day of the month of August recently past, with our beloved son Vincent, Cardinal of the Holy Roman Church, Prefect of the same Congregation of the Propagation of the Faith, placed in the stead of our beloved son Charles, Cardinal of the Holy Roman Church, the aforesaid Cardinal Rezzonici, presiding, being absent, sufficing in his place.
§ 8.
13 The following doubts were proposed in the Congregation:
14 I. Whether it is established that the said Synod is legitimate?
15 II. Whether the canon regarding the prohibited cohabitation of nuns or women with monks is to be sustained, or in what manner is it to be moderated?
16 III. Whether the canon prohibiting the Patriarch from any exaction in the distribution of holy oil to the parish priests is to be sustained and merits confirmation?
17 IV. Whether the canon regarding the residence of Maronite Bishops in their own titles of episcopal churches is to be approved; and what regarding the appendix of the Synod, cap. XLI., in which there is a division of episcopal sees with the limits of the dioceses of the Maronites for the distribution of dioceses among so many Bishops, so that they cannot be removed by the Patriarch?
18 V. Whether it should be referred to the Most Holy Father for the approval of the said Synod also by apostolic Brief? To which doubts indeed, all things having been carefully weighed, response was made by the same Cardinals.
19 To I. That it is established that the Synod is legitimate, all voting in agreement.
20 To II. For the approval of the canon, yet without approval of the monasteries. To III. To be approved: and to the Most Holy Father, who may deign to provide otherwise for the Lord Patriarch.
21 To IV. For the approval of the canon requiring the residence of Bishops: and to His Holiness regarding the contents in the Appendix cap. xli, in which the sees and limits of the Maronite Metropolitans and Bishops are proposed. To V. To His Holiness, who may deign to approve the Synod with an Apostolic Brief.
§ 9.
22 Hence it is that we, who by the abundance of divine goodness are placed in the lofty watchtower of the most sacred Apostolate, desire nothing more earnestly than to evangelize throughout the whole Catholic world and to instruct all the Christian faithful in the dogmas of the orthodox faith, and to ensure that the precepts of ecclesiastical discipline are kept inviolate and most holy; for this reason, imposing perpetual silence upon all and singular dissensions, controversies, disagreements and all other matters whatsoever which up to this day have been stirred up in any way and manner concerning all the aforesaid; and likewise, as Pontiff of all and singular the aforesaid Patriarch, Legate, Archbishops, Bishops and others of the Maronite nation, being willing to assent favorably, as far as we are able with the Lord, to the wishes of men in this matter, and to pursue their individual persons with special favors and graces, and commending them with apostolic praise, and absolving them by the tenor of these presents from whatsoever excommunication, suspension and interdict, and other ecclesiastical sentences, censures and penalties, whether by law or by man, imposed for any occasion or cause, if they are bound by them in any manner whatsoever, for the purpose of obtaining the effect of the present letters only, and holding them to be absolved, inclined to the supplications of the same humbly presented to us in their name, by the counsel of our venerable brothers the Cardinals of the Holy Roman Church, we confirm and approve by apostolic authority, by the tenor of these presents, this Synod and all and singular the statutes, decrees, ordinances and canons issued therein, as aforesaid, and we add to them the strength of inviolable apostolic firmness; provided, however, that by our aforesaid confirmation of the Synod nothing shall be deemed to have been derogated from the constitutions of the Roman Pontiffs our predecessors and the decrees of general councils made concerning the rites of other nations whatsoever, whether specially or generally, which, notwithstanding this confirmation, ought to remain in their force; and the authority of the said Congregation of the Propagation of the Faith being always saved in the aforesaid matters, yet to us and our successors the Roman Pontiffs, as often as need shall be, upon the aforesaid matters being first consulted.
§ 10.
23 Decreeing that these same present letters and the Synod, and the statutes, ordinances, decrees and canons issued therein, shall always be firm, valid and efficacious, and shall obtain and secure their full and complete effects, and shall be inviolably and unshakably observed in all things and by all and singular to whom it pertains and shall pertain at any time; and thus in the aforesaid matters judgment and decision and interpretation ought to be made by whatsoever ordinary and delegated judges, and even by the auditors of the causes of the apostolic palace, and if anything contrary to these matters shall be attempted by anyone whatsoever, whether by the Patriarch, Archbishops and Bishops of the Maronite Nation, both individually and all together in assembly, or by apostolic workers who are sent by the same Congregation to whatsoever parts of the world, by any authority, even granted by this Holy See, unless express faculty regarding this Synod shall have been granted by us and our successors the Roman Pontiffs, knowingly or unknowingly, it shall be null and void. Notwithstanding all the aforesaid, and apostolic, and in universal, provincial and synodal councils issued general or special constitutions and ordinances, and all other things whatsoever to the contrary.
24 And the faculties of the same Congregation.
25 Clauses for the observance of decrees, revoked, etc.
26 Notwithstanding all the aforesaid, and apostolic, and in universal, provincial and synodal councils issued general or special constitutions and ordinances, and all other things whatsoever to the contrary.
27 § 11. Moreover, whatever concerning all and singular the aforesaid doubts and all other matters whatsoever which we shall know to be profitable and salutary for the splendor, utility, peace and concord of the whole Maronite nation, we shall declare cumulatively by other letters of ours in similar form as a Brief.
28 § 12. We will, however, that to copies or exemplars of these same present letters, even printed ones, subscribed by the hand of some public notary and furnished with the seal of a person established in ecclesiastical dignity, the same faith shall be given in judgment and outside of judgment as would be given to these same presents, if they were exhibited or shown. Given at Rome, at St. Mary Major, under the Fisherman's Ring, on 1 September in the year of our Lord one thousand seven hundred and thirty-one, in the second year of our pontificate.

IIR. PONT. DE P. P. PARS I.
4 Et a Conc. Trident. commendata.
§ 7.
12 Narratis autem relalisque prius in eadem eiamque saepe dicta Congregatione Propagandae Fidei non semel habita quamplurimis, tum quoad puncta in antedictis articulis contenta tum quoad auctoritatem legitimitatemque Synodi praefatae rationum momentis hinc inde adductis et accuratissime expensis audita tum ven. fratris Gabrielis Evae Archiepiscopi Cypri Maronitae, tum intectorum filiorum Thomae Budi abbatis generalis monachorum S. Antonii dictae Congregationis Montis Libani, et Pompilii Rodatd in Bibliotheca nostra Vaticana graeci scriptoris et de rebus orientalibus non ignari, quibus Synodus praefata revidenda et examinanda commissa fuerat, relatione; particularem Congregationem eorumdem venerabihum fratrum nostrorum Propagandae Fidei iam a nobis deputatam coram Sanctissimo nobis die xxvii. proxime elapsi mensis augusti, ponente dilecto pariter filio nostro Vincentio S. R. E. Cardinali Petra eiusdem Congregationis Propagandae Fidei praefecto in locum dilecti illius filii nostri Caroli S. R. E. praefati Cardinalis Rezzonici ponentis absentis suffecto, habendam indiximus.
§ 8.
13 Proposita fuerunt in Congregatione huiusmodi dubia, quae sequuntur:
14 I. An constet de legitimitate dictae Synodi?
15 II. An canon quoad cohabitationem prohibitam monialium seu mulierum cum monachis sustineatur, vel quomodo moderandus?
16 III. An canon prohibens Patriarchae quamcumque exactionem in distributione Olei sancti parochis sustineatur et mereatur confirmationem?
17 IV.
