11 Statuendo inoltre e decernendo, ecc.
17 Contro i detti delinquenti.
18 Errori ecc.

A. VI. BENEDICT XIV POPE, to those who might attempt to introduce it in this manner; Venerable Brethren, greetings and Apostolic Blessing.
3 The supreme solicitude of all Churches, which is the Divine charity of Christ, the Prince of all Pastors, whose office We, though unworthy, discharge, constantly urges Us to watch vigilantly over the care of the universal flock of the Lord committed to Us, and to meet opportunely, as far as We are able with the Lord, the perils of souls, should they perchance threaten, throughout all peoples and nations of the Christian world, and to provide with particular zeal and apostolic care of charity and foresight especially to those kingdoms and places in which Faith, Religion, and Piety flourish most greatly; since the cunning enemy of mankind, despairing of open warfare against the Faithful, employs frauds and stratagems, transforming himself, as it were, into an angel of light, and employing a deceptive appearance by which he often brings about no less damage to souls than from manifest aggression, which We justly detest and condemn. We number among these frauds a matter which has come to Our knowledge not without great sorrow of Our heart, that in the flourishing kingdoms of Portugal and the Algarves, and in the dioceses over which you, Bishops, preside with the commendation of your sacerdotal virtue, and to which, on account of your singular devotion toward the Catholic Church and this Apostolic Holy See, praise is justly due, there has recently occurred: For it has reached Our ears not long ago that some confessors of those regions, under the appearance of zeal but deviating far from zeal according to knowledge, have begun to introduce a perverse and pernicious practice in hearing the confessions of Christ's faithful and in administering the most salutary Sacrament of Penance, namely that if by chance penitents had fallen into a sin having an accomplice, they would openly demand from those same penitents the name of such accomplice or partner in crime, and compel them to reveal it;
4 and what is more detestable, they would also compel them, by denying sacramental absolution, to denounce and reveal such accomplice, and would even demand that they designate not only the name of the accomplice but also the place of his dwelling. These confessors indeed attempted to palliate this intolerable imprudence both under the specious pretext of procuring the correction of the accomplice and collecting other goods, and did not hesitate to defend it with certain opinions of Doctors, which in reality, either by following opinions that are false and erroneous, or by wrongly applying those that are true and sound, could not but produce

6 effects. And for this reason, objections, scandals, and not only hatred of the ministers but also of the sacred ministry itself, and great disturbance of souls in the faithful people have arisen. When We received these sad tidings and heard them, We were moved at once by righteous indignation against this pernicious abuse, and We learned that Our beloved sons, the Cardinals of the Holy Roman Church, Nuno da Cunha, Inquisitor General in the kingdoms of Portugal and the Algarves, and Thomas of Almeida, Patriarch of Lisbon, had labored diligently to check and eradicate this growing evil. But We, lest Our Apostolic Ministry appear to be lacking in any respect in so grave a peril of souls, and lest Our mind on this matter be obscure and ambiguous to you, wish it to be known to you that the aforementioned practice is to be entirely reprobated, and is reprobated and condemned by Us through these present Letters in the form of a Brief, as scandalous and pernicious, injurious both to the salvation of neighbors and to the Sacrament itself, and tending toward the violation of the sacred seal of the sacrament, and
7 YEAR 56 worthy to be alienated from the profitable and necessary use of the Sacrament of Penance by the faithful. For this reason, Venerable Brethren, We exhort your diligence against it:
8 Brethren, although we do not doubt concerning your pastoral vigilance, yet we deem it to be also the duty of Our Office to signify to you by this Our open declaration your alacrity. The Apostles, urged on by Our exhortations, may apply themselves more earnestly, so that each one of you may employ whatever prudence shall suggest, with fitting reasons and more efficacious remedies, which remedies of law, insofar as it shall be necessary, being applied against delinquent Ministers, may suppress this harmful novelty springing up, and may not permit that an obstacle be prepared for your sheep where salvation is placed by Christ, and from which the fountain of divine mercy may be turned away and deterred, to whom by the same Redeemer Our Lord you are invited most lovingly to wash and whiten souls in His blood. Therefore, while we promise ourselves from your zeal and prudence more brilliant proofs of your piety and observance, We confirm to you the Apostolic Blessing joined with the most abundant abundance of heavenly charisms. Venerable Brethren, we impart this from our soul. We will, moreover, that by transcripts or copies of these presents, even printed, subscribed by the hand of some public Notary and furnished with the Seal of a Person in Ecclesiastical Dignity, the same faith be given everywhere as would be given to these presents, and could be given if they were exhibited or shown.
9 Given at Rome at St. Mary Major under the Fisherman's Ring on the 7th day of the month of June in the year 1747, in the fifth year of Our Pontificate:
10 Cajetan Amatus. — We moreover confirm and strengthen these Letters, which were then given in the form of a Brief, by these Our present Letters, and we enjoin and command that they be faithfully and exactly observed by all and each one.
11 Establishing moreover and decreeing, etc.
12 That whosoever, of whatever state, grade, condition, dignity and order, even with special and individual mention, to the effect that these Our present Letters may comprehend them in mention and expression, shall presume hereafter to teach that such a practice is licit, as it is set forth and reprobated in Our aforesaid Brief; or shall presume to write or speak in defense of the same condemned practice; or to impugn those things which in the said Brief are decreed against the same practice, or rashly to distort or interpret them into other senses; shall incur by the very fact excommunication, from which he cannot, except in the article of death, be absolved by another, however much shining in dignity or supported by authority, unless by Us or by the Roman Pontiff existing for the time being. And because it is not enough to provide for this:
13 that those things which are decreed by Us in the aforesaid Letters be safe and immune from all impugnation, contradiction and perverse interpretation; and truly that no one in the administration of the Sacrament of Penance ever recede from their observance; therefore to all and each of the Confessors of both the Secular and Regular Clergy, however much exempt, and with whatever special and express mention otherwise perhaps to be named; we gravely and strictly, by the divine threatening of judgment and in virtue of holy obedience, prohibit; that, in conformity with the aforesaid reprobated practice, penitents who confess a sin or
14 And penalties for those teaching the opposite, contradicting, badly interpreting.
15 tes.
16 And in Confessors acting contrary, some crime, of which they have an accomplice or accomplices, themselves in the Tribunal of Penance confess, presume to interrogate concerning the name of the accomplice or accomplices; the place of habitation; or other such adjuncts or circumstances; concerning the more individual expression and manifestation of the same accomplice; to the same penitent, if he refuse to make it known, denying sacramental absolution: otherwise let them know that they, beyond the incurrence of mortal sin, are subject to suspension from the office of hearing confessions and other penalties to be proceeded with.
17 Against the said delinquents.
18 Errors, etc.
19 and also to graver penalties shall be subjected.
20 Furthermore, since we judge it necessary to establish against such a condemned and pernicious abuse, lest it take root with the destruction of souls, also the manner and form of proceeding in the external forum and of imposing avenging penalties against the guilty; and to ordain and decree all dissensions arising or even already arisen over this matter; and we wish to cut away completely both those teaching and those contradicting, as well as confessors—we declare that those teaching, as above, that the praxis already reprobated by us is licit, or writing or speaking in defense of the same praxis, or impugning or perversely interpreting the reprobation of the same contained in our aforesaid Brief, shall be severely punished in the Office of the Holy Inquisition of the aforesaid Kingdoms and Dominions; and against some specific mention shall be made; the Inquisitors of the aforesaid Kingdoms and Dominions, with power delivered to us and, insofar as need be, newly granted by the tenor of these presents, as in matters of Faith, according to the form of the Sacred Canons, and also the constitutions, privileges, customs, and decrees of the Holy Office of Inquisition itself, shall diligently inquire and proceed; and those whom they shall find culpable in any of such excesses, against them, according to the quality of the crimes and circumstances, they shall decree suspension from office, hearing confessions, or even from the execution of Orders; privation of Benefices, Dignities, and perpetual incapacity for the same, as well as active and passive voice, if they shall be Regulars; and other penalties; all also, or only some of them, perpetual or for a time, let them be deprived in the same Office. Whoever truly denounces any other person of having in any way offended according to the aforesaid modes, no less, and against any one of the aforesaid modes having delinquished, there let them proceed as is customary there, who assert, hand down, uphold opinions scandalous, pernicious, and as such rejected and condemned by the Apostolic See.
21 Similarly in the same Office proceeding shall be made, and We will and decree that proceeding be made against Confessors also, as above, offending, and interrogating the penitent concerning the name of an accomplice, and denying absolution to the same penitent unless he manifest it to himself: Provided, however, that such interrogating and denying act be joined and clothed with such circumstances as render the Confessor so acting suspect of adhesion to the aforesaid reprobated practice, as to a licit one, or in any other way of depraved credulity. Therefore against all and each of the aforementioned Delinquents, both secular and of any kind whatsoever exempt, and to the Apostolic See: shall have become known; him, within the term of days customarily fixed in the Edicts of the Holy Office of such Inquisition, they shall be bound to denounce to the same Holy Office: otherwise they shall incur the penalties customarily inflicted by the same Edicts against those not denouncing. Nevertheless, from such burden of denouncing We will and do exempt for just causes; and We exempt the person of the penitent himself only in his own cause, that is in the case that, confessing his sin, he is compelled by the Confessor to manifest to him the name of the accomplice in the same sin: then indeed We free the penitent from the obligation of denouncing the same Confessor. But when from elsewhere than from his own confession, as has been said, he shall have known that the Confessor has offended in any of the ways enumerated above and to be denounced to the Holy Office, then he himself also shall be bound to denounce him from this knowledge obtained from elsewhere. [[fn:Confessors indeed]] If Confessors interrogating wrongly concerning the name of an accomplice, denying absolution, and denying the same; unless it be revealed to him: the judgment and action; even if such action should befall those adorned with eminence before the Ordinaries, or any privilege whatsoever; and whose special and notable [[fn:subjects of the Orders, Institutes, Societies, and Congregations of Regulars, of whatever dignity; and the rule decrees, and with statutes being abrogated—
22 ANNO
23 These procedures to be observed. And otherwise than heretofore, however, some; and a bare act shall have been, that is destitute of those circumstances; which from depraved cruelty; or from evil adhesion to the practice in the often-mentioned Our Brief reprobated, as to a licit one, render the same Confessor suspect; then such a delinquency of this kind; shall be subject neither to the burden of denunciation; nor to the cognition of the aforesaid Holy Office; but to know of it, and to animate against the offending Confessor by suspension from hearing confessions, or other canonical and legitimate penalties according to the manner of the delinquency; shall belong entirely to the Ordinaries of the places in each one's Diocese.
24 Concerning these matters therefore, and the manner of proceeding against such delinquents, as aforesaid, having been constituted; and to each Ecclesiastical Judge having been assigned and distributed his rights; We will that this rule be henceforth observed and kept by Us; and We command it; if at any time such crimes should happen to be discovered; which nevertheless We trust in the Lord will never hereafter occur, with the addition moreover of the illustrious and renowned observance of the entire Portuguese Nation toward the Apostolic See; and obedience, as well as the outstanding vigilance both of this Holy Office of the Inquisition, and of the Ordinaries of each place, which will never be lacking. Wherefore whatever otherwise than as We have decreed and constituted in these Our letters, whether in the Edicts of the aforesaid Office of the Inquisition; or in whatsoever mandates of any Ordinaries whatsoever, or Pastoral Letters, or Decrees, have heretofore been issued; these We, since after this Apostolic norm of proceeding or judging proposed by Us they shall be deemed less necessary, do now define and cease, and, as if they had never been issued, lose all binding force; by Our own motion, and from certain knowledge, by the fullness of Apostolic power We declare, establish, and enact.
25 OF BENEDICT XIV, that whosoever, of whatever state, rank, order, pre-eminence, and dignity they may be, or otherwise worthy of special and individual mention and expression, having an interest in the foregoing matters or claiming to have any interest whatsoever, if they have not consented to these things, nor having been called, cited, and heard, and if the causes on account of which both the foregoing and the present matters have been issued have not been sufficiently adduced, verified, and justified, or from any other cause whatsoever, even privileged, under color, pretext, and head of subreptiousness or obreption, or the vice of nullity, or of our intention or the consent of those having an interest, or any other defect whatsoever, may be noted, impugned, or called into question; but these present letters themselves, and the same in the form of Brief Letters, are valid, and efficacious, and shall be, and shall obtain their full and complete effects, and shall be observed exactly and inviolably by all and each of those to whom it pertains, or shall pertain in time. Thus and not otherwise shall it be held, and thus by any Judges Ordinary and Delegate, even Cardinals of the Holy Roman Church, and Inquisitors General against heretical depravity, Legates also of the Apostolic See, and Nuncios of the Apostolic See, and any others whatsoever exercising any authority, power, and pre-eminence, and who shall exercise it, the faculty of judging and interpreting otherwise being removed from them and from each of them, it ought to be judged and defined, and if anything contrary to these things should be knowingly or ignorantly attempted, it shall be null and void. Notwithstanding any Derogations, Constitutions and Ordinances, whether Universal or Provincial, or Synodal, Edicts also of the aforesaid Office of Inquisition, and of any Ordinaries whatsoever, even Bishops, and Metropolitans, Mandates, Pastoral Letters, or Decrees; nor the statutes, privileges, indults, and Apostolic Letters of the same Office, and of any Churches whatsoever, even Episcopal and Metropolitan, and of any Orders, Congregations, Religions, and Institutes whatsoever, even of the Society of Jesus, or any others whatsoever, even those confirmed by oath, Apostolic confirmation, or any other firmness, uses, and customs, privileges also, indults, and Apostolic Letters granted to the same Office of Inquisition, and to its Inquisitors, Commissaries, and other Officials, and also to Churches, their Prelates, Orders, Congregations, Institutes, Societies, their Superiors, and any persons whatsoever, under any forms and tenors of words, and with any even most efficacious and unusual derogatory clauses and decrees, even by Motu Proprio and the fullness of Apostolic power similar, or granted, confirmed, and renewed in any way contrary to the foregoing at the instance of any persons whatsoever, even those shining with Royal or any other worldly or ecclesiastical power, or otherwise in any manner whatsoever. All and each of which, even if for their sufficient derogation special and individual mention of them and their entire tenors, word for word, and not through general clauses, and any other expression, or any other exquisite form to be observed for this were required, we hold the aforesaid tenors as sufficiently and word for word expressed and inserted, and this form as fully and exactly observed for the effect of the foregoing, this time only specially and expressly we derogate.
26 We will, however, that transcripts or copies of these same present letters, even printed, subscribed by a public notary and furnished with the seal of a person constituted in ecclesiastical dignity, shall have the same force in judgment and outside of judgment, everywhere, as would be afforded to these present letters themselves, if they were exhibited or shown. Let no one therefore whatsoever be permitted to infringe this page of Our condemnation, reprobation, confirmation, sanction, prohibition, ordinance, abrogation, derogation, and will, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul His. Given in the Fortress of Gandulphi in the Diocese of Albano in the Year of the Incarnation of the Lord one thousand seven hundred and forty-six, on the fourth day before the Nones of June, in the sixth year of Our Pontificate.
