Bolla sulla riforma dell'Ordine cistercense

Bolla di papa Benedetto XII ·

1 rogalo contrariorum. — 57.

§ 45. Provisionem equidem studentium

58 taliter limitamus, et sufficientem esse conspicimus, videlicet quod magister regens Parisiensis de communi contributione dicti ordinis, vel de reditibus communibus octoginta libras turonensium parvorum, et a monasterio proprio vigintiquinque libras eiusdem monetae, prò bursa et aliis necessitatibus suis: baccalarius vero regens Parisiis, de dicta communi vigintiquinque, et a proprio monasterio alias vigintiquinque, prò bursa et aliis necessitatibus eius: ac lector Bibliae in eodem Studio de praefato communi decem, et a proprio monasterio viginti libras ipsius monetae percipiant annuatim: quilibet vero scholarium studens in ipso Studio, viginti libras dictae monetae a proprio monasterio prò bursa et aliis necessitatibus suis percipiant similiter annuatim. Sed in aliis Studiis abbates ipsorum Studiorum rectores, magistro in theologia facilitate in illis regenti, de quadraginta libris praedictae monetae prò bursa et aliis necessitatibus suis providere annis singulis teneantur. Quando autem baccalarius in eisdem Studiis reget, ubi commode non reperietur magister, teneantur dicti abbates dicto baccalario de triginta libris praedictae monetae prò bursa et omnibus necessitatibus suis annis singulis providere.

§ 46. Ordinamus quoque ut in quolibet generali praedictorum Studiorum unus, qui Bibliam biblice seu textualiter continue legat, existat, cui ultra quindecim libras iam dictae monetae, quas percipiat a proprio monasterio prò bursa, centum solidi eiusdem monetae prò omnibus aliis necessitatibus suis annuatim a cellarario de bursis scholarium tribuantur. Quilibet autem scholaris in dictis aliis Studiis generalibus praeter Studium Parisiense, ac in dicto Studio Melensi quindecim libras praedictae monetae a proprio monasterio prò bursa et omnibus aliis necessitatibus suis percipiat annuatim. Siquidem omnes provisiones huiusmodi tam abbates dictorum Studiorum rectores, quam abbates proprii, prout quemlibet eorum contingat seu tangere poterit, mittere teneantur ad dicta Studia eorum sumptibus, et illas ibidem solvere, terminis superius designatis, quibus ipsi mittendi esse debent in Studiis memoratis.

A nessuno dunque, ecc. Se qualcuno però, ecc.

1 of the contrary. — 57. Order that this constitution be read in the first general chapter and in other chapters each year, and also once a year in the particular chapter of each place.

Benedict, bishop, servant of the servants of God, for perpetual remembrance of the matter.

2 Shining like the morning star in the midst of the mist, the sacred Cistercian order in the Church militant strives valiantly with good works and examples, and with fervent zeal through the applause of holy contemplation and the merit of innocent life, to climb the mountain with Mary; and through the exercise of praiseworthy actions and the careful weight of pious works, to conform itself to the office of Martha laboring. This order indeed, diligent in the ministry of divine worship, that it may profit itself and others unto salvation, studious in sacred reading of the page, that it may be able to attain to the perfect knowledge of heavenly excellence; excellent and prompt in works of charity, that it may fulfill the law of Christ, has merited to extend its branches from sea to sea, because it has gradually and openly ascended to the heights of virtue, and therefore through the Holy Spirit inflaming weak hearts has abounded in the streams of grace, and has shown itself worthy to be distinguished by the Roman Church, the teacher of all churches, with many privileges and enriched with gracious favors.

3 § 1. We also from our youth have perseveringly borne the yoke of this order, and having become its students, we have grown through the long course of time, both within it and outside it, through successive honors of various positions; and at length we have ascended, although unworthy, to the chair of the supreme pastoral office. Although, however, the care of apostolic ministry requires that we zealously promote with full affection the happy and flourishing increase of every approved order, from which the perfection of heavenly and earthly salvation is derived; we nevertheless regard this same Cistercian order with the keen eye of internal devotion and charity; and those things which concern its salvation and prosperity, insofar as we believe we gratify the good pleasure of the eternal Father, we favorably advance.

4 § 2. Indeed, recalling to mind that when we were presiding within the order in earlier times, certain experience instructed us that on very many articles explained below, the order itself needed the remedies of apostolic provision; we, having been fully informed on these matters through diligent consultation undertaken with our beloved sons William of Cîteaux, John of Firmitas, John of Clairvaux and Rainald of Morimond, abbots of monasteries of the said order in the dioceses of Châlons and Langres, and on some other matters as well, deem it worthy and for the urgent necessity and evident advantage of the said order, other just and reasonable causes also urging it, to issue by apostolic authority statutes and ordinances, as the following series describes: which we will and decree to have solid strength and firmness, and to be firmly observed in perpetuity for future times, namely:

5 § 3. Since provision for caution in every matter ought to be taken, and especially lest that which has been acquired by antiquity or the length of elapsed time gradually fall into collapse, we decree and also ordain that every convent of any monastery or other conventional place of the said order shall have its own and special seal. And that every abbot of a monastery or other conventional place of the said order, presiding principally in the administration thereof, and also the abbot of Cîteaux, who is for the time being, before he involves himself in his abbacy or such administration, shall be held to take an oath upon the holy Gospels of God, each namely inferior in the hands of the abbot who shall have to confirm the election made of him and in the presence of his own convent, and the abbot of Cîteaux himself, who is for the time being, to his convent and the aforesaid three, as well as to the abbots of the monastery of Pontigny of the said order in the diocese of Auxerre, if they should be present at the said monastery of Cîteaux; that he will not sell, nor alienate, nor pledge, nor newly enfeoff, nor in any manner give away the possessions or rights pertaining or appertaining to his monastery or other conventional place of his, except in the manner designated below. And the same those who are now abbots of monasteries or other conventional places presiding in the governance of the said order shall be held to take oath within six months after this statute and ordinance shall have been published, in the next following general chapter of the same order.

Oath to be taken by the abbot concerning not alienating.

6 Cases and Form of alienating or of another conventional place of another conventional place of the said order, presiding principally in the administration thereof, and also the abbot of Cîteaux, who is for the time being, before he involves himself in his abbacy or such administration, shall be held to take an oath upon the holy Gospels of God, each namely inferior in the hands of the abbot who shall have to confirm the election made of him and in the presence of his own convent, and the abbot of Cîteaux himself, who is for the time being, to his convent and the aforesaid three, as well as to the abbots of the monastery of Pontigny of the said order in the diocese of Auxerre, if they should be present at the said monastery of Cîteaux; that he will not sell, nor alienate, nor pledge, nor newly enfeoff, nor in any manner give away the possessions or rights pertaining or appertaining to his monastery or other conventional place of his, except in the manner designated below. And the same those who are now abbots of monasteries or other conventional places presiding in the governance of the said order shall be held to take oath within six months after this statute and ordinance shall have been published, in the next following general chapter of the same order.

§ 4.

7 That whenever it shall happen that an alienation of immovable property or of any rights of a monastery or other conventional place of the said order, or a diminution of rents or pensions or canon, or a sale of trees of forests not subject to cutting is to be made, a discussion of two days (at least) with intervals between them, diligent and mature, ought to precede, to be held by the abbot of the monastery or the superior governing another conventional place, whose property, rights, rents, pensions, canon and forests these shall be, with his convent of the monastery or other conventional place aforesaid. And nevertheless such alienation or sale shall be made with the consent of the said convent or the greater and sounder part thereof; and that from the discussion the superior of another place shall be benefited, with the date and consent already mentioned, authentic writing shall be drawn up, in which the names and surnames of those discussing and consenting, namely of the abbot of the monastery or superior of the conventional place and the convent of the monastery or place of this kind, shall be set forth. And before proceeding to such alienation or sale, permission on this matter shall be sought and obtained from the general chapter of the order itself; and there shall follow a discussion concerning such alienation or sale, to be made by two abbots of the aforesaid order, not remote from the said monastery or other conventional place, to be appointed by the said general chapter, and with the approval or authority of the two abbots aforesaid. And that both the abbot of the monastery or superior of the conventional place itself, and the two abbots aforesaid and also the abbot of the same monastery or one deputed by him, in the presence of the convent of the monastery or other conventional place, whose property, rights, rents, pensions or canon, or forests of this kind are to be alienated or sold, shall take an oath before the aforesaid discussion, that in the foregoing matters they shall conduct themselves faithfully, with all deceit and inordinate affection removed; and that also concerning the causes of such alienation or sale and the aforesaid solemnities, by the four abbots aforesaid and the superior of the conventional place itself, under their seals, a full and faithful report shall be made in the next following general chapter aforesaid; so that it may be seen whether they have proceeded rightly concerning all these things. But when a monastery or other conventional place, castle, village, grange or other notably valuable property is to be alienated or is to be alienated or is to be alienated, the general chapter of the order shall not presume to grant permission for alienation, nor shall it be proceeded to in any way to be made or authorized, unless first by the same general chapter the Roman Pontiff be consulted, and permission on this matter be sought from him and obtained. But if otherwise than as aforesaid any abbot or superior governing a place shall presume to alienate, both he himself and the officials of the monastery or conventional place, consenting to him in this matter, shall be deposed from their administrations by the abbot of their order, and such presumed alienation shall be null and void by the law itself.

§ 5.

8 Moreover, if on account of debts of a monastery or conventional place to be paid out by alienations, or so that something useful for the monastery or conventional place itself be acquired, something shall have been alienated, the money which shall be had from it shall be converted to no other uses than to the acquisition or payment of such debts. And if it shall be done otherwise, the abbot of the monastery or other superior of the conventional place, converting such money to other uses, as aforesaid, or consenting to such conversion, shall be deposed from his administration by the abbot of his order. But the other monks participating or consenting in the same shall be incapable of any office or administration of the same order by the fact itself. Nor shall such money remain in the power of the abbot alone or other superior or bursar of any of them: but it shall be placed in some secure place under four locks with different keys, of which the first shall be held by the abbot of the monastery or superior governing the conventional place, the second by the bursar, the third by the prior of the cloister, and the fourth by another monk of the monastery or conventional place, concerning whom it shall seem expedient to the convent or greater and sounder part thereof, to be faithfully preserved.

§ 6.

9 We also will that concerning the concession of rights or revenues to someone for his favour or for another certain time, and concerning leases or also sales of revenues or fruits to be made beyond five years, the aforesaid form shall be observed in all respects; such consultation and permission of the Roman Pontiff and also permission of the said general chapter and report to be made in it being excepted. We permit, however, that small, barren or mutilated possessions may be conceded under an annual monetary rent or under a certain law of this kind.

10 portion or share of revenues, for such time as shall seem good to the abbot of that monastery and to another abbot of some monastery or to the one presiding over the governance of a convent of the same order. Provided, however, that mature and diligent discussion shall have been held with his convent, and with the consent of the same or of the greater and wiser part thereof, and after an oath shall have been taken by both aforesaid abbots, in the presence of the same convent, that they intend to make such concession for the useful benefit of the monastery or convent, whose possessions those shall be. And if such concession shall have been made otherwise, by that very fact it shall be null and void. But if the multitude of the said possessions, although small, sterile or useless, should exist to be conceded, then before such concession of them the same general chapter shall be consulted, lest permission be had over this, as is distinguished above. But the abbot, or the one presiding over the governance of a convent, if he shall presume to attempt the contrary, and the officials of his monastery or convent, consenting to him in this, shall be deposed from their administrations by their abbot. § 7. Moreover, because it often happens that necessity compels abbots and those presiding over the governance of other convents to contract a loan, we wish this provision to be applied with caution modified in this part, that no abbot or other one presiding over the governance of a convent of this order, without the consent of his own convent, shall be able to receive a loan; and that in an authentic instrument of obligation to be made therefrom the seals of the same abbot or one presiding over the governance and of the convent shall be affixed. But if an abbot should be removed from his monastery, or one presiding over the governance from his convent, and such necessity should prevail, that without the receipt of a loan he could not provide for himself or his household or for useful matters or causes to be done by him; we permit that then without his consent and his seal he shall be able to receive a loan, provided, however, that the sum of one hundred pounds of small Tours currency or the value thereof, whether wholly or in part, shall not exceed; the quantity of which loan, the cause of the obligation, and the person from whom he shall have received it, the abbot or other one presiding over the governance, receiving the same loan, shall be bound to explain to the convent, specially assembled for this, within eight days after his return to his own monastery or his convent. And that from the time he shall once have received a loan up to such sum of one hundred pounds, he shall not be able to receive a loan further without the consent and seal of the same convent, until the said one hundred pounds shall have been fully paid. Whoever, however, abbot or other one presiding over the governance of a convent shall have acted contrary, either by himself or through another, by that very fact shall be suspended from entrance to the Church and from divine offices.

11 § 8. And because the deeds of men are committed to writing for the sake of faith, that the memory of things done may be had in perpetuity, we will and ordain that wherever abbots or others presiding over the governance of convents shall do anything with the express counsel of their convents, concerning which a testimonial instrument shall be made, the seals of the same abbots or others presiding over the governance, and of their convents, shall be affixed to it. And that henceforth in the seal of any abbot or other one presiding over the governance of a convent, by whatever name it be called, the proper name of the same shall be expressed, so that it may be better known by whom and in whose time the matter, of which it shall be, was done, and so that the way may be better closed to the devices of malice and falsehoods.

XII PP.

12 § 9. Furthermore, since it is consonant with reason that those who manage affairs and officials, in managing faithfully and usefully the affairs and offices committed to them, should be bound by the bond of an oath, we will and ordain that cellarers, bursars, managers of affairs, those called rentiers, and other officials of any monastery or other convent and the masters of their granges, when they are assumed to such offices or masteries, shall be bound to take an oath in the hands of their abbot or other one presiding over the governance of the convent, and of the convent itself, that in the committed offices, administrations or granges they shall conduct themselves faithfully; and that they shall render a faithful account of receipts and expenses, and shall assign the remainder to the monastery or convent or to their bursars. And that those cellarers, bursars, managers of affairs, officials and masters, who now are, shall be bound to take a similar oath.

13 § 10. And because, where prudence and the steadfastness of faith are not fortified, luxury finds a place for itself; and the brief span of time consumes the substance of individual monasteries, it is fitting and expedient that through prudent and faithful stewards each substance be maintained and also dispensed. Wherefore we establish and also ordain that in each monastery and other conventional places of the aforesaid order, by the abbot or other superior presiding over the governance, with the counsel of the seniors of his convent, two bursars shall be appointed, of whom one shall be principal. These bursars shall receive all monies of the monastery or conventional place, coming from whatever source, universally, and by the mandate of the said abbot or superior presiding over the governance, shall distribute them to the other officials and others as shall be opportune; and the same bursars four times in the year, but the other officials and receivers of revenues once and also more frequently, if it shall seem expedient to the said abbot or superior presiding over the governance, shall be bound to render a most full and faithful account before the aforesaid abbot or superior presiding over the governance, and the seniors of the convent of the same monastery or conventional place, of all things received and expended. § 11. Abbots also or superiors presiding over the governance shall render a full and faithful account to the said seniors annually of things received and expended by the bursars. And let the same abbots, or superiors presiding over the governance, receive from the said bursars monies for their expenses. And if, when they shall have gone outside the monasteries or other conventional places of theirs, it should happen that they receive monies from the revenues of the monasteries or conventional places of theirs, or from elsewhere, they shall deliver such monies to the aforesaid bursars upon their return, accounting for whatever of such monies they shall have expended; but abbots or other superiors presiding over the governance, if they shall presume to attempt otherwise, or to retain something else for themselves, shall be suspended from entrance to the Church and from divine offices, after the lapse of two months from the day of such return to be reckoned, for so long until they deliver those things to the aforesaid bursars.

14 § 12. Moreover, because through the office of visitation the life and conduct of those who are visited, their number, office, and conditions are inquired into, and through it the office of correction and reformation ought to be exercised sincerely, and therefore these visitors, according also to canonical sanctions, ought not to be burdened with superfluous expenses, we establish and also ordain that visitors of the said order in some monastery being visited by them, before they begin the office of visitation, unless on the first day on which they shall arrive at it, shall be able to remain; and if they shall wish to stay there, only on the following day shall this be permitted to the same. And that visitations in the same order to be made henceforth shall not last beyond three continuous days, unless apparent necessity or great utility of the monastery visited should require longer days: and that the visitor who shall presume to prolong the same visitations beyond the said two days, or beyond the aforesaid three days, without the aforesaid necessity or utility, if he shall be an abbot, shall be suspended from his stall and place in the chapter of abbatial rank by the very fact for one following year, and shall be bound to sit in a stall and place in the chapter remote from other stalls and abbatial places; but if he shall be a monk, by the very fact he shall be unable for one following year to obtain any office and administration or governance in the same order. And nevertheless for six following months on bread and water in his monastery he shall be bound to fast every sixth day; and that similar penalties shall be incurred by abbots and monks who, in rendering the office of visitation, shall exceed the number of journeys fixed by our predecessor of happy memory, Pope Clement IV, on this matter. Nor shall these visitors presume before such visitation of theirs or in it or after it, on occasion of the said visitation, to receive any suspicious gift through themselves or another, nor shall they permit it to be received by theirs; they may, however, receive the expenses which they shall have made in going to the monastery to be visited and in returning from it, according to the ordinance made on this matter by Clement himself.

16 § 13. But when from a monastery already visited by visitors up to a monastery to be visited there are situated in the way certain monasteries to which the said visitors may conveniently turn aside, they may do so; and the monasteries thus situated ought to receive the same visitors charitably, treat them decently, and provide for them in victuals, and for the days on which they shall turn aside to such monasteries thus situated, as aforesaid, and provision shall have been made for them as aforesaid, they may receive no expenses from the monastery or places visited. But an abbot acting contrary to the aforesaid, unless within two months to be reckoned from such reception he restore what he received to those from whom he received it, those months having elapsed, abbots are to be joined to the visitors for this reason.

17 the mistress of those whose secrets have been made known to them cannot reveal them.

18 he ought to restore. A monk indeed whatever he shall have received contrary to this ought not to delay in restoring, and on account of this shall be subject to regular discipline.

19 § 14. Nor shall the aforesaid visitors dare to join other abbots to themselves in the same visitations, nor shall those other abbots themselves join themselves to them, unless for counsel or aid, where the case of the deposition of some abbot, or another great and difficult matter, or danger to the country or places through which they would have to pass should threaten, or interpretation of languages should be necessary; nevertheless the Cistercian and the four abbots of the four principal daughter houses, who are for the time being, and are named above, in the same visitations may receive with themselves or join to themselves one other abbot, if they wish.

20 § 15. Nor shall the aforesaid visitors presume to reveal the names of those who shall have revealed to them any secrets in the same visitations, unless then indeed, when on account of such revelations it shall be necessary to proceed to the punishment or penalty of someone, and those revealing such things shall be punished more or less, as the quality of the deed shall require, according to the judgment of the general chapter of the order itself.

21 § 16. And that the greater abbots after the Cistercian abbot and four other abbots of the same principal daughter houses, who are for the time being, outside their visitations, six only; but the other lesser abbots shall be content with four journeys; nor on this pretext, those who were accustomed to use fewer, believe that power of more has been granted to them.

22 § 17. Again, wishing to take precaution lest through abbots or monks of the said order, turning aside to other monasteries of the same order, coming to such general chapter, or returning from it, or otherwise, such other monasteries be burdened more than is due, we establish and ordain that abbots or monks aforesaid coming to the same chapter or returning from it, or otherwise, as guests to— Visiting abbots what they may receive.

23 Abbots and monks turning aside to other monasteries, etc., shall not remain in them through which they pass for more than two days.

24 that a monastery or conventional place of the said order already mentioned, turning aside, shall not remain in the same monastery or conventional place or places thereof, beyond the day on which they turned aside there, and the following one, nor beyond the said days; nor shall an abbot or cellarer or any other of the said monastery or conventional place, or of any of the places thereof, presume to invite them or minister anything further to them. But if from any reasonable cause they or any of their household wish to remain longer, they ought to pay the expenses which they shall have incurred there from the goods of their own monastery, or procured from elsewhere. But whoever shall have acted contrary, both those giving and those receiving, shall be punished by the general chapter of the said order for disobedience and transgression of this statute and ordinance of ours. But by the aforesaid no right shall be acquired by those turning aside, even through the said two days or otherwise to any monastery or conventional place of the same order or of their places to turn aside, or to remain in any of them; this however being saved, that concerning those manifestly infirm the customary charity and pious hospitality shall be observed.

25 § 18. Since, moreover, abbots of this kind were instituted for general chapters precisely so that in them careful treatment should be given to the state of monasteries and other places of the order and to the correction and reformation of the order and regular observance, it is recognized to be fitting and proper that all those to whom this pertains should come to them, not having canonical impediment. Wherefore we establish and also ordain that the abbots of this order, who henceforth do not come to the said general chapter (who nevertheless were bound to come, according to the statutes of the aforesaid order, not having legitimate impediment or special license from him who is able to give the same) shall be required to exhibit double what they would have expended in coming to and returning from the same chapter, and such double shall be paid at the following general chapter to be converted to the utility of the same general chapter: and that the definitors of the same general chapter may, by apostolic authority, through ecclesiastical censure, with the obstacle of appeal removed, compel such abbots not coming to pay such double, and their process to be had and sentences to be rendered and published and caused to be published. And that concerning the same double in whole or in part no grace may be made to anyone, nor remission indulged. But that abbots who shall assert that they have legitimate impediment or such license shall be required to set forth those impediments to their convents at the time when they ought to undertake the journey to the said chapter, and nevertheless subsequently concerning the said impediment or license in the same general chapter make proof through their proctor or excuser, a worthy and suitable man, having special mandate to render an oath in the hands of him sending them, that the causes of absence and impediment are true; which oath indeed they shall be bound to render, if it shall seem good to the Abbot of Cîteaux, who is for the time being, and to those presiding over the same general chapter. And if the abbot and the aforesaid presidents shall have judged such impediment and license itself not to be legitimate, such abbots, who came not at all to the same chapter, shall be declared to have incurred the penalty of paying the aforesaid double, as has been set forth above.

26 § 19. Since, moreover, some, as we have learned, in the matter of paying contributions which in the same order are imposed for necessities and common uses, and otherwise customary in the same order for the time being, render themselves difficult and remiss, we have thought it fitting to provide against them and concerning the business of the same contributions and other matters pertaining thereto, as follows: namely that to the Abbot of Cîteaux and the four co-abbots of the principal daughter houses aforesaid and who shall be for the time being and to each of them, by apostolic authority, with the obstacle of appeal removed, through ecclesiastical censure and through other remedies according to the institutes and customs observed of the said order, and other fitting remedies, to compel those to whom the said contributions shall have been imposed for the time being to pay the same; and also to constrain those refusing or neglecting to pay the aforesaid contributions already imposed, and any others presenting impediment publicly or secretly whereby the aforesaid contributions may not be paid, to desist entirely from such impediment, and also processes to be had and excommunication, suspension and interdict, and other sentences to be rendered against such refusing, neglecting and presenting impediment, now and in the future, in their and other monasteries and places neighboring the said order, as shall be fitting and in the general chapter of the same order to be published and caused to be published, we grant by the tenor of these presents full and free power.

27 § 20. We will, however, that the aforesaid contributions be received henceforth by three abbots of the said order, to be appointed for this by the same general chapter, or by the definitors thereof in individual years, who according to the ordinance of the said chapter, or its definitors, for necessities and common uses and otherwise customary in the said order, shall dispense the same; and if anything of the same contributions remain over, let it be placed in some secure monastery chosen for this by the said chapter or by its definitors and under the provision of custody to be exercised by the same three abbots thereupon, under three locks and diversified keys, of which each of the three abbots shall hold his own key, let it be faithfully preserved. The aforesaid three abbots shall indeed be bound in the subsequent general chapter to review the account of what was received and expended by them before the definitors of the same chapter; and that which shall remain, let them restore to the same chapter or to the definitors thereof to be kept, in the manner aforesaid, by other three abbots to be appointed by the same chapter or its definitors, as is aforesaid.

28 § 21. And the aforesaid three abbots, when they shall be appointed to the aforesaid duties, shall take an oath that in receiving, keeping and expending the aforesaid contributions, and in rendering account of the same, they shall conduct themselves faithfully.

29 § 22. Moreover, the aforesaid three abbots, receivers appointed in the manner aforesaid by the general chapter or by the definitors of the same chapter, may, with the counsel of the Abbot of Cîteaux and four co-abbots of the same number of principal daughter houses, commit their duties to certain faithful and discreet persons, year by year, for receiving contributions not paid at the general chapter. These same discreet persons shall solemnly take an oath that they will receive, collect, exact and faithfully keep the aforesaid contributions, and shall bring them intact to the next general chapter to the aforesaid commissioners of the general chapter or its definitors; and the aforesaid three abbots shall render account before the same Abbot of Cîteaux and four co-abbots of the same number of principal daughter houses, if all shall be present, as well as before those definitors whom the aforesaid Cîteaux and four co-abbots shall have decreed to be retained in the division. § 23. We also will that there be made a special seal, by which letters of payment and acknowledgment of the contributions of the aforesaid order shall henceforth be sealed, which seal indeed shall be kept under strict custody with two locks and different keys with the aforesaid three abbots or in some monastery, which shall seem more expedient to them, with some person or persons whom they shall choose or shall have chosen, the aforesaid seal being kept in the manner aforesaid: nevertheless the aforesaid persons, to whom the Abbot of Cîteaux and four co-abbots of the same number of principal daughter houses, by counsel, the aforesaid three abbots, as is aforesaid, shall commit their duties, when they shall have received contributions not paid, may make acknowledgments of particular payments which are made outside the general chapter under their own seals; but those which are made afterwards to them shall be sealed with the aforesaid special seal.

30 § 24. Moreover, the aforesaid matters concerning the ordinance of contributions shall be so exactly and diligently observed in the aforesaid order, that nothing shall be presumed to be done against them by the general chapter or by any other or others whatsoever, under any pretext sought; and if anyone shall presume to attempt otherwise, he shall incur the sentence of excommunication ipso facto.

31 § 25. Namely, wishing to provide more carefully that suitable persons, congruous to the offices themselves, be received for divine worship and other services to be rendered in the aforesaid order, we establish and ordain that henceforth in the same order no one shall be received as monks or lay brothers except suitable persons for those things which befit monks or lay brothers of the aforesaid order, and unless by the abbots of the monasteries or those principally presiding over the governments of other conventional places of the same order and within the monasteries or such places, with the counsel of the seniors of the convent, or the greater and wiser part of that monastery or other conventional place, in which the reception of the aforesaid monks or lay brothers is made. If it be done otherwise, we decree that it shall lack force.

32 § 26. Truly, because honesty, temperance and modesty ought to hold a principal place in all ecclesiastical persons, and especially in regulars diligently dedicated to divine praises, we establish and also ordain that all abbots and those presiding over the governments of other conventional places, and monks of the same order, shall use cloth of brown or white color only, and that they shall not presume to lead a young nobleman or young noblemen clothed or clad in divided garments or

On receiving into the order.

On the habit of abbots and monks:

34 robes, or otherwise sumptuous garments.

35 § 27. And that they shall take care to abstain entirely from curiosity or superfluity in the abundance of silver vessels, coverings of dormitories and any ornaments whatsoever. But those doing otherwise shall be punished by their abbots and by visitors, or by the general chapter of the same order, in such manner that the fear of punishment may be a restraint to others wishing thus to exceed.

36 § 28. And that the abbots of monasteries and those presiding over the governments of other conventional places of the said order, excepting the Abbot of Cîteaux and the four co-abbots of the same number of principal daughter houses aforesaid, who are and shall be for the time being, shall not presume to lead more than one secular cleric or lay person riding.

37 § 29. Since it is fitting that persons dedicated to regular observance, especially in the matter of abstinence, should refrain from the eating of forbidden meats both from love of virtue and from fear of punishment, lest they descend into the slippery path of unchastity, we firmly prohibit by the authority of these presents that henceforth abbots and monks of the said order, outside monasteries or conventional places of the same order, and even the monks themselves within monasteries or such places, or in cells and outside the common infirmary, shall presume to eat meat or dishes prepared or cooked with meat, contrary to the observance of the said order long observed. For we entirely revoke the licenses which some abbots and monks of the said order claim to have from the Apostolic See concerning the eating of meat, since such licenses result in the scandal of others. A monk or lay brother, however, who shall be a transgressor of this our prohibition, shall fast for three days on bread and water for each eating of meat or of the said dishes, and nevertheless on each of those days shall receive regular discipline in chapter. But an abbot is prohibited, and all who are transgressors of the aforesaid prohibition are bound not to the discipline itself, but to such fasting, and if he knowingly or negligently omit to have this observed, he is also bound by such fasting as aforesaid, which penalties can be remitted to no one, nor can any dispensation be granted concerning them or any part thereof. But if any shall be found frequently offending concerning the eating of meat or the aforesaid dishes, or frequently eating the same contrary to this ordinance, and, canonically admonished by their own abbots that they abstain from such things, do not cease, they shall be, after such admonition, for two years ipso facto incapable of obtaining any offices and administrations in the same order; and those holding them shall be removed, if it shall seem good to their abbots, from what they hold. We also prohibit that no monk or lay brother of the said order of whatever condition, even if he hold office, unless he be detained by grave illness or weakness, shall presume to eat meat henceforth in a cell in the infirmary; but all shall eat in the common refectory of the infirmary appointed for that purpose. § 30. Nor shall meat be prepared or cooked there except in the common infirmary or in the kitchen appointed for the same infirmary or to be appointed in the future, unless the abbot, for some reasonable cause, shall order the same to be cooked or prepared elsewhere, or in his absence, he to whom the said abbot shall have committed his authority. Wherever meat shall be prepared for others than for the sick or weak, let it be divided among those eating in the infirmary by the infirmarian.

38 § 31. To abbots of merit, however, who have ceased or shall cease in the future of their own will, a place and the eating of meat may be granted by their own abbot according to the discretion of his judgment. And each abbot of the said order by indulgence may sometimes call to him some of the brothers, now these and now those, as necessity shall have demanded, 1

Let monks sleep in the common dormitory.

BENEDICT XII, POPE.

39 to call them, and to have them with him in his chamber better and more fully provided for. Abbots, however, and other notable persons of the same order coming to monasteries, with the permission of the abbot or, in his absence, of the superior governing the same monastery, may use meat in the chamber of the abbot himself or in the common infirmary.

40 § 32. And since some monks of the said order in certain monasteries and studies presume rashly to claim for themselves that on certain days each week according to observances or customs or statutes which they allege concerning this, which are nevertheless less reasonable, meat ought to be ministered to them; we, entirely reprobating such abuse, observances, customs or statutes of this kind, as tending to the reproach of their religion and to the example and harm of others, by authority ordain the same, that no abbot, provisor, prior, cellarer or other henceforth presume to observe these in any way, nor even permit them to be observed, or to minister or cause to be ministered meat to any of the said order on account of the aforesaid observances, customs or statutes, except in other lawful and permitted cases.

41 § 33. Since according to both canonical and regular institutes, all monks ought to sleep in one place, and under the pretext of separate chambers, which in some monasteries outside the infirmaries on account of cells constructed in the dormitories, many improprieties and dissolutions have been introduced; we, wishing to provide more expressly and beneficially concerning these matters, decree and ordain that henceforth no one of the monks shall dare to lie in chambers, unless solely on account of bodily infirmity (and then in the chambers of the infirmary only), but all shall lie in the dormitory, unless perhaps someone be excused from this on account of office; and then he may lie elsewhere, if he cannot conveniently lie in the dormitory otherwise.

42 § 34. To this also decreeing and ordaining we add that henceforth cells in the dormitory shall in no way be constructed, and if any have already been constructed, they shall be entirely destroyed by the abbots or principal prelates of their own within three months from the time when this statute and ordinance shall have reached them, and if they neglect or are unable to do so, by the visitors, in the first visitation which they shall conduct, by apostolic authority they shall be destroyed; and that those resisting the same or presenting any impediment or procuring impediment to be presented and giving aid, counsel or favour to this, publicly or secretly, shall incur the sentence of excommunication by that very fact. From which sentence they cannot be absolved except by the aforesaid visitors, whom also the visitors themselves may coerce by other remedies of law and of the statutes of the same order. The cloister priors and superiors, however, may have a cell within the dormitory suitable according to the discretion of the abbot or principal prelate. The said visitors, what they shall find or do concerning these matters, shall report fully and faithfully in the subsequent general chapter of the order itself.

43 § 35. Since indeed in some monasteries of the order it is said to be observed abusively, that each monk receives a certain portion of grain, bread, wine or money, we, utterly detesting and also abolishing such abuse, and wishing to provide beneficially in this part, by the aforesaid authority firmly prohibit that henceforth in no monastery of the order itself such portions be made. But let there be ministered to each, as the community of the order itself has observed hitherto and observes.

44 § 36. Adding and also prohibiting that no monk shall henceforth be granted or assigned any certain revenue or income or part of revenues or incomes or any pension for sustenance or clothing or from any other cause, or that any be permitted to be granted or given to any or to several monks by outsiders; but let them be converted to the utility of the monasteries themselves by their own abbots.

45 § 37. And that among the abbots and the convent or officials of any monastery of the said order, there be in no way a division of goods and fruits, revenues or incomes, but let them be assigned to their common uses. For we revoke entirely the concessions or assignments made to the same monks of the said revenues or incomes or their part or any pension, and the divisions of goods or discretions of fruits, revenues or incomes of this kind, if any have been made. The abbots indeed, who henceforth shall make the aforesaid portions or divisions or divisions of such goods and other of their aforesaid monasteries or shall permit them to be made, or shall permit those made hitherto to be observed, shall be deposed. The monks, however, who shall resist the aforesaid or shall present impediment by themselves or another or shall procure impediment to be presented, shall be committed to prison for such time as shall seem expedient to the abbot or other principal prelate of theirs; and if they shall also contradict the abbot or the same principal prelate in this, they shall be committed to perpetual prison. To the abbots indeed well-deserving, who shall have voluntarily ceded or shall cede in the future, sufficient and suitable provision, as shall seem fit to the abbot and to the successor of the ceding abbot, by the counsel of the seniors of the convent of that monastery whose governance he ceded or shall cede, shall be assigned and also provided.

46 § 38. And that all occasion of wandering about and useless expenditure be removed, by the same authority we prohibit that anyone, a monk or lay brother of the said order of whatever status or condition he may be, shall presume to keep horses, the cellarers, procurators and granary stewards alone excepted, to whom the abbot may grant this of one only, if he shall see it expedient. To the cellarers of the Cistercians and of the other four orders, however, horses are not to be denied.

47 of the same principal daughter houses aforesaid, two may be granted riding allowances, if it shall seem good to their abbots. § 39. Although indeed against monks owning property, except administrators, it is fully provided by canonical sanctions, since the renunciation of property is annexed to the monastic rule; we nevertheless, wishing to provide more specially against those monks and lay brothers of the said order, who, forgetful of their own salvation, contrary to regular institution, have purchased or caused to be purchased and do purchase with money gathered together, rights, possessions, revenues, pensions, animals and other goods, sometimes in their own name and often in the name of another, with many fabrications employed thereupon, and entrust these same animals to others to be nourished, and to be returned to them or to another with increase or profit in their name or for them, and exercise many other contracts as merchants; and likewise, calling foul gains and pursuing hidden peculium, conceal and unlawfully retain it to the peril of their souls, by the authority aforesaid we decree that all the aforesaid matters, which however are not otherwise subject to restitution to others, shall be applied by their own abbots to their own monasteries, and shall be wholly converted to the utility of those monasteries themselves. And that those same abbots may not grant to any monk or lay brother license to do such things, and that the said monks and lay brothers committing the aforesaid or in any way resisting or impeding such application or conversion publicly or secretly or procuring impediment to be offered, and not revealing and rendering the aforesaid peculium to the aforesaid abbots, shall by that very fact be incapable of obtaining any office, administration, governance and rule whatsoever in the same order: we permit however that with those monks and lay brothers their abbot may dispense concerning these penalties, when they shall have revealed the aforesaid and fully made restitution, when it shall seem expedient to him. To monks and lay brothers also having administrations, to each one to be supplied:

48 the number of monks shall be according to the resources of the monastery.

49 Concerning Places of Study.

50 BENEDICT XII P.P.

51 to those borrowing monies or feigning debts which they ought not, such penalty shall be imposed by their own abbots as shall be to them for the profit of salutary correction, and to others wishing to attempt similar things as an example.

52 § 40. And because through prudent ministers administrations of goods are accustomed to be exercised fruitfully and laudably, we will that the abbots of the monasteries of the same order thus dispense the goods of their monasteries and provide such things, that monks and lay brothers both healthy and infirm be sufficiently provided in food and clothing according to the resources and qualities of each monastery and of each region.

53 § 41. And that in the aforesaid monasteries no more monks or lay brothers be placed than can be suitably provided for from the resources of the said monasteries.

54 § 42. Intending indeed to provide matter, that in the same order through the study of sacred theology professors thereof be instructed and illuminated in it, so that in the Church of God to themselves and to others they may produce the fruits of salvation, favor, honor and honesty, the heavenly Husbandman irrigating and multiplying, mature deliberation having been had, subscribed concerning the aforesaid and otherwise liberal study, for advanced scholars, and doctors, and other things which concerning these we perceived to be reasonable and opportune, by the authority aforesaid we have established, ordained and disposed, for the present and future time to be valid, perpetually and inviolably to be observed: namely that the general Studies of the said order in sacred Scripture shall henceforth be at Paris, Exeter, Toulouse and at Montpellier in the diocese of Maguelone. The Study moreover which at Stella in the diocese of Pamplona was accustomed to be, we transfer to Salamanca on account of the proximity of the Study of Toulouse: ordaining that at Bononia a Study be made when it can conveniently be done and a house for students be provided, (1) or be purchased. And let that same be done at Salamanca. Let there also be at Metz a particular Study (1) A word is missing. in the primitive sciences, where also a house for the Germans through the generation of the aforesaid monastery of Morimond be purchased, as far as that generation itself extends in Germany. And that to the houses of those who shall study at Bononia and Salamanca, those abbots or rectors of them preside, concerning whom it shall be ordained through the general chapter of the order itself.

§ 45. Concerning these provinces, namely:

55 Quiet as to the Studies, namely of Vienna, Lorraine, Liège, Arles, Aix, Narbonne, Bourges, Auxerre, Tarragona, Zaragoza, Bordeaux and Toulouse, to the aforesaid Toulouse and Montpellier Studies are sent. Those who were accustomed to be sent to Stella are to be directed to Salamanca, except those from the kingdom of Navarre, who are sent to the same Study of Toulouse. But Germans are to be directed to the Study of Metz for the aforesaid primitive sciences, to which indeed Metz Study no one from the generation of Clairvaux is sent unwillingly. Italians to Bologna and English, Scots, Welsh and Irish to Exeter are to be sent. But to the Study of Paris, which is preeminent among the rest and the fountain of all studies, are sent indiscriminately from every nation or generation, according to the manner noted below, namely that abbots send those monks whom they shall have to send to the said Studies, to them by the counsel of the father abbot or visitor and their own convent or the wiser part of the same convent. Yet so that those who are sent are more docile and suitable, and disposed to make progress, and that they are sent at such a time that on the first day of the month of October, or thereabouts, they exist in the Study of Paris, and in the other Studies on the feast of St. Luke or All Saints they are without fail present.

§ 44. The number moreover of those to be sent

56 Which seems to suffice, as follows: the burdens of the said order being considered, and the quality of the times, namely from each monastery of each province or generation, in which there are, or will be, or shall be

57 Provisions for students forty monks or more, to Paris two at least must be sent. From each monastery moreover, in which there are, or shall be able to be thirty monks and more, up to forty monks exclusive, to the same Study of Paris one must be sent. And from each monastery in which there will be or shall be able to be eighteen monks and more, up to thirty monks exclusive, to other general Studies, or to Paris, if those sending shall prefer, one monk similarly must be assigned. To the Metz Study moreover, when it shall have been established, from each monastery of the generation of the said monastery of Morimundus, insofar as that generation extends itself into Germany and beyond the Rhine, in which there will be or shall be able to be eighteen monks inclusive up to thirty monks exclusive, one at least is to be sent for the primitive sciences. For which, provided that those sending send to another, they are not to be compelled to assign to others.

§ 45. The provision moreover of students

58 We limit in this manner, and we perceive to be sufficient, namely that the master regent of Paris from the common contribution of the said order, or from common revenues eighty pounds of small Tours currency, and from his own monastery twenty-five pounds of the same money, for his burse and other necessities: a bachelor moreover regent at Paris, from the said common twenty-five, and from his own monastery another twenty-five, for his burse and other necessities: and a reader of the Bible in the same Study from the aforesaid common ten, and from his own monastery twenty pounds of the same money receive annually: each moreover of the scholars studying in the same Study, twenty pounds of the said money from his own monastery for his burse and other necessities receive similarly annually. But in the other Studies the abbots of those Studies, rectors, to the master in the theological faculty reigning in those, from forty pounds of the aforesaid money for his burse and other necessities are bound to provide in each year. When moreover a bachelor in the same Studies shall reign, where a master cannot conveniently be found, the said abbots are bound to provide the said bachelor from thirty pounds of the aforesaid money for his burse and all necessities in each year.

§ 46. We ordain moreover that in each general one of the aforesaid Studies, who reads the Bible biblically or textually continuously, exist, to whom beyond fifteen pounds of the already said money, which he receive from his own monastery for his burse, one hundred shillings of the same money for all his other necessities annually from the cellarer of the burses of scholars are to be given. Each moreover scholar in the said other general Studies besides the Study of Paris, and in the said Study of Metz fifteen pounds of the aforesaid money from his own monastery for his burse and all his necessities receive annually. Provided indeed that all such provisions both the abbots of the said Studies, rectors, and the abbots proper, as it shall happen to each of them or be able to touch them, are bound to send to the said Studies at their expense, and to pay those there, at the terms designated above, at which those to be sent ought to be in the Studies mentioned.

§ 47. Moreover, the cellarer and others managing the expenses of the aforesaid Studies shall be bound to take an oath that they will faithfully dispense all things which they receive from the provisions of the Studies themselves and of the students, and they shall also be required to render an account of receipts and expenses at the end of each month, in the presence of the master or lecturer of the aforesaid Studies, the bachelor, and the provisor, as well as seven other discreet scholars, whom the said provisor, master and bachelor shall have decided to summon for this purpose.

§ 48. And so that the abbots themselves, who are bound to send students as is expressed above, may exercise diligence and cast off negligence in these matters, we will and ordain that an abbot who, according to the aforesaid ter-

59 Biblical Lecture be in any general Study. Studies and managing expenses shall ensure that Abbots ceasing to send students with the aforesaid provisions shall incur the penalty of monks or a monk in the manner aforesaid, has not sent with the provisions aforesaid, shall be bound, the month having elapsed, to send double such provisions at his own expense to the aforesaid Study. Of which double, one half shall be applied to the student for whom they ought to have been sent, for the purchase of books, and the other half shall be converted to the common uses of the other students by the cellarer. And if the said abbot shall not send the aforesaid double, as is aforesaid, within six months immediately following the said terms, it shall be to him, those six months having elapsed, an interdict of entry into the Church, and the aforesaid abbots of the same Studies and rectors of the Studies shall incur the said penalties, who have not sent within the said terms and have not paid the aforesaid provisions, as is described above. But if the aforesaid penalties of this kind they shall pertinaciously endure for three months, the said six immediately following, they shall by that very fact be suspended from divine offices.

§ 49.

60 And so that the care of souls may not be lacking to the same students, we will and ordain that in the same general Studies the abbots, rectors of the Studies themselves, shall appoint suitable provisors, who shall have care of the souls of the students in the same, and who shall correct and absolve them, just as their own abbots can correct and absolve subjects in their own monasteries: nevertheless, on account of this, the said students shall not be exempt in any way from the power of their own abbot.

§ 50.

61 But where there shall be someone of the order assigned in the Parisian Study, who is of the order of Cistercians, of praiseworthy life, and otherwise suitable and discreet, and disposed to the baccalaureate or to the mastership in theology, the abbot of Cistercians, who is for this purpose, with the counsel of the masters, bachelors and provisors of the house of students at Paris, shall mandate to the proper abbot that he not recall such a one, but permit him to proceed in such learning, and to be advanced to the status of baccalaureate and to the honour of mastership, and to continue his lectures, as the general chapter of the order shall ordain; nevertheless, the general chapter can, with a deficiency of masters or bachelors in theology, appoint such a one even before the baccalaureate or mastership in any of the aforesaid general Studies as principal rector, as it shall seem expedient to the same general chapter.

§ 51.

62 In favour indeed of the study of the same theology, so that it may be attended more fervently by the students of the same order, we establish, ordain and expressly prohibit that in none of the aforesaid Studies shall canon law be read or heard, nor even outside it, by any of the students of the same; and if anyone shall presume to act contrary to this, he shall by that very fact be recalled from such a Study to his own cloister. Nor shall the cellarer of the aforesaid Studies from then on provide for him in any way, but he shall immediately be sent back to his own monastery, and for this transgression and disobedience shall be punished according to the discretion of his own abbot.

§ 52.

63 And so that in the said Studies the necessary services for the students in them may not be lacking, we will and ordain that the aforesaid abbots, rectors of the Studies themselves, shall provide in them with suitable cellars and other officials, as the necessity or utility of each of the Studies themselves shall require. And that the same cellars and officials shall take an oath of faithful dispensing, and of rendering an account of receipts and expenses, in the manner as is expressed above.

§ 55.

64 And because it is fitting and expedient that among the other Studies the Parisian Study may flourish, and be maintained with continuous and uninterrupted support, we establish and ordain that in the same Parisian Study there be appointed masters, bachelors, lecturers of the Bible, and provisors, cellars and officials of the aforesaid order by the general chapter. But if they or any of them should fail, or for any reason the masters, bachelors and lecturers should not assume or continue their lectures, or the cellars and officials aforesaid of the Study of the order should not hear the laws of the same.

65 Officials suitable for the service of the students shall be appointed.

66 That rectors and officials in the Parisian and other Studies be elected and by whom. If they are unable to exercise their offices, others shall be substituted in their place by the visitor of that year, until the next general chapter only. In the other general Studies also, the masters or principal lecturers shall be appointed by the said general chapter. But the other lesser rectors and officials ought to be appointed by the abbots of the same Studies as rectors. For the greater favor and lasting continuation of this Study of theology already mentioned, we establish and ordain that, inasmuch as for the said general Studies, besides the Bononian, Salamantine and Metensian Studies, suitable masters in theology of the aforesaid order can be found in the same Parisian Study, or if not there, elsewhere, the same general chapter shall be bound to appoint a principal master in theology as lecturer, or otherwise the most suitable bachelor, whom they can find at Paris, or if not there, elsewhere, whom the said general chapter shall be able to compel to undertake and continue this lecturing, if necessary, by ecclesiastical censure and other appropriate remedies, with the obstacle of appeal removed, and also by apostolic authority, and to this said chapter and its definitors, as well as to the abbots of the said Studies as rectors, we grant in common or severally by the tenor of these presents full and free power. Moreover, to the aforesaid general chapter we grant similar power to compel, with appeal removed, by censure and such remedies, the abbots of the same Studies as rectors to receive masters in theology and bachelors for the aforesaid lecturing and to provide them from the common contribution of the order itself and for the burse and other necessities, in each year, as has been limited above concerning such provisions. But these masters themselves shall not presume to remain pompously or live luxuriously in the aforesaid Studies, but shall read humbly and devoutly, shall partake of suitable food, and shall be content with one single clerical servant. In the Metensian Study, however, let the abbot of the aforesaid monastery of Morimond, who is and who shall be for the time being, provide for the lecturers and other officials of the house of students, by the counsel of his convent, or of the greater and wiser part of the same, as shall seem expedient to him.

§ 54.

67 And since it is unbecoming and dishonorable that anyone, especially a religious, should ascend the chair of the eminence of the magisterial office with vain pomp and lack of skill, we establish and ordain that henceforth no one of the aforesaid order shall be admitted to receive the honor of mastership or doctorate, unless he shall first have taken an oath before the provisor and the students of that order then present in the Study in which he shall wish to receive such honor, or before the greater part in number of the same, that in the assumption of such honor or before or after on the occasion thereof, concerning food, clothing or other things he shall not expend through himself or through another from wherever he shall have had or shall be given to him; nor, so far as in him lies, shall he permit more than the value of a thousand Tours pounds of silver to be expended by his relatives or friends. Bachelors also shall be bound to swear similarly before the aforesaid, that on the occasion of their bachelorhood or before or after, they shall not make any feast or banquet through themselves or another, or permit it to be made, so far as in them lies, by any of their relatives or friends.

§ 55.

68 Finally, we establish and ordain that whoever of the said order, who nevertheless shall have studied in the same Parisian Study or in some other of the aforesaid general Studies of the order for six years in theology, and shall have been suitable for this, in the said Parisian Study may undertake courses in the Bible, and whoever shall have studied for eight years, as aforesaid, may read the Sentences in the aforesaid Parisian Study.

§ 56.

69 Notwithstanding any statutes and customs and observances of the order of the monasteries, places and convents and Studies so often mentioned, contrary to these, oaths, apostolic confirmations or any other securities strengthened thereby, and especially that statute by which in the same Parisian Study it is said to be provided that no one can read a course in the Bible unless he shall have studied there for seven years, and that it is not permitted to read the Sentences unless he shall also have studied there for ten years, as is thus or otherwise said to be contained in the statutes of the Parisian Study itself: as well as any privileges, indulgences and apostolic letters granted to the order, monasteries, places and convents and Studies aforesaid, or to the universities of masters and scholars of the same, to the contrary, by which these presents not being expressly mentioned or wholly inserted, the effect of these statutes and ordinances of ours and of all and each of the things contained in the same presents might be hindered in any way, and of which and of all the whole tenors it shall be necessary that full and express mention be made in our letters.

§ 57.

70 Lest, however, the aforesaid matters or any, whatever they may be, or anything of the same kind be brought into the oblivion of forgetfulness or be held of little account by anyone, but rather so that concerning these matters now and in other times to come, and even once in perpetual future times, certain knowledge and memory may be held, by the same authority we establish, ordain and strictly enjoin that in the first general chapter of the said order and thereafter each year, in the same general chapter and once in every year in any of the monasteries and conventional places of the aforesaid order, all the monks thereof gathered together in chapter for this purpose specially, all and singular of the aforesaid matters shall be read word for word and also published. To no one therefore, etc. If anyone, however, etc.
