Encyclical on the residence of bishops

Encyclical of Pope Benedict XIV ·

Year Six* 1741

ON THE RESIDENCE

of Bishops,

BENEDICT BISHOP

1 Servant of the Servants of God To perpetual memory of the matter. For the state of the whole Christian Commonwealth, for the Pontifical custody of Ecclesiastical Laws, and for the salvation of the Faithful and the care of peoples, it matters greatly that those placed over Patriarchal, Primatial, Metropolitan, and Cathedral Churches should assiduously reside in those Churches themselves, or in the Dioceses entrusted to them; so that it is difficult to find any other head of Ecclesiastical discipline which has been so often and so earnestly inculcated and commended by the Conciliar Canons and Decrees, or by the Constitutions and Sanctions of the Apostolic See. But in order that we may pass over the more ancient canonical statutes, it will suffice for Us to recall what the most holy Tridentine Synod decreed on this matter in sess. 6, cap. 1, and sess. 23, cap. 5; then what Our Predecessor Urban, Pope VIII, prescribed in his Constitution given at St. Peter on 12 December of the year 1634, which begins Sancta Synodus, and in which he set forth, confirmed, and enlarged the Laws and Constitutions of the preceding Roman Pontiffs Pius V, Gregory XIII, and Clement VIII. Nor is it necessary to recount all the Encyclical Letters which were customarily sent from this Apostolic See to the Patriarchs, Primates, Archbishops, and Bishops, repeatedly admonishing them concerning the fulfillment of this duty of Residence; as is evident from the Letter written by order of the Venerable Servant of God Innocent, Pope XI, also Our Predecessor, on 5 February of the year 1678, and likewise from another dated 24 December of the year 1707, written by the happy memory of Clement, Pope XI, to his and the Apostolic See's Nuncio residing at Naples, so that the Prelates of that Kingdom might be compelled to reside in their own Churches and Dioceses; as well as from the same Clement's Informative Brief given on 25 May of the year 1709 to the Archbishops and Bishops of Poland, who on the pretext of the tumults and dissensions which then prevailed in that Kingdom had abandoned their Churches and Dioceses.

2 Moreover, We have not permitted Our part in this matter of Apostolic duty to be found wanting. For scarcely had We, by the inscrutable counsel of Divine Providence, been placed in this supreme seat of the universal Church, when, reviving the ancient custom of Our Predecessors, We directed Apostolic writings to Our Venerable Brethren, the Prelates of all the Churches throughout the world, in which, among other salutary admonitions, We took care to inculcate in them with particular zeal this matter of residing in their own Churches, and did not fail to set before their eyes both the most grave harms which arise from their absence and the great benefits which their presence brings to the Dioceses entrusted to them, as may be seen in the Encyclical Letter written by Us on 3 December of the year 1740, which was printed in the 2nd volume of Our recently published Bullarium, no. 174. But God, who searches the hearts of men, surely knows with what bitter sorrow of Our heart We have sometimes learned that Ecclesiastical Rules have been violated by some of Our Brethren in this matter, and how greatly We have striven, now by admonishing, now by beseeching, now by rebuking, to recall the absent by Letters, and the present by Our own voice, to the duty of proper Residence. Indeed, following the praiseworthy footsteps of Our Predecessors, in Our and the Apostolic Chancery's Rule, by which We have reserved Ecclesiastical Benefices vacating within eight months of the year to Our disposition and conferral, We have at the same time willingly offered to these same Patriarchs, Archbishops, and Bishops residing in their sees the grace of alternate months, to be accepted by them in a certain manner and form; namely, that so long as they themselves truly and personally reside at their Churches or Dioceses, they might freely dispose of such Ecclesiastical Benefices as happen to fall vacant outside the Roman Curia in February and other alternate months of the year, provided they are not otherwise reserved or assigned to Apostolic disposition; We have granted this faculty to last during the time of Our Pontificate: so that these same Bishops and Prelates of greater Churches, obtaining thus a broader power in conferring the aforesaid Benefices, might be induced by this gratification of Our Apostolic liberality to undertake the aforesaid personal Residence more willingly.

3 Since, however, certain causes can exist and such occasions can arise on account of which, with the prior assent and approval of the Roman Pontiff, it may be lawful for a Bishop to be absent from his own Church and Diocese for some definite time; but that absence which is prolonged for a brief time renders no one guilty of desertion of Residence.

4 BULLARIUM. 275 on the third day of December in the year 1740. written in the second year of Our pontificate, which was printed in the Bullarium of Ours recently published, No. 174. But God, who searches the hearts of men, certainly knows with how great and how bitter a sorrow of Our mind We have sometimes received word that the Ecclesiastical Rules have been violated by some of the Brethren in this matter, and how greatly We have striven, now by admonishing, now by beseeching, now by rebuking, those absent indeed through Letters, those present moreover by Our own voice, to recall them to the duty of due Residence in Office. Indeed, adhering also to the praiseworthy footsteps of Our Predecessors, in Our own and the Apostolic Chancery's Rule, by which We have reserved Ecclesiastical Benefices vacating in eight months of the year to Our disposition and collation, We have at the same time willingly offered to those same Patriarchs, Archbishops, and Bishops residing the grace of an alternating arrangement of months, to be accepted by them in a certain manner and form; namely, that so long as they themselves truly and personally reside at their Churches or Dioceses, concerning Benefices of this kind Ecclesiastical, which happen to fall vacant outside the Roman Curia in February and other alternating months of the year, provided they are not otherwise reserved or assigned to Apostolic disposition, they might freely dispose of them, We have granted a faculty to endure during the time of Our Pontificate: by which indeed those same Bishops and Prelates of greater Churches, thus obtaining greater power in conferring the aforesaid Benefices, enticed also by this gratification of Our Apostolic liberality, might be led more willingly to undertake the aforesaid personal Residence.

5 Since indeed certain causes of absence can exist, and occasions of this sort can arise, on account of which causes, with the prior assent and approval of the Roman Pontiff, it is permitted to the Bishop to be absent from his own Church and Diocese for some definite period of time; but that absence, which is prolonged beyond a brief time, makes no one guilty of abandoning Residence.

6 276 BENEDICT XIV. PART I. constituted; therefore both in Councils and in Apostolic Constitutions, for the prevention of abuses as much concerning the relevance of such causes and occasions as concerning tolerable periods of time, prudent Laws and Rules are found. And indeed just and legitimate causes of absence from the aforesaid Tridentine Synod were recognized in cap. 1, sess. 23, none other than Christian charity, urgent necessity, due obedience, and evident utility of the Church or the Commonwealth. But when even these causes were lacking, since the same Most Holy Synod had considered, according to the opinion of the ancient Canons, that those who are absent for some time and are about to return immediately do not seem to be at fault, it enjoined upon all Bishops of Churches that they should not think it lawful for themselves to dwell outside their own Dioceses for more than two or three months at most, whether continuous or interrupted; and it admonished them at the same time that during this period of time they should not be absent from their Cathedral Churches on the days of the Lord's Advent, Lent, the Nativity, the Resurrection of the Lord, Pentecost also, and Corpus Christi, unless perhaps Episcopal duties in other places of their Dioceses detained them; and it wished moreover that this account be rendered by them, so that they might use the granted liberty without any detriment to their Flock, and that it be done from a motive of charity; by which words levity of mind, desire for amusements, and other futile causes are entirely excluded.

7 The aforesaid Predecessor, descending to particular cases occurring at that time, granted to Bishops promoted in the Curia one month (which was afterwards declared to be reckoned from the day of their appointment in Consistory), in which month each one should betake himself to his own Church. But when in the Roman Council held by the happy memory of Pope Benedict XIII, Predecessor likewise of Ours, the Bishops had set forth that in so short a space of time the newly promoted could not dispatch their business in the City, the same

8 Benedict granted the faculty to the Holy Roman Church and to the Cardinal of the Roman Church and to the Vicar of the Roman Pontiff for the time being in the City and its District, that the aforesaid term of one month, according to the contingency of cases and upon examination of the cause, could be prorogued to another forty days, and not beyond.

9 Furthermore, to Bishops coming to visit the Sacred Thresholds of the Apostles personally at the times prescribed above, the aforesaid Urban Predecessor granted that those who presided over Churches on this side of the Mountains and on this side of the Sea should be excused for four months; those who presided over Churches beyond the Seas and beyond the Mountains, for seven continuous months from residence in their respective Sees, for the sake of such visitation. But when the same Urban declared that by Decree he had by no means wished to remove the said three-month license granted by the Council from the things constituted in his aforesaid Letters, hence many questions arose, and various Decrees were drawn up, approved by the same Urban and his Successors; of which kind are, that it is not lawful to combine the aforesaid three-month absence, either with that time in which it is permitted to Bishops after their promotion to dwell in the City, or with that which was granted to them for performing the visitation of the Sacred Thresholds: nor is it permitted to arrange the periods of absence in such a way that the three last months of one year continue with the three first months of the following year. Just as it was also forbidden to combine the aforesaid months with that time of year in which, on account of the unhealthiness of the air, it is permitted to some Bishop to dwell outside his Diocese; lest namely, with continuous periods of absence, the spring and summer months, or summer months together with autumn months, should be spent outside the Diocese. Finally, lest anyone should be able to abuse the indulgence of the Sacred Council through fraud, it was declared that the aforesaid three-month vacation should be confined within the limits of each year, so that he who in one year shall not have used it

10 PART I. A. VII. may not on that account be able to be absent from his Church for a longer time in the following year. And concerning Bishops of the Roman Church, since the Tridentine Synod under these Laws comprehended by name even the Cardinals of the Holy Roman Church; the aforesaid Urban Predecessor, observing that it sometimes happens that one of the Cardinals is placed over a Patriarchal, or Metropolitan, or Episcopal Church, and at the same time holds one of the Episcopal Suburbicarian sees, constituted that such Cardinals should be bound to reside in the first-mentioned Churches, but not at the Suburbicarian Episcopates.

11 Finally, both in the aforesaid Council and in the cited Constitution of Urban, most grave penalties were established against transgressors of these laws which pertain to Residence; the execution of which the same Urban first committed to the Auditor of Cases of the Apostolic Camera: But two years later he delegated the entire cognizance of this matter to a Congregation for a particular legation appointed by him, which he wished to be composed from that time, and for the time being, of the existing Cardinal Vicar of the Roman Pontiff in the City, as well as of the same Pontiff's Datary, and the Secretary of State, and the Secretary of Briefs, and two other Secretaries of the Congregations charged respectively with the affairs and consultations of Bishops and Regulars, and with the interpretation and execution of the Decrees of the aforesaid Council of Trent. And indeed to the aforesaid Cardinal Vicar he granted the faculty that, for just causes and with the counsel of the aforesaid Prelates, he could grant to Bishops license to be absent from their own Churches and Dioceses for a space only of forty days, as is more distinctly prescribed in the Letters of the same Urban given on the first day of January in the year one thousand six hundred thirty-six.

12 The Head, or Prefect, of this Congregation, from the time it was instituted, has always been the aforesaid Cardinal Vicar existing for the time; just as the office of its Secretary has always been held by him who was Secretary to the Congregation of the Council of Trent; whence also We ourselves, while constituted in the lesser office of Secretary of the aforesaid Congregation of Cardinals interpreters of the Council of Trent, likewise sustained at the same time the office of Secretary of another Congregation concerning the Residence of Bishops. This Congregation indeed, as appears from its Secretary's Registers, both in the times of the same Urban Our Predecessor and in other subsequent times, was accustomed to be convened not once but several times each year; which was recalled into use by Our Predecessor of blessed memory, Pope Clement XI, and was performed from time to time, We ourselves discharging the aforesaid office of Secretary, and having prepared and printed by Us the folios, in that very method which is observed for causes pertaining to the Congregation of the Council. But in order that Bishops may lawfully be absent from their Churches or Dioceses, since besides a canonical cause, express license of the Roman Pontiff is also necessary, as We said above; except in the case of the aforesaid three-month absence from the Council permitted, for which no special license is required, since the Council itself leaves to the conscience of departing Bishops the judgment of making equity; hence it is that whatever license of this kind was formerly granted was expedited by special Chirograph signed by the Pontiff's hand. Subsequently, however, the custom was introduced of describing all such licenses in a single Folio, which was brought to the Pontiff to be subscribed; which custom indeed introduced by Our predecessors in the office of Secretary, We also observed.

13 But after an absence of twelve years, two of which We spent residing assiduously at the Anconian Church, and ten at the Bolognese Church committed successively to Our governance, having returned to the City, and to the Apostolic See, although unworthy, We were called forth

14 First; the sessions of the aforesaid Congregation, the matter perhaps being deficient, we have found are no longer frequently attended; nor were Chirographs or Sheets to be signed offered to Us; but oral reports were made to Us by the Prelate of the said Congregations concerning the execution and interpretation of the Council, and concerning the Residence of Bishops, the Secretary [reporting] both the petitions of Bishops who were seeking vacation from Residence and the Causes on which such petitions were based; and upon receiving Our response thereon; appropriate Decrees were written out for each case, and these were customarily signed by Our Cardinal Vicar, as Prefect of the aforesaid Congregation on the Residence of Bishops. But since We have judged this manner of proceeding to be far too summary for the gravity of the matter; it has seemed good to Us, by Motu Proprio, and from certain knowledge, not only for the due solemnity of acts, as they say, but also for the subsistence of the matter itself, and for more mature examination of the causes which are brought forward for obtaining such licenses, to decree and establish by Apostolic authority, by the tenor of these presents, the underwritten laws and ordinances to be inviolably observed hereafter. First therefore, the aforesaid sacred Decrees of the Tridentine Council, sess. 6, cap. 1, and sess. 23, cap. 1 on Reform, being recalled, and the Decisions of Our Predecessors, Pius IV, Gregory XIII, Clement VIII, and Sixtus VIII, being approved and confirmed, We, renewing all and singular the Apostolic Resolutions issued by the authority of the Apostolic See which We mentioned above, and holding and wishing to hold the tenors of the said Decrees, Constitutions, Ordinances, and Resolutions, even more accurate ones, as sufficiently expressed here, and also inserted word for word; and approving and confirming those and those, insofar as it is necessary, again most fully; all and singular things contained in them are to be

15 attended to by those to whom it pertains, and will pertain in the future, and in all these matters which are not contrary to these Our Letters, We will, decree, and in virtue of holy obedience command and enjoin that they be most exactly fulfilled and observed; notwithstanding any privileges whatsoever, or contrary customs and practices, even if ever so long established, which ought rather to be called abuses and corruptions, which, if perchance they should exist or be alleged, by motion and knowledge similar [to above], and from the fullness of the aforesaid Apostolic authority of Ours, We derogate, and will and decree that they be derogated.

16 Secondly, and consequently to the foregoing; against the transgressors of the aforesaid Laws and Constitutions, We also confirm and renew all and singular the penalties imposed and threatened in the same Decrees and Constitutions; namely the loss of a fourth part of the fruits of one year, to be incurred ipso facto by those who, legitimate impediment or just and reasonable causes ceasing, and without express license from the Apostolic See as aforesaid, shall have been absent from their Diocese for six continuous months; and the loss of another fourth part of the fruits, to be incurred in the same manner, where such absence is prolonged to another six months; as was decreed in the aforesaid Council of Trent, sess. 6, cap. 1 on Reform; also the incurring of the guilt of mortal sin, and the obligation of restoring the fruits received during absence, without any prior declaration, and of distributing them in the fabric of Churches, or in the sustenance of the poor of that place, any agreement or composition concerning such fruits wrongly received being prohibited; as is prescribed in the same Council, sess. 23, cap. 1. Similarly, the penalty imposed by the aforesaid Pius IV, Our Predecessor, of the loss of the faculty of making a will and disposing, if any such should be found to belong to transgressors of this kind; and also of ineligibility for obtaining greater Dignities and Churches, which the aforesaid Predecessor

17 P n T. sor Clement VIII confirmed, in all respects we confirm, and renew. To all which we also add this further provision, that the same transgressors shall be deprived ipso facto of all and singular Indults and Privileges which, as assisting at the Pontifical Throne, shall have been granted to them: Decreeing that under the name of Transgressors shall be comprehended not only those who, beyond the three Assistants of the Summa tolerated by the Council, without legitimate cause and express licence of the Roman Pontiff, dwell outside their own Dioceses; but also those who have not hesitated to extort such licence by false or simulated causes through deceit; or who, having once duly and rightly obtained it, have exceeded the prescribed limits in the same and the fixed time. But if nevertheless some, despising no less the Canons than the aforesaid penalties, should presume to persist in their contumacy; we will that proceedings be taken against these to further effect, according to the mind of the same Council of Trent, which in the cited c. i. sess. 6., exhorts the Roman Pontiff for the time being, that by the authority of his supreme See he may take action against such Transgressors according to the severer norm of the Sacred Canons, and also provide the Churches themselves with more useful Pastors, as he shall know to be salutarily expedient in the Lord. In the third place we will and command that the functions of the aforesaid Congregation concerning the Residence of Bishops, instituted by Pope Urban VIII, be resumed and its sessions restored; confirming the office of the same Prefecture in our beloved Son John Anthony, of the title of St. Martin in the Mountains, Presbyter of the Holy Roman Church, Cardinal named Guadagni, now Vicar in the City of Rome and its District in spiritual matters, and his Successors in the Office of this Vicariate; as also the Office of Secretary of the same Congregation in our beloved Son Master Joseph Alexander Furietto, and his Successors as Secretaries of the Congregation of Cardinals Interpreters of the Council of Trent; and we establish the same in this Congregation now and henceforth for the time being to have a place and to cast a vote, whosoever holds or shall hold in the future those offices and duties which are designated in the aforesaid Letters of our Predecessor Urban. Moreover, since it is by no means expedient that this Congregation should lack a Promoter Fiscal, we appoint him who holds the office of Promoter Fiscal in the Tribunal of the aforesaid Cardinal Vicar of the City, and his Successors in office for the time being, to discharge the same duty in the aforesaid Congregation, to which we will that he or they attend with consultative vote. But considering that if this Congregation were to be held so often as whenever some Bishop should seek licence to depart from his Diocese, it would either become too burdensome on account of its frequency, or on account of the lightness of the matters might be neglected and held in little regard in the course of time; we will and decree that it shall then only be convened and held, when either by us or by our Successors the Roman Pontiffs, the cognition of some matter shall have been remitted and delegated to it: Or, even with such remission ceasing, as often as it shall be necessary to deliberate upon imposing and inflicting the penalties constituted above against some transgressor; since the manner of such penalties, as the greater or lesser contumacy of each shall have demanded, shall be determined by the same Congregation, so that, a report having been made through its Secretary to us or our Successors, and the resolution of the Congregation having been approved, proceedings may be taken with effect to the execution of such penalties; or finally when some Bishop shall propose a petition for being absent from his own Diocese on account of some duty or office, of which it is said to be of such a nature that an Apostolic Indult of non-residence for a long time should be granted to him; we indeed decree that such Indults ought never to be granted to anyone, unless after a previous examination of the causes to be conducted in the same Congregation, with our and our Successors' knowledge and approval, and by means of the expedition of Apostolic Letters in the form of a Brief; and therefore we command our and the Roman Pontiff's for the time being Secretary of Petitions, and other Secretaries of whatever Congregations to whom petitions on this matter shall have been presented, that they remit them entirely to the aforesaid Congregation concerning the Residence of Bishops; and at the same time we forbid our and our Successors' for the time being Secretary of Briefs, lest he bring examples of Apostolic Letters concerning such Indults to us or our Successors to be signed, in any way whatsoever, unless authentic documents both of the examination of causes conducted in the said Congregation and of the Apostolic approval and assent consequently emanating therefrom shall have been exhibited to him.

18 Fourthly, we decree that the Sheets mentioned above shall be completed in the future with the names of Bishops to whom permission to reside is granted outside their Diocese inscribed thereon, together with the causes presented and approved by them, and the period of time for which such permissions are granted by the Pontiff; which Sheets, indeed, subscribed by the Roman Pontiff, we order to be preserved in the Archives of the aforesaid Congregation: We wish, however, that this be understood not of those Indults which, as described in the paragraph above, are to be expedited through Apostolic Letters in the form of a Brief; but of another kind of Indults, concerning which we shall speak below, which, after Pontifical assent has been requested and obtained from the Secretariat, ought to be expedited through Decrees subscribed by the aforesaid Cardinal Vicar of the City, as Prefect of the aforesaid Congregation. For it is fitting that these permissions also proceed not without Pontifical subscription; and this will be obtained by the addition of the Pontiff's Signature upon the aforesaid Sheets, in which the tenor of each Indult and the causes described by the Secretary shall be set forth; in the manner in which, in times past, and even by Us ourselves, while we were performing the office of such Secretary, it is reported to have been observed. In the year 1744. Fifthly, since by experience we have learned that in order to obtain permissions to reside absent from their Diocese, the following causes are usually brought forward by Bishops; namely, either the necessity of being present personally at some litigation or controversy, in which the Church, or its Clergy, or even the Bishop's own Family affairs are being conducted, and which has been introduced in the Roman Curia, or another in the City, in which the greater Tribunals reside, whose judgment it ought to be; or bodily infirmity with which the Bishop has been seized while residing outside his Diocese during the Conciliar months, so that he cannot return to the same Diocese; or ill health contracted in the Diocese itself, to remedy which Physicians think it necessary for the Bishop to change air and place for some time, or finally the malignity of the air prevailing in the Diocese, which ought to be avoided for some months of the year: And since none of the aforesaid causes, without express approval of the Roman Pontiff, can exempt anyone from the duty of residing; and unless under certain express circumstances, and those verified, it is difficult to proceed rightly and properly to such approval; it has seemed necessary to Us to establish the Rules set forth below, which in each respective case we command and decree to be observed by those to whom it pertains, and shall pertain for the time being.

19 If therefore anyone in the future shall seek permission to depart from the Diocese entrusted to him, in order that he may be present at a judicial controversy which is being conducted elsewhere, and which concerns him; he shall be required to express in his petition both the Place, or City, in which such litigation is being conducted, and also whether it pertains to the Church itself of the Petitioner, or to the Clergy, or rather to his own Family. And indeed if it pertains to the Family, without the Secretary of the Congregation approaching the Pontiff, or the Cardinal Prefect, it shall be answered by him, so that the Petitioner may use the months indulged by the Councils for the purpose mentioned in the petition. If he has already used them, no further permission shall be granted to him. But if the matter concerns his Church, or the affairs of the Clergy, there shall be set forth both the status of the litigation and its gravity, and the causes for which the presence of the Petitioner in the place of judgment is deemed necessary; and it shall also be declared whether he has used the Conciliar months. And indeed if he has not yet used them, it shall be answered that he should devote them to such a cause. But if this is no longer possible for the Bishop (in which matter neither fraud nor deceit shall have intervened), and otherwise his petition shall appear just, only so much time, and no more, shall be granted to him for residing outside his Diocese, as shall have been judged necessary to be, for the Defenders of the Cause, Advocates, and Judges to be sufficiently instructed concerning all matters pertaining to the matter. For if permission to be absent from the Diocese were to be extended until the final conclusion of the cause, anyone can see how prolonged the absence of Bishops would usually be in these cases, and how easily it could happen that many Dioceses would be deprived of the presence of their Pastors for the space of several years.

20 What if they should seek permission to be absent from the Diocese on account of infirmity contracted outside the Diocese while using the vacation granted by the Council, they assert that the cause of their return to their own Diocese should not be prohibited to them; they ought to set forth the nature of the infirmity contracted, and upon it exhibit the testimony of a Physician confirmed by oath. And when the requested permission is granted to them, it ought always to be conceded for a certain and definite time, with also a clause added if the infirmity should last so long. Moreover, those who have sought such permission, on the ground that a change of air is necessary for them from the disease to recover from illnesses which they contracted in their own Churches while residing in the Diocese, it must be expressed in the petition, what kind of diseases they suffer from, and how gravely they labor, and the testimony of a Physician is to be produced, who by oath shall testify that it is useful and necessary for the Petitioner to transfer himself to another Region and air for some time. Nor is that to be passed over in silence, namely whether the Petitioner, before he was seized by disease, had used the three-month permission granted by the Council: If indeed he has not yet done so, and the time granted by the Council does not seem sufficient to him, it may be granted to him that for four months, in which however the Conciliar Months are to be comprehended, he remain absent from Residence: But if he has already spent the aforesaid Conciliar Months, with all fraud and deceit removed, outside the Diocese: so much time shall be granted to him as shall be prudently judged to be truly necessary for the confirmation of his health.

21 Finally, whoever shall seek permission to dwell outside the Diocese on account of the unhealthiness of the air, which in his own Diocese at some time of year he affirms to be unwholesome; let him see to it also, and indeed what he does. And indeed let him set forth the truth, in which months of the year the air of the Region is harmful: Likewise whether the same condition of the sky comprehends the whole Diocese, so that no place exists within its tract in which he might be able to pass through that suspected time without detriment to his health; finally whether he has used the Conciliar Months. For if he has not yet taken them for himself, he will not with difficulty obtain the Permission to be absent for four months (insofar as the danger from the air is reckoned to last so long), in which however those three permitted by the Council are to be counted: But if he has already made use of such indulgence of the Council, he will seek in vain a new Permission from the Apostolic See on the aforesaid ground; and he ought to impute it to himself, that when he knew for certain that at some time of year the air in his own Diocese would be unwholesome, he did not reserve the vacation Months granted for that time. In all Permissions of absence, however, which on account of unwholesome air shall henceforth be granted, this

22 a clause to be added: Provided that between the aforesaid A.VII. there is some place where the air is healthy, and in which the Bishop can reside. What for Indeed the aforesaid Urban, Our Predecessor, did not omit to consider the cause of those Prelates who are accustomed to be personally present at Provincial Councils, or Congregations, or general Assemblies, in which ecclesiastical persons are wont to intervene, or to be occupied in other duties or offices of the Republic, which are attached to their Episcopates and Churches, and are accustomed and ought to be exercised for a certain time outside the Diocese; and to them indeed in the aforesaid Constitution he granted permission to be absent for that fixed time during which such Councils, Congregations, and Assemblies are conducted, and the exercise of their office or public duty attached to their Churches shall have lasted; provided that, these being finished, they return by the right path to the Churches committed to them; the equity of which concession We also recognizing, We approve and confirm the same. But since the same Urban established nothing concerning Bishops who depart from the place of their Residence for the compilation of Processes in causes of Beatifications, or Canonizations, delegated to them by Apostolic authority; it is necessary that something be constituted by Us opportunely for these cases also. What for Letters are expedited by the Congregation of Sacred Rites, which they call Remissorial, and Compulsorial, by which it is committed that the aforesaid Process be compiled by Apostolic authority; and these are directed to three Bishops, or Superior Prelates, with a clause, that they proceed to the aforesaid matters. And since in such a number of Bishops the Ordinary of the place in which the Process is compiled is always included; it happens that of the three to whom the Letters are directed, one only is called away from Residence. Where therefore some Bishop Titular of a Church in the parts of the Infidels might be constituted, We will that he be included in the aforesaid Letters as one of the three Bishops. Which if three Prelates altogether residing in their own Churches ought to be delegated for this effect, We establish and command, that Letters be directed by the aforesaid Congregation to Bishops, who are nearer to the Diocese, in which the Apostolic Process is to be compiled. Since however the matter is not one which can be completed in two or three weeks, but which often requires the labor of several months, or even years; We will, that Bishops, who have accepted such a delegation, do not omit to seek and obtain the necessary permission to depart from the Diocese, expressing the cause of absence, under the penalties established against those who dwell outside the Diocese without cause. In granting such permissions, however, We establish, that the Conciliar Months be always included, and besides these, thirty days only, if need be, be added; for a space of four months is sufficient for accomplishing more; and, if there still remain things to be done, four other months in the following year can be spent on the same work. These are the things, which We have judged should be established soberly in the Lord, and which We will to be made a rule and norm for the future, so that by Our venerable Brothers the Patriarchs, Archbishops, and Bishops, the most grave duty of Residence, which is incumbent upon them, be exactly fulfilled. Therefore to Our beloved Son, the present Secretary of the aforesaid Congregation over the same Residence, and to his Successors in perpetuity, We enjoin, and in virtue of holy obedience, under the penalties against those disobedient to Apostolic mandates in a grave matter, We command and order, that supplicant Petitions presented to him on behalf of any Prelates whatsoever, in which those things which We have noted above are not expressly set forth, and to which the necessary authentic documents, likewise indicated above, are not attached, he in no way receive, and much less refer to the Pontiff: In the Decrees, however, which after Pontifical assent obtained by the same Secretaries in the customary audience, are to be subscribed by the Cardinal Prefect of the same Congregation, let them not omit to append the aforesaid clauses respectively; also expressly providing, that the Indults which are granted be understood to run from the day of the Date of their Decrees.

23 Concerning the Burden Finally, Venerable Brethren, Patriarchs, Primates, Metropolitans, and all Bishops, we admonish you that not only you yourselves observe most carefully the laws established concerning Residence, but also, mindful of the Decree issued by the Sacred Council of Trent, sess. 25, cap. 1, of Reformation, by which each one is commanded to the best of his ability to watch over the conduct of others respectively, and to denounce to the Roman Pontiff within a certain time those who are not resident. We likewise entrust and enjoin this same duty upon Our own and the Apostolic See's Nuncios; wherever within the bounds of their Nunciature there exists any Bishop or Superior Prelate who is known to violate the Canonical Laws in this matter. Special Commission to the Nuncio in Naples And because it has been reported to Us that nowhere are the aforesaid Laws violated more frequently by Bishops than in the nearby Kingdom of Naples (nor indeed in so great a number of them), We will and decree that in the Indults of absence which shall henceforth be granted to the Bishops of the aforesaid Kingdom, to the other clauses prescribed above, this also shall be added, that the obtained license must be exhibited to the Apostolic Nuncio residing in Naples, otherwise it shall have no force or effect. We indeed, by the tenor of these present letters, commit to the aforesaid Nuncio that he cause such Licenses to be entered into the records of his Tribunal, and likewise that he inquire into the causes for which they were granted, and observe the time prescribed therein; to this end, namely, that through him it may be ascertained whether anything was obtained by surprise or misrepresentation in the petitions; and that it may not be hidden from him if anyone transgresses the prescribed limits assigned to him, whether he dwells far from his Church and Diocese without the necessary Indult of the Apostolic See, outside the times permitted by the Council. For those, however, who, as has likewise been reported to Us, desert their Dioceses, and not indeed to the principal City of the Kingdom, where the Apostolic Nuncio resides, but betake themselves to other Cities of the same Kingdom, without the Nuncio himself hearing anything of them; We enjoin upon the same Nuncio that through his Officials and Ministers, whom he retains in all the Dioceses, he take care to be informed concerning Bishops, whosoever depart from their own Dioceses: So that both those who abuse obtained licenses, and much more those who presume to conduct themselves on their own authority (while either without prior license, beyond the time indulged by the Council, they are absent from their Dioceses, or if compelled to depart from them on account of some unforeseen event, they fail to seek and obtain such license immediately upon arriving at the designated place), shall be subjected to the more severe censures of the sacred Canons and Apostolic sanctions.

24 Moreover, We intend under the ordinance and disposition of these present Letters of Ours that the same Venerable Brethren, Our Cardinals of the Holy Roman Church, who now preside over and in the future shall preside over the aforesaid Patriarchal, Primatial, Archiepiscopal, and Episcopal Churches by concession and Apostolic dispensation, be comprehended and understood to be comprehended and to be.

25 These present Letters likewise, and all and singular things contained in them, on account of any defect of subreption or obreption, or any nullity or invalidity, or defect of intention on Our part, and by whatever consultation, even from the fact that those having or pretending to have any interest whatsoever in the premises, and especially the Cardinals of the same Holy Roman Church, have not consented to the premises, nor have been called and heard, and the solemnities and other things to be observed and fulfilled have in no way been observed and fulfilled, and by whatever other color, pretext, occasion, and cause, even those necessarily to be expressed, from which

26 which can be noted, impugned, brought to law, or revoked in contention, or reduced to the terms of law, or against which the remedy of opening of the mouth, restitution in full, or any other remedy whatsoever of law, fact, or grace can be obtained at no time whatsoever; but shall always and perpetually be valid, firm, and efficacious and shall be, and shall obtain and secure their full and complete effects, and be inviolably observed by all and each to whom it pertains and shall pertain in any way in the future, just as if they had been enacted in Our Consistory in secret and with the counsel and unanimous consent of the same Our Brethren: And thus and not otherwise in all the aforesaid matters and each of them by whatsoever Judges Ordinary or Delegated, even the Auditors of Cases of the Apostolic Palace, as well as the aforesaid Cardinals of the Holy Roman Church even Legates a Latere, Vice-Legates, and Nuncios of the Apostolic See, and the aforesaid Congregation deputed over Residence, and whatsoever others exercising any authority and power now and for the time being, with any other faculty of judging, declaring, interpreting, and defining taken away from them and from each of them, it ought to be judged and defined; and whatever otherwise shall happen to be attempted in these matters by anyone whatsoever with any authority knowingly or unknowingly, We decree to be null and void.

27 Notwithstanding the Constitutions and Ordinances Apostolic, even those issued or to be issued in Universal, General, Provincial, and Synodal Councils; nor, insofar as it shall be necessary, without taking away acquired right, and other Rules of the Apostolic Chancery, Statutes also, even sworn, customs also, even long-standing and immemorial, of the said respective Churches, nor the licenses, privileges, and indults even Apostolic, granted in any way heretofore to the same Churches and their Prelates, and all and each of the others which Urban wished not to stand in the way of the firmness and execution of his Letters, and all other things whatsoever to the contrary. 1746.

28 But so that these same presents and the contents therein may be brought to the knowledge of all by public notice, and lest anyone of them be able to claim ignorance; We will that these same presents be published by one or more of Our Couriers at the doors of the Basilica of the Prince of the Apostles, and of the Apostolic Chancery, and in the Acie of the Campus Florae of the City, and copies thereof be affixed there and remain affixed, which thus published and affixed shall bind and affect all and each whom they concern, no less than if they had been personally intimated and notified to each of them; and that the Transcripts of these same presents, even printed, subscribed by the hand of any public Notary and furnished with the seal of a Person constituted in Ecclesiastical dignity, the same faith shall be given in judgment and outside it everywhere, which would be given to the presents themselves, if they were exhibited or shown. Let it be lawful for no one whatsoever to infringe this page of Our Ordinances, Constitutions, Derogations, Precepts, Statutes, and Decrees, or to dare to act contrary to the same with rash presumption. But if anyone shall presume to attempt this, let him know that he shall incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul.

29 Given at Rome at St. Mary Major in the Year of the Incarnation of Our Lord 1746, on 3 September, in the Seventh Year of Our Pontificate. D. Cardinal Passioneus.

DELLA RESIDENZA

dei Vescovi,

BENEDETTO VESCOVO
