DELLA SMEMBRAZIONE E DELL'ISTITUZIONE DI UNA NUOVA DIOCESI PIO DELLA VILLA REALE IL VESCOVO SERVO DEI SERVI DI DIO A PERPETUA MEMORIA DELLA COSA

1 La sollecitudine apostolica dei Nostri Predecessori nel conseguire la salvezza delle anime li ha sempre spinti a provvedere affinché la circoscrizione ecclesiastica del mondo cattolico rispondesse opportunamente alle condizioni dei tempi e delle cose.

2 Poiché dunque l'arcidiocesi di Braga, nel Portogallo, si estendeva vastissimamente e i cristiani della provincia civile comunemente chiamata Traz-os-Montes, a causa delle difficili vie di accesso alla lontana sede episcopale, non potevano compiere gli affari religiosi se non con grave disagio, l'odierno Arcivescovo di Braga ha supplicato con insistenza la Sede Apostolica affinché fosse istituita una nuova diocesi in quella provincia, almeno in luogo di quelle che il nostro Predecessore di felice memoria, il Papa Leone XIII, per mezzo delle Lettere Apostoliche munite di piombo Gravissimum Christi Ecclesiam, date il trentesimo giorno del mese di settembre dell'anno milleottocentottantuno, spinto dalle necessità dei tempi, aveva soppresso.

3 Poiché però questa erezione di una nuova diocesi sembrava giovare alla comodità dei fedeli e al bene delle anime, il nostro Predecessore di felice memoria, il Papa Benedetto XV, ha benignamente accolto le suppliche a lui presentate; ma, prima che si decretasse alcunché in proposito, ha ordinato che fossero ascoltati tutti i Vescovi del Portogallo, soprattutto i Presuli di Braganza e di Lamego, ai quali ciò più da vicino interessava, poiché alcune parrocchie dovevano essere staccate anche dalle loro diocesi.

4 Avuto dunque il suffragio di costoro, e integrato inoltre, per quanto fosse necessario, il consenso degli altri, ai quali interessa o si presume che interessi la cosa, Noi, che abbiamo succeduto al nostro Predecessore di felice memoria, il Papa Benedetto XV, inaspettatamente tolto dai vivi e da Noi dolorosamente rimpianto, consultati i Cardinali della Santa Romana Chiesa preposti agli affari ecclesiastici straordinari, abbiamo decretato di costituire una nuova diocesi da chiamarsi Villaregalense dal paese di Villa Real, nel modo che segue.

5 Anzitutto stabiliamo che questa nuova diocesi comprenda interamente la provincia civile, che trae il nome dalla detta città di Villa Real, e sia circondata dai confini di quella medesima provincia. Alla diocesi così novellamente eretta attribuiamo duecentocinquantasette parrocchie, delle quali centosessantasette dovranno essere separate dalla diocesi di Braga, diciannove da quella di Braganza, e settantuno da quella di Lamego; cioè dalla diocesi di Braga l'arcipresbitero comunemente detto Boticas, che ha sedici parrocchie; Mondim de Basto con quattordici parrocchie; Montalegre con trentacinque parrocchie; Villa Pauca de Aguiar con sedici parrocchie; Villa Beai con ventiquattro parrocchie; e trentaquattro parrocchie dal municipio di Chaves, e venticinque dal municipio di Valpaços; dalla diocesi di Braganza undici parrocchie dal municipio di Chaves, e otto dal municipio di Valpaços; dalla diocesi di Lamego i municipi di Alijó con diciotto parrocchie; Mesão Frio con sette parrocchie; Murça con nove parrocchie; Begoa con dieci parrocchie; Sabrosa con quindici parrocchie; Santa Marta de Penaguião con dieci parrocchie, e una parte del municipio di Villa Beai con due parrocchie.

6 La città di Villa Beai costituiamo invece come sede e cattedra episcopale con tutti i diritti, i privilegi e gli onori, di cui godono le altre sedi episcopali del Portogallo; parimenti la chiesa parrocchiale di San Domenico ivi esistente eleviamo al grado e alla dignità di cattedrale con i diritti, gli onori, gli insegni e i privilegi, di cui per diritto o per legittima consuetudine godono le altre cattedrali.

7 Ordiniamo inoltre che ivi sia costituito un Capitolo cattedrale con i diritti e i privilegi, di cui legittimamente godono gli altri Capitoli nel Portogallo, ferma restando l'elezione dei Canonici e delle Dignità del Capitolo secondo le norme del diritto comune. Qualora però al presente, a causa delle circostanze dei tempi, non sia possibile costituire un Capitolo di Canonici, vogliamo che, secondo le disposizioni di Pio XI, al posto dei Canonici, siano eletti i Consultori diocesani, secondo i canoni quattrocentoventitreesimo e seguenti. Tuttavia rimmettiamo alla prudenza e al giudizio dell'Esecutore di queste Lettere, di cui parleremo più avanti, il decidere se al presente sia più opportuno procedere subito alla costituzione del Capitolo cattedrale, oppure all'elezione dei detti Consultori. Decretiamo inoltre che la dote della nuova diocesi sia costituita dai redditi degli indulti Apostolici, che sostituiscono l'antica Bolla della Crociata, dagli emolumenti della Curia episcopale e dalle oblazioni spontaneamente date dai pii fedeli, nella cui generosità molto confidiamo. Parimenti stabiliamo che, al più presto possibile, sia eretto un Seminario diocesano, secondo le disposizioni del Codice e le norme stabilite dalla Sacra Congregazione dei Seminari, nel quale possano essere istruiti e formati i ministri del santuario: nel frattempo però l'Ordinario provveda nel miglior modo possibile a coloro che aspirano al sacerdozio, inviandoli cioè nei Seminari più vicini.

8 Infine questa diocesi di nuova istituzione la costituiamo suffraganea dell'arcidiocesi di Braga, e finché la medesima diocesi non sia provvista di proprio Pastore, il suo governo affidiamo al venerabile fratello Emanuele Vieira de Mattos, attuale Arcivescovo di Braga, come Amministratore Apostolico, conferendogli tutte le facoltà e i diritti che convengono a questo incarico.

9 Le presenti Lettere e tutto quanto in esse contenuto, anche per il fatto che coloro ai quali interessa o presumono che interessi loro non siano stati ascoltati e non abbiano consentito alle premesse, anche se degni di menzione espressa, specifica e individuale, non potranno mai in alcun tempo essere impugnate, contestate o messe in controversia per vizio di surrezione, di obrepzione, di nullità, o di Nostra intenzione, o per qualsiasi altro difetto, anche sostanziale e imprevisto; ma esse, come fatte e emanate da certa scienza e da pienezza di potestà, rimangono perpetuamente valide e saranno, producono e ottengono i loro pieni e interi effetti, e devono essere inviolabilmente osservate da tutti coloro ai quali spetta; e se per caso da chiunque e da qualsiasi autorità, consapevolmente o inconsapevolmente, fosse tentato qualcosa in contrario, vogliamo e decretiamo che sia del tutto nullo e vano.

10 Affinché tutte le cose sopra costituite siano mandate ad esecuzione, deputiamo il venerabile fratello Achille Locatelli, Arcivescovo titolare di Tessalonica, Nunzio Apostolico in Portogallo, conferendogli le facoltà necessarie e opportune, anche di subdelegare, allo scopo di cui si tratta, qualsiasi uomo costituito in dignità ecclesiastica, con l'obbligo tuttavia di inviare alla Sacra Congregazione Concistoriale entro sei mesi, computati da quando queste Lettere sono date, una copia autentica dell'esecuzione compiuta. Ordiniamo infine che ai transunti di queste Lettere, anche stampati, sottoscritti però da mano di qualche notaio pubblico e muniti del sigillo di qualche persona costituita in dignità ecclesiastica, sia prestata la medesima fede che sarebbe prestata a queste Nostre Lettere, se fossero esibite o mostrate.

11 Non ostante, per quanto occorra, le regole edite nei concili sinodali, provinciali, generali e universali, le costituzioni e ordinazioni Apostoliche speciali o generali e qualsiasi altra disposizione dei Nostri predecessori Romani Pontefici, e qualunque altra cosa contraria.

12 A nessuno dunque sia lecito infrangere queste Nostre Lettere di dismembrazione, erezione, esenzione, decreto, mandato, deroga e volontà, o contravvenirvi. Se qualcuno invece, con temerario ardimento, presumesse di tentare ciò, sappia che incorrerà nell'indignazione di Dio onnipotente e dei Beati Pietro e Paolo, suoi Apostoli.

Quod, si in praesens ob temporum adiuncta fieri non potest ut Canonicorum Capitulum constituatur, volumus ut, Apta Pii PP. XI loco Canonicorum, dioecesani Consultores, iuxta canones quadringentesimum vigesimum tertium et sequentes, eligantur. ON THE DISMEMBERMENT AND ESTABLISHMENT OF A NEW DIOCESE OF PIUS OF VILLA REAL THE BISHOP SERVANT OF THE SERVANTS OF GOD FOR THE PERPETUAL MEMORY OF THE MATTER

1 The apostolic solicitude of Our Predecessors in achieving the salvation of souls has always moved them to take care that the ecclesiastical division of the Catholic world should be aptly suited to the conditions of the times and circumstances.

2 Since therefore the archdiocese of Braga in Portugal extended very widely, and the Christian faithful of the civil province commonly called Traz-os-Montes, on account of difficult access to the distant episcopal seat, were unable to conduct religious matters without grave inconvenience, the present Archbishop of Braga earnestly petitioned the Apostolic See that a new diocese should be established in that province, at least in place of those which Our Predecessor of happy memory, Pope Leo XIII, by Apostolic Letters under the lead seal Gravissimum Christi Ecclesiam given on the thirtieth day of the month of September in the year one thousand eight hundred and eighty-one, compelled by the necessities of the times, had suppressed.

3 Since, however, this erection of a new diocese appeared to serve the convenience of the faithful and the good of souls, Our Predecessor of happy memory, Pope Benedict XV, kindly received the petitions laid before him; but, before anything should be decreed in the matter, he ordered that all the Bishops of Portugal should be heard, especially the Bishops of Bragança and Lamego, to whom this more nearly pertained, since certain parishes were also to be separated from their dioceses.

4 Having therefore obtained their votes, and moreover supplemented, insofar as it was necessary, the consent of others whose concern it is or who may presume it to be their concern, We, who succeeded Our Predecessor of happy memory, Pope Benedict XV, unexpectedly taken from the living and deeply lamented, having taken counsel with the Cardinals of the Holy Roman Church placed in charge of extraordinary ecclesiastical matters, have decreed to establish a new diocese to be named Villaregalensis from the town of Villa Real in this manner which follows.

5 First We decree that this new diocese shall comprehend the entire civil province which takes its name from the said city of Villa Real, and shall be circumscribed by the boundaries of that province. To the diocese thus newly erected We assign two hundred fifty-seven parishes, of which one hundred sixty-seven are to be separated from the diocese of Braga, nineteen from Bragança, and seventy-one from Lamego; namely from the diocese of Braga the archpresbyterates commonly called Boticas, which has sixteen parishes; Mondim de Basto with fourteen parishes; Montalegre with thirty-five parishes; Villa Pauca de Aguiar with sixteen parishes; Villa Beai with twenty-four parishes; and thirty-four parishes from the municipality of Chaves, and twenty-five from the municipality of Valpassos; from the diocese of Bragança eleven parishes from the municipality of Chaves, and eight from the municipality of Valpassos; from the diocese of Lamego the municipalities of Alijó with eighteen parishes; Mesão Frio with seven parishes; Murga with nine parishes; Begoa with ten parishes; Sabrosa with fifteen parishes; Santa Marta de Penaguião with ten parishes, and a portion of the municipality of Villa Beai with two parishes.

6 We establish the city of Villa Beai as the seat and cathedral of the bishop with all the rights, privileges and honors which the other episcopal sees of Portugal enjoy; likewise We raise the parish church of St. Dominic existing there to the rank and dignity of a cathedral with the rights, honors, insignia and privileges which other cathedrals enjoy by law or legitimate custom.

7 We further command that a cathedral Chapter be established there with the rights and privileges which the other Chapters in Portugal legitimately possess, with the firm election of Canons and Dignitaries of the Chapter according to the norm of common law. If, however, at present on account of the circumstances of the times it cannot be done that a Chapter of Canons be established, We will that, in place of Canons according to the Apostolic Constitution of Pius XI, diocesan Consultors be chosen according to canons four hundred twenty-three and following. Nevertheless We remit to the prudence and judgment of the Executor of these Letters mentioned below whether it be more expedient at present to proceed immediately to the establishment of the cathedral Chapter, or to the election of the said Consultors. We further decree that the endowment of the new diocese shall be constituted from the revenues of Apostolic indults, which substitute for the old Crusade Bull, from the emoluments of the episcopal Curia and from offerings freely given by pious faithful, in whose generosity We place great confidence. Likewise We decree that, as soon as it can be done, a diocesan Seminary shall be erected according to the provisions of the Code and the rules established by the Sacred Congregation of Seminaries, in which the ministers of the sanctuary may be trained and educated: in the meantime, however, let the Ordinary provide in the best way that can be done for those who aspire to the priesthood, namely by sending them to other nearer Seminaries.

8 Finally, we constitute this newly-established diocese as a suffragan see of the archdiocese of Braga, and until the same diocese shall be provided with its own Pastor, we commit its governance to our venerable brother Emmanuel Vieira de Mattos, the present Archbishop of Braga, as Apostolic Administrator, granting to him all the faculties and rights which are fitting for this office.

9 Moreover, these Letters and all things contained therein, even from the fact that any persons concerned or presuming their interest to be involved have not been heard, and have not consented to the foregoing, even if they should be worthy of express, specific and individual mention, can never at any time be noted, impugned, or brought into question on account of the vice of subreptitiousness or obreption, or nullity, or of Our intention, or any other defect, however substantial and unforeseen; but these Letters, as made and emanated from certain knowledge and fullness of power, shall exist perpetually valid and shall be, and shall produce their full and complete effects and obtain them, and ought to be inviolably observed by all to whom it pertains; and if otherwise anything contrary to these things should be attempted by anyone whatsoever, with or without knowledge, we will and decree that it be entirely null and void.

10 For the execution of all things constituted as above, we appoint our venerable brother Achilles Locatelli, Archbishop with the title of Thessalonica, Apostolic Nuncio in Portugal, conferring upon him the necessary and opportune faculties, even to subdelegate, for the purpose in question, any man constituted in ecclesiastical dignity, with the burden however of sending to the Sacred Consistorial Congregation within six months, reckoned from the date of these Letters, an authentic copy of the execution completed. We finally command that to copies of these Letters, even printed ones, subscribed however by the hand of some public notary and furnished with the seal of someone constituted in ecclesiastical dignity, the same faith be given as would be given to these Our Letters, if they were exhibited or shown.

11 Notwithstanding, insofar as it may be necessary, the rules established in synodal, provincial, general, and universal councils, special or general Apostolic constitutions and ordinances and any other dispositions of Our predecessors the Roman Pontiffs, and all other things to the contrary whatsoever.

12 Let no one therefore infringe these Our Letters of dismemberment, erection, exemption, decree, mandate, derogation and will, or act contrary to them. If anyone, indeed, shall presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the Blessed Peter and Paul, His Apostles.

13 Given at Rome at St. Peter's, in the year of Our Lord one thousand nine hundred twenty-two, on the twentieth day of the month of April, in the first year of Our pontificate.
